Do not put a new AI legal assistant on live matters because a demonstration looked convincing. Test the exact task with fictional, public, redacted, or expressly approved material; compare every answer with a lawyer-checked reference; verify authorities and factual claims; inspect retention, training, access, deletion, security, and data-location terms; then set human-review and escalation rules before a controlled pilot. The lawyer remains responsible for the final advice and work product.
What a proper evaluation must establish
An AI legal assistant is not evaluated in the abstract. Its usefulness and risk depend on the particular tool, model version, prompt, source collection, jurisdiction, practice area, and task. A successful summary of one contract does not show that the system can research a limitation period, distinguish two jurisdictions, draft a filing, or handle incomplete facts.

ABA Formal Opinion 512 says lawyers need a reasonable understanding of a generative-AI tool’s benefits and risks, with the amount of verification depending on the tool and the task. The opinion describes competence as “not a static undertaking” because capabilities and risks change. The opinion addresses the ABA Model Rules and is not automatically binding in every jurisdiction; check your own regulator’s rules. Read ABA Formal Opinion 512.
Your evaluation should answer four separate questions:

- [Deep Bass with Clear Vocals] High-performance drivers produce punchy bass while keeping vocals clean and detailed for everyday listening.
- Can it perform the defined task? Measure accuracy, completeness, jurisdictional fit, source support, consistency, and error visibility on representative examples.
- Can the firm use it without compromising duties? Examine confidentiality, privilege, privacy, security, provider access, retention, reuse, deletion, subprocessors, and data location.
- Can lawyers supervise it effectively? Test whether a reviewer can find and correct errors before work reaches a client, court, opposing counsel, or regulator.
- Can the firm govern it over time? Document approved uses, excluded uses, training, ownership, costs, and the trigger for reassessment after product or contract changes.
Define the intended use and its risk before testing
Write a one-page use-case specification before opening the tool. Naming a product without naming the work it will perform makes the evaluation too vague to be useful.
Record the use case
- Task: for example, summarize a contract set, extract change-of-control clauses, produce a chronology, draft an initial research outline, or identify potentially relevant authorities.
- Jurisdiction and law: state, province, territory, country, governing law, court, tribunal, and any required date range for authorities.
- Users: partners, associates, paralegals, law clerks, support staff, or clients. Their training affects the required controls.
- Matter sensitivity: public information, internal work product, confidential client information, privileged material, personal information, trade secrets, or information subject to a protective order.
- Expected benefit: time saved, improved retrieval, more consistent extraction, drafting assistance, or another measurable outcome.
- Consequence of error: inconvenience, missed issue, incorrect advice, missed deadline, filing defect, waiver of privilege, financial loss, or disciplinary exposure.
Separate low- and high-consequence work
| Use category | Examples | Minimum evaluation and control |
|---|---|---|
| Low consequence | Brainstorming headings, generating interview questions, reorganizing a public memo | Check for invented facts and confidential-data leakage; a lawyer reviews before anything is reused. |
| Moderate consequence | Extracting obligations from contracts, summarizing a deposition, preparing an internal issue list | Use a lawyer-checked benchmark, test omissions and contradictory facts, and preserve an audit trail. |
| High consequence | Legal research supporting advice, deadline analysis, drafting a filing, calculating exposure, or producing client-facing work | Verify every material proposition and authority independently; require a named lawyer’s approval; do not delegate professional judgment to the system. |
The category is about the consequence of an error, not how polished the output looks. A fluent answer can still be unsupported or wrong.
Build a representative and safe test set
Early testing should not use live client confidences. Use fictional files, public records, redacted matters, synthetic clauses, or data for which the firm has explicit approval. This protects confidentiality while allowing realistic testing. The approach is a practical implementation of lawyers’ duties to protect information and verify work; it is not a quoted regulator-mandated testing protocol.

Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Clear out junk files and repair common Windows errorsFree Scan →- Assemble ordinary examples. Include the documents, questions, file formats, and vocabulary the proposed users handle every week.
- Add difficult examples. Include missing facts, conflicting clauses, scanned pages, tables, handwritten annotations, old authorities, amendments, exceptions, and documents with similar party names.
- Test jurisdictional distinctions. Include otherwise similar questions whose answers differ by state, province, country, court, or governing law.
- Include false premises. Ask questions that contain a wrong date, nonexistent case, misstated rule, or unsupported assumption. A safe assistant should flag the premise rather than silently accept it.
- Require sources where the task needs them. Ask for full citations, links or pinpoint references, the proposition supported, and any uncertainty.
- Create the reference answer first. A qualified lawyer should prepare or validate the expected answer, the controlling authorities, material issues that must not be omitted, and acceptable alternatives.
- Freeze the test version. Save the exact prompt, input files, tool name and version, settings, date, user role, and expected output so another reviewer can repeat the test.
Do not make the set artificially easy. A pilot that contains only clean, short documents measures demo performance rather than real matter performance.

