Do not rely on a prediction-market brand’s “regulated” badge. First identify the platform’s exact legal entity and the contracts it offers, then verify that entity in the relevant regulator’s live records. In the United States, that usually means checking Commodity Futures Trading Commission (CFTC) registration, category, status, restrictions and enforcement history. You must also confirm that the authorization covers the specific product and your location.
A regulator relationship can be verified at a point in time; it does not by itself prove that a platform is solvent, safe, profitable or lawful for every contract in every state or country. Record what you find and check again immediately before depositing money.

What “licensed and regulated” can mean
Prediction-market operators use several legal descriptions that are not interchangeable. A platform may be an exchange, a broker or another intermediary. It may hold a direct registration, operate under a specific exemption or no-action position, possess a state gaming authorization, or have no verifiable authorization at all. “Available in your state” is a separate question from “registered with a federal regulator.”
In U.S. materials, prediction markets are generally described as markets for event contracts. The CFTC discusses exchanges, brokers and intermediaries that provide access to those contracts. A registration record tells you who is supervised and in what capacity; it does not automatically approve every market the business advertises.

The wording on a website can blur these distinctions. “Licensed,” “registered,” “regulated,” “approved,” “compliant,” and “legal” may refer to different facts, different agencies or different dates. Ask which entity received which authorization, for what activity, and under what conditions. A logo or a sentence in a footer cannot answer those questions.
Four claims you should keep separate
| Claim | What it establishes | What it does not establish |
|---|---|---|
| Registered or licensed | The named legal entity appears in a regulator or licensing record under a stated category. | That every product, promotion or jurisdiction is covered. |
| Regulated exchange or intermediary | The entity operates in a role subject to the regulator’s rules. | That the regulator guarantees withdrawals, profits or solvency. |
| Covered by no-action relief or similar relief | A regulator has limited enforcement or compliance relief under specified conditions. | A broad license or permanent approval for unrelated products. |
| Legal or available in a state | The operator currently permits access under its interpretation of applicable law or an identified order. | That another state, contract type or future court ruling will produce the same result. |
These categories can overlap, but they should not be treated as synonyms. A platform might have a federal registration and still restrict particular states, or have relief that applies only to a narrowly described activity. Your notes should state exactly which claim you verified.
The verification workflow
Use this sequence for any event-contract, sports-contract or binary-option website. Save screenshots or PDFs of the records and write down the date, because registration, court orders, geofencing and market availability can change.
1. Capture the exact legal entity
Open the platform’s legal, terms, privacy and customer-agreement pages. Record:
- the full company name, including corporate suffix;
- the exchange or trading venue name, if different;
- the domain and any mobile-app publisher name;
- country and state of incorporation;
- the role the company claims to perform (exchange, broker, intermediary or other);
- the precise product: event contracts, sports contracts, binary options or another instrument.
Also note the entity that holds customer funds or appears as the counterparty in the contract. It may differ from the company operating the website or providing technology. Record any parent, subsidiary or affiliated broker named in the terms. Those details help you avoid matching a regulator record to a similarly named but unrelated business.
Do not search a regulator database using only a brand name. A brand can cover several entities, and a similarly named company can produce a false match. If the legal pages omit the entity, treat that omission as a warning and ask customer support for the registered name before funding an account. Request the answer in writing and retain it with your other records.
2. Identify the claimed regulator and category
For a U.S. venue, determine whether the materials claim CFTC oversight and what type of registration is asserted. The CFTC’s consumer guidance tells traders to check registration and backgrounds before trading. A statement such as “CFTC-regulated exchange” is a claim that must be matched to a CFTC record, not accepted as proof on its own.
Outside the United States, identify the national or regional authority named by the operator and the relevant license class. The same checklist applies: entity, category, status, product scope and geography. If a site names several authorities, determine which one supervises the actual contract and which one relates only to payments, identity verification or a separate affiliate.
3. Search the regulator’s own records
Use the regulator’s official registration or licensing database, not a directory, review site or search-ad result. Search the exact legal name and, if available, the exchange name. Confirm all of the following:

