How to Donate Cryptocurrency to a Political Campaign Safely: U.S. Federal, State, and Local Rules

Yes— a U.S. federal political committee may accept bitcoin, but a crypto contribution is not a casual wallet transfer. The committee must verify who is giving, confirm the source is permitted, apply contribution limits, value the asset at its market value when received, and report it as an in-kind contribution. State and local campaigns follow different rules; Oregon prohibits cryptocurrency contributions, while Texas permits them under specific in-kind reporting rules. Use only the campaign’s official donation page or named processor, retain complete transaction records, and do not treat the payment as a charitable tax deduction.

Can you legally donate cryptocurrency to a political campaign?

For a U.S. federal campaign, the Federal Election Commission (FEC) permits a political committee to accept bitcoin. The FEC treats bitcoin as “money or anything of value” under the Federal Election Campaign Act. The contribution is generally valued at the bitcoin’s market value at the moment the committee receives it, not at the price you paid for it and not at a later sale price.

That permission is conditional. The committee must examine contributions for prohibited sources and excessive amounts, identify the donor, apply the correct election designation, and keep records that support its reporting. A committee may have to return or refund a contribution that is prohibited, excessive, inadequately identified, or otherwise noncompliant. A donor cannot avoid those controls by using a self-custody wallet, a privacy tool, an intermediary, or an address with no name attached.

Federal permission does not carry over to every state or municipality. A state party, governor campaign, legislative campaign, ballot committee, or city candidate may be governed by rules that differ from federal law. Confirm the office and jurisdiction before moving any cryptocurrency.

First identify the race and the governing law

The same token can be lawful for one committee and prohibited for another. Start by determining all three of these facts:

  • Office: Is the recipient a federal candidate or committee, or a state, county, city, school-board, or ballot-measure committee?
  • Committee: Is the recipient’s legal committee name the one shown on the official donation page?
  • Jurisdiction: Which election authority regulates that committee?

Federal committees follow FEC rules. State and local committees follow their own statutes, regulations, and agency guidance. The differences can include whether crypto is allowed at all, which tokens qualify, when value is measured, what donor information is mandatory, how quickly assets must be converted or deposited, and how gains or losses are reported.

Examples of different state outcomes

Jurisdiction or source Crypto status Valuation and reporting rule What a donor should do
U.S. federal committees Bitcoin contributions are permitted, subject to source, identity, limit, and reporting controls. Value at market value when received. A committee that keeps the bitcoin records an offsetting receipt and disbursement and should add memo text that the asset was received but not liquidated. Use the committee’s official processor, provide the requested donor information, and retain the receipt and transaction hash.
Oregon Oregon Revised Statutes §260.011 prohibits using cryptocurrency to make a contribution. Not applicable because the contribution is prohibited. Do not send crypto to an Oregon political committee unless the relevant election authority has changed or clarified the rule.
Texas Texas §22.37 treats virtual-currency contributions as in-kind contributions. Report fair market value when received. A gain on sale must be reported when the applicable threshold is exceeded. Ask the committee which virtual currencies it accepts, how it documents receipt value, and how it handles a later sale.
California landscape described by the 2022 FPPC memo The memo described nine states prohibiting crypto contributions and twelve states plus the District of Columbia expressly allowing them in some form. That count is historical and does not establish the current rule for a particular California committee or any other state. Check the current state and local rule for the exact office before donating.

The 2022 California Fair Political Practices Commission count is useful background, not a current nationwide map. Statutes and agency rules can change, and local committees may have additional requirements.

Use this safe donor workflow

Complete the following checks before approving a blockchain transaction. If any answer is unclear, pause and ask the campaign’s compliance contact rather than guessing.

  1. Confirm the committee and race. Write down the candidate or ballot committee’s legal name, office, election date, and jurisdiction. Confirm whether it is a federal committee or governed by state or local law.
  2. Open the official donation page yourself. Type the campaign’s known web address or use a bookmark you created earlier. Follow the page to the named payment processor. Do not use a wallet address sent only by text message, direct message, email, or a social-media reply.
  3. Check authorization and notices. Federal internet-fundraising guidance calls for authorization information and best-efforts notices. The page should identify the committee and explain the donor information it must collect. A page that hides the committee name or provides no compliance contact is a reason to stop.
  4. Verify that you are an eligible donor. A federal committee must screen for prohibited sources and excessive amounts. You must not donate for another person, obscure the true source, use an anonymous arrangement, or contribute as a foreign national. Be prepared to provide your legal name, address, occupation, employer, and election designation if requested.
  5. Check your remaining contribution capacity. The campaign may need to aggregate your crypto gift with your cash, card, stock, or other contributions. Ask the committee how it applies the applicable federal, state, or local limit. Do not assume that splitting one transaction into several wallets or days creates additional capacity.
  6. Confirm the exact asset. Ask whether the committee accepts bitcoin only or also accepts a specified network, token, or stablecoin. Sending an unsupported token or using the wrong network can make recovery impossible and may prevent the committee from treating the transfer as a valid contribution.
  7. Ask how value is calculated. Confirm the exchange-rate source, the exact receipt time used, whether the processor converts immediately, and how network or processor fees affect the amount credited. FEC guidance prefers a contemporaneous processor valuation; if that is unavailable, the committee may use another reasonable exchange rate.
  8. Review the tax notice. Political contributions are not charitable donations. Federal fundraising guidance requires a notice that contributions are not tax deductible for committees whose gross annual receipts normally exceed $100,000. Do not rely on a wallet receipt as a charitable-donation receipt.
  9. Send only after the details match. Compare the asset, network, amount, recipient address, and committee name on the final confirmation screen. Blockchain transfers are generally irreversible once confirmed.
  10. Save a complete record. Keep the campaign receipt, date and time, asset and quantity, dollar valuation, wallet address, transaction hash, processor name, fee information, donor-information submission, and any refund correspondence.

