First identify the legal entity that will owe you money, verify that entity’s permission in the relevant regulator’s official register, and then examine the contract, custody arrangements, liabilities, liquidity and insolvency terms. A regulator logo, an anti-money-laundering registration or a proof-of-reserves page does not by itself show that a yield product is authorised or that you will recover your crypto in a failure.
The practical test is whether you can trace a specific product to a specific regulated (or honestly unregulated) entity, understand exactly how the return is generated, and find credible evidence that assets and liquidity cover customer claims under the governing law. Treat unexplained yield, incomplete liabilities, rehypothecation rights and withdrawal restrictions as material risks rather than minor fine print.

What “regulated” means for a crypto yield account
Crypto regulation is activity-specific and jurisdiction-specific. A firm may be registered for anti-money-laundering purposes while having no authorisation to offer lending, staking, custody, brokerage or investment advice. Registration can also apply to one subsidiary while your yield agreement is with another company in a different country.
The Financial Conduct Authority (FCA) states that registration under the Money Laundering Regulations is a legal requirement to carry on business, “not a recommendation or endorsement of your business.” Its register guidance says to check that a firm’s permissions and activities match the service it is providing. FCA registration alone does not guarantee Financial Services Compensation Scheme or Financial Ombudsman protection.

In the United States, securities laws can apply to crypto lending and staking products. A FINRA BrokerCheck record can confirm registration and disciplinary history for a covered broker or adviser, but it does not prove that a particular crypto yield product is registered or that customer assets are safe. The SEC’s investor guidance says that “the risk of loss for individual investors who participate in transactions involving crypto assets, including crypto asset securities, remains significant.”
Step 1: Map the product to the exact legal entity
Ignore the consumer-facing brand until you can identify the company named in the agreement and the entity that holds or controls your assets. Save a copy of the terms in force when you open the account; websites and app screens can change.
Record these details
- Full legal name, company or registration number and place of incorporation.
- Parent company, subsidiaries, affiliates and any special-purpose borrower.
- The contracting entity named in the yield, lending or staking agreement.
- Custodian, wallet operator and the location where private keys are controlled.
- Governing law, courts or arbitration forum, and the address for legal notices.
- Official support email, telephone number and website domain shown in the legal documents.
Compare every detail with the regulator’s register and the contract. A mismatch between the app, domain, support contacts and registered entity can indicate that you are dealing with an unlicensed affiliate, a clone site or a product outside the entity’s permission.

Step 2: Verify the permission in an official register
- Choose the right jurisdiction. Start with the country or state where you are onboarded and where the contracting entity claims to operate. Do not rely on a register from a country that has no legal connection to your account.
- Search the exact legal name and registration number. Check spelling, former names, status, addresses and authorised representatives. Use contact details displayed in the register, not a telephone number supplied by an advertisement or chat agent.
- Read the permission scope. Match the listed activities to what you will do: lending, staking, custody, brokerage, dealing, arranging transactions or investment advice. A general financial registration may not cover a crypto interest account.
- Check restrictions and warnings. Read limitations, geographic exclusions, appointed representatives, suspension notices and enforcement information. “Authorised” is not the same as “approved,” “safe” or “government guaranteed.”
- Confirm the product itself. Ask the firm to identify the regulated entity and permission that cover the specific yield product, in writing. If it cannot do so, treat the product as unregulated even if an affiliated company appears in a register.
United Kingdom timing matters
The FCA published final cryptoasset standards on 30 June 2026. Those rules apply to firms authorised under the Financial Services and Markets Act regime on or after 25 October 2027. A firm’s status today therefore depends on the transitional and existing permissions that actually appear in the register; do not assume that a future framework already protects a current account.

