This guide covers how to tell what protection you have, what to check before uploading records, how to secure your side of a telehealth visit, and how to get your records back. It is written for U.S. patients.
Does HIPAA cover an AI prescriber?
Sometimes. HHS’s Office for Civil Rights describes the rule this way in The HIPAA Privacy Rule: “The HIPAA Privacy Rule establishes national standards to protect individuals’ medical records and other individually identifiable health information (collectively defined as “protected health information”) and applies to health plans, health care clearinghouses, and those health care providers that conduct certain health care transactions electronically.”

Two points follow from that sentence. Coverage attaches to covered entities (most licensed providers who bill electronically, plus health plans and clearinghouses) and to their business associates. It does not attach to every app or every health detail you type somewhere. HHS’s guidance on personal phones and tablets says that in most cases HIPAA does not protect data in an app you choose yourself, unless the app is provided by a covered entity or its business associate. Other federal and state laws may still apply.

Three things “AI prescriber” can mean

HHS’s Business Associates guidance lists a third-party AI chatbot on a provider’s patient portal as a possible business associate. That is a fact-dependent example, not a blanket rule. You can’t call a given service compliant or noncompliant from its marketing. The deciding facts are its role, its agreements and its current terms.

What happens when you send records to an app yourself
HIPAA lets you direct a covered entity to send an electronic copy of your records to a recipient you choose, including an app. HHS’s FAQ on patient-directed transmission says that once the data reaches an app that isn’t acting for the covered entity, the app’s later handling may fall outside the sending provider’s HIPAA responsibility. Your hospital may be bound by HIPAA while the copy sitting in the app is not. Decide whether the app’s own promises are good enough before you send anything.
Questions to answer before you upload anything
This article does not establish the practices of any particular AI prescriber, so check each one yourself. Open the current privacy notice and look for the following.

- Role: Does it provide care on behalf of a HIPAA-covered provider? Does the AI company say it is a business associate?
- Collection: Which categories of data does it collect: uploaded records, medication lists, conversation text, voice recordings, device data?
- Recipients: Who gets the data, including pharmacies, labs, analytics providers and affiliates?
- Purposes: Is your data or are your transcripts used to improve or train AI systems, or for marketing? Is there an opt-out?
- Retention and deletion: How long is data kept, and what is the account-closure or deletion process? Is there a contact for privacy requests?
A privacy “badge” or a line of marketing copy does not answer all of these. If the notice is vague, ask the company in writing and keep the reply. If it won’t answer, treat that as information.

Your state may add protection. HHS’s Telehealth.HHS.gov privacy guidance notes that some state privacy laws apply to entities outside HIPAA. Which ones apply depends on where you live and what the service does.

Share less in the first place
- Use the provider’s official app or portal where one exists, and confirm the prescriber’s identity and the organization behind the service.
- Upload only the records the visit needs, such as current medications, allergies and relevant diagnoses, rather than your whole chart.
- Skip optional integrations that pull in your full health-record history unless you have read what the service does with it.
Secure your side of the visit
HHS’s Telehealth Privacy and Security Tips for Patients gives practical steps for the appointment itself.
- Choose a private spot. Use a room where others can’t overhear you. Headphones can help.
- Silence nearby listeners. Turn off or mute smart speakers and other voice-responsive devices that might record.
- Use a personal, updated device. Avoid public or workplace devices and, where possible, public networks.
- Lock it down. Set a screen lock and use a unique password for the service.
- Turn on multifactor authentication if the service offers it.
- Use encryption where available, as HHS recommends.
What a covered provider should be doing
You can’t audit a provider’s systems, but HHS’s audio-only telehealth guidance shows what covered entities are expected to consider in their security risk analysis: interception of communications, encryption, whether recordings or transcripts are stored, authentication, and device locking. These are good prompts for questions. For example, ask whether visits are recorded or transcribed and where those files are kept.

Getting, correcting and moving your records
Under the HIPAA Privacy Rule, you can generally inspect and obtain your records from a covered entity, request corrections, and have an electronic copy sent to a recipient you choose. Use the provider’s records-request process, usually through the portal or the medical records office, and put the request in writing.
These rights apply to covered entities and the information they hold. Don’t assume they automatically govern a consumer app’s independent copy of your data. For that copy, your tools are the app’s own deletion and account-closure process and any rights under your state’s privacy law. Ask for deletion in writing, ask what is retained after it, and save the confirmation.

Verdict
Treat HIPAA coverage as something to verify, not assume. Establish who the covered provider is, what role the AI vendor plays, and what the current privacy notice says about training, retention and deletion. Then share the minimum and secure your own device and connection.
