How to Check Whether a Crypto Platform Is Registered With the SEC or CFTC

There is no single SEC or CFTC registry for every crypto website. The correct check depends on what the platform does: investment advice and securities activity point to SEC and FINRA records, while futures, options, forex, commodity pools and other derivatives point to the CFTC and NFA. A spot-only virtual-currency service is not required to register with the CFTC solely for spot trading, but that does not answer SEC, state or money-transmission questions.

The most reliable process is to identify the legal entity, classify each product, search the appropriate public databases and then match every result to the website you plan to use. These checks are free, but they require the exact name and careful reading of status, dates and disclosures.

Start with the platform’s legal identity

Do not begin with a logo, app name or “regulated” badge. Write down the exact information the platform publishes:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Legal company name, including corporate suffixes such as Inc., LLC or Ltd.
  • Trading name and every website domain or app publisher name.
  • Headquarters and any U.S. office address.
  • Regulators the company claims to work with.
  • Names of executives, advisers, broker-dealers, introducing brokers or other representatives.
  • Terms of service, risk disclosures, privacy policy and any Form ADV or registration number the firm provides.
  • The name on deposit, withdrawal and custodial instructions, which may be different from the consumer-facing brand.

Search the legal entity and associated people, not just the consumer-facing brand. A database result for a similarly named company is not proof that it is the same business. Record former names, parent companies and affiliates too, because a platform may claim that a registration belongs to another entity.

Save the pages as PDFs or screenshots and note when you checked them. Websites can change their terms, domains and claimed licenses. Keep the exact URL, telephone number and address shown at the time you make your decision.

Classify what the platform actually does

The activity determines which regulator’s records matter. Read the product description, customer agreement, fee schedule and risk disclosures, then place each service in the closest category.

What the platform offers Primary records to check Why the distinction matters
Personalized investment advice about securities or digital assets treated as securities SEC Investment Adviser Public Disclosure (IAPD) Adviser registration, reporting status, Form ADV and disciplinary disclosures are recorded there when applicable.
Buying or selling securities for customers, soliciting trades or operating a securities-trading interface Investor.gov, FINRA BrokerCheck and the relevant state securities regulator A platform that enables securities trading may have broker-dealer obligations. Brokers generally must register with the SEC and become FINRA members.
Commodity futures, options, forex, commodity pools or virtual-currency derivatives NFA BASIC and CFTC-related records NFA BASIC can show registration, regulatory or disciplinary history and available financial information.
Only buying or selling virtual currency on the cash (spot) market No CFTC registration solely because of spot trading; check SEC, state and other licensing issues separately The CFTC states that spot-market virtual-currency websites are not required to register with it solely for that activity.

One company can fall into more than one category. For example, an exchange may offer spot purchases, a separate futures product and an advisory service. Check each legal entity and product rather than applying one conclusion to the entire brand. A platform may route one service through an affiliate, so identify the entity named in the agreement for each product.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Look for words that signal a regulated activity: “managed account,” “portfolio management,” “recommendations,” “broker,” “dealer,” “margin,” “perpetual,” “futures,” “options,” “forex,” “pool” and “yield strategy.” Marketing language is not a legal conclusion, so confirm what the customer agreement says the company actually does.

Check investment-adviser status in IAPD

IAPD is the SEC’s public system for finding investment advisers and associated individuals. It displays registration or reporting information, business details, Form ADV filings and disciplinary disclosures. Use the current firm-search function rather than relying on an old search result or a link supplied by the platform.

Step 1: Search the firm

  1. Open the current firm-search function in the Investment Adviser Public Disclosure system.
  2. Enter the exact legal name you recorded. Try distinctive portions of the name, former names and the adviser’s principal office if the first search produces no result.
  3. Compare the result’s address, telephone number, website, business names and representatives with the platform’s own disclosures.

Search a parent or affiliate only as a follow-up. A result for a similarly named adviser does not authorize a separate exchange or website.

