Put safety ahead of recording. If it is safe to do so, capture the encounter’s context and sequence; afterward, write a factual timeline, preserve original files without editing them, make a separate backup, and seek medical care for injuries. Recording laws and complaint procedures vary by location and circumstances, so treat this as general U.S.-oriented guidance rather than legal advice.
During the encounter: stay safe and capture context
Keep a safe distance, do not obstruct officers, and do not physically resist. ACLU guidance describes a general First Amendment protection for recording law-enforcement officials performing their duties in public when the recorder is lawfully present, but warns that exercising the right can still carry real-world risks, including arrest or other consequences. If recording is safe
When practical, keep the recording continuous and include visible landmarks, street signs, and surrounding activity. Context can help establish where the recording was made and how events unfolded. If you are driving, do not hold a phone while driving; the ACLU suggests using a hands-free dashcam or having a passenger record instead.

The general protection for recording in public does not mean every recording is lawful in every context. You must be lawfully present, and private-property owners may set rules for photography or video. Privacy and notice requirements involving other people can vary by state. Check local law or consult a lawyer for advice about a particular situation.

If an officer seeks your device
The ACLU’s general rights summary says that, if you are not under arrest, an officer needs a warrant to confiscate your device or view its contents without your consent; if you are arrested, an officer may take the phone but still needs a warrant to search its contents. This is not a reason to physically resist a seizure or search. Prioritize safety and seek legal advice afterward.
Afterward: write down what happened
As soon as you can, make a dated account in your own words while details are fresh. Distinguish what you directly saw or heard from what you learned later. Keep the account factual and note uncertainty rather than filling gaps with guesses.

Use this checklist
- Date, approximate time, and exact location, including nearby landmarks.
- Agency name, number of officers, and any names, badge numbers, or patrol-car numbers you observed.
- What happened in sequence, including the stated reason for a stop, requests or commands, searches, use of force, and how the encounter ended.
- Statements you remember, identifying whether you are recording exact words or a paraphrase.
- Weapons you observed, injuries, and any medical care received, including when and where you were treated.
- Witness names and contact information, if they are willing to provide it.
The ACLU recommends noting officer and patrol-car numbers, agency, number of officers, names, weapons, injuries, and witness details. If witnesses made recordings, ask them to preserve their own original files and offer to share them with you or your lawyer if they choose.

- Keep the original file. Do not crop, trim, add captions to, or otherwise alter the original photo or video. The ACLU advises preserving originals unedited so they remain available as evidence if needed. ACLU guidance on recording and documenting police.
- Make a separate copy. Copy the files to another device so the only copy is not at risk of loss or deletion. The ACLU does not endorse a particular storage product; any choice should keep the original intact and make the backup accessible to you or your lawyer.
- Keep a simple file note. Record who made each file, when and where it was recorded, when copies were made, and who received copies. This is practical recordkeeping, not a formal chain-of-custody protocol.
- Label any edited version as a derivative. If a shorter clip helps explain the event, make it separately and clearly label it as an edited copy; retain the original unchanged.
Avoid posting sensitive footage publicly before you or the affected person’s lawyer can assess privacy, safety, and case concerns. The ACLU recommends sharing documentation with the affected person’s loved ones or attorney so they can decide whether and when to share it.

Care for injuries and consider a complaint
If you are injured, seek medical care and photograph injuries when it is safe and appropriate. Keep relevant medical records and note when and where you received treatment.
Complaint routes depend on the agency and allegations. The ACLU recommends documenting what happened, collecting witness contact information, and filing a written complaint with the agency’s internal affairs division or a civilian complaint board; anonymous complaints may be possible in many cases. The U.S. Department of Justice describes federal laws covering certain categories of law-enforcement misconduct and provides information on DOJ complaints. A federal complaint is not a substitute for a local agency complaint; the appropriate channel depends on the situation. If a complaint or legal claim may follow, contact a local attorney or civil-rights organization promptly. They can advise about applicable deadlines, evidence requests, preservation notices, and local recording rules. There is no single deadline or records-request procedure established for every jurisdiction and case.

What official evidence rules do—and do not—establish
Some official requirements apply only in a defined setting. For example, a DOJ consent decree for specified LAPD investigations requires collection and preservation of appropriate evidence, including canvassing for witnesses where appropriate, subject to applicable state law. It does not establish a universal obligation for every department or complainant. DOJ: LA Consent Decree — Section III.
