Do not judge a health AI app by a “HIPAA compliant” badge alone. First trace what information enters the tool, where it comes from, how the provider uses it, who receives it, how long it remains, and which safeguards and contracts apply. Then assess the model’s accuracy, transparency, human oversight, and accountability for the specific situation in which you will use it.
That process matters because HIPAA does not automatically follow health information into every app. A person’s voluntary entry of medical details into an independent consumer app may fall outside HIPAA, even when those details were copied from a medical record. The same product may have a different legal status when a hospital or other regulated organization deploys it. The guide below uses United States federal guidance; laws and terminology differ in other countries.

Why health information requires a higher bar
Health information can identify a person, reveal diagnoses or treatment, expose family relationships, and enable inferences that the user never typed. AI systems may also derive risk scores, summaries, classifications, or other profiles from seemingly ordinary inputs. A voice recording, free-text question, image, wearable reading, or medication list can therefore be more sensitive than its individual fields suggest.
AI adds another layer of uncertainty. A service may retain prompts to operate a feature, use them to improve a model, send them to contractors, or combine them with account and device data. Its answer may sound confident even when the system has incomplete context or makes an error. A sound evaluation looks at the entire information lifecycle and the consequences of relying on the output, not just the quality of the interface.

Establish who operates the tool and which rules apply
Consumer use is not automatically covered by HIPAA
HIPAA applies to covered entities and, in relevant circumstances, their business associates. The U.S. Department of Health and Human Services explains that HIPAA generally does not protect information a person voluntarily enters into an app that was not developed or offered by, or for, a regulated entity—even if the person obtained the information from a medical record. That does not mean the app is free from every privacy obligation; other federal or state laws may apply.
Ask what role the provider is playing in your use, rather than what role it plays in another customer’s deployment. A consumer app used independently is different from software supplied to a clinic for the clinic’s functions. If a provider is acting as a business associate for a covered entity, the covered entity must authorize relevant protected-health-information uses or disclosures through a business associate agreement (BAA). A marketing statement that the company serves healthcare customers does not establish that your account has that relationship.
Use HIPAA language precisely
“HIPAA compliant,” “HIPAA secure,” and “HIPAA certified” are not interchangeable proof marks. Federal Trade Commission guidance warns businesses against false or misleading versions of those claims. There is no general government badge that substitutes for examining the provider’s role, contract, data practices, and safeguards. Ask which covered entity is involved, what services the BAA covers, and whether the promises apply to the product and plan you will actually use.
Do not generalize United States guidance
The legal examples in this article are based on U.S. federal guidance from HHS and the FTC. They are not a determination that a particular product complies with any law, and they should not be carried over to another country without local advice. The FTC’s mobile-health-app tool is informational, notes that more than one federal law may apply, and does not guarantee compliance.
Map the complete data flow before you sign up
Use the same questions for every tool you are comparing. Record the answers and the exact wording of the provider’s policy or contract; a privacy notice is evidence to examine, not proof that operations always match it.

| Evaluation axis | Questions to answer | Evidence to request |
|---|---|---|
| Data collected and sources | Does the service receive typed prompts, uploaded records, images, voice, device readings, location, contacts, or data from connected apps? Which fields identify the person? | Input list, permissions screen, integration documentation, and examples of required versus optional fields. |
| Purpose and model use | Is information used only to provide the requested feature, or also to improve services, train models, advertise, or create other products? Can optional uses be refused without losing the core service? | Plain-language purposes, opt-in or opt-out controls, and retention or training settings for each plan. |
| Sharing and tracking | Which vendors, analytics services, cloud hosts, human reviewers, or other recipients receive the information? Are third-party trackers present in a health workflow? | Recipient categories, subprocessors, transfer descriptions, and a way to inspect network or app permissions where appropriate. |
| Retention and deletion | How long are prompts, files, account data, and derived records kept? Can you delete them? What remains in backups, security logs, or de-identified datasets? | Retention periods, deletion procedure, backup timetable, and an explanation of what deletion cannot remove. |
| Legal and contractual context | Is the provider acting for a covered entity or as its business associate in this use? Is a BAA relevant and available to the regulated organization? What other rules may apply? | Contract terms, BAA availability, organizational privacy contact, and jurisdiction information. |
| Safeguards and response | What access controls, risk-management measures, encryption practices, staff permissions, and incident procedures are described? Are the promises specific enough to assess? | Security documentation, incident-notification terms, access-control description, and a current contact for security questions. |
| Transparency and accountability | Can an ordinary user understand the policy? Who is responsible for the AI’s decisions, and how are ethics, human rights, and affected users considered? | Governance documentation, escalation path, model limitations, change notices, and a named responsible function. |
Inventory every input
Start with the smallest useful test. List what you plan to enter and classify each item as identifying, health-related, financial, behavioral, or technical. A typed symptom is obvious; a timestamp, IP address, device identifier, microphone recording, or connected fitness account may also reveal health information when combined. Check whether the tool requires an account, phone number, location, or advertising identifier for a feature that should work without it.
Look for “optional” fields that are preselected, permissions requested at first launch, and integrations that continue sending updates after the original task. If an upload is processed by a separate service, treat that service as another recipient to investigate.

