How to detect copied code in an AI-generated project

Do not try to identify an “AI style.” The defensible way to investigate an AI-generated repository is to preserve its provenance, search distinctive code for exact and near matches, inspect the earliest source and its licence, and document a decision for every finding. A similarity hit is a lead for investigation—not proof of plagiarism, licence infringement, or AI authorship.

Small fragments cannot currently be classified as AI-written with true confidence. GitHub’s own explainer says, “For smaller amounts of AI-generated code, there is no way at the moment to detect traces of AI in code with true confidence.” Focus on where code came from and whether your project may use it lawfully.

What you can actually detect

There are three different questions, and each needs different evidence:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Provenance: Did a block come from a public repository, package, template, internal project, or the project’s own earlier commit?
  • Licence compliance: If it came from elsewhere, what licence applies and did the project preserve notices, attribution, source-disclosure terms, and other conditions?
  • Security and quality: Does the code contain vulnerabilities, secrets, unsafe dependencies, or defects?

Similarity searches address provenance. Licence review addresses permission and obligations. Tests, static analysis, dependency review, secret scanning, vulnerability checks, and runtime monitoring address security. A clean similarity search does not make code safe, and a vulnerability finding does not establish that code was copied.

AI-authorship detectors are a weak basis for decisions about small snippets. A human may have edited generated output, a model may produce a conventional implementation, and unrelated developers may independently write the same algorithm. Treat detector scores, stylistic clues, and unusual formatting as triage signals only; require source and history evidence before taking action.

Preserve the project before searching

Investigation can destroy the evidence you need. Make a read-only snapshot before rewriting, squashing, deleting generated files, or updating dependencies.

  1. Clone or archive the complete repository. Include all branches and tags that are available, the commit graph, submodules, generated artifacts, vendored directories, and ignored files that are part of a build or release.
  2. Save dependency and build metadata. Keep lockfiles, manifests, package registries, container files, CI configuration, code-generation settings, and checksums. A later dependency update can otherwise make an old result impossible to reproduce.
  3. Export AI-tool records where policy permits. Preserve prompts, session logs, accepted-suggestion records, model and tool versions, dates, and the identity of the person who accepted each change. Do not collect personal data outside your retention policy.
  4. Record the repository state. Note the commit or release under review, the review date, the branch, and any known merges or rewrites. Generate a cryptographic archive hash if your audit process requires immutable evidence.
  5. Separate application code from dependencies. Mark generated output, vendored code, and third-party packages so a normal dependency is not misclassified as copied application code.

This snapshot lets a reviewer distinguish generated output from later edits and gives legal or security teams a stable object to examine.

Find regions worth investigating

Reviewers should not search every line with equal intensity. Start with blocks whose origin is unclear or whose wording is unusually distinctive:

  • Long comments, documentation, or error messages with polished or idiosyncratic wording.
  • Rare constants, unusual regular expressions, hard-coded tables, or distinctive string literals.
  • Unexplained licence headers or notices that do not match the project’s normal conventions.
  • Large functions that are much more complete or stylistically different from surrounding code.
  • Repeated identifiers, helper names, or comment phrases that look copied as a group.
  • Generated files and vendored directories, reviewed separately from application code.
  • Code that introduces an unfamiliar framework pattern, API wrapper, or dependency without an accompanying design decision.

These clues do not prove reuse. Their purpose is to choose high-value samples for a provenance search and a manual comparison.

Search exact and near matches

Use several representations because a copied block may have been reformatted, renamed, or lightly edited. Search public Git hosting, your organisation’s repositories, package source, and the project’s own history.

Search representation What it reveals Typical limitation
Exact multi-line text Verbatim reuse, including distinctive comments and error messages Formatting or a small edit can hide the match
Identifier-renamed text Copied logic whose variable and function names were changed Requires a meaningful normalisation or token comparison
Whitespace- and comment-normalised text Equivalent code after formatting and comment changes Common boilerplate can produce many false positives
Distinctive literals Rare strings, constants, regular expressions, and table entries Short or generic literals are not discriminating
Token, AST, or structural similarity Reordered or refactored code with the same structure Needs a review workflow to separate algorithms from copying
Repository history search Earlier internal versions, deleted files, and the commit that introduced a block Rewritten or unavailable history can leave gaps

For a local first pass, search a distinctive phrase with your code-search tool, then inspect history with commands such as git log -S 'distinctive text' --all and git blame -L start, end path/to/file. These commands identify commits to inspect; they do not establish that an external source was copied.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Searches can fail even when reuse occurred. Private repositories, deleted projects, recently added files, and sources outside the index may be unavailable. A failed search is therefore not proof of originality.

