How to Reverse and Reclaim Input Tax Credit Under GST

GST ITC reversal and reclaim depend on why the credit was reversed. Learn the Rule 37 payment condition, the GSTR-3B Table 4 entries, and how permanent reversals differ from conditional reclaims.

To reverse and reclaim input tax credit (ITC) under Indian GST, first identify why the credit is being reversed. A temporary reversal—such as one triggered by non-payment to a supplier within the prescribed period—may be reclaimed after its condition is met. Ineligible or apportioned credit is generally not a temporary reversal. In GSTR-3B, the distinction matters: permanent reversals go in Table 4(B)(1), qualifying temporary reversals in Table 4(B)(2), and eligible reclaims in Table 4(A)(5) with disclosure in Table 4(D)(1).

The right treatment also depends on the tax period and the applicable version of the law. This guide is for Indian GST-registered businesses and return preparers; it is not a taxpayer-specific opinion.

Start by identifying the reason for the reversal

Reversing an amount in a return does not, by itself, determine whether you can claim it again. First check whether the original credit satisfied the applicable eligibility conditions and whether the cause of reversal can later be cured. Section 16 includes conditions concerning prescribed tax documents and invoice details furnished by the supplier and communicated to the recipient, alongside other requirements. Check the provision that applied to the tax period in question.

Classify the issue before changing the return: supplier non-payment, missing or uncommunicated invoice information, common-use apportionment, blocked credit, an earlier reporting mistake, or a time-limit dispute can lead to different legal and reporting outcomes.

Which reversal can be reclaimed?

Reason for adjustment Can it be reclaimed? GSTR-3B treatment Key qualification
Supplier not paid within the section 16(2) period Potentially, after the required payment is made and the credit otherwise qualifies. Temporary reversal: Table 4(B)(2). When eligible to reclaim: Table 4(A)(5), with disclosure in Table 4(D)(1). Rule 37 addresses the reversal attributable to the unpaid amount and interest. Check the operative law and facts for the period.
Specified temporary reversals for section 16(2)(b)/(c) conditions Potentially, when the relevant condition is met and the credit is otherwise eligible. Table 4(B)(2); eligible reclaim in Table 4(A)(5) and disclosure in Table 4(D)(1). Apply the particular statutory condition; do not assume a later supplier payment is the cure for every case.
Ineligible or non-reclaimable credit, including specified blocked or apportioned credit Not merely because time has passed or another condition was met. Table 4(B)(1). CBIC Circular 170/02/2022-GST identifies specified Rule 38, Rule 42, Rule 43 and section 17(5) reversals as examples for this table.
Qualifying correction of ITC mistakenly availed in an earlier period Depends on the underlying eligibility and the facts; a correction entry does not make ineligible credit eligible. Circular 170 permits Table 4(B)(2) for certain such corrections. Reconcile the original entry and correction, and confirm the applicable return instructions.
Historical section 16(4) time-limit dispute potentially covered by section 16(5) or 16(6) Only if the statutory conditions and the applicable procedural route are met. Depends on the underlying relief and return or proceeding; Circular 237 does not make every past reversal reclaimable. Check the exact tax period, order and procedural stage. Refunds are barred in the circumstances described below.

The table reflects Circular 170/02/2022-GST and Circular 237/31/2024-GST, together with the provisions and rules they address. Confirm the current form and operative law for the relevant tax period before filing.

Supplier not paid within 180 days

Section 16(2) includes a condition to pay the supplier the value of the supply and the tax within 180 days from the invoice date, except for the specified reverse-charge supplies. Where payment is not made, the provision requires payment of an amount equal to the ITC availed, with applicable interest, in the prescribed manner. Rule 37 provides the mechanics, including reversal attributable to the portion left unpaid and the interest treatment.

This is not necessarily a permanent loss of credit. The section 16(2) proviso allows the recipient to take the credit again on payment to the supplier, subject to the applicable procedure and continuing eligibility. Rule 37 also contains deemed-payment provisions for Schedule I supplies made without consideration and for specified amounts under section 15(2)(b); assess those cases under the rule rather than treating them as ordinary unpaid invoices.

