How to Prove a Genuine Supply for GST Input Tax Credit

No. An invoice and a bank entry alone do not prove a genuine GST supply. A defensible input-tax-credit (ITC) claim connects six facts: an identifiable registered supplier, a complete tax document, actual receipt or performance, a payment trail, matching GST-portal data and a clear business-use or onward-supply trail. Keep those records together for the relevant tax period and be ready to explain any mismatch.

What “genuine supply” means for GST ITC

Section 16 of the Central Goods and Services Tax (CGST) Act permits credit for goods or services used, or intended to be used, in the course or furtherance of business, but only when the prescribed conditions are met. The practical question in an audit is therefore not simply whether an invoice exists. It is whether the invoice represents a real taxable supply that your business received, paid for and used.

Rule 36 identifies the documentary bases for claiming credit, including a supplier tax invoice, debit note, bill of entry and applicable Input Service Distributor documents, with the required particulars. These documents establish the starting point; corroborating records establish that the transaction actually happened.

The second proviso to Section 16 requires payment of the value of the supply plus tax to the supplier within 180 days from the invoice date. If that condition is not met, the related credit must be reversed or otherwise dealt with as prescribed, with re-availment when the payment condition is later satisfied. Keep a due-date tracker rather than discovering the issue during an assessment.

The evidence test at a glance

Statutory or factual question Records that answer it What the record does not prove by itself
Who supplied the goods or services? Legal name, GSTIN, registration status, contract or purchase order, quotation and vendor-master approval A GSTIN alone does not prove that the named supplier delivered anything
What was invoiced? Invoice or debit note with number, date, description, quantity, taxable value, rate, tax amount and place of supply A correctly formatted invoice does not prove an underlying supply
Was it received or performed? Delivery, transport and inward records for goods; engagement, milestones, deliverables and acceptance for services A goods-receipt note or acceptance email can be unreliable if it is unsupported by business records
Was the supplier paid? Bank statement, payment reference, purchase ledger, freight invoice and proof of freight payment A payment to an unrelated account or a circular payment does not establish genuine performance
Was the transaction reported in GST systems? GSTR-2B or equivalent portal evidence, reconciliation and correspondence on discrepancies Portal reflection supports a statutory condition but does not prove that goods or services existed
Was the input used in business? Stock movement, production or project records, consumption entries, resale invoices and other business-use evidence A generic accounting entry does not show how the input served the business

Build the six-part evidence file

1. Establish the supplier’s identity

Capture the supplier’s legal name exactly as shown on the GST registration, GSTIN, registered address and registration status for the invoice date. Retain the onboarding form, due-diligence checks, contract or purchase order and the quotation that led to the order. If the supplier’s name, GSTIN or bank-account holder differs across documents, obtain a written explanation and supporting proof before claiming credit.

Keep a dated copy of the supplier’s GST registration details or your portal verification. Registration status can change, so a check made long after the transaction may not explain the position on the supply date. Record amendments, cancellations or changes in place of business that affect the invoice.

2. Check every invoice field

Match the invoice to the purchase order and the physical or service records. At minimum, the file should show the invoice number and date, supplier and recipient details, GSTINs, description, quantity or service basis, taxable value, applicable tax rate and amount, place of supply and any transport or delivery reference. Preserve debit notes and credit notes with the original invoice so the tax value can be followed from issue to return.

Use a three-way check: purchase order or contract, supplier invoice and receipt or acceptance record. Differences in quantity, rate, tax classification or place of supply should be resolved in writing, not silently overwritten in the ledger.

3. Prove receipt of goods

For goods, assemble a chain that follows the consignment from dispatch to your premises and then into stock or production. Where applicable, retain the e-way bill, transporter’s lorry receipt or consignment note, vehicle number, weighbridge slip, gate-entry log, goods-receipt note, warehouse inward register and stock ledger. Photographs, inspection reports, quality certificates and batch or serial-number records add strength when your business normally creates them.

Each record should identify the same supplier, invoice, quantity and date, or explain a legitimate timing difference. A vehicle number that appears on the transport document but not on the gate register needs an explanation. Partial deliveries should be recorded by quantity and date, with the balance traced to a later receipt or cancellation.

4. Prove performance of services

Services require evidence of performance rather than a delivery truck. Keep the signed engagement or statement of work, agreed scope, rate card, purchase order, work plan, timesheets or milestone certificates, deliverables, acceptance emails and invoices. Link the work to a project, production activity, customer order or internal function. For recurring services, retain periodic reports or service logs instead of relying on a single year-end confirmation.

Acceptance should come from an authorised business user and identify what was accepted and when. If the contract requires a completion certificate, retain it. A payment made against a bare invoice, without scope, output or acceptance evidence, leaves the service portion of the claim exposed.

5. Preserve the commercial and payment trail

Keep the quotation, negotiation record, purchase order, contract, supplier ledger, bank statement and payment advice together. The bank narration and beneficiary should identify the invoicing supplier. If a factor, group company or authorised collection agent receives the money, retain the written arrangement and proof linking that account to the supplier.