Separate service delivery from secondary use
Find out whether prompts and files are used to answer your request only, to monitor abuse, to improve a general model, to train a product-specific model, or to personalize advertising. These purposes can coexist. A meaningful control tells you exactly which purpose changes when you switch it off and whether existing data is included. “We may use data to improve our services” is not enough to determine whether health content enters training.
Ask whether humans can review conversations, how reviewers are selected, and whether sensitive content is filtered before review. If the answer is unclear, do not submit information that would create harm if exposed.
Identify every recipient and tracker
“We do not sell data” does not answer whether information is shared with cloud providers, analytics companies, customer-support contractors, model hosts, or legal advisers. Request the current subprocessor or service-provider list and the purpose of each transfer. A health-related screen that loads advertising or analytics trackers creates another path for identifiers and usage events to leave the service.

Check permissions on a phone or browser and, where your organization permits it, observe which domains are contacted during a test with non-sensitive data. This does not replace contractual review, but it can reveal unexpected integrations.

Retention should be stated separately for conversation content, uploaded files, account details, backups, abuse logs, and model-training datasets. Ask whether deletion is immediate or scheduled, whether it removes copies held by subprocessors, and whether a derived profile can persist after the original prompt is gone. A “delete account” button may not erase records needed for security, billing, legal obligations, or system backups; the provider should explain those exceptions.
Assess safeguards instead of collecting vague assurances
Look for controls that match the risk: least-privilege staff access, authentication for administrators, encryption in transit and at rest, logging, separation of customer environments, secure development, and a defined incident process. The provider should explain who can access raw health content, under what conditions, and how access is reviewed.
FTC guidance emphasizes robust safeguards, meaningful consent where appropriate, periodic review, and claims that match actual practice. A polished privacy policy cannot establish that a control works. Prefer specific commitments, current documentation, and a route to report a suspected exposure. If the provider will not explain basic access, retention, or incident practices, treat the unanswered question as a risk rather than assuming the most favorable answer.
Evaluate the AI, not only the privacy policy
Check the purpose and the level of reliance
Define what the output is allowed to do. An administrative summary that a professional verifies has a different risk from a system that recommends medication, triages an emergency, or communicates a diagnosis directly to a patient. Ask whether the tool is decision support, automation, education, or a general conversational system, and identify who must review its output before action.

Look for limitations and uncertainty
A responsible provider describes the populations, languages, data types, and situations for which the system was evaluated, along with known failure modes. Be cautious when accuracy claims omit the test population, reference standard, date, or conditions. A high average score does not tell you how the system performs for a rare condition, an underrepresented group, poor audio, mixed languages, or incomplete records.
Check whether the interface distinguishes retrieved information from generated text, displays the source of a claim, records the model version, and allows a user to correct an error. If the system cannot explain when it is uncertain, keep a qualified human in the loop and avoid treating fluent wording as evidence.
Consider accountability, ethics, and human rights
The World Health Organization’s 2021 guidance on AI in health identifies ethical challenges and risks and sets out six consensus principles intended to put ethics and human rights at the center of design, deployment, and use. Consult the full guideline for the exact formulation of those principles rather than relying on a marketing summary. In practice, ask who is accountable for harm, how affected patients and workers can raise concerns, how discrimination is assessed, and whether people can obtain human review of a consequential output.
Governance should continue after launch. A provider should communicate material model, policy, or subprocessor changes; monitor incidents and performance; and explain how it decides whether to pause or withdraw a feature. An organization buying the tool also needs an owner, training, escalation process, and periodic review.