Score outputs instead of judging a polished demonstration
For each test, compare the assistant’s response with the lawyer-checked reference. Record observations in a worksheet rather than relying on memory or an overall impression.
| Criterion | How to test it | Failure signal |
|---|---|---|
| Factual accuracy | Check every material name, date, amount, quotation, procedural fact, and conclusion against the source. | An invented fact, changed number, or confident statement contradicted by the file. |
| Legal accuracy | Compare the rule, elements, exceptions, burden, remedy, and procedural posture with authoritative law. | A rule from the wrong jurisdiction, outdated standard, missing exception, or incorrect application. |
| Completeness | Use a checklist of issues, clauses, authorities, and requested outputs that must appear. | A persuasive summary omits a material limitation, adverse fact, or required step. |
| Citation existence | Search the cited case, statute, regulation, rule, or secondary source in an authoritative database or official publication. | The citation cannot be found, has the wrong caption or date, or points to a nonexistent authority. |
| Citation support | Read the cited source and confirm it actually supports the proposition, including the quoted language and context. | The authority exists but says something narrower, different, or opposite. |
| Jurisdiction and currency | Check court level, controlling status, effective date, amendments, and whether later authority changed the rule. | A persuasive out-of-jurisdiction decision is presented as controlling, or an old rule is treated as current. |
| Consistency | Run the same prompt more than once and vary harmless wording to see whether material conclusions change. | Unexplained changes in authorities, holdings, calculations, or recommendations. |
| Error visibility | Ask whether a reasonably trained reviewer could spot the problem from the response and cited sources. | The answer is confident, specific, and difficult to audit despite being wrong. |
These measures are a practical firm framework, not a universal industry benchmark. Preserve the raw outputs, reviewer comments, and pass/fail rationale. Set a minimum acceptable result for each use case; do not average a catastrophic citation failure away with several good summaries.
What published testing can—and cannot—tell you
A 2024 preregistered study by Stanford researchers tested Lexis+ AI, Westlaw AI-Assisted Research, and Ask Practical Law AI on more than 200 legal queries. The tested systems hallucinated—that is, produced false or unsupported material—between 17% and 33% of the time under that study’s methods. Lexis+ AI answered 65% of the tested queries accurately, Westlaw AI-Assisted Research answered 42% accurately, and Ask Practical Law AI gave incomplete answers on more than 60% of queries. These figures describe those products, versions, prompts, and study conditions; they are not a market-wide probability, a current ranking, or a prediction for your workflow. Verify every legal citation and source claim
“It cited a case” is not the same as “the case supports the answer.” Treat citations as leads until a lawyer verifies them.
- Parse the proposition. Break the answer into individual claims. Mark which claims require authority and which are factual statements drawn from a document.
- Locate the authority independently. Search an official court, legislature, regulator, or trusted legal database rather than clicking only the assistant’s link.
- Confirm identity. Check the case name, docket or reporter citation, court, date, statute section, regulation number, and version.
- Read the relevant passage. Do not rely on a headnote, snippet, or generated quotation. Read enough context to confirm the holding, rule, exceptions, and procedural posture.
- Check current status. Look for amendments, subsequent decisions, overruling, negative treatment, or a later effective date.
- Match the jurisdiction. Label binding, persuasive, administrative, foreign, or secondary authority accurately.
- Record the result. Mark each citation as verified, partially supports, unsupported, nonexistent, outdated, or not applicable, with the reviewer and date.
If the tool cannot provide traceable sources or routinely invents authorities, exclude it from research and citation-dependent work even if it remains useful for lower-risk drafting or organization.
Review privacy, security, and contract terms separately from answer quality
A highly accurate assistant can still be unsuitable for confidential matters. Obtain the operative terms for the exact product tier and configuration, not only a marketing page or a general enterprise statement. Ask the vendor to identify which commitments are contractual and which are merely product descriptions.
| Question to answer | Evidence to request | Why it matters |
|---|---|---|
| Are prompts, uploaded files, outputs, or usage logs retained? | Retention schedule, deletion process, backup treatment, and records available to administrators. | Retention can extend exposure of confidential or privileged material beyond the matter. |
| May data be used to train, improve, or otherwise develop services? | Exact policy and contract language for the chosen tier; opt-out mechanics and default settings. | Reuse may conflict with client instructions, confidentiality duties, or privacy restrictions. |
| Who can access the content? | Provider personnel access rules, support procedures, logging, and subprocessor list. | Access by people outside the legal team can create confidentiality and privilege concerns. |
| Where is data processed and stored? | Countries or regions, transfer mechanisms, residency options, and subprocessors. | Cross-border processing can trigger privacy, professional, client-contract, or court-order requirements. |
| How is data protected? | Encryption in transit and at rest, identity controls, tenant isolation, vulnerability management, and independent assurance reports where applicable. | Security claims must be assessed against the sensitivity of the matter and the firm’s obligations. |
| What happens after deletion or termination? | Deletion timelines, backup expiration, export format, account closure, and return or destruction certification. | A firm may need to retrieve its records and demonstrate that retained copies were removed. |
| How are incidents handled? | Notice deadline, investigation cooperation, affected-data details, and response responsibilities. | Late or incomplete notice can impede client communication and regulatory response. |
| Can the firm audit and administer use? | Access logs, workspace controls, role-based permissions, retention settings, and exportable records. | Auditability supports supervision, incident investigation, and proof of compliance. |
Compare the answers with privilege, confidentiality, privacy law, protective orders, client engagement terms, procurement rules, and any data-residency requirement that applies to the matter. Professional guidance identifies these categories as material risks; it does not certify any vendor’s current protections. Recheck the terms after a plan, model, subprocessors, or privacy policy changes.