- the entity exists in the database;
- the registration category matches the role advertised;
- the status is current rather than expired, withdrawn, suspended or pending;
- the record identifies the same corporate address or jurisdiction shown in the platform’s legal documents;
- any conditions, limitations, orders or geographic restrictions are visible.
Save the record’s displayed date and registration number. If the search returns several similarly named entities, do not assume they are related; resolve the identity with the platform’s corporate disclosures. Try common variations of the legal name, but treat a partial match as unconfirmed until the address, registration number or other identifying information lines up.
Read the record itself rather than relying on a search-result snippet. A snippet may be stale, omit a status change or describe an affiliated entity. Follow links to amendments, notices and orders, and check whether the database distinguishes an active registration from an application or a historical entry.

Follow the regulator’s links to background, disciplinary and enforcement information. Look for cease-and-desist orders, settlements, suspensions, revoked registrations, unresolved proceedings and litigation involving the entity or its principals. Search the regulator’s enforcement releases as well as the registration page, because the two systems may be separate.
A clean search only means that the claimed regulator relationship was not contradicted by the records you checked at that time. It is not a safety certification. An unresolved allegation is not the same as a final finding, so describe the status accurately and check for later orders. If the operator has changed names or reorganized, search the former names shown in its disclosures as well.
5. Match the authorization to the product
Read the contract description, settlement rules and trading terms, then compare them with the activity covered by the registration. An entity can be authorized for one activity while marketing another. Check whether the record or relief covers:
- political, economic, weather or other event contracts;
- sports or athletic-event contracts;
- cash-settled or physically settled outcomes;
- the exchange itself versus brokerage or order-routing services;
- the customers you are (retail, professional or institutional).
Pay attention to how the outcome is determined, who supplies the settlement information and what happens if an event is postponed, canceled or disputed. Those terms help you identify the product you are actually buying, rather than the marketing label used on the home page. Compare the contract’s title, definition, settlement source and expiration with the scope described in the regulator record.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsThe CFTC distinguishes event-contract markets from other products. It also warns that some online binary-option platforms are not CFTC-regulated and says U.S. binary options must trade on a regulated U.S. exchange. A website that calls a product an “event contract” does not make it one legally; the contract terms and authorization determine the category. If the site offers a menu of products, verify each category separately instead of assuming one registration covers the entire menu.
6. Check geography and contract-specific access
Federal oversight does not eliminate every state-law dispute. CFTC materials state that federally regulated prediction markets can operate under federal law in all 50 states, while a 2026 Wisconsin litigation announcement records states asserting gambling-law jurisdiction over some offerings. Those positions can coexist while litigation is pending.
Check the law and current orders for your state, country and contract category, especially sports-related markets. A platform may geofence one state, disable selected markets, or change access after a court order. Do not infer nationwide availability from the fact that a friend in another state can trade. A user’s physical location, residence, account verification and contract type can all affect access.

Read the platform’s eligibility page and attempt to identify the exact restriction that applies to you. A general statement that a service is “available in the United States” may not address a particular state or market. Keep copies of notices explaining blocked jurisdictions or disabled contracts, since those notices can change without altering the platform’s general marketing language.

Compare the legal name, registration number, regulator, product description and geographic limitations in the platform’s disclosures with the regulator’s record. For example, Kalshi states that it operates as a CFTC-regulated exchange. That statement is useful as a lead, but the decisive step is matching the named entity and status in current CFTC records.
Apply the same standard to any platform, including one that is widely discussed or appears in news coverage. Popularity, app-store presence and a polished compliance page are not substitutes for a matching government record. If the platform links directly to a regulator page, verify that the link identifies the same entity and has not been redirected to a generic agency homepage.
8. Re-check immediately before funding
Perform the search again on the day you deposit money. Confirm that the registration remains current, no new order changes the product’s status, your state or country is still eligible, and the market you intend to trade is still offered. Keep a dated copy of the regulator record, terms and withdrawal rules. If the result differs from your earlier check, pause until you understand why.
Re-check after a major platform change as well, such as a new corporate name, a new app publisher, a new contract category or a move to a different domain. A previously verified record may no longer identify the entity accepting your funds. Set a personal rule that an unexplained change means no deposit until the identity and authorization are reconciled.

