Yes—if you own a genuine physical disc or cartridge, you can generally sell that particular copy or hand it to a friend temporarily in the United States. The rule is different for digital downloads, which usually give you an account-bound license rather than a resalable object. Your practical result still depends on the console, region, edition, condition, redeemed codes, online requirements, retailer policy, and local law.
Physical ownership is different from a digital license
U.S. copyright law draws a line between a copyrighted work and a particular lawful copy of it. Under 17 U.S.C. §109(a), the owner of a lawfully made copy may sell or otherwise dispose of possession of that copy without getting permission from the copyright owner. For a game disc or cartridge, that supports transferring the actual object you bought—not copying the game, transferring your account, or granting someone copyright ownership.

This is why a used physical game can move from one person to another even though the publisher still owns the copyright. The buyer receives the disc or cartridge and whatever functionality is built into that copy. They do not receive your account, your downloadable purchases, or a right to duplicate and redistribute the software.

Commercial rental and lending of computer programs involves additional rules under 17 U.S.C. §109(b). The statute treats programs embodied in limited-purpose computers designed for playing video games differently from ordinary computer software. A one-to-one private loan of your own game is not the same thing as operating a commercial rental business, but anyone planning to rent games for money should obtain jurisdiction-specific legal advice.

Digital storefront purchases follow a different model. Current U.S. PlayStation Store terms describe purchases as a personal license for private, non-commercial use. The terms say the license is not transferable unless local law requires it and restrict selling, renting, leasing, loaning, sublicensing, or transferring content except where expressly allowed. Do not assume that a right to resell a disc also applies to a download.
Check the copy before choosing a route
Most failed listings and rejected trade-ins result from missing information rather than the game itself. Gather the details below before you advertise, visit a store, or promise the game to a friend.
- Platform and exact title: Identify the console generation, edition, and region. A PlayStation 4 disc, PlayStation 5 disc, Xbox One disc, Xbox Series disc, and Nintendo cartridge may have different compatibility and value.
- Completeness: Note the original case, cover art, manual, inserts, map, soundtrack disc, steelbook, cartridge or disc, and any other included item.
- Codes and account content: Treat redeemed DLC, online passes, currency, and promotional codes as unavailable unless you can prove they are unused and transferable. A code already tied to your account does not travel with the physical copy.
- Condition: Look for scratches, cracks, label damage, bent contacts, residue, smoke odor, liquid exposure, and case damage. Distinguish cosmetic wear from a fault that prevents the game from starting or saving.
- Function: Test the game on compatible hardware. Confirm that it boots, reaches gameplay, reads consistently, and saves. Check whether an update, internet connection, or paid online subscription is needed for features you describe.
- Region and language: Record the disc or cartridge region and the available language options. Imported copies can run on some consoles but still have region-locked DLC or different rating and packaging information.
Keep photographs of the label, contacts or data side, case, rating label, barcode or serial information where appropriate, and every included component. Do not photograph account credentials, console serials that you prefer to keep private, or unused codes in a way that exposes them.
Reselling directly to another player
A private sale usually produces the highest potential cash because you set the price and reach collectors, but you perform the inspection, listing, packing, communication, and dispute handling yourself. No universal current payout exists for every title; values change with platform, edition, scarcity, condition, region, demand, and date.

Prepare an accurate listing
- Write the exact identification. Include the platform, region, edition, rating, and whether the item is a standard release, collector edition, steelbook, bundle copy, or cartridge-only package.
- Describe function and wear. State whether you tested booting and saving, identify visible scratches or case damage, and disclose intermittent read errors instead of calling the game fully working.
- Separate included and unavailable content. List manuals, inserts, maps, soundtracks, and unused codes individually. Say clearly when DLC or an online pass has already been redeemed.
- Photograph the actual item. Use well-lit images of the front and back of the disc or cartridge, case, cover art, and accessories. Avoid stock photographs that hide defects.
- Choose a permitted sales channel. Use a marketplace, local listing, or community that allows used physical games in your country. Read its current rules for shipping, tracking, returns, buyer protection, prohibited items, and seller fees.
- Set a realistic price. Check recent completed sales when the service provides them, then subtract platform fees, postage, packing materials, taxes, and the cost of your time. A faster sale may justify a lower net price than waiting for a collector.
- Pack for the format. Protect discs from bending and cartridges from impact and static. Keep the game in its case when possible, use a rigid mailer, and retain the tracking receipt.
Disclose the limits of what the buyer receives
A physical copy can start the game without transferring your account. Explain whether the buyer needs a console update, an online subscription, a publisher account, or a region-matched store account. State that redeemed DLC, virtual currency, season passes, and account-bound bonuses are not included. If a game requires servers that may be unavailable, describe that risk instead of implying that every advertised feature will work indefinitely.
Private-sale risks
- Returns and disputes: A buyer may claim the disc was damaged in transit or did not match the description. Keep listing photographs, packaging photographs, tracking, and proof of shipment.
- Fraud: Follow the marketplace payment and communication rules. Be cautious of requests to move payment off-platform or to ship to an address that is not covered by seller protection.
- Shipping economics: A low-priced game can lose its advantage after postage, packing, fees, and a possible return. Calculate net proceeds before accepting an offer.
- Collectible value: Manuals, inserts, original artwork, unusual editions, and undamaged packaging may matter more to a collector than to a trade-in counter. Photograph and price those components separately in your description.
Trading in at a retailer
A trade-in is faster and simpler than a private listing, but the retailer controls acceptance and the final offer. GameStop’s support instructions say to bring the item to a store, where an associate evaluates it and offers cash or store credit. Online values are estimates only, store availability varies by location, and the offer can change after in-person inspection.
What to bring
- Bring the correct disc or cartridge and its original case, cover art, and manuals when available.
- For a console bundle, bring every required component. GameStop’s example includes the console, power cable, HDMI cable, and the Sony wireless controller.
- Bring identification or other documentation if the current store policy requires it for a transaction.
- Remove personal accounts, saved payment details, and personal data from consoles before handing them over.
Condition standards used at inspection
GameStop describes eligible items as fully functional, safe to handle, and free from major physical damage. Scratches, smudges, residue, dings, and ordinary cosmetic wear can reduce value. Smoke damage, strong odors, cracks that make an item unsafe or unusable, pest contamination, or non-functionality can lead to rejection. The store makes the final acceptance and valuation decision after inspecting the item.

