How to claim additional depreciation on a captive power plant under Section 32(1)(iia)

Yes, a captive power plant can qualify for additional depreciation under Section 32(1)(iia), but the project label alone is not enough. The deduction is available asset by asset when the machinery or plant is new, owned wholly or partly by the assessee, acquired and installed after 31 March 2005, and used in a business of generation, transmission or distribution of power (or manufacture or production). The ordinary additional-depreciation rate is 20% of actual cost.

If an eligible asset is put to use for fewer than 180 days in the previous year, only half of the calculated additional depreciation is allowed in that year. At the ordinary 20% rate, that is 10% in the first year and the remaining 10% in the immediately succeeding previous year, subject to the statutory conditions. Every boiler, turbine, generator, transformer, control system and other component therefore needs its own eligibility and first-use record.

What Section 32(1)(iia) allows

Section 32(1)(iia) of the Income-tax Act, 1961 provides an additional deduction for qualifying new machinery or plant. The deduction is separate from normal depreciation. It is calculated at 20% of the asset’s actual cost when the statutory requirements are met. The provision covers an assessee engaged in manufacture or production, or in generation, transmission or distribution of power. It applies to tangible assets owned wholly or partly by the assessee and used for business or profession.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The provision excludes ships and aircraft and contains further exclusions for particular uses and locations. The statutory wording, as amended and in force when the return is prepared, controls the claim; a project’s accounting name, financing structure or internal description does not.

Why “captive” does not decide eligibility

A captive plant generates electricity for the owner’s own industrial or commercial operations rather than primarily for sale. That use may fit the statutory activity of generation of power, but “captive” is not a separate automatic entitlement in Section 32(1)(iia). The question is whether each proposed asset satisfies the legal tests and is actually used in the qualifying power-generation business.

The asset-level tests you must satisfy

Apply the following tests separately to every item included in the engineering, procurement and construction (EPC) project cost:

  • Newness: the machinery or plant must be new for the statutory purpose. Machinery or plant used by another person before its installation is an exclusion risk.
  • Acquisition and installation date: the asset must have been acquired and installed after 31 March 2005. Keep documentary evidence for both events; an invoice date alone may not establish installation.
  • Nature of the asset: the item must be machinery or plant, not land, a building or merely civil construction. Mixed EPC invoices must be split using a defensible allocation.
  • Ownership: the assessee must own the asset wholly or partly. Identify the legal owner and, where ownership is shared, the portion of actual cost attributable to that owner.
  • Business use: the asset must be used for business or profession and connected with the qualifying generation, transmission or distribution activity (or another qualifying activity in the section).
  • Actual cost: calculate the 20% deduction on the eligible asset’s actual cost after removing amounts relating to non-qualifying land, buildings, civil work or other excluded items.
  • Exclusion screening: check the statutory exclusions before calculating any amount, including office-premises or residential-accommodation installations, office appliances and road transport vehicles.
  • First-use timing: record the date on which the asset was first put to use in the relevant previous year so the 180-day rule can be applied correctly.

Which captive-plant components need separate review?

Engineering descriptions are not tax classifications. A component that is mechanically integrated into generation may still require a current tax opinion if the invoice combines plant with civil or building work. Use an asset schedule that preserves the technical identity and the tax conclusion for each line.

Project item Questions for the schedule Evidence or risk to address
Boiler Is the boiler new, separately identifiable and used in generation? Supplier invoice, delivery and installation certificate, commissioning record and cost allocation.
Turbine Does the turbine represent machinery acquired and installed by the assessee? Purchase contract, erection records, synchronization or commissioning log and capitalization entry.
Generator When was the generator first capable of and actually put to use? Trial-run and first-generation records, meter logs and fixed-asset-register entry.
Waste-heat-recovery unit Is the unit new plant used in the power-generation process rather than a building or civil structure? Technical drawings, EPC allocation, installation certificate and operating records.
Transformer Is it used in the qualifying power system and owned by the assessee? Electrical single-line diagram, invoice, ownership documents and energization record.
Switchgear and control system Are the items separately identifiable machinery or plant, and what is their actual cost? Itemized invoice, bill of quantities, commissioning test and asset-register mapping.
Buildings, foundations and other civil work Is the cost a building or civil structure rather than machinery or plant? Architect or engineer certification and a documented exclusion or allocation methodology.
Land and site costs Can the amount be separated from eligible plant cost? Land deed, capitalization schedule and EPC cost split; land is not qualifying machinery or plant.