United States checks
Search SEC filings, state licensing records and FINRA BrokerCheck where relevant to the entity and product. BrokerCheck can reveal whether a covered broker or adviser is registered and whether disciplinary events are recorded. It cannot establish that a crypto yield arrangement is a registered security, a bank deposit or an insured account. Ask which federal or state rule permits the exact activity and which entity holds customer assets.
Step 3: Find out where the yield comes from
An attractive annual percentage yield is compensation for risk. Require a plain-language explanation that connects your deposited asset to a source of return and identifies who bears losses.
Questions the platform should answer
- Are returns generated by secured loans, unsecured borrowers, market making, validator rewards, protocol incentives, proprietary trading or token emissions?
- Who are the borrowers or counterparties, and what are their collateral, margin-call and liquidation rules?
- What is the maximum exposure to one borrower, affiliate or blockchain protocol?
- Can the platform change rates, suspend withdrawals, substitute assets or reinvest collateral without your consent?
- Are returns paid in the deposited asset, another token or newly issued platform tokens?
- What happens when a borrower defaults, a validator is slashed, a protocol is exploited or a token becomes illiquid?
“Guaranteed” or unusually high yield with no identifiable source is a warning, not evidence of superior management. If the explanation is a list of strategies without counterparties, collateral values, limits or loss-allocation rules, you cannot assess the credit, market or liquidity risk.
Step 4: Test solvency instead of accepting a reserve headline
Solvency means that the value of assets available to satisfy claims is sufficient for the liabilities owed, taking account of valuation, liquidity and legal priority. A wallet screenshot or reserve ratio can address only a narrow part of that question.

What to request
- Audited financial statements, the audit firm, the reporting period and the accounting standard used.
- A complete schedule of customer liabilities, including accrued interest, pending withdrawals, loans, derivatives and off-chain obligations.
- Details of assets supporting those liabilities, including who controls them, their liquidity and any encumbrances.
- Affiliate loans, related-party transactions, pledged collateral and assets that cannot be withdrawn promptly.
- Auditor opinions, qualifications, going-concern language and any gap between the reporting date and today.
The SEC explains that proof-of-reserves is a voluntary method for offering evidence about selected crypto assets. It may be a point-in-time snapshot, omit liabilities and fail to show how assets were used between checks. The SEC also says that these reports and the reviews behind them are not equivalent to financial-statement audits performed under PCAOB standards.
How to read a proof-of-reserves report
| Evidence shown | What it may establish | What remains unknown |
|---|---|---|
| Blockchain wallet balances at a stated time | Control or access to the listed on-chain balances at that moment, subject to the method used | Customer liabilities, borrowed funds, off-chain assets, ownership disputes and future liquidity |
| Signed message or cryptographic tree of account balances | That selected claims were included in a calculation | Completeness of the customer list, hidden liabilities, exclusions and legal enforceability |
| Attestation or verification letter | A limited procedure defined by the provider or reviewer | Whether the work was an independent audit, its assurance level, scope and treatment of liabilities |
| Reserve ratio above 100% | An arithmetic comparison under the report’s definitions | Asset quality, price volatility, withdrawal queues, encumbrances and bankruptcy priority |
No authoritative statistic shows how reliably proof-of-reserves predicts solvency or customer recovery across crypto yield platforms. Treat it as one dated data point, not a solvency certificate. Compare the reported assets with total customer claims and ask what happens if the largest assets fall sharply in value or cannot be sold.
Step 5: Read custody, rehypothecation and insolvency clauses
Your recovery in a bankruptcy depends more on the contract, custodian and jurisdiction than on the marketing description of an account.
Ownership and use of your crypto
- Does title remain with you, or do you transfer ownership to the platform in exchange for a contractual claim?
- May the platform lend, pledge, stake, commingle or rehypothecate your assets without separate consent?
- Are wallets segregated by customer, pooled by asset or recorded only as an internal ledger balance?
- Who controls private keys, how many signers are required, and what happens if a custodian fails?
- Can the platform substitute an equivalent token, settle in cash or use your assets to satisfy another customer’s claim?
Priority if the platform fails
Find the clause that describes your ranking against secured lenders, employees, tax claims and general unsecured creditors. “Segregated” is meaningful only if local law recognises the arrangement and records are sufficient to identify your assets. If you transferred title, you may be an unsecured creditor rather than an owner seeking return of specific coins.

FINMA’s custody guidance, updated 12 January 2026, warns that foreign custody can create complex legal issues, especially if the custodian becomes insolvent. Determine which country’s insolvency law applies to each custodian and whether customer assets are excluded from that custodian’s bankruptcy estate.
Step 6: Check whether any protection scheme actually applies
Do not treat a crypto interest account as a bank deposit or brokerage account merely because a platform uses a bank, trust company or broker. FDIC, NCUA and SIPC protection depends on the insured institution, account structure, asset type and applicable rules. Crypto held in an interest-bearing account generally does not receive automatic coverage.
Ask for the name of the actual insured institution, the account registration, the assets covered and the limits. Verify the answer directly with the institution or scheme using independently sourced contact details. If the platform says that FCA registration provides FSCS or Financial Ombudsman protection, check the precise eligibility rules; FCA registration alone does not create either protection.

