Before depositing, identify the platform’s legal entity, verify that entity and its intermediary in official Commodity Futures Trading Commission (CFTC) and National Futures Association (NFA) records, authenticate the website or app from the platform’s own domain, and read the exact event-contract terms. Then confirm that the service is currently available where you live and fund it only with money you can afford to lose. A registration record is a status to check at the time of deposit—not a promise of profit or protection from market losses.
What “regulated” means in a prediction market
The CFTC generally describes prediction-market products as event contracts. They are usually derivatives whose payoff depends on whether a defined event occurs. In a regulated U.S. market, the exchange and relevant intermediaries must complete an application process and undergo periodic examinations. Exchanges are expected to monitor trading for manipulation and insider trading, while intermediaries must follow customer-protection requirements.

The CFTC says regulated prediction markets have existed in the United States for more than two decades and that it has regulated prediction markets since 2004. Its timeline identifies Hedge Street Inc. as the first designated contract market approved to offer binary options in 2004. That history explains why a site can describe itself as a prediction market while actually operating a derivatives exchange, a broker, or both; the legal entity and registration category matter more than the marketing label.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteRegulation does not remove ordinary trading risks. Prices can move against you, a contract can settle at zero, and a dispute over the event definition can produce an outcome you did not expect. It also does not automatically settle the question of whether a particular product is available in every state or country. Treat regulation as a verification requirement and a source of defined oversight, not as a guarantee.

The deposit-time verification workflow
Complete these checks before sending money. Save screenshots or PDF copies of the pages you reviewed, because registration status, product lists and geographic restrictions can change.
- Write down every legal entity. Record the operator, exchange, broker and any futures commission merchant named in the account agreement, risk disclosure, footer or regulatory disclosures. A brand name alone is not enough.
- Search official records. Look up each relevant entity in the NFA BASIC database and the CFTC’s registration resources. Check the registration category, current status and any disciplinary or regulatory history.
- Match the records to the service. The legal name, address and role shown in the official record should match the names in the platform’s terms. A similar name, a different subsidiary or an expired status is a stop signal until clarified.
- Authenticate the website and app. Begin at the verified trading website and use its own links to an app store. Do not treat an app-store listing, social-media advertisement or search result as proof of authenticity.
- Read the contract specification. Confirm exactly what event is measured, how prices and payouts work, what fees or penalties apply, when the contract expires, what triggers settlement, who makes the settlement determination and how disputes are handled.
- Review account and customer protections. Look for a complete account agreement, understandable statements, a process for accessing funds and a clear complaint path to the broker, exchange, NFA or CFTC.
- Check your location. Review current state notices, court orders and the platform’s own eligibility rules. Federal registration is not a substitute for checking the law and availability where you are.
- Fund with risk capital only. Deposit only money left after living expenses and savings needs. Ignore pressure, countdowns, bonuses or claims that a deposit is guaranteed to grow.
Step 1: Identify the legal entity behind the brand
Open the site’s terms of service, customer agreement, privacy notice, risk disclosure and account-opening screens. Look for the full corporate name, jurisdiction of incorporation, principal address and the role each company performs. A platform may use one company as the exchange and another as the futures commission merchant that handles customer accounts. Both roles affect what protections and complaint procedures apply.
Write the names exactly as shown, including punctuation and suffixes such as Inc., LLC or Ltd. Then compare them with the names in NFA and CFTC records. If the site displays only a short brand, refuses to identify the operator or places the legal name behind an inaccessible document, do not deposit until you can establish who is responsible for the account.

