Before buying a meme coin, verify the exact token and blockchain, check what ownership actually promises, investigate promoter incentives, and assess whether there is enough liquidity to sell. Treat social-media hype and guaranteed-return claims as warning signs. This checklist can help expose unanswered questions; it cannot establish that a coin is safe or predict its price. The legal discussion below is specific to the United States.
What should I check before buying a meme coin?
Use this checklist for the specific token and the conditions that exist when you are considering it. Names, prices, pool conditions, and trading venues can change, and a ticker alone does not identify an asset.

- Verify the token. Match its blockchain and contract or mint address using an independently reached, reputable chain or market reference. Do not rely on a name, ticker, search result, or social account alone: impersonators can copy them. The SEC warns that fraudsters use trusted-source impersonation and social channels to lure investors in its May 29, 2024 investor alert.
- Write down what is actually promised. What rights, if any, does the token confer? Is there a usable function, and what evidence shows it exists? Who is responsible for promised development, how are funds intended to be used, and what progress can be independently verified? The CFTC recommends examining token rights, affiliates, intended use of funds, and liquidity; difficulty finding information about affiliated people or entities is a warning sign. See its customer advisory on digital coins and tokens.
- Separate evidence from promotion. A meme, roadmap, white paper, celebrity association, or slogan is not proof of utility or value. SEC Corporation Finance staff describes the category covered by its 2025 statement as typically having limited or no use, with value driven primarily by market demand and speculation. That is a description of the category in the staff statement, not a finding about every token; read the statement and its limits.
- Investigate supply and incentives. Look for disclosures about total and circulating supply, allocations, promoter or insider holdings, vesting or lockups, and who can change relevant token settings. Public information may be incomplete, and concentration alone does not predict a price move. Commissioner Caroline Crenshaw argued in an individual response that promoters may retain significant supply and that offerings vary; she expressly said her views are her own, not necessarily those of the SEC, its staff, or fellow commissioners. Her February 27, 2025 response is a dissenting view, not the SEC’s institutional position.
- Check liquidity and the practical exit. Find where the exact asset trades and examine current market or pool conditions. Consider whether a small trade could move the price substantially and whether the displayed price appears executable for the amount you might sell. Liquidity affects value and exit conditions, but the CFTC sets no universal safe-liquidity threshold. A screenshot or headline price cannot establish what a sale would return.
- Investigate promotion before acting. Urgency, presale pressure, guaranteed returns, claims of certain listings, celebrity endorsements, and instructions to transact through a direct message deserve independent verification. The SEC describes a pump-and-dump pattern in which promoters tout a memecoin to attract buyers and then sell before the hype ends. It says, “Never make investment decisions based solely on information from social media platforms or apps.” The warning appears in the SEC’s May 29, 2024 alert.
- Check whether key uncertainties remain. If you cannot verify token identity, material claims, promoter incentives, liquidity, or sale conditions, those questions are unresolved—not evidence that the asset is safe. Research completed is not the same as risk removed.
Why a displayed price may not be your sale price
A quoted or last-traded price does not guarantee that a buyer is available for your amount at that price. Thin liquidity or a trade that moves the market can make an exit materially different from the figure shown. Check conditions for the exact token and venue at the time you would trade; there is no authoritative minimum liquidity figure in the CFTC advisory that makes a token safe or guarantees an exit.
How to interpret meme-coin promotion
Promotional attention can create demand, but it can also be part of the risk. Be especially cautious where the pitch presses you to act immediately, promises a return, or directs you to an unsolicited message or link. The SEC alert also warns about advance-fee and recovery scams: do not pay an unexpected extra “tax” or fee to unlock a withdrawal or recover lost crypto, and do not give a supposed recovery helper your private key or seed phrase.

What U.S. sources say about legal status
A token’s “meme coin” label does not settle its legal status. SEC Division of Corporation Finance staff’s May 2025 statement addresses only the kind of meme coins it describes and says it is not a rule, regulation, Commission guidance, or Commission-approved statement. For that described category, the staff says, “neither meme coin purchasers nor holders are protected by the federal securities laws.” That is the staff’s view, not a binding Commission rule; the statement says fraud may still be addressed under other laws and that its analysis does not extend to tokens inconsistent with its description or relabeled products that may otherwise be securities. See the SEC staff statement.
Separate SEC educational material dated April 22, 2026, and updated April 29, 2026, explains that a crypto asset that is not itself a security may still be offered under an investment contract depending on the representations, promises, and facts. It describes the Howey elements as an investment of money, a common enterprise, a reasonable expectation of profits, and profits derived from the essential managerial efforts of others. The SEC’s crypto-asset transactions page does not determine the status of a particular token; avoid categorical conclusions without a token-specific legal analysis.

How to compare more than one coin
Compare the same evidence for each token rather than compressing unlike risks into a single “safe” score.
| Question | What to compare |
|---|---|
| Identity | Verified chain and contract or mint address, not just name or ticker. |
| Rights and utility | Actual ownership rights and demonstrated function versus promotional claims. |
| Incentives | Disclosed supply, promoter or insider allocations, vesting, and control over relevant settings. |
| Trading conditions | Current liquidity, venues, and likely friction when buying or selling. |
| Evidence quality | Whether important claims can be checked independently and whether material information is missing. |
| Legal and operational questions | Unresolved claims about legal status, promised development, or ability to trade and exit. |
What research can—and cannot—tell you
The CFTC Office of Customer Education and Outreach and LabCFTC warn: “Buying digital coins or tokens only because you expect to sell them at a higher price later is the definition of speculation and carries considerable risk, regardless of how good a white paper, application or business plan sounds.” Checking a token does not remove that risk, establish a safe purchase, or predict future returns. The CFTC advisory also cautions against promises of guaranteed value.
