There is no single U.S. opt-out right for every AI-based assessment. Whether you can decline depends on what the system does, whether the assessment is required by state or district rules, what data it collects, and which privacy law applies. A state accountability exam, a classroom quiz, an AI proctor, an automated essay scorer and a sensitive survey can have entirely different rules.
Start by identifying the tool and asking the school, in writing, for its legal authority, data practices, human-review process and a non-AI alternative. Keep the response. If the school will not explain the system or refuses a lawful request, escalate through the district and the appropriate state or federal privacy channel.

What “AI-based assessment” can mean
Schools use the term AI for systems with very different purposes. An adaptive test may select the next question from a bank based on a student’s answers. An essay scorer may estimate a rubric score from written work. A proctoring service may analyze a webcam feed, microphone audio, eye movements or keystrokes. A behavior or risk model may infer a profile that is not visible in the student’s original work. A survey may ask about health, family or beliefs while using automated analysis.

Before discussing an opt-out, ask the school to name the product, assessment window and function. The same vendor can offer both a required state test and an optional practice tool. “AI-based” describes the technology, not the legal status.

| Activity | Typical purpose | Questions that affect an opt-out |
|---|---|---|
| State accountability assessment | Measures achievement for state and federal reporting | Is participation required by state law? Does declining affect the school’s reporting or the child’s services? |
| District benchmark or adaptive test | Placement, progress monitoring or curriculum decisions | Is it required locally, tied to a grade, or offered only for practice? |
| Classroom assessment | Teacher grading or feedback | Can a paper or human-scored version measure the same standard? |
| AI proctoring | Identity, test-security or misconduct flags | Are video, audio, biometrics or behavioral inferences collected, and is there a human review? |
| Automated essay or short-answer scoring | Scores or suggests scores for written work | Can the student receive human scoring and challenge an inaccurate result? |
| Survey or evaluation | Collects information about attitudes, health or family circumstances | Does the Protection of Pupil Rights Amendment (PPRA) cover the questions, and are there state privacy rights? |
What federal law does—and does not—guarantee
Every Student Succeeds Act and required testing
The Every Student Succeeds Act (ESSA) requires states to maintain academic assessment systems. Its parent-rights language preserves state and local authority over declining participation: “Nothing in this paragraph shall be construed as preempting a State or local law regarding the decision of a parent to not have the parent’s child participate in the academic assessments under this paragraph.” (20 U.S.C. §6311.) In practical terms, ESSA itself does not create one nationwide opt-out procedure. State law, district policy and the purpose of the assessment determine the result.
Some states treat accountability tests as mandatory. For example, the Iowa Department of Education says that Iowa and federal law do not give parents authority to opt children out of required accountability assessments. That statement applies to Iowa’s assessments; it is not a rule for every state. Ask for the exact statute, regulation or board policy that the school believes makes a test compulsory.
PPRA and sensitive information
The Protection of Pupil Rights Amendment requires annual notice and an opportunity to opt out of certain activities involving protected, sensitive information. Its statutory exceptions include ordinary school tests and assessments used to provide cognitive, evaluative, diagnostic, clinical, aptitude or achievement information. Consequently, labeling a test “AI” does not automatically place it in PPRA’s opt-out category. A separate survey or evaluation can raise PPRA issues when it asks about protected subjects, so request the questions and the school’s PPRA notice.
FERPA: access, correction and disclosure controls
The Family Educational Rights and Privacy Act (FERPA) gives parents rights to inspect education records, seek amendment of records they believe are inaccurate, and control many disclosures of personally identifiable information. FERPA is not a blanket right to refuse every instructional or accountability test. It is nevertheless important when an AI system creates a score, flag, profile or other record. Ask to inspect the record, the information used to create it and the process for requesting an amendment.

Use this written-request sequence
A short, specific request is more effective than an informal objection. Send it to the teacher and principal, copy the district privacy officer or superintendent, and retain a dated copy and any reply.
- Name the tool and activity. Ask whether it is a state test, district benchmark, classroom assessment, adaptive test, essay scorer, proctoring system, behavior-risk model or survey. Include the date or testing window if known.
- Ask about legal status. Is participation required by state law, district policy, a course-credit rule or an individual education plan? Or is it optional? Request the exact policy or statute and ask what happens if the child declines.
- Inventory the data. Request a list of information collected or inferred, including student work, identifiers, location, device data, audio, video, facial or voice biometrics, keystrokes, eye tracking and behavioral profiles.
- Ask about the vendor lifecycle. Where is data stored? How long is it retained? Who receives it? Is it sold, shared, disclosed to subcontractors or used to train a general or vendor-specific AI model? Ask whether deletion is possible and on what schedule.
- Identify human control. Is a person reviewing the score or an alert before it affects a grade, placement, discipline, services or a report? Who can override it, and how quickly?
- Request documentation. Ask for the vendor privacy notice, contract or data-protection agreement, assessment-validity information, accessibility documentation and the school’s procedure for correcting an inaccurate score or profile.
- Request an equivalent alternative. Ask for a paper test, teacher- or human-scored work, an in-person proctored session or another method that measures the same standard. Ask whether declining changes grades, course credit, accommodations, special-education services or state accountability reporting.
- Request a written decision. Ask the school to state whether the child may decline, the reason, the alternative offered and any consequences. A written answer creates a clear record for an appeal.
Questions to ask about data and model training
Do not limit the inquiry to “Does the system use AI?” The consequential issue is what happens to the child’s information. Ask for answers in plain language to each of these points:
- What exact fields leave the school’s systems?
- Does the service collect raw audio or video, face or voice templates, typing patterns, device identifiers or approximate location?
- What inferences are generated, such as proficiency estimates, attention scores, misconduct flags or risk categories?
- Is the student’s work or metadata used to train, fine-tune or evaluate a model? If so, is that use limited to the school’s account or shared across customers?
- Which vendor employees, contractors, subprocessors or government agencies can access the information?
- How long are raw files, derived features, scores and audit logs kept, and what triggers deletion?
- Can a parent obtain a copy of the data and the resulting score or profile?
- What security incident notice and breach-response procedures apply?
- Can the school prevent advertising, sale or unrelated commercial use?
A contract may define the vendor as a school official or service provider under FERPA, but that designation does not answer every question about retention, secondary use or model training. Ask to see the actual data-protection terms rather than relying on a product description.
When a non-AI alternative is appropriate
An alternative should measure the same learning objective and provide a comparable opportunity to demonstrate it. A paper version may be reasonable for a multiple-choice benchmark; a teacher-scored essay may replace an automated writing score; an in-person session may replace webcam proctoring. The school can explain why a particular accommodation is impractical, but it should identify the educational standard being measured and the consequence of declining.

