How to Check Whether a SaaS Provider Stores Your Data in the EU

By Freedom251 Team · · 10 min read

Do not rely on an “EU-hosted” badge or a data-center map. To determine whether a SaaS provider really keeps your data in Europe, obtain its current Data Processing Agreement (DPA), identify every country and cloud-region used for storage and processing, review the complete subprocessor list, and verify what happens during support access, backups, failover and service migration. Confirm that the commitment covers your exact plan, tenant, enabled features and support tier.

EU residency is a scope question, not a marketing label. Primary records may sit in an EU region while replicas, logs, telemetry, analytics, support tickets or disaster-recovery copies are handled elsewhere. If any personal data leaves the European Economic Area (EEA), document the legal transfer mechanism and the technical and organizational controls protecting it.

What “stored in the EU” actually means

Start by defining the boundary you need. “EU storage” can mean only the production database, or it can include every copy and processing path associated with your account. A useful review covers:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Primary application data and file storage
  • Read replicas, caches and search indexes
  • Backups and long-term archives
  • Disaster-recovery and failover environments
  • Application, security and audit logs
  • Telemetry, diagnostics and product analytics
  • Support tickets, screen recordings and troubleshooting exports
  • Data used by subprocessors, contractors or service desks

The EEA consists of the EU member states plus Iceland, Liechtenstein and Norway. A provider may describe an EEA region rather than an EU-only region, so record the exact countries named in the contract. The United Kingdom and Switzerland are outside the EEA; processing there requires its own legal analysis.

EU residency is not the same as GDPR compliance. GDPR obligations depend on the data, the parties’ roles, the processing instructions and the safeguards in use. Conversely, a provider can offer an EU region while still allowing remote access from outside Europe. Treat location, access and legal safeguards as separate questions.

Step 1: Identify the data and legal roles

Make an inventory before asking the vendor for assurances. Mark which fields identify or relate to a person: names, email addresses, account IDs, IP addresses, device identifiers, support conversations and free-text content can all be personal data in context. Include metadata if it can be linked to an individual.

Then document the role each party performs. Your organization may be the controller while the SaaS company acts as processor. A provider may be a controller for billing, fraud prevention or its own service analytics, or the parties may be joint controllers for a particular operation. The DPA should not use one blanket role for activities that are materially different.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keep mixed datasets in scope. If personal and non-personal records are combined and cannot be separated, the dataset generally remains subject to GDPR requirements. If you can technically separate categories, ask the provider whether the residency commitment differs for each category and have that distinction written down.

Step 2: Obtain and read the DPA and service terms

Request the provider’s current DPA, privacy terms, service description and any regional-residency addendum. You need a written processor agreement containing the elements expected of an Article 28 GDPR arrangement, not a sales email.

Clauses that should be explicit

  • Instructions and purpose: what the provider may do with your data and what it may not do.
  • Data categories and subjects: the information and people covered by the service.
  • Locations: countries and, where relevant, named cloud-region identifiers for each processing activity.
  • Security: access controls, encryption, key management, vulnerability handling, incident response and personnel confidentiality.
  • Subprocessors: authorization method, current list, purposes, locations and notice of changes.
  • Return and deletion: export format, deletion deadlines, backup treatment and certificates or other evidence.
  • Audit and information rights: how you can obtain compliance evidence or conduct an assessment.
  • International transfers: the mechanism and supplementary measures for every non-EEA path.

The Irish Data Protection Commission (DPC) summarizes the controller’s responsibility this way: “A data controller must remain in control of the personal data it collects when it subcontracts the processing to a cloud provider.” The DPC also states, “Important for both control and security is the location of the data.” These are practical contract requirements, not merely data-center preferences.

Check version dates, incorporated documents and precedence rules. A regional addendum that conflicts with general service terms should state which document controls. Save the exact copy you reviewed.

Step 3: Demand precise locations for every data path

Ask for named countries and exact cloud-region identifiers rather than “Europe” or “the EU.” If the provider uses a hyperscale cloud, a region identifier should distinguish, for example, one European region from another. Do not accept a list of possible regions if the vendor cannot tell you which one your tenant uses.