How donor identity and source checks work

Crypto’s pseudonymous appearance does not eliminate campaign-finance identification rules. A committee has to be able to connect the contribution to a real, eligible donor and determine that the funds are not coming from a prohibited source.

Information the campaign may request

  • Full legal name and residential address
  • Occupation and employer
  • Citizenship or other information needed to screen foreign-national restrictions
  • Whether the contribution is for a particular election
  • The wallet or account from which the asset was sent, when needed for compliance review

Answer truthfully and consistently. Do not use another person’s identity, a company’s name when you are the actual donor, or a service that intentionally conceals the source. “Anonymous” on-chain transactions can still create a compliance problem because the committee may be unable to establish who made the contribution.

Foreign nationals and intermediaries

Do not contribute as a foreign national where federal law prohibits the contribution, and do not ask a U.S. person to pass through money that originated with a prohibited source. The same principle applies to a friend, business, political group, or wallet provider acting as an undisclosed donor. If someone else is funding the transaction, stop and obtain legal advice before proceeding.

How the campaign values and reports your crypto

The FEC states: “A political committee that receives a contribution in bitcoins should value that contribution based on the market value of bitcoins at the time the contribution is received.” The relevant time is the committee’s receipt, not the time you acquired the bitcoin and not the time the committee later sells it.

Immediate conversion through a processor

If the processor converts the bitcoin to dollars at or near receipt, the processor’s contemporaneous valuation is the preferred evidence under FEC guidance. The campaign should retain the conversion record, including the time, exchange-rate source, quantity, gross value, and fees. Ask whether the amount displayed on your receipt is the gross contribution or the net amount after processing costs.

Committee holds the bitcoin

If a federal committee keeps the asset rather than liquidating it, the FEC describes offsetting receipt and disbursement entries. The committee should add memo text stating the amount received and that it was not liquidated. A later sale can produce a gain or loss that must be handled under the applicable reporting rules.

Why the receipt timestamp matters

Crypto prices can change materially within minutes. Preserve the processor’s timestamp and the blockchain confirmation details. If the campaign asks you to explain a difference between the amount on your wallet and the dollar amount on its report, those records show which valuation moment was used.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What happens if the contribution is excessive or prohibited?

A committee cannot keep an unlawful contribution simply because the transaction settled on-chain. Federal guidance requires treasurers to examine contributions and return or otherwise properly handle prohibited or excessive amounts. The same practical risk exists under state rules.

  • Excessive contribution: The committee may return the excess or refund the contribution under the applicable procedure.
  • Prohibited source: The committee may need to return the entire amount or follow a specific remedial process.
  • Unclear donor identity: The committee may hold the funds while requesting information or return them if compliance cannot be established.
  • Unsupported asset or wrong network: Recovery may depend on the processor’s technical capability; do not assume the campaign can reverse the transfer.

Holding the cryptocurrency in a personal wallet does not remove the committee’s duty to return or refund a contribution. If the campaign contacts you, respond promptly and keep every message with your transaction records.

Tax treatment: why this is not a charitable deduction

A political campaign contribution is not a charitable donation. You should not claim a charitable deduction merely because the campaign provided a receipt, converted your crypto, or used a nonprofit-looking payment page. The federal fundraising guidance specifically requires a notice that contributions are not tax deductible for committees whose gross annual receipts normally exceed $100,000.

Your separate tax obligations from disposing of cryptocurrency can still matter. A processor conversion or later sale may be a taxable disposition under ordinary tax rules, with the result depending on your basis, holding period, jurisdiction, and other facts. The campaign’s contribution receipt does not calculate that tax result. Keep the acquisition records and consult a qualified tax professional for your circumstances.

Security checks that prevent wallet fraud

Political campaigns are attractive targets for impersonation because donors expect urgent appeals and large public audiences. Treat a wallet address as payment information, not as proof of identity.