Step 2: Read the status, not just the name

Check whether the entry is currently SEC-registered, reporting, inactive or otherwise shown under a different status. Review effective dates and the jurisdictions listed. An old filing or a historical result does not establish that the firm is currently registered. Note whether the record identifies an SEC registration, a state reporting arrangement or another status that limits what the firm may do.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 3: Open Form ADV and disclosures

Form ADV describes the adviser’s business, ownership, clients, fees, conflicts and disciplinary information. Read the brochure and relevant supplements for the service you are considering. Look for custody arrangements, affiliated businesses, compensation and conflicts involving tokens or trading venues. Disciplinary disclosures do not automatically prove current wrongdoing, but they are a reason to investigate dates, findings and resolutions.

Step 4: Search people as well as firms

Advisers and representatives can appear under their individual names. Search the named portfolio manager, adviser or solicitor when the platform identifies one. Match employment and address information before treating a personal record as evidence about the platform. A person’s registration may relate to a different employer, activity or period.

Step 5: Ask about a missing IAPD entry

An absent IAPD result can mean the legal name is wrong, the firm is registered with a state rather than the SEC, an exemption or reporting status applies, the service is not investment advice, or the firm is unregistered. Ask the company for the precise entity name and legal explanation in writing, then confirm that explanation with the relevant regulator. Do not accept a screenshot without matching the underlying record.

Check broker-dealer claims

If the service executes or intermediates securities trades, check both federal and industry records. The SEC explains that “brokers generally must register with the SEC and become members of the Financial Industry Regulatory Authority (FINRA).” Operating a platform that enables securities trading can itself raise broker-dealer questions, even when the site calls itself an exchange or technology provider.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Investor.gov

Use the SEC’s Investor.gov broker and investment-professional lookup to search the legal entity and the people dealing with customers. Review the firm’s registration details, business names and any reported disciplinary information. Confirm that the record covers the activity and location in which you will transact, not merely a historical or unrelated registration.

FINRA BrokerCheck

Search the firm and each registered representative in FINRA BrokerCheck. Compare the record’s official name, locations, registration categories, current status, former names and disclosures with the platform’s documents. Read customer complaints, regulatory events, settlements and termination information in context, including dates and outcomes. A representative’s clean record does not establish that an unrelated website is authorized to hold your assets.

Confirm with the state regulator

Federal and FINRA records do not answer every state-law question. Contact the securities regulator in the state where the company operates or where you live. Ask whether the exact entity is registered, notice-filed, exempt or subject to an order, and whether the registration covers the service being offered. A state notice or exemption is not interchangeable with SEC registration, and requirements can differ between the firm and an individual representative.

Check the interface and contracting entity

Identify who actually accepts your order, holds funds, provides statements and controls withdrawals. A technology company may display a broker-dealer’s name while your contract is with a different affiliate. Match the legal name in the customer agreement, trade confirmations and funding instructions to the Investor.gov and BrokerCheck records.

Check derivatives status in NFA BASIC

For futures, options, forex, commodity pools and other derivatives, use the National Futures Association’s BASIC system. It is the CFTC-related public check for firms and individuals. The CFTC’s consumer guidance says: “Before working with any person or firm to trade in commodity futures, commodity pools, options, forex, or other derivatives, verify that the entity is properly registered with the CFTC.”

  1. Search the exact legal company name and every person who solicits or manages accounts.
  2. Try former names, initials and distinctive portions of the name if the first search fails.
  3. Open the result whose address, telephone number and business names match the platform.
  4. Review registration categories, current status, registration dates and listed principals or associated persons.
  5. Read regulatory and disciplinary history, including cases that were resolved or closed.
  6. Review available financial information and disclosures, particularly for a futures commission merchant, introducing broker or commodity-pool operator.
  7. Confirm that the registration category fits the specific product, leverage and customer relationship you are considering.

NFA BASIC can show that a firm or individual has a registration or regulatory history; it does not certify profitability, solvency beyond the information disclosed, or the safety of a token. A clean search also does not prove that a website using the same name is genuine. Match the address, domain, representatives and payment instructions.

If the platform advertises “perpetual futures,” leveraged crypto contracts or a pooled strategy, do not classify it as spot trading merely because the underlying asset is virtual currency. Ask which legal entity offers the contract and which registration category it relies on.