Step 2: Verify registration and disciplinary history
Use NFA BASIC and CFTC records
NFA BASIC is the National Futures Association’s public database for checking firms and individuals involved in the derivatives industry. CFTC registration resources provide the federal regulator’s corresponding information. Search every entity you recorded, not only the exchange name. A broker or futures commission merchant may be the party that actually holds or processes your account.
Check three things on each result:
- Registration category: Confirm that the entity is registered in a category consistent with the service it offers. A record for an unrelated business activity does not validate a prediction-market account.
- Current status: Make sure the status is active or otherwise authorized for the relevant role on the date you plan to deposit. Do not rely on an old press release, cached page or a logo displayed on the platform.
- History: Read disciplinary, regulatory and membership information. A clean marketing page cannot override an official enforcement or restriction record.
Registration is time-sensitive. Recheck it immediately before funding and again if the platform changes its legal terms, domain, app publisher or account provider. The CFTC’s customer guidance warns that people who trade with unregistered entities operating outside the United States may have little or no protection.
Step 3: Prove that the website and app are genuine
Phishing sites and copycat apps can borrow a legitimate company’s name, colors and contract descriptions. The safest sequence is to type the official trading domain yourself or use a saved bookmark, open its app-download page, and follow the store link from there. Confirm that the developer or publisher name in the store matches the legal entity or an identified subsidiary in the platform’s disclosures.

Before installing, compare the domain spelling character by character. Be wary of extra hyphens, substituted letters, unusual top-level domains and links that redirect through unrelated domains. A secure connection icon is useful for encryption but does not prove that the business is regulated. Likewise, an app-store listing is not independent evidence of licensing; the CFTC specifically advises ensuring that websites and mobile apps belong to CFTC-registered entities.
After installation, open the app’s account, legal and support pages. They should lead to the same terms, privacy policy, support address and legal entity shown on the official website. If the app cannot be reached from the official site, requests payment to a personal wallet, or uses a different operator name, stop and contact the platform through a verified channel.
Step 4: Read the event-contract specification line by line
A regulated service should provide timely, transparent information about the contract. Do not rely on a headline such as “Will event X happen?” The binding specification controls your payout.
Define the event and the source
Check the precise wording, geographic scope, time zone, measurement period and source used to determine the result. A contract about an election, economic release, weather reading or sports result can turn on a particular official announcement rather than a commonly reported headline. Look for definitions of amendments, cancellations, ties and unavailable data.
Understand prices, payouts and fees
Confirm how the displayed price relates to the potential payout, whether prices can change while an order is pending, and whether the contract pays a fixed amount or varies by position. Read all commissions, exchange fees, bid-ask spreads, withdrawal charges, penalties and minimums. Determine whether fees are charged when opening, closing or settling a position.

Check disputes and corrections
Read the procedure for challenging a settlement, the deadline for a complaint, the governing law and any arbitration requirement. Find out whether an exchange committee, a designated official, an administrator or another body has final authority. Keep a copy of the version of the specification that applied when you traded.
Step 5: Inspect customer-fund and complaint protections
Account terms should explain where customer money is held, how deposits and withdrawals are processed, and what statements you will receive. They should provide a reliable way to see open positions, settled contracts, fees and transaction history. Test the support channel with a basic question before depositing; a real response that identifies the responsible entity is more useful than a generic chat widget.
Record the escalation path. The first contact is normally the broker or exchange named in your agreement. If the issue is not resolved, the documents should explain how to contact the NFA or CFTC. The existence of a complaint process does not guarantee reimbursement, but an absent or evasive process is a serious warning sign.
Step 6: Check geography and the changing legal landscape
Ask two separate questions: Is the entity registered for the activity, and may I use this product from my location today? The answers can differ. The CFTC asserts exclusive jurisdiction over U.S. commodity-derivatives event-contract markets, while state authorities have challenged aspects of that position. Court orders, state notices and platform restrictions can change access even when a federal registration record remains visible.
| Date | Official development | Practical check for a depositor |
|---|---|---|
| 2004 | The CFTC approved Hedge Street Inc. as the first designated contract market offering binary options. | Prediction markets have a history within regulated U.S. derivatives markets; verify the current entity rather than relying on historical status. |
| February 17, 2026 | The CFTC filed an amicus brief asserting exclusive jurisdiction over U.S. commodity-derivatives event-contract markets. | Federal and state positions are part of an active legal dispute, so review current notices and platform eligibility before funding. |
| March 12, 2026 | The CFTC issued an advisory reminding designated contract markets about Commodity Exchange Act Part 38, Core Principle 3 and product-submission obligations. | Check that newly offered contracts and the exchange’s disclosures reflect current regulatory requirements. |
Do not treat any one of these developments as a permanent nationwide legal conclusion. If your state has issued a notice, a court has entered an order, or the platform blocks residents of your jurisdiction, follow the current restriction. When the position is unclear, obtain advice from a qualified lawyer familiar with derivatives law before depositing.
A practical comparison sheet for two platforms
When choosing between services, compare the same evidence rather than comparing advertising claims. Use a separate row for each platform and fill it from documents you can verify.