Request a location map that separates storage from processing. The Irish DPC advises customers to “establish precisely where and how the data you provide to a cloud provider will be handled.” Your map should answer the following:

Data path What to verify Evidence to retain
Primary production data Country, cloud region, service and tenant scope Region setting, contract language and provider confirmation
Replicas and caches Whether copies are synchronous, temporary or persistent; their locations Architecture description or residency schedule
Backups and archives Backup region, retention period, encryption and deletion behavior Backup policy and deletion terms
Disaster recovery Failover destination, activation criteria and whether a non-EEA site is used Business-continuity statement and regional commitments
Logs and telemetry Fields collected, aggregation, retention and processing countries Data-flow or diagnostic-data documentation
Analytics Whether event data is exported to a separate analytics service Feature documentation and subprocessor entry
Support tooling Ticket, call, screen-share and session-recording locations Support policy and access-control description
Service migration Temporary copies made during upgrades, moves or capacity changes Migration procedure or contractual notice

Ask whether encryption keys, key-management services and identity logs are also confined to the stated boundary. A database can remain in an EU region while an external logging or key service processes identifiers elsewhere.

Step 4: Audit the complete subprocessor chain

A SaaS provider’s residency promise is only as complete as the third parties and processing paths it discloses. Obtain the current subprocessor list and capture it with the date. For every entry, record:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Legal entity and corporate location
  • Service or purpose
  • Countries and cloud regions where processing occurs
  • Whether it receives content, metadata, support information or only aggregated data
  • Type of access: persistent, limited, administrator, emergency or no human access
  • Retention and deletion behavior

Review the provider’s change process. The European Data Protection Board’s Cloud Code of Conduct expects mechanisms for supplying subprocessor information and advance communication of additions or replacements where general authorization is used. Your contract should explain how notice is delivered, how much time you have to object, what constitutes a valid objection and what happens if the parties cannot resolve it.

Check more than the headline list. A support platform, error-monitoring service, email-delivery system or identity provider may process account details even if it never stores your main files. Ask whether optional features create additional subprocessors and whether disabling a feature removes its data path.

Step 5: Verify international-transfer safeguards

If any personal data is accessed, stored or otherwise processed outside the EEA, request the legal safeguard for that specific path. Possible mechanisms include an applicable adequacy decision or Standard Contractual Clauses (SCCs), together with supplementary measures where required.

  • [Easy Disassemble] Making incidental repairs quick and easy! Very nice, flexible cable
  • [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by

Do not treat an SCC reference as a complete answer. Ask:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Which transfer mechanism applies to each country and subprocessor?
  • Which SCC module and version are incorporated?
  • Has the provider assessed the destination country’s laws and practices?
  • What supplementary measures are used, such as encryption, pseudonymization, strict access controls or split-key designs?
  • Who can authorize exceptional access, and how is it logged and reviewed?
  • How are government or law-enforcement requests handled and communicated?

GDPR protection follows personal data when it is transferred outside the EU. A provider cannot avoid transfer obligations by calling a foreign operation “support,” “maintenance,” “telemetry” or “remote access.” Ask for the operational control that accompanies the legal mechanism.

Step 6: Test the promise against your purchased configuration

Residency may apply only to particular plans, tenants, services or categories of data. Confirm the commitment for your exact subscription and configuration, not a product family in general.

Configuration checks

  1. Record the plan name, service edition, tenant identifier and selected region.
  2. List enabled modules, integrations, APIs, mobile apps and collaboration features.
  3. Check whether each module has its own storage or subprocessor location.
  4. Confirm the support tier and whether premium support permits access from additional countries.
  5. Ask whether trial accounts, sandbox environments, free features or developer tools use a different boundary.
  6. Verify that new regions or features cannot be enabled without notice or an administrative decision.

Microsoft’s Entra documentation illustrates why tenant boundaries matter: collaboration with tenants outside the EU Data Residency and EU Data Boundary can result in some account, usage and configuration data being stored or processed outside those boundaries. The same principle applies broadly: guest users, cross-tenant sharing, external integrations and global administration can create paths that are not covered by a simple region selection.

Ask specifically about account records, usage data, configuration data and security logs. They may be treated differently from customer content.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 7: Examine failover, incidents and maintenance

Normal operation is only one scenario. Ask what happens when the primary region is unavailable, a security incident is investigated, a database is restored or a service is migrated.

Questions for continuity events

  • Which region receives traffic during failover?
  • Is the alternate region inside the EEA, and is that location guaranteed or merely preferred?
  • How long may emergency copies remain there?
  • Can support engineers access production data during diagnosis, and from which countries?
  • Are incident snapshots, memory dumps or forensic images retained?
  • Are backup restores tested in a different region?
  • Will the provider notify you before or after a location change?