Ask these questions before accepting an alternative:
- Will the result count for the same grade, placement or credit?
- Will the child receive the same time, accessibility tools and language support?
- Will the alternative avoid the same vendor and data collection?
- Will choosing it affect special-education services, a 504 plan, course enrollment or participation reporting?
- Who will score it, and how can an error be challenged?
State examples show why location matters
Iowa
The Iowa Department of Education states that none of the statutes, regulations and rules in state or federal law give parents authority to “opt” their children out of accountability assessments. If your child attends an Iowa public school, ask whether the particular test is one of those required assessments and request the policy in writing. Do not assume the Iowa position applies elsewhere.
Florida
Florida law provides a parental opt-out for district-level data collection about a minor child when the collection is not required by law. The threshold is whether the collection is legally required, not whether a vendor markets the tool as AI. Ask the district to identify the legal requirement it relies on and whether the system is collecting data beyond what that requirement permits.

California guidance discusses rights under the California Consumer Privacy Act (CCPA), the Student Online Personal Information Protection Act (SOPIPA) and FERPA. Depending on the entity and data, families may have rights to know how information is used, request deletion or correction, opt out of sale or sharing and limit certain disclosures. Public-school processes and statutory exceptions matter, so use the district’s privacy contact and the state’s current notices rather than a generic internet form.

Pennsylvania
Pennsylvania implementation guidance tells schools to comply with FERPA and the Children’s Online Privacy Protection Act (COPPA) and to address whether student data are used to train an AI system. Ask the school to state its training-use restriction and the contract clause that implements it.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How to challenge an AI-generated score or profile
- Request the record. Under FERPA, ask to inspect the score, flag, profile and the education records used to make the decision.
- Ask for the method at a useful level. Request the rubric, scoring criteria, input data, confidence or error information supplied to decision-makers, and the identity of the human reviewer. A school may not provide proprietary source code, but it should explain how the result was used.
- Document the error. Point to factual mistakes, missing context, disability-related effects, language issues, false identity matches or work that was not the child’s.
- File an amendment request. Ask the school to correct or remove information that is inaccurate or misleading and follow its FERPA amendment procedure.
- Request a human re-review. Ask that no grade, discipline, placement or service decision rely solely on the disputed output while the review is pending.
- Use the school’s appeal route. Follow the principal, district assessment office or special-education process, depending on the decision affected.
Keep copies of the original work, the system result, correspondence and dates. A clear timeline helps distinguish a scoring disagreement from an inaccurate education record.
Escalation when the school refuses or does not respond
- Ask the school to provide the refusal, governing policy and explanation in writing.
- Escalate to the district privacy officer, superintendent or assessment director.
- Contact the state education agency for state-testing and state-law questions. Include the assessment name, district, dates and the written response.
- For a possible FERPA or PPRA violation, consider a complaint to the U.S. Department of Education’s Student Privacy Policy Office, which administers federal student-privacy guidance and complaints. Whether a complaint is accepted, the deadline and the available remedy depend on the facts and jurisdiction.
Do not upload a child’s identity documents or sensitive records to an unofficial complaint form. Use the agency’s stated secure process and send only what is necessary.

If your child is outside the United States
U.S. FERPA, PPRA and ESSA rules do not automatically apply in another country. In the United Kingdom, the Department for Education recommends transparency when AI processes pupil data and says pupils and parents or legal guardians should understand that personal data is being processed by AI. Ask the school for its lawful basis, privacy notice, retention period, human-review safeguards and a non-AI option under the applicable UK data-protection and education rules. Seek local advice before using a U.S. template.

Quick Recap
Common mistakes to avoid
- Assuming “AI” is a legal category. The purpose and legal authority matter more than the label.
- Relying on a verbal promise. Without a dated written response, it is difficult to prove what the school decided.
- Demanding source code as the only remedy. Ask for data, scoring criteria, validation information, human review and correction rights; proprietary code may not be disclosed.
- Ignoring inferred data. A proficiency estimate or behavior flag can be as consequential as the original answer.
- Accepting an alternative without checking consequences. Confirm that grades, services, accommodations and reporting are unaffected.
- Using another state’s template unchanged. Iowa’s accountability position, Florida’s nonrequired-data rule and California’s privacy rights illustrate different state approaches.
- Confusing privacy with participation. A school may have a lawful basis to administer a required test while still needing to explain disclosures, retention and correction procedures.