Set human-review and escalation rules before a pilot
Human review must be a defined workflow, not a reminder to “use judgment.” Assign a responsible lawyer and specify what the reviewer must inspect.
- Define prohibited delegation. Do not let the assistant alone decide legal advice, sign or file a document, communicate a conclusion to a client, set a deadline, waive a right, or make a material strategic choice.
- Require source and fact checks. Reviewers verify every material factual assertion, calculation, quotation, and authority against the underlying record.
- Use a second review for high-consequence work. A partner or designated subject-matter lawyer should approve filings, dispositive analysis, deadline conclusions, and client-facing advice according to firm policy.
- Escalate uncertainty. Stop and consult a lawyer when the assistant expresses uncertainty, gives conflicting answers, lacks a source, encounters a new jurisdiction, or handles privileged, highly sensitive, or regulated information.
- Label internal drafts. Keep AI-assisted drafts distinct from approved work product, preserve the prompt and source files where appropriate, and record the human reviewer.
- Correct and learn from errors. Log material failures, identify whether the cause was the model, prompt, source set, user, or workflow, and adjust the approved-use list.
ABA Formal Opinion 512 states that lawyers may not abdicate professional judgment. Its discussion of testing a subset of summarization work can help determine how much review is reasonable for that particular task, but it is not blanket permission to rely on an assistant. Apply the analysis to the tool, task, jurisdiction, and matter.
Compare multiple assistants on the same axes
Run the same frozen test set and use the same scoring rules when comparing tools. A side-by-side comparison should include:

Best Value
Run a controlled pilot and document the decision
A pilot should be narrow enough to supervise and long enough to reveal ordinary workflow problems. Start with approved data and preselected tasks. Keep the assistant out of final client communications and filings until the approval gate is met.
Minimum pilot record
- Approved use cases and explicitly excluded uses.
- Jurisdictions, practice areas, matter types, and user roles covered.
- Tool name, model or product version, configuration, date, and vendor terms in force.
- Test-set description, lawyer-checked reference answers, scores, material failures, and remediation.
- Data-handling assessment, approved input types, retention settings, and incident route.
- Human-review standard, escalation owner, training completion, and sample audit results.
- Expected benefit, implementation and review cost, and the date or event for reassessment.
Triggers for reassessment
Repeat the relevant tests after a material model update, new retrieval source, interface or workflow change, contract or privacy-policy change, security incident, new jurisdiction, new practice area, or repeated user error. The ABA describes technological competence as ongoing, and the Law Society of Alberta advises lawyers to understand capabilities, monitor output, and implement security measures. See the Law Society of Alberta’s quick tips.
Apply the rules of the jurisdiction and matter
Professional obligations vary. ABA Formal Opinion 512 is guidance on the ABA Model Rules, not an automatic rule in every U.S. state. Alberta guidance and New Zealand guidance apply to their own professional settings. The New Zealand Law Society states: “All lawyers are ultimately responsible for the legal services they provide.” Read the New Zealand Law Society guidance.

Before a pilot, check the current requirements of the relevant bar or law society, court, privacy regulator, client, insurer, and procurement authority. Consider whether a protective order, engagement letter, government contract, legal-aid rule, or cross-border transfer restriction imposes a stricter limit than general professional guidance.
Courts are also addressing AI-generated filings and citations. The Texas State Commission on Judicial Conduct notebook dated January 30, 2026 is a compilation that reproduces guidance and materials about hallucinated citations; it is not a universal rule for every court. Review the Texas courts notebook and then check the rules of the court in which you practice.
Use a clear go/no-go decision gate
Approve a use case only when the written record supports all of these statements:
- The task, jurisdiction, users, sensitivity, and consequence of error are specific.
- The test set includes ordinary, difficult, conflicting, incomplete, and false-premise examples.
- A qualified lawyer prepared or validated the reference answers.
- Material facts, legal propositions, citations, currency, completeness, consistency, and error visibility were scored.
- Failures have an owner, a remedy, and a documented limit; no catastrophic failure is hidden by an average score.
- The exact product tier’s retention, training or reuse, access, deletion, security, subprocessors, and data-location terms are acceptable.
- Approved inputs exclude data the firm cannot lawfully or contractually provide.
- A named lawyer reviews final work and knows which tasks require escalation or a second review.
- Users are trained, outputs are auditable, and the firm can suspend use or retrieve its work if the service changes.
- The expected benefit justifies the subscription, implementation, review, training, monitoring, and exit costs.
If any answer is “no” or “unknown,” keep the assistant in a non-client sandbox or restrict it to a lower-risk use until the gap is resolved. The final approval is a professional and operational decision, not a vote on how impressive the demo appeared.
