For an Indian GST rate change, determine the time of supply under Section 14 of the Central Goods and Services Tax Act, 2017. That test first asks whether the supply occurred before or after the effective date, then compares the invoice date with the statutory payment date.
CBIC illustrates the risk with a pending-goods order: if the goods are supplied and invoiced after the rate change, the new rate can apply even when the supplier received the entire advance before the change. The order date alone is not decisive.

What controls the rate when GST changes?
Section 14 of the CGST Act overrides the ordinary time-of-supply rules in Sections 12 and 13 when the government changes a rate. It is a date-based test involving three events:
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitches- the effective date in the rate-change notification;
- the date the goods are supplied or the service is completed, as applicable;
- the invoice date and the statutory date of receipt of payment.
Classify the transaction using the branch for supply before or after the change. Do not decide from the purchase order, quotation, contract signature or advance receipt in isolation. The exact notification, classification and effective date still have to be verified for the particular goods or service.

Section 14 decision table
Use the following statutory branches after establishing whether the supply happened before or after the rate changed. “Payment date” means the date determined under the payment rule explained below, not necessarily the date printed on a bank advice.
| When the supply occurred | Invoice timing | Payment timing | Time of supply for the rate change |
|---|---|---|---|
| Before the change | Invoice after the change | Payment after the change | Whichever occurs first: receipt of payment or invoice issue |
| Before the change | Invoice before the change | Payment after the change | Invoice date |
| Before the change | Invoice after the change | Payment before the change | Payment date |
| After the change | Invoice before the change | Payment after the change | Payment date |
| After the change | Invoice before the change | Payment before the change | Whichever occurs first: receipt of payment or invoice issue |
| After the change | Invoice after the change | Payment before the change | Invoice date |
The table does not turn an uncertain delivery or service-completion date into a settled fact. Keep evidence for when the supply actually took place and apply the row that matches the evidence.
How the statutory payment date is determined
For Section 14, receipt of payment is generally the earlier of:
Recommended Free Tools
- the date the payment is entered in the supplier’s books; or
- the date the amount is credited to the supplier’s bank account.
There is also a special proviso for a bank credit occurring more than four working days after the rate-change date. That rule can alter the result, so retain both the books-entry date and the bank-credit date rather than recording only the date shown by an accounts-receivable system.
For a customer’s advance, the supplier should be able to show the receipt voucher, ledger entry, bank statement and the terms identifying what supply the money relates to. A payment reference or an undated remittance email is not, by itself, a substitute for the statutory record.
Why an advance does not settle every pending order
In CBIC’s FAQ example, goods are supplied and the invoice is issued after a rate change in June 2017, while the full advance was received in April 2017. CBIC’s answer applies the new rate because the supply and invoice are after the change. The example is illustrative, but it rejects the blanket statement that “advance paid means the old rate.”

A practical workflow for a pending order
Use this sequence for each affected order or order line. It can be implemented in an accounting or ERP workflow without assuming that every line in an order has the same tax event.
- Identify the supply. Record the precise goods or service, the tax classification and the rate notification that applies. Confirm whether the transaction is a single supply, a bundle, a milestone arrangement or multiple deliveries.
- Capture the effective date. Save the notification and its effective date in the transaction file. A public announcement, a customer email or a purchase-order date is not a replacement for the notified effective date.
- Prove when the supply occurred. For goods, retain delivery, dispatch, acceptance or other records relevant to the contract and applicable GST rules. For services, retain the completion, milestone or acceptance evidence that establishes the service event.
- Record invoice timing. Use the actual issue date of the tax invoice. If an invoice was cancelled and reissued, preserve the original record and the reason for the correction.
- Determine payment timing. For every instalment or advance, record the books-entry date and bank-credit date, then apply the statutory earlier-date rule and any applicable four-working-day proviso.
- Select the Section 14 branch. Mark supply as before or after the change, mark invoice and payment as before or after, and document the row of the decision table used.
- Reconcile tax documents. Match the receipt voucher, advance ledger, tax charged, final invoice and credit or debit adjustments. Resolve differences before filing the return for the relevant period.
- Escalate exceptions. Obtain GST advice for disputed delivery dates, unusual cancellation clauses, bundled supplies, related-party arrangements, partial performance or a notification with special transitional language.
Partial advances, instalments and staged delivery
Do not assume that one advance fixes the rate for a later series of supplies. Separate the transaction into the portions supported by the facts. For a staged delivery, map each delivered portion to its supply date, invoice and related payment. For a service with milestones, identify the event that creates the relevant supply and connect each instalment to that milestone.
A partial advance may be linked to the first stage, spread across stages under the contract, or left unidentified. The accounting treatment should follow the documented commercial arrangement and the applicable time-of-supply rules; do not allocate the entire advance to a later invoice merely because that is operationally convenient.
When a rate changes between stages, preserve an allocation schedule showing the taxable value, advance applied, balance collected and rate used for each stage. This makes it possible to explain why two lines on one customer order carry different rates without changing the legal test.
Receipt vouchers: what to check
When an advance is received for a taxable supply, the receipt voucher should be consistent with the underlying transaction. The GST Rules list particulars including:
Rank #3
- the advance amount;
- the tax rate and tax charged;
- a description of the goods or services;
- recipient information; and
- the place of supply.
The official Rules compilation reviewed for this guidance states that, where the rate is not determinable when the advance is received, tax is paid at 18%. That compilation is amended through 1 January 2022. Before relying on the 18% fallback for a current transaction, verify whether a later amendment or the applicable notification changes the rule.
Do not use a receipt voucher to conceal an unknown supply. If the customer, place of supply, classification or rate is genuinely unresolved, document the issue and obtain professional advice; correcting an assumption later can affect the voucher, invoice and return.
Final invoices and service-invoice deadlines
CBIC’s invoice rules identify taxable value, tax rate, tax charged and place of supply among the particulars of a tax invoice. The invoice should reconcile to the advance already reported, showing the amount adjusted and the remaining amount payable or refundable.
For taxable services, the general rule is to issue the invoice within 30 days from the date of supply, subject to specified exceptions. That 30-day statement should not be applied indiscriminately to goods. Goods have their own invoicing and movement requirements, so use the rule applicable to the actual supply and notification.
If the rate changed between an advance receipt and the final invoice, show the rate selected under Section 14 and retain the calculation supporting it. A system-generated rate is not evidence that the correct branch was chosen.
Worked date patterns
Supply before the change; invoice before, payment after
A supplier completes the supply before the effective date, issues the invoice before that date and receives the customer’s balance afterwards. Under the supply-before branch, the invoice date is the time of supply. The later payment does not move the transaction to the new rate.