Understand the spot-market limitation

A company that only lets customers purchase or trade virtual currency for immediate delivery on the cash or spot market is not required to register with the CFTC solely because it offers that spot service. The CFTC’s guidance states that “Websites or companies that offer customers the ability to purchase or trade virtual currencies on the cash or spot market are not required to be registered with the CFTC.” This is a narrow statement about CFTC registration; it is not a general approval of the company.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Spot trading can still raise separate questions about securities laws, state money-transmitter or virtual-currency licensing, consumer-protection rules, sanctions compliance and foreign regulation. If the same platform offers leverage, perpetual contracts, futures, options, forex or pooled investment products, check the derivative or advisory records as well. A “spot only” label on a home page is not enough if the terms permit borrowing, margin or contracts settled later.

Interpret what you find

Record wording or result What it can mean What to do next
Currently registered The named entity appears in the regulator’s current record for a specified activity. Confirm that the address, domain, product and representatives match. Registration is not an endorsement or guarantee.
Notice filed or reporting The firm may be subject to a filing or state notice regime rather than the status you expected. Read the filing and ask the firm which regulator accepts its notice and what services it covers.
Exempt An exemption may remove a registration requirement under particular conditions. Ask for the legal basis, scope and expiration or conditions of the exemption. Do not treat “exempt” as equivalent to “registered.”
No result The name may be wrong, the entity may use another legal name, the activity may not require that registration, or the firm may be unregistered. Try the exact legal name, former names and associated people. Ask the company for a written explanation and verify it with the regulator.
Disciplinary or regulatory disclosure The firm or person has a reported action, settlement, restriction or other disclosure. Read the underlying document, dates and outcome before deciding whether the risk is acceptable.
Inactive or historical record The firm or person may no longer hold the status shown for the period you care about. Check effective dates and current status, then confirm authorization for the product today.

“Licensed,” “registered,” “notice filed” and “exempt” are different legal descriptions. Use the wording shown by the regulator and do not convert one into another. A registration may cover only a particular entity, state, product or time period.

Match the database record to the website

Before sending money, compare every important identifier:

  • Legal name and corporate suffix.
  • Website domain and app publisher.
  • Headquarters, U.S. address and telephone number.
  • Names of directors, advisers, brokers and solicitors.
  • Registration numbers, effective dates and products covered.
  • Bank or custodial account name shown in funding instructions.
  • Email domains, social-media handles and support contacts.

Stop if the platform refuses to identify the legal entity, uses a regulator’s logo without a matching record, directs payment to an unrelated person, or claims that a registration belongs to an affiliate. Be especially cautious when a representative pressures you to act before you can verify a record, asks for cryptocurrency payments to a personal wallet, or says a “compliance deposit” is needed to release a withdrawal.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Contact the regulator through a contact method you obtain independently, not one supplied only by the platform. Ask whether the domain, phone number and named representative are associated with the registered entity. Do not assume that a copied certificate, registration number or seal is authentic.

What registration does—and does not—tell you

Registration is a threshold compliance signal. It does not mean the SEC, CFTC, FINRA or a state regulator recommends the platform, approves its tokens, guarantees withdrawals or insures you against losses. The SEC states that it does not approve or endorse particular securities, issuers, products, services, credentials, firms or individuals.

A registered firm can still suffer a cyberattack, make poor investments, impose fees you dislike or become insolvent. Registration also does not eliminate market, custody, liquidity, operational or counterparty risk. Conversely, an absent record can reflect a wrong legal name or a lawful exemption rather than fraud. The CFTC warns that many scams involve unregistered entities, people or products, while also explaining that registration itself does not protect customers from fraud.

Treat a database search as one part of due diligence. Read custody and withdrawal terms, understand fees and conflicts, test whether contact information works, and avoid transferring more than you can afford to lose while unresolved discrepancies remain.