Record freight separately where the supplier or a transporter charges it. Keep the freight invoice, transport document and proof of freight payment. Reconcile the invoice’s taxable value and GST with the amount settled, including advances, deductions, retention, credit notes and withholding entries. A ledger that merely clears an invoice does not show that the supplier received the consideration.

6. Connect the input to business use

Show what happened after receipt. For inventory, link the inward entry to a stock ledger, production batch, consumption issue, transfer or outward sale. For project costs, identify the project code, site record or customer invoice. For services, show the department, cost centre, deliverable or revenue activity that used the work.

Where the same goods are resold, retain the outward invoice and dispatch record. Where they are consumed, retain the material-issue note, bill of materials, production report or other normal operational record. The aim is not to create paperwork that your business never uses, but to preserve the ordinary records that demonstrate a credible purchase-to-use path.

How to assemble a defensible file, step by step

  1. Open a transaction folder when the order is placed. Add the vendor approval, quotation, purchase order or contract and the agreed delivery or milestone terms.
  2. Verify the supplier before posting the invoice. Record the legal name, GSTIN, registration status and the bank-account details approved for payment.
  3. Validate the invoice against the order. Check numbering, dates, description, quantity, value, tax rate, tax amount, place of supply and recipient details. Resolve exceptions with a dated email or revised document.
  4. Capture receipt or performance immediately. For goods, file the e-way bill where applicable, transporter record, vehicle details, gate entry, weighment, goods-receipt note and stock entry. For services, file the work record, milestone or deliverable and authorised acceptance.
  5. Record the accounting and payment trail. Post the supplier ledger, retain the bank statement and payment advice, and reconcile the amount paid with the invoice value plus GST and any agreed adjustments.
  6. Check the GST portal data. Save the relevant GSTR-2B or equivalent evidence, match supplier GSTIN, invoice number, date, taxable value and tax, and log any mismatch or follow-up with the supplier.
  7. Document business use. Add the stock, production, project, resale or service-use reference that explains why the input relates to business.
  8. Run the 180-day review. Track unpaid balances, process the prescribed consequence where necessary and retain later payment evidence.
  9. Lock the file for retention. Keep originals or reliable electronic copies with an index so an auditor can move from invoice to receipt, payment, portal match and business use without relying on oral explanations.

Goods: a practical movement-and-receipt checklist

  • Purchase order or contract showing item, quantity, price, delivery location and terms.
  • Supplier invoice or debit note with complete particulars.
  • E-way bill when the movement falls within the applicable requirement.
  • Transporter lorry receipt or consignment note, including vehicle and consignor/consignee details.
  • Vehicle number, gate entry, weighbridge slip and unloading record where normally maintained.
  • Goods-receipt note and inspection or quality report.
  • Warehouse inward register, batch or serial-number record and stock ledger.
  • Evidence of issue to production, transfer, consumption or onward sale.
  • Photographs or other inspection evidence where the nature of the goods or your controls normally generate them.

These documents should tell one coherent story. A large purchase delivered in several vehicles should have corresponding transport and receipt entries. A purchase that never appears in stock, production or resale records needs a documented explanation, such as immediate consumption or a legitimate third-party delivery arrangement.

Services: show what was done and accepted

  • Signed engagement letter, statement of work or purchase order.
  • Scope, rates, deliverable schedule and responsible personnel.
  • Timesheets, work logs, milestone certificates or progress reports.
  • Files, reports, designs, software outputs, training attendance or other deliverables appropriate to the service.
  • Acceptance email or certificate from an authorised business owner.
  • Invoice, supplier ledger and bank payment proof.
  • Project, cost-centre, customer or operational record showing business use.

Do not manufacture timesheets or acceptance notes after a notice arrives. If a service was genuinely performed but your normal process was informal, gather contemporaneous emails, meeting records, work products and user confirmations, and explain the control gap accurately.

GSTR-1, GSTR-2B and supplier mismatches

Section 16 includes the condition that invoice details be furnished by the supplier and communicated through the GST system. Retain the GSTR-2B or equivalent portal evidence for the relevant period and reconcile the supplier GSTIN, invoice number, date, taxable value and tax amount. Save the reconciliation file and correspondence showing how you asked the supplier to correct an omission or error.

A missing or incorrect entry is a warning to investigate, not automatic proof that no supply occurred. First check whether the invoice was reported in a different period, with a typographical variation, under a debit or credit note, or with the wrong recipient GSTIN. Ask the supplier to amend the return where the law and portal window permit, and preserve the request and response.

Conversely, a matching 2B entry is not a substitute for receipt and business-use evidence. Circular 171/03/2022-GST, dated 6 July 2022, addresses cases in which registered persons issue tax invoices without actual supply to enable recipients to avail and utilise ITC fraudulently. Portal data can corroborate reporting while an audit still tests whether anything was actually delivered or performed.

Why an invoice and bank payment can still fail

The Supreme Court authority cited in this context states that “mere production of tax invoices would not be sufficient to claim ITC.” Its evidentiary reasoning refers to the seller’s name and address, vehicle details, freight payment, acknowledgement of delivery, tax invoices and payment particulars. The case arose under the Karnataka VAT Act, so it is persuasive guidance on how evidence is assessed, not a replacement for the CGST Act or rules.