Do not use a generic interest calculation without checking the effective law, payment history and facts. Keep evidence of the invoice, payments, reversal and subsequent re-availment so the entries can be reconciled.

Report reversals and reclaims in the right GSTR-3B fields

CBIC Circular 170/02/2022-GST distinguishes reversals that are absolute from those that may be reclaimed after conditions are fulfilled. Its clarification states that reversal of ineligible credit under section 17(5) or other provisions of the CGST Act and rules belongs in Table 4(B), not Table 4(D).

  • Table 4(B)(1): permanent or non-reclaimable reversals, including the specified Rule 38, Rule 42, Rule 43 and section 17(5) examples in Circular 170.
  • Table 4(B)(2): temporary reversals that may be reclaimed after the relevant condition is satisfied, including the specified Rule 37 and section 16(2)(b)/(c) cases. The circular also permits this field for certain corrections of ITC mistakenly availed in earlier periods.
  • Table 4(A)(5): report an eligible reclaim here once the condition for taking the credit again is met.
  • Table 4(D)(1): disclose the reclaim reported in Table 4(A)(5). This disclosure is not a substitute for claiming it in 4(A)(5).
  • Table 4(C): net ITC available after subtracting the reversals in Tables 4(B)(1) and 4(B)(2) from the ITC in Table 4(A).
  • Table 4(D)(2): serves a different purpose: specified ITC unavailable because of the section 16(4) time limit or the described intra-State place-of-supply mismatch. It is not the reclaim disclosure field.

Use the return statement and applicable instructions for the filing period; do not treat all adjustments as one generic “reversal” entry.

Common credit, exempt supplies and non-business use

Rules 42 and 43 provide for attribution and reversal where inputs, input services or capital goods are used partly for non-business purposes or partly for exempt supplies. The calculation depends on the taxpayer’s use, supplies and supporting records; Rule 42 also provides for an annual final calculation and adjustment.

These apportionment reversals should not be treated as automatically reclaimable temporary reversals. Paying an invoice later does not, by itself, undo a reversal required because credit relates to exempt supplies or non-business use. Apply the relevant rule to the facts and period.

Historical section 16(4) disputes: check the order and stage

Retrospective sections 16(5) and 16(6) can make certain credits available in specified periods and circumstances despite the section 16(4) time limit. Circular 237/31/2024-GST explains different routes depending on whether a demand notice has been issued, a notice or appeal/revision is pending, or an order has been issued without an appeal. Relief is therefore procedural as well as substantive: establish that the credit falls within the statutory provision, then check the taxpayer’s exact proceeding and order.

For specified confirmed orders that were not appealed, the circular described a special rectification route under Notification 22/2024–Central Tax, with a six-month filing window measured from that notification. That historical window is not open as of 4 October 2026. The circular also explains that section 150 of the Finance (No. 2) Act, 2024 bars a refund of tax already paid or ITC already reversed on account of the relevant section 16(4) issue where the retrospective provisions now make the credit available. Other eligibility conditions and grounds in the order still matter.

A practical filing and review sequence

  1. Pin down the period and legal cause. Identify the tax period, the applicable statutory version, and whether the issue is supplier non-payment, an invoice or supplier-reporting condition, apportionment, blocked credit, an earlier mistake or a time-limit dispute.
  2. Decide whether the reversal is permanent or conditional. Use the relevant Act, rule and Circular 170 examples. Do not label a reversal reclaimable just because the return field allows a later entry.
  3. Reconcile the return fields. Check the ITC figures and supporting statements against Tables 4(B)(1), 4(B)(2), 4(A)(5), 4(C), 4(D)(1) and 4(D)(2), as applicable. Confirm the filed return produces the intended net credit.
  4. Document the original claim and each later event. Retain the tax document and invoice details, relevant supplier information, payment evidence, return workings and records linking the reversal to a later reclaim. This is practical support for demonstrating eligibility and reconciliation, not a separate retention period stated here.
  5. For a historical dispute, read the actual order. Match the tax period and procedural status to Circular 237’s route; do not infer a general right to reclaim or a refund from the retrospective amendments.

GST statutes, rules, notifications, forms and return interfaces can change. Verify the operative requirements for the period being reported and the currently available portal fields before filing.
