How to Check AI-Generated Game Assets and Code for Copyright and Security Risks

Do not ship an AI-generated game asset or code change until you can show where it came from, what a human contributed, which licenses apply, and why the file is safe. Prompts by themselves do not establish U.S. copyright authorship. Human-created expression, creative arrangement, or meaningful modification may be protectable, while copied characters, code, music, trademarks, secrets, malicious packages, and unreviewed dependencies can create legal or security exposure. Use the workflows below for every sprite, texture, mesh, animation, sound, dialogue line, shader, script, and binary, then check the rules of each store and country where you will release.

What you are actually checking

An AI-assisted game release has several separate risk questions. Copyrightability asks whether your studio created protectable expression. Infringement asks whether the result or its inputs unlawfully copy someone else’s work. Contract review asks whether the model, asset, package, or reference permits your intended commercial use. Security review asks whether generated code or files introduce vulnerabilities, secrets, malware, or unsafe behavior. Store and jurisdiction review asks whether a platform or local law imposes additional disclosure or content requirements.

As an Amazon Associate I earn from qualifying purchases.

These questions overlap but none answers the others. A file can be original enough for your team to claim rights yet still violate a model’s contract, contain a leaked credential, or fail a store’s policy. Conversely, code that is technically safe may include a license obligation that your distribution package does not satisfy.

How U.S. copyright applies to game components

U.S. copyright can protect original expression in computer software, artwork, music, dialogue, and other game elements. It does not protect ideas, facts, systems, methods of operation, or a game mechanic considered at that abstract level. The U.S. Copyright Office’s January 29, 2025 release on generative-AI outputs says the analysis turns on the centrality of human creativity to copyright. Its statement explains that when creativity is expressed through an AI system, that human-created expression can continue to enjoy protection.

A prompt is an instruction, not automatically authorship of the resulting pixels, audio, or code. Protection is more plausible when a person makes creative selections and arrangements or materially edits the output. Keep evidence of those contributions rather than assuming the tool’s terms transfer copyright to you.

Component Potentially protected expression Usually outside copyright by itself
2-D art and textures Original drawing, paint-over, composition, and creative selection of elements Ideas, color facts, generic shapes, or a method of play
3-D meshes and animation Original sculpting, topology choices, rigging, keyframes, and arrangement The underlying physical idea or a functional method
Music and sound Original melody, harmony, lyrics, recording, or edited sound design Short facts or functional audio needed only to signal an event
Dialogue and narrative Original wording, character expression, and creative selection or arrangement Ideas, historical facts, and game rules
Source code Original code expression and creative structure Ideas, algorithms as concepts, systems, and methods of operation
Compiled binaries The underlying protectable program expression, subject to the source and build record A function’s abstract result or a purely functional requirement

Copyrightability does not decide whether an output resembles a protected character, logo, costume, environment, song, voice, or code fragment. Similarity and permission must be investigated separately.

Why training data and model terms remain unsettled

The legality of using copyrighted works to train generative systems remains an active policy and litigation issue. The Copyright Office reported that its August 2023 notice of inquiry received more than 10,000 comments by December 2023. Part 2 of its report, released January 29, 2025, addresses copyrightability of generative-AI outputs. The page reviewed identified Part 3, concerning generative-AI training, as a pre-publication version released May 9, 2025. Those publications do not settle every training-data dispute, model contract, or infringement fact pattern.

Read the terms in force for the exact model or service version you used. Check whether prompts and uploads may be retained for training, whether commercial use is granted, whether attribution is required, how outputs are treated, and what indemnities or exclusions apply. Save a copy of the terms and the date you retrieved them.

Copyright review workflow for every generated asset

  1. Inventory each component before editing

Create one record per generated item and separate categories that may receive different treatment: sprites, textures, 3-D meshes, animations, sound effects, music, dialogue, shaders, scripts, and compiled binaries. Record the file path, internal asset ID, build in which it appears, and the person responsible. Do not treat an entire game as one undifferentiated AI work.

  2. Capture provenance at generation time

Save the tool or service name, model and version, generation date, full prompt, negative prompt, input references, seed and settings when available, output file hash, and the tool’s commercial-use and attribution terms. Hash the original output before an editor overwrites it; retain later hashes for each revision. Store source images, audio, fonts, packages, and other inputs with their license text and retrieval date.