| Comparison point | Evidence to record | Why it matters |
|---|---|---|

| Authenticity | Official-domain link to the app, matching publisher and matching legal pages | Reduces the chance of funding a copycat site or app. |
| Availability | Current state or country eligibility, notices and court orders | Registration alone does not establish that you may trade. |
| Trading costs and liquidity | Published fees, spreads, order rules and observable ability to enter or exit | Costs and thin trading can materially affect the result even when the market is legitimate. |
Red flags that should stop a deposit
The CFTC warns about unregistered entities and promises that sound too good to be true. Treat the following combination of signals as a reason to stop and verify independently:
Free tools Windows power users keep installed
One-click scans. No signup required.
- Promises of huge payoffs, guaranteed returns or “free money.”
- Celebrity endorsements or glowing reviews presented instead of registration details.
- Pressure to deposit immediately, countdown timers or claims that an opportunity will disappear.
- Grammatical errors, copied legal text, missing headquarters or no usable customer-service information.
- An app that cannot be reached through the official trading website or whose publisher name does not match the disclosures.
- A request to send funds to a personal bank account, gift card, cryptocurrency wallet or unrelated payment processor.
- Terms that omit the event source, settlement authority, fees, expiration or dispute process.
- A legal name that differs between the website, app, account agreement and NFA or CFTC record.
One minor design flaw is not proof of fraud, but several unresolved inconsistencies are enough to decline the deposit. Contact the regulator or the company through an independently verified channel; never use a phone number supplied only in a suspicious advertisement.
If the checks do not line up
The entity cannot be found
Do not assume a spelling difference explains the problem. Recheck the exact legal name and search the operator, exchange and intermediary separately. If none appears in official records, do not fund the account.
The record exists but the status is unclear
Pause. Ask the platform which entity is responsible, why the status differs and which contracts are covered. Obtain the explanation in writing and verify it against the regulator’s records. Marketing language is not a substitute for a current registration status.
The contract is understandable but your location is restricted
Respect the restriction. Do not use a virtual private network, a borrowed address or someone else’s account to bypass it. The restriction may reflect a state order, a court ruling or the platform’s compliance policy, and bypassing it can create additional legal and account risks.
You already deposited and now see warning signs
Stop adding funds. Download statements and contract specifications, record the transaction dates and contact the platform through the verified support address in the legal documents. If withdrawals are blocked or the entity will not respond, preserve all communications and consider reporting the matter to the NFA, CFTC and relevant law-enforcement or consumer-protection authorities. Do not pay a third party that promises to recover the money for an upfront fee.
Best Value
Use risk capital and document your decision
The CFTC advises using money you can afford to risk after living expenses and savings needs. Set a maximum deposit before opening the account, and do not increase it because of a losing position, a promotional bonus or a message from support. Understand that a regulated market can still produce rapid losses and that liquidity may be insufficient when you want to exit.
Keep a dated file containing the legal-entity names, registration searches, contract version, fee schedule, eligibility page, deposit confirmation and screenshots of the app publisher. This record helps you identify what you agreed to and gives a complaint reviewer the facts needed to investigate.
Bottom line: the standard to meet before funding
Deposit only after you can answer, in writing, all of these questions: Who is the legal operator? Which registered exchange, broker or futures commission merchant handles the account? What do NFA BASIC and CFTC records show today, including disciplinary history? Did the official domain authenticate the app? What exact event, price, payout, fee, expiration and settlement authority govern the contract? What complaint and withdrawal protections are documented? Is the product currently available in your jurisdiction despite ongoing federal-state disputes?
If any answer is missing, contradictory or based only on an advertisement, wait. The safest decision is often to leave the money in your bank account until the identity, registration, contract and geographic status can be independently verified.
