There is no single nationwide answer for every firearm sale. To find out whether a check is required, identify the buyer’s and seller’s states, who is making the transfer (a licensed dealer or an unlicensed person), and whether the transaction is a sale or another kind of transfer. Federal law sets a baseline; state and local rules can add requirements.
How to check whether a specific sale requires a background check
- Write down the locations. Identify the buyer’s state of residence, the seller’s state of residence, and where the transfer will take place. A same-state private transfer and an interstate transfer are treated differently under federal law.
- Identify the seller and transaction. Is a federal firearms licensee (FFL) making the transfer, or are both parties unlicensed individuals? Also determine whether the transaction is a sale, gift, or another transfer; the relevant state rules may depend on those details.
- Check ATF’s Brady State Lists. The lists show whether the FBI, a state agency, or a partial state point of contact handles NICS checks in each state. ATF’s lists were last updated February 10, 2026. They identify who handles checks, not every state rule governing whether a particular transfer requires one.
- Read the current rules for the state or states involved. Check official guidance from the relevant state police, attorney general, or legislature. Look specifically for private-transfer requirements, permits, waiting periods, firearm-type distinctions, and other conditions. For an interstate transfer, check the recipient’s state as well.
- Ask an official authority or an FFL if the result is unclear. A licensed dealer can explain whether it offers private-transfer facilitation and what process applies. For a specific transaction, confirm the current rules with the relevant state authority or a licensed dealer before transferring the firearm.
Does a private gun sale require a background check?
For a same-state transfer between two unlicensed people, federal law generally does not require the parties to use an FFL or keep federal transfer records. That federal baseline does not settle the question for every transaction: state or local law may require a background check, an FFL, a permit, or other conditions. ATF’s Firearms Questions and Answers page, last updated January 15, 2026, cautions that state or local laws may govern these transfers.

Federal law also prohibits a person from transferring a firearm when they know or have reasonable cause to believe the recipient is prohibited from possessing it. ATF addresses this requirement in its guidance, “Do I need a license to buy and sell firearms?” A private seller should not treat the absence of a federally required dealer check as permission to transfer to a prohibited person.

When an FFL transfers a firearm to an unlicensed person, the general federal rule is that the dealer must initiate a National Instant Criminal Background Check System (NICS) check before the transfer, unless a narrow federal exception applies. The dealer must also follow applicable state requirements.

A qualifying state permit may serve as an alternative to a NICS check only if it meets federal criteria and ATF has assessed it as qualifying. A dealer is not required to accept a permit as a substitute and may contact NICS if there is reason to question whether the permit is valid or qualifies. ATF’s Brady Permit Chart lists permits assessed for this purpose; check the current chart and the dealer’s process rather than assuming any firearm permit qualifies.
If the FBI check is delayed
The FBI says that if it cannot make a determination within three business days, federal law may allow the FFL to transfer the firearm unless state law prohibits it. This is not a guarantee that a delayed purchase will be released: state law may bar transfer after an unresolved delay, and the dealer must follow the rules that apply to the transaction.

Can a private seller transfer a firearm to someone in another state?
Generally, an unlicensed person cannot directly transfer a firearm to an out-of-state resident. The standard procedure is to send it to an FFL in the recipient’s state, where the dealer completes the lawful transfer to the buyer. The recipient-state dealer’s process, the applicable background check, and state restrictions still matter. Limited exceptions may apply, so confirm any claimed exception against official guidance before arranging delivery.
Can a gun dealer run a background check for a private sale?
Yes. ATF says an FFL may voluntarily facilitate a private sale; federal law does not require a dealer to offer the service. If the dealer agrees, it must follow the applicable Form 4473, NICS, and recordkeeping process, along with stricter state requirements where applicable. Ask the dealer whether it handles private transfers, what steps it requires, and what state-specific conditions apply. The option of dealer facilitation does not replace any separate requirements imposed by state or local law.
