Start with an authentic photo of the property, use AI only to stage movable contents, keep the untouched original, and disclose the alteration exactly as the property’s MLS requires. There is no single nationwide workflow: image order, labels, and restrictions on edits vary by market. Check the current local rules before creating or uploading a staged image.
What makes an AI-staged listing image compliant?
The baseline is truthful representation. The National Association of REALTORS® (NAR) Code of Ethics Article 2 addresses misrepresentation of pertinent property facts. Standard of Practice 12-10 applies the duty to present a true picture to Internet advertising, including images, and prohibits misleading consumers through images. Read the 2026 NAR Code of Ethics.

That standard does not establish one national watermark or upload sequence. The applicable MLS and state requirements determine the operational details. The CRMLS and SmartMLS examples below illustrate why you must check the rules for the listing’s actual market rather than assume another MLS’s process applies.

Find the current instructions for the property’s state and MLS, and look specifically for rules on virtually staged, digitally altered, or digitally enhanced images. Confirm:

- Which kinds of staging or image correction are allowed, and how the MLS defines a material alteration.
- Whether the unaltered photo must accompany the staged one, and the required order.
- What disclosure wording is accepted and whether it belongs on each image, in a photo field, or elsewhere in the listing.
- Whether edits to the building, fixed features, or visible surroundings are prohibited or allowed only under specified conditions.
- Whether the MLS requires a particular stamp or other marking on one or both images.
For example, CRMLS’s guidance calls for the original unaltered image immediately before or after the altered image and a clear label on the altered image. SmartMLS instead specifies an accurate, unenhanced photo first, followed by the altered photo, with stamps on both. These are market-specific examples, not universal instructions. Use this workflow to create and submit the images
- Save the authentic source photo. Keep an untouched copy. Use an editing workflow that changes only the intended staging layer; do not ask a model to recreate the room or infer details hidden by objects. No particular software can guarantee compliance.
- Stage movable contents only. Adding furniture to an empty room or changing décor can help a buyer visualize the space. Do not make the image imply that the property has different walls, floors, windows, cabinetry, fixtures, dimensions, views, landscaping, façade, or neighboring features. CRMLS distinguishes ordinary corrections that do not change the property’s representation from edits that add, remove, or change real-property elements or visible surroundings; its guidance restricts those changes subject to stated conditions tied to planned improvements.
- Compare the result with the original. Check the room’s geometry, openings, fixed finishes, built-ins, and view for changes introduced by the AI. Remove the image from the listing workflow if it changes a real feature or adds an object that could be mistaken for an included item or existing amenity.
- Prepare the required image pair. Keep the framing consistent where possible, and follow the MLS’s precise sequence. CRMLS says the original must immediately precede or follow the altered image; SmartMLS requires the as-is photo first and the altered photo next.
- Apply the required disclosure and submit it in the right place. Use the terms and locations accepted by the MLS. CRMLS lists wording such as “Photo Modified,” “Virtually Staged,” “Digitally Altered,” and “AI Altered,” or substantially similar accurate language. SmartMLS directs users to use its designated field as well as stamps on the images. Do not assume a tool’s automatic watermark meets your MLS’s wording, visibility, placement, or submission requirements.
- Keep a listing record. Retain the original, staged output, edit or prompt notes, disclosure copy, and the applicable rule version with the listing file. This is a practical recordkeeping step, not a checklist prescribed by the cited MLS guidance.

What to verify before publishing
The cited material covers United States MLS and REALTOR® guidance; it does not establish requirements for every state, MLS, brokerage, portal, or advertising channel. If a listing appears in more than one MLS or will be distributed elsewhere, check the applicable rules for each destination. The available guidance does not establish whether portals preserve MLS image order or disclosures, so do not assume that they do.

California-related guidance appears in CRMLS material and includes requirements effective January 1, 2026. For a California listing, confirm the current state requirements and the applicable MLS instructions directly before relying on a detailed legal interpretation.
Rules can change. The cited CRMLS FAQ was updated July 24, 2026, and SmartMLS compliance guidance was updated September 2, 2026. Check the current version when preparing the listing and again before relying on a saved workflow.