Step 7: Run a small operational test before committing more
A successful small withdrawal cannot prove solvency, but it can reveal operational friction before your exposure is large.
Best Value
- Read the current withdrawal policy for each asset and chain.
- Check minimums, maximums, daily limits, notice periods, network fees, spread, lockups and early-exit penalties.
- Confirm identity-verification requirements and whether withdrawals can be frozen during reviews.
- Deposit an amount you can afford to leave at risk.
- Request a withdrawal to a wallet you control and record the request time, transaction hash and amount received.
- Compare the result with the stated policy. Escalate unexplained delays, changed terms, partial fulfilment or pressure to cancel.
Do not interpret a processed withdrawal as proof that all customers could withdraw simultaneously. Liquidity can disappear during a market shock, and a platform can change its terms after your test.
Red flags that should stop an increase in exposure
- Reserves are displayed without a complete liability schedule.
- A report is called an attestation or verification but gives no audit standard, scope, independence or assurance level.
- Wallet balances exclude off-chain assets, affiliate borrowing or customer claims.
- Yield is unusually high or described as guaranteed without a traceable source of return.
- Lending is unsecured, concentrated in a few counterparties or routed through opaque related parties.
- Withdrawals are queued, frozen or subject to unilateral lockups.
- Legal terms permit rehypothecation or place customers behind general creditors.
- Register details do not match the app, website, domain, legal entity or support contacts.
- The platform refuses to identify its custodian, governing law, auditor or liability totals.
- Management, ownership, jurisdiction or key personnel change without a clear customer notice.
Compare two platforms with one evidence table
When two products remain under consideration, fill in the same fields for both. “Not stated” is a finding that requires follow-up, not a neutral assumption.
| Comparison field | Evidence to record | Decision question |
|---|---|---|
| Legal entity and permission | Exact name, number, jurisdiction and register entry | Does the permission cover this activity and customer location? |
| Governing law | Contract, courts and insolvency forum | Where would a claim be brought? |
| Yield source | Borrowers, collateral, validator or trading activity, fees and token emissions | Can the return be explained and stress-tested? |
| Assets versus liabilities | Audit date, standards, total customer claims and liquid assets | Are liabilities complete and assets available? |
| Custody | Custodian, key control, segregation and rehypothecation rights | Do you retain title and can assets be traced? |
| Liquidity | Notice, lockups, limits, queues and withdrawal history | Can you exit under normal and stressed conditions? |
| Insolvency priority | Customer ranking, trust language and security interests | What recovery position would you have? |
| Insurance | Named scheme, insured institution, eligibility and exclusions | Is protection legally applicable to this account? |
| Counterparty transparency | Names, concentration, collateral and related-party exposure | Could one failure impair the platform? |
| Disciplinary history | Register warnings, enforcement and material litigation | Are there unresolved conduct or compliance concerns? |
Monitor after onboarding
Authorisation and solvency are changeable conditions. Set a recurring review rather than treating your opening checks as permanent.

- Review changes in ownership, directors, custodians, auditors and key counterparties.
- Search official enforcement notices, court records and bankruptcy filings.
- Reassess whether the yield source still exists and whether concentration or collateral has changed.
Reduce or stop deposits when a platform changes its legal entity, moves custody abroad, delays withdrawals, subordinates customer claims or cannot explain a material gap between assets and liabilities. Do not wait for a formal insolvency filing to act on evidence that your access or priority has deteriorated.
A practical go/no-go decision
Proceed only when all of these statements are supported by documents you can verify:
- You know the contracting entity and its jurisdiction.
- An official register confirms a permission that matches the exact product, or the platform clearly discloses that it is outside a protective regime.
- The yield source, counterparties, collateral and loss rules are understandable.
- Financial evidence addresses both assets and complete customer liabilities.
- The custody contract explains title, segregation, key control and rehypothecation.
- You understand your insolvency ranking and have not mistaken a promise to repay for ownership of coins.
- Any insurance claim has been confirmed with the actual scheme or institution.
- A withdrawal test met the published terms without unexplained friction.
If one of these conditions cannot be verified, size the position as money that could be frozen or lost, not as a cash equivalent. The absence of evidence is itself a risk factor.
The Bottom Line
Verify the legal entity and activity-specific permission first; then test liabilities, custody, liquidity and insolvency priority. Proof-of-reserves and a regulator logo are incomplete evidence, and crypto interest accounts are not automatically insured.