Supply before the change; payment before, invoice after
The supply occurs before the effective date, the advance is received before it and the invoice is issued afterwards. The payment date is the time of supply for this branch. Keep evidence of when the payment was entered in the books and credited to the bank.
Supply after the change; invoice after, payment before
The supplier receives the full advance before the effective date, completes delivery afterwards and issues the invoice afterwards. The invoice date controls under the supply-after branch. This is the pattern addressed by CBIC’s FAQ example and is the reason a pre-change advance cannot be treated as an automatic old-rate guarantee.
Supply after the change; invoice before, payment after
The invoice is issued before the effective date, but the supply occurs after it and payment arrives later. For this supply-after branch, the payment date is the time of supply. The contract and records should explain why an invoice preceded the completed supply.

Using the purchase-order date
A purchase order shows commercial intent, not necessarily the GST time of supply. Correct the review by replacing the order date with documented supply, invoice and payment dates.
Treating every advance as an old-rate transaction
An advance is one input to the Section 14 test. Reclassify the order using the supply-before or supply-after branch, especially where delivery and invoicing occur after the change.

Applying a service deadline to goods
The general 30-day taxable-service invoice rule is not a universal goods deadline. Check the rules for the actual supply.
Letting software overwrite the rate
Automated tax engines can be useful, but a changed master rate does not document the transaction’s historical rate. Lock the notification, effective date, branch selected and supporting documents with the order record.
Ignoring later amendments
The Rules compilation containing the 18% advance fallback is consolidated through 1 January 2022, while the CBIC FAQ example is historical. Verify current amendments, notifications and classifications before filing a live transaction.

Create a rate-change checklist that becomes mandatory when a notification is received. At minimum, configure fields for the effective date, supply status, invoice date, each payment’s books-entry date, each bank-credit date, receipt-voucher number, final-invoice number and the Section 14 branch.
Freeze historical documents so a later master-data change cannot rewrite the rate originally selected. Require a reviewer to approve orders with advances before the change and fulfilment afterwards. For bulk orders, generate an exception report for lines where the supply date, invoice date and payment date fall on opposite sides of the effective date.
Reconcile customer advances to open delivery schedules at each rate change. The review should identify undelivered goods, incomplete services, cancelled lines, returned advances and instalments that cannot yet be tied to a particular supply. Keep the notification and calculation with the tax workpapers for the statutory record-retention period.
What to keep in the transaction file
- the applicable rate notification and effective date;
- classification support for the goods or service;
- purchase order, contract and amendments;
- delivery, acceptance, milestone or completion evidence;
- bank statements and ledger entries for every payment;
- receipt vouchers and any advance-adjustment documents;
- the final tax invoice and credit or debit notes;
- the Section 14 decision worksheet and reviewer approval; and
- records of corrections, cancellations and customer communications.
A complete file allows the supplier to explain not only the rate charged, but why that rate was selected when the order crossed a rate-change date.

When professional review is warranted
Obtain transaction-specific GST advice when the effective date is unclear, a notification changes classification as well as rate, a contract has milestones or acceptance conditions, goods move in multiple consignments, a service is performed over time, an advance is refunded, or the parties dispute when supply occurred. Section 14 supplies the framework, but the outcome depends on the facts and the wording of the applicable notification.
For a current filing, verify the latest CGST Act and Rules, the rate notification for the exact supply, and any later amendment to receipt-voucher or invoicing requirements. This article explains the decision process; it is not a determination of liability for a particular transaction.