The table is a starting review, not a blanket ruling for every design. Replacement assets, mixed civil-and-plant invoices, shared facilities and components used partly outside the qualifying business should be reviewed under the current law and project facts.

How the 180-day rule changes the deduction

When an eligible asset acquired during the previous year is put to use for fewer than 180 days in that year, the additional-depreciation amount for that year is restricted to 50% of the applicable amount. For the ordinary 20% rate, the first-year deduction is therefore 10% of actual cost. The remaining 10% is allowed in the immediately succeeding previous year when the statutory conditions continue to be satisfied.

First-use result in the previous year Additional depreciation in that year Amount in immediately succeeding previous year Timing and evidence focus
Asset used for at least 180 days 20% of eligible actual cost No deferred half under the 180-day rule Prove the first-use date and continuous business deployment through commissioning and operating records.
Asset used for fewer than 180 days 10% of eligible actual cost Remaining 10% in the immediately succeeding previous year, where permitted Prove both the first-use date and the calculation of days in the previous year.

Worked timing examples

Assume an eligible generator has an actual cost of ₹10 crore and is first put to use on 1 September in a financial year ending 31 March. If the applicable day count is at least 180 days, the additional depreciation calculated for that year is 20% of ₹10 crore, or ₹2 crore. The precise day count should be checked against the records and the relevant return year.

If the same generator is first put to use on 15 December and is used for fewer than 180 days before 31 March, the first-year amount is restricted to 10% of ₹10 crore, or ₹1 crore. The remaining ₹1 crore is claimed in the immediately succeeding previous year if the statutory conditions are met. These figures illustrate the rate mechanics; they do not decide whether the generator or any related EPC cost is eligible.

What counts as first use for your records

Use a contemporaneous event that demonstrates the asset entered business use, such as a commissioning or synchronization record, first-generation log, energization certificate or comparable operating evidence. A capitalization date can support the file but may not, by itself, prove that the asset was put to use. Keep the exact date used in the tax computation and reconcile it to the engineering and operations records.

Step-by-step claim workflow

  1. Break the EPC bill into assets. Obtain the detailed bill of quantities and map each line to a boiler, turbine, generator, transformer, switchgear item, control system, waste-heat unit, building, foundation, land or other category. Do not claim the entire project total as plant.
  2. Build an eligibility schedule. For every proposed asset, record whether it is new or previously used, the invoice and acquisition date, installation date, first-use date, actual cost, ownership, business use and plant-versus-civil classification.
  3. Check the statutory dates and exclusions. Confirm acquisition and installation after 31 March 2005, screen for prior use by another person, office or residential installation, office appliances and road transport vehicles, and remove ships or aircraft from the calculation.
  4. Confirm the qualifying activity. Link the asset to generation, transmission or distribution of power, or to another qualifying business activity under the section. A captive label, an electricity bill or a power-purchase arrangement is not a substitute for an asset-level use analysis.
  5. Determine the 180-day treatment. Compare the documented first-use date with the 180-day condition for the relevant previous year. Use 20% when the full-use condition is met; use 10% in the short-use year and track the remaining 10% for the immediately succeeding previous year where allowed.
  6. Calculate on actual cost. Apply the rate only to the eligible portion of actual cost. Remove land, buildings, civil work and any excluded or non-business component. If ownership is partial, document the assessee’s attributable cost.
  7. Reconcile the books and tax records. Tie each amount to the general ledger, capitalization entry, fixed-asset register, normal tax-depreciation schedule and return computation. The opening balance for the deferred 10% should agree with the prior-year working.
  8. Review the return-year requirements. Assessment-year return utilities and schedules can change. Have an Indian tax professional verify the current fields, calculation and supporting position before filing.
  9. Preserve the file. Keep invoices, bills of entry, installation and commissioning certificates, synchronization or energization records, generation or first-use logs, EPC allocation workings, ownership documents and approvals with the return support.

Documents that make the claim defensible

A defensible file lets an assessor trace the deduction from the return to a particular asset and then to the physical project. At minimum, organize the following:

  • Purchase invoices, bills of entry and payment or acquisition records showing the asset and supplier.
  • EPC contracts, itemized bills of quantities and the method used to allocate bundled costs.
  • Installation, erection, testing, commissioning, synchronization or energization certificates.
  • Generation, meter, trial-run and first-use logs showing when the asset entered business operations.
  • Fixed-asset-register entries with asset number, location, capitalization date, actual cost, ownership and useful identification.
  • Technical drawings or engineer certifications separating machinery from foundations, buildings and other civil work.
  • Evidence that the assessee owns the asset wholly or partly and that it is used in the qualifying power business.
  • Prior-year computation supporting any 10% amount carried into the succeeding previous year.