A practical evaluation procedure
- Define the use case. Write down the task, the people affected, the worst plausible consequence of an error, and whether a qualified human will review every output.
- Minimize the input. Remove names, contact details, exact dates, images, and identifiers unless they are necessary. Use synthetic or redacted data for an initial trial.
- Map the data flow. Complete the seven-axis table above, including connected services and recipients. Mark every answer that is missing, conditional, or limited to a different plan.
- Confirm the legal role. Determine whether a covered entity is involved, whether the provider is acting as a business associate, and whether the appropriate BAA exists. Do not infer this from a badge or a generic healthcare webpage.
- Test controls with low-risk data. Exercise account deletion, consent toggles, export functions, access requests, and notification channels. Record what the interface says and what actually happens.
- Challenge the AI safely. Use non-identifying test cases that represent your population, include ambiguous inputs, and check whether the tool states uncertainty or invents details. Never use a live emergency as a test.
- Set a decision threshold. Approve only when the remaining unknowns are acceptable for the consequence of failure. For high-impact decisions, require documented human review and an escalation path.
- Monitor after adoption. Recheck policies, subprocessors, model versions, permissions, incident notices, and performance at intervals set by your organization. A one-time review does not cover later changes.
Use a clear pass, caution, or stop decision
| Finding | Decision signal | What to do |
|---|---|---|
| Purpose, recipients, retention, legal role, and safeguards are documented; controls work in a low-risk test; human accountability is clear. | Pass for the defined use | Limit inputs, document the approval, train users, and schedule a review. |
| One or more details are incomplete, such as backup deletion, model-training use, or subprocessor access, but the task has low consequences and no sensitive identifiers are required. | Caution | Use redacted or synthetic data, obtain written clarification, and keep the tool out of high-impact decisions. |
| The provider refuses basic data-flow questions, makes unsupported HIPAA claims, requires broad secondary use, or cannot provide human escalation for a consequential feature. | Stop | Do not upload health information; choose a process with clearer accountability or obtain organizational and legal review. |
This is a practical decision aid, not a government certification or a legal conclusion. The acceptable threshold depends on the people affected and the consequences of disclosure or error.

How the answer changes by use context
Independent consumer symptom or wellness app
Assume HIPAA may not protect information you enter voluntarily unless the facts establish a covered-entity or business-associate relationship. Minimize the data, inspect secondary-use and deletion terms, and avoid uploading medical records merely for convenience. Treat generated advice as informational unless a qualified professional evaluates it.
Tool supplied through a clinic or health plan
Ask the organization’s privacy or compliance contact which entity controls the information, whether the provider is a business associate, and what the BAA covers. Confirm how the tool fits the organization’s patient-notice, access, correction, and incident processes. A patient-facing interface can still route data to subprocessors that the organization must understand.
Workplace, school, or community program
Clarify who can see individual entries, whether participation is voluntary, and whether data is used for eligibility, discipline, employment, or other decisions. Separate aggregate reporting from identifiable records and require a human review for consequential actions.
Telehealth session or home use
HHS advises choosing a private location, turning off nearby devices that could overhear, and using encryption when available. These steps reduce exposure around your side of the interaction; they do not verify the vendor’s storage, sharing, or model-training practices. Apply the same data-flow review to the platform itself.
Questions to send a provider
- What exact data types do you collect from prompts, uploads, voice, devices, and connected accounts?
- Which fields are required, and can I use the core feature without an account, location, contacts, or advertising identifier?
- Are my inputs used for service delivery, human review, analytics, advertising, model improvement, or training? Which controls change each purpose?
- Who receives the data, including cloud hosts, model providers, support staff, and analytics services? Where are they located?
- How long are prompts, files, derived records, logs, and backups retained, and what does deletion remove?
- Can your organization act as a business associate for this deployment, and is a BAA available to the covered entity?
- What access controls, encryption, logging, testing, and incident-notification commitments apply to this plan?
- What populations and tasks were used to evaluate the model, what are its known limitations, and how is uncertainty shown?
- Who is accountable for harmful output, how can a person request human review, and how are affected users involved in governance?
- How will you notify customers about material changes to the model, policy, subprocessors, or retention schedule?
If you already entered sensitive information
- Stop sending additional health details until you understand the provider’s practices.
- Use the account controls to revoke connected-app permissions, disable optional model-improvement uses, and delete conversations or files where available.
- Request a written explanation of retention, subprocessors, deletion limits, and any incident affecting your account.
- If the tool was supplied by a clinic, plan, employer, or other organization, contact that organization’s privacy or compliance office and ask which entity controls the record.
- Keep copies of notices and responses. If the provider’s public claims appear inconsistent with its practices, consider the appropriate consumer-protection or regulatory channel for your jurisdiction.
Deletion requests may not remove security logs, legal records, backups, or data already incorporated into a derived system. The provider should identify those limits rather than promising an absolute erasure.
Bottom line: evaluate the flow, the role, and the consequences
A safe decision is specific to a tool, a plan, a jurisdiction, and a use case. Trace the data, establish whether HIPAA and a BAA actually apply, verify safeguards and retention, scrutinize “HIPAA compliant” language, and evaluate the AI’s uncertainty and human accountability. If essential answers remain unknown, keep identifiable health information out of the system and use a process with clearer controls.