Verify every candidate source

Never act on a search-result snippet alone. Open the candidate file and the surrounding code, then work backwards through its history.

  1. Open the original file. Confirm that the matched text is real code, not an index artefact, generated documentation, or a quote in a test fixture.
  2. Inspect the earliest available commit. Record the repository URL, file path, commit or release identifier, author as displayed by the host, and commit date.
  3. Compare context. Measure the reused lines and compare control flow, helper functions, comments, constants, tests, and surrounding structure. A short idiomatic loop may be independent; a long sequence of unusual names, comments, and edge-case handling is stronger evidence of reuse.
  4. Classify the source. Decide whether it is a standard algorithm, framework template, generated scaffold, common Stack Overflow pattern, package source, or project-specific implementation. Common algorithms and boilerplate create false positives.
  5. Read the licence at the source. Check the licence file, headers, release notes, and any separate terms for examples or generated assets. Preserve the exact notice and version you reviewed.
  6. Capture evidence. Save the source URL, commit or release, relevant excerpts, comparison method, licence, and reviewer notes in the investigation record.

GitHub notes that its public-code index may omit recently added code and may retain references to code that was moved or deleted. A result can therefore point to a historical location, while no current file is visible at that path.

What GitHub Copilot code referencing tells you

GitHub’s current documentation describes code referencing for inline Copilot suggestions. The service compares a potential suggestion and approximately 150 characters of surrounding code with an index of public GitHub repositories. For an accepted suggestion that is unchanged, it can show matching file URLs and detected licence information. GitHub says matches to public code typically occur in less than one percent of Copilot suggestions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

On September 30, 2024, GitHub announced general availability of code referencing in GitHub Copilot and Microsoft Azure AI; the announcement was updated October 7, 2024. The notification is useful provenance evidence, but it is not a complete plagiarism detector.

  • It covers public code indexed by GitHub, not private repositories or code hosted outside GitHub.
  • The index is refreshed periodically, so a recent public commit may not appear immediately.
  • The comparison is tied to accepted, unchanged inline suggestions; later edits may no longer match.
  • A match identifies a source and possible licence, but a reviewer still has to compare the full context and determine whether the licence permits your use.
  • No match does not establish originality because the source may be private, deleted, moved, unindexed, or outside GitHub.

Read the current feature boundaries in GitHub’s Copilot references documentation, and use the general-availability announcement for the feature’s launch context.

Make a licence decision, not just a similarity finding

For each candidate, write the evidence, confidence, amount and structure reused, source licence, and action. Use the same open-source compliance process you would apply to any third-party code.

Finding Evidence to record Possible action
Match is confirmed and the licence is compatible Source file, commit, licence text, reused lines or structure, and required notices Keep the code, preserve attribution and notices, and satisfy source-disclosure or other licence terms
Match is confirmed but obligations are missing Source and licence, plus the notice or attribution that the project lacks Add the required notices, documentation, and source offer or disclosure before release
Licence is unclear or incompatible Similarity evidence, ownership questions, and the conflicting terms Replace the implementation, obtain permission, or escalate to legal counsel before distribution
Similarity is weak or appears to be standard code Comparison showing common algorithm, template, or independent history Document the reasoning and close the finding; continue normal quality and security review
Source cannot be verified Queries attempted, repositories and dates searched, and unavailable coverage Record the uncertainty, seek an independent implementation, or hold release if the risk is material

Do not assume that an AI tool’s output is automatically owned by the tool provider, your organisation, or the model’s training-data authors. Ownership and licence questions depend on the source, the applicable terms, your contract, and local law. Ask qualified counsel when substantial similarity, contributor rights, or licence compatibility is uncertain.

Keep provenance review separate from security review

After recording origins, run the controls that answer different risks:

  • Execute unit, integration, property-based, and regression tests that cover error paths and boundary conditions.
  • Run static analysis and type checking, then review warnings rather than suppressing them automatically.
  • Scan dependencies and container images for known vulnerabilities and verify package publishers, versions, and checksums.
  • Search for hard-coded credentials, tokens, private keys, and personal data in source, history, build logs, and generated files.
  • Review network, file-system, process, and deserialisation behaviour for least-privilege violations.
  • Test the deployed feature and monitor runtime errors, unexpected outbound requests, and privilege changes.