Keep the records asset-specific. A single project completion certificate that does not identify individual components may not establish the installation or first-use date for every item.

Common mistakes and how to correct them

Claiming the entire captive-project cost

Land, buildings and civil work do not become machinery merely because they are necessary to operate a plant. Correct the schedule by separating those amounts and retaining the engineering basis for the allocation.

Using the invoice date as the first-use date

Acquisition, installation and first use are distinct events. Replace a presumed date with the commissioning, synchronization, energization or first-generation record that shows when business use began.

Applying 20% to a short-use asset

If use was for fewer than 180 days, halve the calculated additional depreciation for the first year. Record the deferred 10% as a separate succeeding-year item instead of overstating the first-year claim.

Ignoring prior use or replacement history

A replacement bought for an existing line may be new to the assessee but still requires evidence that it was not machinery or plant used by another person before installation. Obtain supplier declarations and delivery or installation records where relevant.

Including office, residential or transport items

Screen auxiliary purchases separately. Office appliances, machinery or plant installed in office premises or residential accommodation, and road transport vehicles are statutory exclusion risks even when purchased under the same project.

Relying on an old opinion for a disputed component

Tax treatment of an integrated waste-heat unit, control system, transformer or mixed civil structure can depend on design, ownership and use. Obtain a current opinion for disputed classifications rather than copying a prior project’s schedule.

Full-year versus short-use treatment: decision table

Decision point Full-use case Short-use case
First-use date Documented date gives at least 180 days of use in the previous year. Documented date gives fewer than 180 days.
Percentage in first year 20% of eligible actual cost. 10% of eligible actual cost.
Later-year amount No 180-day deferral. Remaining 10% in the immediately succeeding previous year, where statutory conditions are met.
Cash-tax timing More of the deduction is available in the acquisition year. Half of the deduction is delayed to the next previous year.
Evidence strength needed Installation and first-use records establish at least 180 days. Exact first-use date and a tracked carry-forward working are essential.

How to document uncertain component classifications

For a disputed item, prepare a short technical-tax memorandum linked to the asset number. Describe the item’s physical function, where it is installed, how it connects to generation, who owns it, how the invoice price was allocated and whether any part is civil or building work. Attach drawings, commissioning records and the relevant ledger lines. The memorandum should state the conclusion and the alternative treatment if the classification is challenged.

This approach is especially important when one EPC invoice covers machinery, foundations, control rooms, roads, buildings and site development. The statute provides the test, but it does not classify every engineering design. A current Indian tax professional should review components for which the plant-versus-civil boundary or business-use link is not clear.

Return preparation and year-specific caution

The legal rate and 180-day mechanism are statutory, while electronic return utilities and assessment-year schedules can change. Before filing, reconcile the Section 32(1)(iia) working to the current assessment-year instructions and return utility, and preserve the calculation used. If a later-year 10% amount is claimed, show how it arose from the prior-year short-use calculation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not treat a software fixed-asset register as a legal requirement. It can help manage evidence, dates and reconciliations, but the legal requirement is to substantiate the statutory conditions with reliable records.

Practical eligibility checklist

  • Is this a specific machinery or plant item rather than land, a building or civil work?
  • Is it new, with no disqualifying prior use by another person?
  • Was it acquired and installed after 31 March 2005?
  • Does the assessee own it wholly or partly?
  • Is it used in the assessee’s qualifying generation, transmission or distribution business?
  • Is its actual cost separately supported and free of excluded amounts?
  • Does it avoid the office-premises, residential-accommodation, office-appliance and road-vehicle exclusions?
  • Are acquisition, installation and first-use dates supported by contemporaneous records?
  • Was the 180-day condition tested for the correct previous year?
  • Do the books, fixed-asset register, tax schedule and return computation agree?
  • Has a current Indian tax professional reviewed disputed components and the assessment-year filing requirements?

Bottom line for a captive power plant owner

Claim additional depreciation only after converting the captive project into an asset-level schedule. A qualifying new generator, turbine, boiler, transformer or other plant item can receive 20% of actual cost under Section 32(1)(iia) when every statutory condition is met. If first use is for fewer than 180 days, claim 10% in that year and the remaining 10% in the immediately succeeding previous year where permitted. The strongest claim is the one supported by itemized EPC costs, ownership and use evidence, commissioning and first-use dates, exclusion screening and a current review of disputed classifications.