A practical pre-funding checklist

  1. Save screenshots or PDFs of the platform’s legal disclosures, terms and funding instructions.
  2. Write down the exact entity, domain, address and people connected with your account.
  3. Classify every product as advice, securities, spot virtual currency or derivatives.
  4. Search IAPD for advisers and Investor.gov plus FINRA BrokerCheck for broker-dealer activity.
  5. Search NFA BASIC for futures, options, forex, pools and other derivatives.
  6. Check the appropriate state regulator for state registration, notice or exemption information.
  7. Read disciplinary records and verify that dates and outcomes are understood.
  8. Compare the record’s address, phone, domain, representatives and registration dates with the platform.
  9. Ask the firm to explain any mismatch in writing, then confirm the explanation with the regulator.
  10. Confirm that the account, custody and payment names belong to the same legal entity or a clearly identified authorized affiliate.
  11. Do not transfer funds until the identity and authorization match the exact product you intend to use.

Current SEC context for crypto interfaces

An SEC staff statement issued April 13, 2026, provides current context for analyzing certain crypto-asset-securities user interfaces and broker-dealer questions. It does not create a universal “crypto exchange registration” category. The activity-based approach remains essential: determine whether the interface involves securities, investment advice or another regulated function, then use the corresponding records.

Because guidance and business models can change, rely on the current database entry, filing and regulator contact rather than a marketing claim that cites an older announcement. Ask which entity the statement applies to and whether the product you are using falls within the described activity.

Where to report concerns

If you find impersonation, misleading registration claims, refusal to return funds or suspicious payment instructions, preserve communications, transaction hashes, account statements and website addresses. Contact the relevant SEC, FINRA, CFTC, NFA or state regulator through its official consumer-reporting channel. Include the legal name, domain, wallet addresses, dates, amounts and names of people involved so the agency can distinguish the complaint from a similarly named business.

A report does not guarantee recovery, so avoid sending additional money to anyone promising to recover a loss for an upfront fee. Notify your bank, card issuer or payment provider promptly when appropriate, secure your accounts and preserve evidence before deleting messages or closing the platform account.

Frequently Asked Questions

Is there one SEC or CFTC database for every crypto exchange?

No. There is no universal crypto-platform registry. Use IAPD for investment advisers, Investor.gov and FINRA BrokerCheck for broker-dealer activity, and NFA BASIC for futures, options, forex, commodity pools and other derivatives.

How do I check a crypto platform that only sells coins for immediate delivery?

A spot-only virtual-currency service is not required to register with the CFTC solely for spot trading. Check the exact legal entity with state securities, money-transmission or virtual-currency authorities and examine whether the platform also offers securities, leverage or derivatives.

What if the platform is not listed in IAPD or NFA BASIC?

A missing result can mean a wrong or incomplete legal name, a different regulated activity, an exemption, a state filing or an unregistered firm. Search former names and associated people, ask the company for a written explanation and verify it independently with the regulator.

Does registration mean my money is safe?

No. Registration is not an endorsement, investment recommendation, insurance policy or guarantee against fraud, insolvency, cyberattacks or losses. Read the firm’s disclosures and assess custody, fees and conflicts separately.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Should I trust a regulator logo or registration number on the website?

Not by itself. Match the number and legal name in the official database, then compare the address, domain, representatives, effective dates and product covered. Contact the regulator using independently obtained contact details if anything differs.

What is the difference between registered, licensed, notice filed and exempt?

They are distinct legal descriptions. A notice or exemption may satisfy a particular filing or condition without being the same as registration. Use the regulator’s exact wording and ask what activity, entity, jurisdiction and dates the status covers.

Do I need to check both the company and the salesperson?

Yes. Search the platform’s legal entity and every adviser, broker, solicitor or account manager named in your documents. A person’s record may belong to another employer or activity, so match employment and address information.

Where can I report a fake registration claim or withdrawal scam?

Preserve messages, payment instructions, transaction hashes and web addresses, then use the official reporting channel of the SEC, FINRA, CFTC, NFA or relevant state regulator. Do not pay an upfront fee to a supposed recovery service.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Bottom Line

Identify the exact legal entity, classify every product and use the matching official database: IAPD for advisers, Investor.gov and FINRA BrokerCheck for securities intermediaries, and NFA BASIC for derivatives. Match names, domains, addresses, people and effective dates before funding. A missing record requires investigation, while a registration is only a compliance signal—not an endorsement or guarantee.