Microsoft’s guidance for Windows development says, “Read and understand every change before accepting it,” “Test AI-generated code at least as thoroughly as hand-written code,” and apply the same open-source licence checks used for any third-party code. The guidance was updated July 5, 2026; its controls are applicable to AI-assisted projects on other platforms as well. Read Microsoft’s security and responsible-AI guidance.

Document the investigation so another reviewer can reproduce it

Create one record per finding rather than a single pass/fail label. Include:

  • Repository, branch, commit, file path, and line range reviewed.
  • Tool or model involved, generation date, and whether the block was accepted unchanged or edited.
  • Search representations used, repositories and package sources searched, and search dates.
  • Candidate source URL, earliest available commit or release, author shown by the host, and licence.
  • Approximate reused lines or structural elements, comparison screenshots or excerpts, and confidence level.
  • Decision owner, required notices, remediation deadline, and the commit that completed the action.

Use confidence labels such as unverified lead, probable match, and confirmed match only when your team defines the evidence required for each label. A confidence label should describe the evidence, not imply a probability that an AI detector measured.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Choose tools by coverage and evidence output

If you evaluate a code-search or compliance product, compare capabilities rather than marketing claims.

Evaluation axis Questions to ask
Source coverage Does it search public GitHub, internal repositories, package registries, or only an uploaded corpus?
Matching method Does it support exact text, token similarity, normalised text, AST comparison, or structural analysis?
Provenance output Does a result include the file, commit or release, author, date, and detected licence?
Private-code handling Can it index private repositories, and where are uploaded snippets stored?
Workflow integration Can reviewers use it in an IDE, pull request, pre-commit hook, or CI pipeline?
Language support Which languages, generated files, templates, and binary or embedded formats are recognised?
Privacy and retention What data is retained, for how long, and under which access controls or regional requirements?
False-positive review Can a reviewer mark standard algorithms, templates, and approved dependencies so they do not repeatedly trigger alerts?
Audit export Can the system export evidence, decisions, notices, and exceptions for an audit or release record?

Require a human review step regardless of the tool. Automated similarity scores cannot determine whether two implementations were independently written, whether a licence is compatible with your distribution model, or whether a source is authoritative.

Prevent untracked reuse in future AI-assisted work

  1. Set an organisation policy. Decide whether developers may accept suggestions that match public code, whether matching suggestions must be blocked, and who can approve an exception.
  2. Require review before merge. The reviewer should inspect generated changes, provenance notices, tests, dependency additions, and security findings—not merely approve a pull request because it compiles.
  3. Keep generation records. Store prompts or session references where permitted, along with model, tool, date, and accepted commit. Explain retention and privacy requirements to contributors.
  4. Add compliance checks to CI. Run licence and software-composition analysis, review new dependencies and publishers, and fail or quarantine builds when policy thresholds are exceeded.
  5. Scan continuously. Run vulnerability and secret scans on pull requests, scheduled builds, release artifacts, and repository history.
  6. Maintain an exceptions register. Record who approved a source, which licence terms apply, required notices, and the expiry or review date for any exception.
  7. Recheck after refactoring. A renamed or reformatted block can evade an exact search, so repeat normalised or structural checks when a generated component is substantially changed.

These controls make a later investigation faster because the project already contains the provenance, licence, and review trail needed to explain each generated change.

A practical release gate

Before shipping an AI-assisted project, the release owner should be able to answer all of these questions:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Do we have an immutable snapshot of the source, history, lockfiles, generated output, and AI-tool records allowed by policy?
  • Have distinctive code regions been searched using exact and normalised methods across public, internal, package, and historical sources?
  • For every credible match, have we opened the original file, checked its earliest available history, and recorded the licence?
  • Are required notices, attribution, source-disclosure terms, and permissions present in the distribution?
  • Have we documented unresolved ownership or licence questions and obtained legal guidance where needed?
  • Have tests, static analysis, dependency review, secret scanning, and vulnerability checks been completed independently of the similarity review?
  • Can another reviewer reproduce the search and understand why each finding was kept, rewritten, permitted, or removed?

Passing this gate means the project has a documented, reviewable basis for using its code. It does not claim that an AI-authorship detector proved who wrote every line.