  • Navigate to the campaign’s official site independently instead of clicking a payment link in an unsolicited message.
  • Verify the committee name, authorization text, and processor name on the page before connecting a wallet.
  • Compare the full destination address and network on the final confirmation screen; do not rely on the first and last few characters alone.
  • Refuse requests to install remote-access software, reveal a seed phrase, share a private key, or sign an unrelated message.
  • Use a wallet with only the amount intended for the contribution and review the transaction simulation when your wallet provides one.
  • Save the transaction hash immediately after broadcasting and again after network confirmation.
  • Contact the campaign through a separately verified email address or telephone number if the page, address, or instructions change unexpectedly.

A legitimate campaign or processor does not need your seed phrase or private key. A hardware wallet, gift card, or printed manual is not legally required to make a campaign contribution; the relevant service is the campaign’s compliant payment and reporting process.

Choosing a campaign’s crypto processor

Donors usually cannot select the processor, but they can ask questions before sending funds. The campaign should be able to explain:

Federal reporting mechanics in more detail

Under FEC Advisory Opinion 2014-02, a nonconnected political committee may accept bitcoin contributions, but its treasurer must examine each contribution for compliance. The committee reports the receipt at market value when received. If the bitcoin is retained, the FEC describes an offsetting receipt and disbursement entry and recommends memo text identifying the amount received and noting that it was not liquidated.

Bitcoin purchased as an investment must be sold, and the proceeds deposited in the campaign depository, before the committee spends those proceeds. This rule is separate from the donor’s transfer decision: a donor can send bitcoin, but the committee must follow its own depository and disbursement controls after receipt.

Campaign reports may display the donor, date, amount, election designation, and other information required by the committee’s jurisdiction. Your processor receipt may show a different number from the report if fees, rounding, or an in-kind valuation method apply. Ask the committee for an explanation rather than editing your own records.

State and local questions to ask before donating

Because state systems are not uniform, ask the campaign these questions in writing:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Does the law for this exact office permit cryptocurrency contributions?
  2. Is the token treated as an in-kind contribution, a monetary contribution, or another category?
  3. At what date and time is fair market value measured?
  4. Is a particular exchange, processor, or valuation source required?
  5. Must the campaign convert the asset immediately or deposit proceeds by a deadline?
  6. How are gains or losses on a later sale reported?
  7. What contribution limit applies, and how are your other contributions aggregated?
  8. What donor-identification, occupation, employer, and election-designation fields are mandatory?

If the campaign cannot answer, contact the relevant election agency or a lawyer familiar with that jurisdiction before sending anything. Do not infer permission from the fact that another candidate accepts crypto.

Worked examples

Federal committee using immediate conversion

You open the committee’s official donation page, complete the identity and eligibility fields, select bitcoin, and see a processor quote. The processor records the quantity, exchange-rate source, receipt timestamp, and dollar value, then converts the asset. You save the receipt and transaction hash. The committee reports the contribution at the market value recorded when received, subject to applicable limits and source checks.

Federal committee holding bitcoin

The committee accepts bitcoin but does not sell it immediately. The receipt is valued at market value when received. The committee follows the FEC’s offsetting receipt and disbursement treatment and adds memo text that the asset was received and not liquidated. A later sale is recorded separately under the committee’s reporting procedures.

Oregon committee

You find an Oregon campaign wallet address in a social-media post. Oregon Revised Statutes §260.011 prohibits using cryptocurrency to make a contribution, so you do not send the asset. A card or bank contribution, if otherwise lawful, must use the campaign’s approved channel instead.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Texas committee

A Texas campaign confirms that it accepts virtual currency under Texas §22.37. You complete its donor screening and send the specified asset through the official processor. The committee values the contribution at fair market value on receipt and follows the rule for reporting a gain on sale when the applicable threshold is exceeded.

Donors outside the United States

U.S. federal rules do not govern every election. The UK Electoral Commission’s guidance dated 7 April 2026 treats cryptoassets as property rather than currency and requires non-monetary reporting, donor identification, and permissibility checks. It also describes proposed legislation that could require the return or forfeiture of crypto donations received from 25 March 2026.

Those UK rules illustrate why country-specific advice matters. If the campaign is outside the United States, identify the election authority, confirm whether cryptoassets are permitted, determine how property is valued and reported, and check whether new legislation changes the treatment of donations already received.

When not to send the transaction

  • The recipient’s office or jurisdiction is unclear.
  • The address came only from an unverified message.
  • The campaign cannot identify its legal committee or compliance contact.
  • You are being asked to donate for someone else or conceal the source.
  • The committee has not confirmed the token, network, valuation method, or refund process.
  • You cannot provide the identity, occupation, employer, address, or election information the committee requires.
  • You need a charitable tax deduction.

In each case, pausing protects both you and the committee. A delayed contribution is preferable to an irreversible transfer that the campaign cannot legally keep or accurately report.

Bottom line

Bitcoin donations to U.S. federal committees are legal when the committee can verify the donor and source, apply contribution limits, value the asset at receipt, and report it correctly. The safest method is the campaign’s official donation page and named processor—not a wallet address forwarded through an unverified channel. State and local rules can be stricter, including an outright prohibition such as Oregon’s. Keep the processor receipt and blockchain records, expect identity questions, and remember that a political contribution is not a charitable tax deduction.