A file containing only an invoice and a bank entry leaves unanswered questions: Did the supplier have the goods or capacity to provide the service? Did the specified quantity reach the recipient? Was the money paid to the invoicing supplier? Was tax reported and paid? Where did the input go? The more of these questions that remain open, the harder it is to defend the credit.

Weak file versus strong file

Evidence axis Materially weak file Stronger, connected file
Supplier identity and registration Invoice image with no onboarding or GST-status check Verified legal name and GSTIN, registration record for the supply date, contract and approved bank details
Invoice and portal match Invoice posted in the ledger; no 2B capture or mismatch log Complete invoice, 2B reconciliation by GSTIN, number, value and tax, plus documented correction requests
Movement or performance Generic goods-receipt note or a service invoice with no output Transport, vehicle, gate, weighment, inward and stock records for goods; scope, work product and acceptance for services
Payment and freight Bank transfer with unclear beneficiary or unexplained netting Payment to the invoicing supplier, reconciled value plus GST, freight invoice and payment proof, with 180-day monitoring
Stock or business-use link No record after purchase posting Production, consumption, project, resale or service-use reference tied to the input
Tax-payment and return consistency Unresolved supplier filing or return discrepancies Return workings, portal evidence, supplier correspondence and documented treatment of exceptions

Fake-invoice risk and the “paper transaction” warning

CBIC Circular 171/03/2022-GST describes cases where registered persons issue “tax invoice, without actual supply of goods or services or both (hereinafter referred to as ‘fake invoices’), in order to enable the recipients of such invoices to avail and utilize input tax credit (ITC) fraudulently.” An invoice without an underlying supply does not satisfy the statutory concept of supply and can lead to demand and penalty consequences.

Red flags include a supplier that cannot explain the source or movement of goods, repeated payments followed by immediate returns, transport records inconsistent with distance or quantity, identical descriptions across unrelated projects, and invoices that never appear in stock, production or customer work. Do not claim credit merely because the supplier is registered or the invoice appears in 2B. Pause the claim, investigate and obtain professional advice when the underlying transaction is doubtful.

What to do when the supplier does not upload the invoice

  1. Confirm that the invoice details and recipient GSTIN are correct and that the relevant return period has not been overlooked.
  2. Ask the supplier in writing to furnish or amend the invoice details, giving the invoice number, date, taxable value and tax amount.
  3. Save the supplier’s response, revised invoice or credit/debit note and the portal evidence after correction.
  4. Separately test the actual supply: receipt or performance, payment, business use and tax-document validity.
  5. Apply the ITC treatment required for the relevant tax period and current rules; do not assume that a later portal appearance cures every other defect.

If the supplier refuses to correct the record, becomes untraceable or provides contradictory documents, escalate the matter internally and obtain advice from a qualified Indian GST professional before filing or defending the claim.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Preparing for an audit, inquiry or notice

Start with an indexed transaction file, not a stack of unlabelled attachments. Prepare a one-page reconciliation showing invoice number, date, supplier GSTIN, taxable value, tax, 2B status, payment date, receipt or acceptance reference and business-use reference. Then attach the underlying records in that order.

Answer factual questions directly. If a document was not created in the ordinary course, say so and provide the closest contemporaneous evidence rather than backdating a form. Explain timing differences such as partial delivery, period-end invoicing, advances, returns or payment through an authorised intermediary. Keep the response consistent with the books, GST returns, bank records and the supplier correspondence.

A notice response or litigation position should be reviewed by a qualified Indian GST professional. The CGST Act, rules, circulars, portal processes and case law can change, and the relevant tax period may be governed by a different version of a condition or procedure.

Retention and control practices that prevent future gaps

  • Use a single electronic folder or document-management record keyed to supplier, invoice and purchase order.
  • Restrict edits and retain an audit trail for invoices, receipt records and reconciliations.
  • Set alerts for missing 2B entries, unpaid invoices approaching 180 days and unmatched quantities.
  • Require procurement, stores, accounts payable and GST teams to resolve exceptions before credit is finalised.
  • Periodically sample invoices across suppliers, values and locations to confirm that movement, payment and business-use records still exist.
  • Date-stamp portal downloads and preserve the return period to which each reconciliation relates.

There is no published general success rate, failure rate or numeric evidentiary threshold for genuine-supply ITC claims. The defensible standard is qualitative: the records should be consistent, contemporaneous and sufficient to show supplier identity, invoicing, actual receipt or performance, payment, GST reporting and business use.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Final decision rule

Before claiming ITC, ask whether an independent reviewer could trace the transaction from order to invoice, from invoice to receipt or service acceptance, from receipt to payment, from payment to the invoicing supplier, from the invoice to GST-portal reporting and from the input to business use. If any link is missing, cure the record where possible or treat the credit conservatively. A genuine supply is proved by the connected evidence file, not by a document that exists in isolation.