Cash versus store credit
Cash is flexible and immediately usable anywhere, but store credit may be higher while restricting you to that retailer’s products and terms. Compare the net cash amount with the credit amount, expiration rules, geographic restrictions, and your realistic plans to use the credit. Do not treat an online estimator as a guaranteed price.

How retailer refurbishment affects the process
GameStop’s 2022 Form 10-K describes a pre-owned program that exchanges used gaming products for cash or in-store credit. It also describes refurbishment centers that test, repair, sanitize, repackage, and redistribute used products. The filing reported 4,573 stores worldwide as of January 29, 2022; that is a historical figure, not a current store count or a guarantee that a location near you still operates.
Preparing a disc or cartridge safely
Cleaning can remove fingerprints and residue that interfere with inspection, but it cannot guarantee acceptance or restore a deeply scratched disc. Use a video-game disc and cartridge cleaning kit or another method specifically marked safe for the material. Follow the manufacturer’s direction, use a soft lint-free cloth, and wipe from the center outward on optical media. Do not use abrasive compounds, household solvents, excessive liquid, or anything that can enter a cartridge shell or console.
After cleaning, let the item dry completely and test it on compatible hardware. If read errors continue, disclose them. Do not sell a burned disc, copied ROM, downloaded file, or so-called backup copy as a replacement for the original. U.S. Copyright Office guidance on archival copies says a lawful archival copy must be transferred with the original copy and may not be sold separately.

If you own the particular disc or cartridge, you can normally hand that same copy to a friend temporarily with an understanding that it will be returned. This is a transfer of possession, not a transfer of copyright and not permission to make a duplicate. Keep the arrangement private and personal; a paid rental operation raises the separate commercial-rental questions discussed above.

Make the loan predictable
- Keep the disc or cartridge with its case and label so it is not confused with another copy.
- Agree on a return date and who pays for loss or shipping before the game leaves your possession.
- Do not lend a copy that is already promised to a buyer or needed for a trade-in appointment.
- Tell the borrower about region limits, required updates, online subscriptions, server dependencies, and language restrictions.
- Explain that redeemed DLC, online passes, and account-linked bonuses remain tied to the account that claimed them.
- Do not share your console account, password, payment method, or recovery codes to make the physical loan work.
The borrower may be able to install or start the game from the physical media while still lacking online features or DLC. Returning the same disc or cartridge does not return any account content that was downloaded separately.

PlayStation’s current U.S. terms also explain that words such as own, purchase, and sale do not transfer ownership of the underlying software or content. That language applies to the digital transaction described by those terms; it should not be used to erase the separate analysis for a physical object.

Common mistakes and how to avoid them
Assuming a redeemed code adds value
A physical game can look complete while its DLC or online pass has already been claimed. List the code as redeemed or unavailable. Never expose an unused code in photographs.
Calling a damaged game tested
Booting once is not proof of reliable operation. Test reading, loading, and saving, then disclose intermittent errors, freezes, missing audio, or a console-specific compatibility problem.

Confusing a trade estimate with an offer
Retail websites and apps can show estimates, but the store’s inspection controls the final result. Check the current estimator shortly before traveling and bring all required components.
Cleaning too aggressively
Abrasive polishing, liquid inside a cartridge, or household chemicals can make damage worse. Clean only with a material-safe process and stop if the surface remains unreadable.
Sharing an account to lend a game
An account is not part of a physical sale or loan. Sharing credentials can expose payment information and may breach platform rules. Lend the media itself and explain which features remain account-bound.
Ignoring local rules
Taxes, consumer-protection duties, marketplace rules, age restrictions, and commercial-rental law vary by country and sometimes by state. The rights described here are a U.S.-focused explanation, not a substitute for local legal advice.
A practical decision checklist
- Do you own the original physical disc or cartridge, rather than a copied or downloaded file?
- Have you identified the exact platform, region, edition, and included components?
- Have you tested booting and saving and recorded any online, update, or subscription requirement?
- Are redeemed codes, DLC, and account-linked bonuses clearly excluded?
- Would the extra money from a private sale justify listing, packing, fees, and possible disputes?
- Would a retailer’s speed and certainty be worth accepting cash or restricted store credit?
- If lending, have you agreed on a return date and explained region and account limitations?
- Have you checked the current retailer policy and the law where the transaction occurs?
The short version is straightforward: sell or trade the original physical copy, lend that same copy temporarily, and keep accounts and copied files out of the transaction. Verify condition, components, codes, region, retailer terms, and local rules before you hand the game over.