A residency statement that covers only “at rest” data may not cover transient processing during a failover. Require the exception, duration and safeguards to be documented.

Step 8: Check deletion, retention and backups

Ask how the provider deletes active records, replicas, indexes, logs and backups when the contract ends or you delete an account. A “deletion” button may remove the production record while encrypted backups persist for a stated period.

Obtain the retention schedule for each category and the trigger that starts the clock. Confirm whether legal holds, fraud records or aggregated statistics are retained, and whether those records still contain personal data. Request an export before termination if you need to demonstrate return or migration.

Deletion evidence can include an automated report, administrator confirmation, certificate or audit record. The DPA should explain the available evidence and any exceptions.

How to compare providers consistently

Use the same written questions and evidence standard for every candidate. Score the following dimensions separately; a strong result in one does not compensate for an unknown in another.

Comparison axis Strong evidence Weak evidence
Residency scope Contract defines content, metadata, logs, support and backups for your plan “Hosted in Europe” marketing language
Primary, backup and failover locations Named countries and region identifiers, including emergency paths “Multiple European data centers” with no locations
Non-storage processing Telemetry, analytics, support and diagnostics mapped to countries Only the database location is stated
Subprocessor transparency Dated list, purposes, locations and advance-change process Undated list or no objection mechanism
Transfer safeguards Mechanism and supplementary controls documented per path Generic “GDPR compliant” statement
Contractual enforceability DPA or addendum binds the provider and identifies precedence Sales assurances not incorporated into the contract
Evidence and auditability Region records, certifications, reports and audit rights are available Provider asks you to trust an unverifiable claim

“Not stated” is a meaningful result. Record it instead of inferring that an unspecified location is in the EU.

Questions to send the provider

Use this questionnaire in procurement or renewal discussions:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. In which countries and exact cloud regions are primary data, replicas, backups and disaster-recovery copies stored?
  2. Where are logs, telemetry, analytics, support tickets and diagnostic data processed?
  3. Which subprocessors can access customer data, for what purpose and from which locations?
  4. Does the EU-residency promise apply to our exact plan, tenant, enabled features and support tier?
  5. Can support personnel or engineers access data from outside the EEA? If so, under what approval, logging and transfer controls?
  6. What happens during failover, incident response, maintenance and service migration?
  7. Which transfer mechanism applies to every non-EEA processing path, and where is it documented?
  8. How are subprocessor additions communicated, and can customers object?
  9. How long do backups, logs and deleted records remain, and how is deletion demonstrated?
  10. Which account, usage and configuration data follows a different residency rule from customer content?

Request answers in writing from an authorized privacy, security or legal contact. Keep the response with the contract rather than relying on a presentation or verbal assurance.

Red flags that require clarification

  • The provider names a city or “EU data center” but will not identify the cloud region.
  • Backups, support access or telemetry are omitted from the residency statement.
  • The subprocessor page is undated, incomplete or silent about locations.
  • The DPA allows broad processing “wherever necessary” without a defined boundary.
  • EU residency is available only on an unnamed enterprise tier, while your quote uses another plan.
  • Failover is described as “global” with no emergency retention or notification terms.
  • The provider cites GDPR certification as proof that no data leaves the EEA.
  • Cross-tenant collaboration or third-party integrations are excluded from the guarantee.

Each red flag may have a reasonable explanation, but the explanation should be specific, contractual and applicable to your tenant.

Keep evidence and recheck it

Create a residency file containing the signed DPA, service terms, regional addendum, subprocessor snapshot, architecture or data-flow diagram, region-selection record, provider answers and audit or certification scope. Date every item.

Recheck after a material product change, new subprocessor, region migration, acquisition, support-tier change or contract renewal. Subscribe to subprocessor notices and assign an owner to review them. If your organization performs a transfer-impact assessment or vendor risk review, link it to the same evidence set.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When the provider changes its architecture, repeat the location questions rather than assuming the original promise still applies. Residency is an ongoing control, not a one-time procurement checkbox.

What to conclude from the evidence

You can describe a provider as meeting your EU-residency requirement only when the scope is explicit: the relevant data categories, primary and secondary locations, non-storage processing, human access, subprocessors, failover behavior and transfer safeguards all match your organization’s requirement and purchased configuration.

If one path remains outside the EEA, decide whether the service is still acceptable under a documented transfer mechanism and risk assessment. If the provider cannot identify the path or safeguard, treat the residency claim as unverified and escalate before uploading personal data.