When comparing venues, use the same evidence fields for both. A simple score based only on “regulated” versus “unregulated” hides important differences. Make a separate row for each product you might trade, because authorization and geographic access can vary within one platform.
| Comparison axis | Questions to answer | Evidence to retain |
|---|---|---|
| Regulatory status | Is there direct registration, limited relief, a state gaming license or no verifiable authorization? | Official record, category, status date and restrictions. |
| Entity and venue | Who is the legal counterparty, and is it the exchange, broker or intermediary? | Terms page, corporate name and matching regulator entry. |
| Product scope | Are the contracts political, economic, weather, sports or another type? | Representative contract rules and the authorization’s scope. |
| Geographic availability | Where can residents open accounts and trade today? Is geofencing used? | Eligibility list, current notices and applicable orders. |
| Consumer controls | What identity, age, responsible-trading, surveillance, dispute and withdrawal controls exist? | Customer agreement, disclosure and support responses. |
| Enforcement history | Are there actions, lawsuits, cease-and-desist orders or unresolved allegations? | Regulator releases and court docket information. |
If a cell cannot be verified, write “not stated” rather than filling the gap with an assumption. A platform with more transparent records is easier to evaluate, even when both claim regulatory coverage. Preserve the same date for each comparison so that a later change is visible.
Questions to answer before opening or funding an account
Verification is not limited to the regulator’s registration line. Read the customer agreement for the practical rules that determine how money enters, remains in and leaves the account. Confirm the identity and age checks, minimums, fees, collateral treatment, settlement source, cancellation rules, dispute process and withdrawal conditions. Note whether the agreement identifies a different legal counterparty from the website brand.
Ask how the platform handles a market that is voided, postponed or subject to an ambiguous result. Check whether support is available through a documented channel and whether the site publishes changes to contract rules. These questions do not replace licensing verification, but they reveal whether the operator gives you enough information to understand the product and enforce your rights.

What regulation does—and does not—protect you from
It can clarify oversight and conduct rules
Registration can identify the regulator, the legal entity, the permitted role and the rules that apply to market access, disclosures, surveillance or customer handling. The CFTC says that CFTC-regulated exchanges, brokers or other intermediaries providing access to prediction markets do not take a side of the trade. That addresses the venue’s market role; it does not predict whether your contract will win.
Knowing the regulated role can also help you direct a complaint or information request to the right authority. Keep in mind that a regulator’s jurisdiction may cover the venue’s conduct without guaranteeing the commercial terms of every contract or resolving a private dispute immediately.
It does not guarantee money or performance
Regulatory status is not a promise that an operator cannot fail, that every withdrawal will be immediate, or that a contract will settle in the way you expect. Read collateral, fees, settlement source, cancellation, dispute and withdrawal provisions separately. Never deposit money you cannot afford to have restricted while a dispute is resolved.
Do not treat registration as an endorsement of a strategy, a forecast or a promised return. A regulated venue can still list an outcome you consider unlikely, and a losing position remains a loss. Separate the question “Who oversees this activity?” from “Is this trade suitable for me?”

