Choose an AI assistant by checking what happens to your conversations—not by relying on a general “private” or “secure” claim. Compare whether chats can be used to improve models, how long they are kept, who may access them, what deletion covers, and whether the rules differ for your account type. Then verify the current policy and settings for the specific plan you intend to use.
What to check before choosing an AI assistant
Privacy is a set of data practices and controls, not a single feature. Review the provider’s policy and the settings available on your account; a company-wide description may not establish how your particular account is configured.

Model training and improvement
Find out whether conversations may be used to train or improve models, whether that use is on by default, and whether the answer changes by plan or account type. Check where to change the setting and what it covers: some controls apply to new conversations or resumed conversations, not necessarily every past interaction or a training process already underway.

Ask how long prompts and related data are kept, including when the provider says conversations are not used for training. Safety, abuse review, or other operational purposes may involve retention separate from model improvement. Check whether you can delete individual chats, saved memories, or the account, and what deletion does—and does not—mean for data already used in training.

Access, sharing, and connected services
Check whether authorized staff or service providers may review conversation data and under what circumstances. If you connect files, apps, or another account, read what information is shared with the assistant and how it is handled. For work or confidential material, look for contractual commitments covering customer prompts and data rather than assuming a consumer-account policy applies.
Security and account controls
Look for concrete measures such as encryption, account protections, access controls, and product-specific compliance information. Security and privacy overlap, but they answer different questions: encryption can help protect data from unauthorized access, while the retention and training policies determine how the provider may handle data within its service. NIST says AI security and resilience are active areas of research, with challenges and potential solutions changing rapidly (NIST, AI Research – Security and Resilience; updated August 14, 2026).

Clear policies and change notices
Prefer explanations that state plainly what data is collected, how it is used, what controls you have, and when terms change. In January 2024, the Federal Trade Commission said using or retaining data for other purposes without clear, conspicuous notice and affirmative express consent can create legal risk. It also cautioned against burying disclosures in legalese or fine print and said existing law still applies to AI providers (FTC guidance).

Compare the exact service, plan, and setting
The following provider examples illustrate why you need to check the account you will actually use. They are dated provider statements, not an exhaustive or independent head-to-head audit.

These examples show why “opt out of training” is not the same as “nothing is retained,” and why a consumer policy may not describe a business service. The Federal Trade Commission’s January 2024 guidance says privacy commitments apply to model-as-a-service companies as well (FTC guidance).
Use a practical comparison checklist
- Choose the account first. Identify the exact assistant, plan, region, and account type you expect to use. Compare consumer and business terms separately.
- Open the current privacy policy and settings. Locate the controls for model improvement, chat history, saved memories, and deletion. Confirm whether a choice affects future chats, resumed chats, or prior data.
- Record the retention rule. Look for a duration and any exceptions for safety, abuse review, or other purposes. If the policy does not state a duration, treat it as not established rather than assuming chats are short-lived.
- Trace data access and sharing. Check who may review conversations and what happens to connected files, apps, or accounts. For workplace use, verify contractual protections with the organization’s administrator or provider.
- Check security separately. Note the safeguards the provider actually identifies, such as encryption and account protections. Do not use a security claim as a substitute for answers about training or retention.
- Check how policy changes are communicated. Look for clear notices and meaningful controls, then revisit the policy before entering sensitive information if terms or settings have changed.
Take extra care with work, children, and teens
For business and confidential information
Use the business product’s own terms and controls, not assumptions drawn from a personal account. Confirm how customer prompts are treated, who in the organization can access them, how long they remain available, and whether the provider makes contractual commitments relevant to your data. If those details are unclear, do not submit confidential information until your organization has resolved them.

For children and teens
Check age rules, parental controls, safety information, and how conversation data is handled for young users. In September 2025, the FTC announced an inquiry involving seven consumer-facing chatbot companies, asking about their handling and sharing of personal information from conversations and how they inform users and parents. The announcement describes an inquiry, not findings against every company involved (FTC inquiry announcement).
When an assistant’s privacy terms are not enough
If you cannot determine whether chats are used for improvement, how long they are retained, or who may access them, treat those practices as unknown. Avoid entering passwords, financial details, health information, personal identifiers, or confidential work material until you can verify the relevant terms and settings. No single privacy feature settles the decision: weigh the data practices that matter for your use, and recheck them because provider policies and controls can change.