It does not settle every state-law question
Federal and state authorities may take different positions about a product. The Wisconsin litigation announcement from 2026 demonstrates that jurisdictional disputes remain active for some prediction-market offerings. Treat a pending case as a live uncertainty, not as proof that either side has already prevailed everywhere.
Red flags that should stop a deposit
- The site names only a brand and refuses to disclose the contracting legal entity.
- The claimed regulator or license number cannot be found in the regulator’s own database.
- The record exists, but the entity name, address or role does not match the platform’s documents.
- The authorization covers one product while the site promotes a different one, such as sports or binary options.
- The site says “legal in all states” without addressing current litigation, geofencing or contract-specific limits.
- Terms, fees, settlement sources or withdrawal rules are missing, contradictory or frequently changed without dated notices.
- Customer support tells you to rely on a logo, influencer or review instead of providing an official record.
- The platform pressures you to deposit before identity checks or disclosures are complete.
- A regulator link leads only to a generic homepage, an unrelated affiliate or an expired notice.
One red flag is not conclusive, but several together justify stopping and obtaining written clarification or choosing a venue with verifiable records. Do not allow a limited-time promotion to shorten your verification process.
A printable verification checklist
- Write down the exact legal entity, exchange name, domain, incorporation country and product type.
- Copy the regulator and license category claimed in the legal disclosures.
- Find the entity in the regulator’s official database.
- Confirm current status, registration category, address and restrictions.
- Search disciplinary, enforcement and litigation records for the entity and key principals.
- Compare the authorization with the exact contract you want to trade.
- Check your state or country’s current access rules, including sports-contract restrictions and geofencing.
- Review identity, age, surveillance, dispute, settlement and withdrawal controls.
- Save dated records, screenshots or PDFs and note the URLs used.
- Ask support to explain any mismatch in writing.
- Repeat the checks immediately before funding and after material platform changes.
Applying the checklist to common reader questions
“Is this prediction market legal?”
There is no reliable one-word answer without the entity, product and location. Verify the claimed registration, then check state or country rules and any current litigation or orders affecting that contract. A federal registration and a state dispute can exist at the same time while a case is pending.
“How do I know whether a prediction-market site is regulated?”
Find the exact legal entity in the relevant regulator’s live database, confirm its category and current status, review restrictions and enforcement history, and match the authorization to the contract you want. Treat the site’s own compliance statement as supporting evidence only.
“Is Kalshi licensed?”
Kalshi says it operates as a CFTC-regulated exchange. Treat that as a claim to corroborate by matching its exact legal entity, exchange role and current status in CFTC records before trading. Then check whether the particular market and your location are currently eligible.
Best Value
“Is Polymarket legal in my state or country?”
Check the platform’s current eligibility rules and the law where you live for the particular market. Do not generalize from another user’s access or from a different contract category. Re-check immediately before funding because geofencing and legal positions can change.
“What regulator oversees prediction markets?”
In the United States, the CFTC is the key federal regulator discussed for event-contract markets, exchanges, brokers and intermediaries. State authorities may still assert jurisdiction over particular offerings, and other countries use different regulators.
“Are sports contracts covered automatically?”
No assumption is safe. Sports or athletic-event contracts may raise different product and jurisdiction questions. Compare the exact sports contract and its settlement rules with the authorization, and check current state or country restrictions.
“What if the regulator database shows an old or inactive record?”
Do not treat an expired, withdrawn, suspended or pending entry as current authorization. Check for amended records, successor entities and enforcement notices, then ask the platform to identify the active record. If the identity or status cannot be reconciled, pause the deposit.
Bottom line
Legitimacy is established by a matching, current regulator record—not by a logo or marketing sentence. Identify the legal entity, verify its registration and disciplinary history, confirm that the authorization covers the exact contract, check your geography, and repeat the process immediately before depositing funds. Keep the dated evidence because a platform’s status and market access can change.
Frequently Asked Questions
How can I verify that a prediction-market platform is regulated?
Identify the exact legal entity, search that name in the relevant regulator’s official database, confirm the registration category and current status, review restrictions and enforcement history, and match the authorization to the specific contract and your location.
Does a CFTC registration guarantee my money or winnings?
No. Registration identifies oversight and the entity’s permitted role, but it does not guarantee solvency, immediate withdrawals, profits or a particular settlement outcome.
Quick wins for a faster PC:
Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Can a federally regulated prediction market still face state legal challenges?
Yes. Federal oversight and state assertions of gambling-law jurisdiction can coexist while litigation is pending. Check current orders and access rules for your state and the exact contract.
Are binary options the same as event contracts?
No. The CFTC distinguishes event-contract markets from other products and warns that some online binary-option platforms are not CFTC-regulated. Verify the product terms and the authorization rather than relying on the label.
Should I trust a platform’s “regulated” badge?
Use it only as a lead. Corroborate the claim in a live regulator record that names the same legal entity, role, product scope and current status.
The Bottom Line
Verify the exact entity in official regulator records, match authorization to the contract and your location, review enforcement history, and re-check everything immediately before funding.