  3. Document human authorship

Describe the person’s creative decisions: which candidates were selected, how layers were arranged, what was composited, painted over, retopologized, rigged, color-corrected, edited, rewritten, or re-recorded. For code, preserve the diff, design decisions, tests, and manual changes. A time-stamped version-control history and reviewer note are stronger evidence than a statement that a prompt was detailed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  4. Compare outputs with known works

Search for recognizable characters, logos, distinctive costumes, environments, music, voices, dialogue, and unusually distinctive code. Use reverse-image or audio search where appropriate, inspect public repositories for suspiciously distinctive functions, and ask a reviewer who was not the generator to assess close matches. Keep screenshots, URLs, search dates, and notes explaining why a match was accepted, changed, or rejected.

  5. Resolve every license

Confirm that each input reference, stock element, sound, font, package, and generated output may be used in your intended territories, storefronts, platforms, and commercial context. Check attribution, notice, share-alike, source-disclosure, field-of-use, and sublicensing clauses. Put the exact license text and retrieval date in the asset record; a vague label such as “free” is not a license determination.

  6. Escalate uncertainty before release

Obtain qualified legal review for a close stylistic or character match, a third-party likeness or voice, unclear model terms, disputed training provenance, or a planned copyright registration or enforcement claim. Ask counsel to review the evidence packet, not just a rendered screenshot. If the risk cannot be resolved, replace the asset or limit its distribution.

Security workflow for AI-generated code

Generated code is an untrusted draft. Apply the same secure-development controls as human code, with extra attention to copied fragments, hidden instructions, and dependencies that a developer did not intentionally choose.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Require peer review and tests

Every generated change needs a named reviewer, a reproducible build, automated tests, and a manual test of failure paths. Run the change in a sandbox with least-privilege credentials. Reject code that cannot be explained line by line or that introduces functionality not required by the feature.

  2. Inspect direct and transitive dependencies

Review imports and dependency manifests, including packages pulled in indirectly. Pin versions, generate a dependency lockfile, inspect changelogs and security advisories before updating, and remove packages that are unnecessary. Verify package names and maintainers to avoid typosquatting or malicious look-alikes.

  3. Run composition and license analysis

Use software-composition analysis and license detection on source and packaged builds. Flag copyleft or source-disclosure obligations, unknown-origin snippets, and code whose license cannot be established. Record any required notices in the game’s distribution materials and preserve the scan report with the release.

  4. Scan for secrets and backdoors

Search source, comments, configuration, binaries, and build logs for API keys, tokens, private URLs, credentials, signing keys, and debug backdoors. Revoke a secret immediately if it was exposed; deleting the string from a later commit does not invalidate a key that was already published. Use environment or platform secret stores instead of embedding credentials.

  5. Review dangerous operations

Inspect file, process, shell, network, serialization, reflection, and dynamic-code operations. Confirm every outbound connection, downloaded file, privileged action, and deserialization path is necessary and authenticated. Remove broad filesystem access, arbitrary command execution, and unexpected telemetry. Treat generated scripts and build tools as executable code, not harmless text.

  6. Run automated security analysis

Use static analysis, dependency vulnerability scanning, secret scanning, and malware or sandbox analysis suitable for the build environment. Test untrusted asset files and plugins in isolated environments. Review findings manually because a clean scanner result does not prove that behavior is safe or licensed.

  7. Check for copied distinctive code

Compare unusual functions, comments, and error messages against public code and internal repositories. Preserve the comparison and determine whether a license notice, attribution, source offer, or rewrite is required. OWASP’s AI and Copyright Security material treats source code as a significant intellectual-property asset and discusses AI-related security and copyright exposure.

  8. Sign the approval record

Link the generated change to its tool metadata, reviewer, test results, dependency snapshot, scan outputs, and approval decision. Require a second approval for code that handles payments, accounts, network services, save files, mod support, or build signing. Keep records long enough to investigate a later complaint or vulnerability.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Red flags that should stop a build

  • An import or package no one can identify, especially one added without a feature requirement.
  • Obfuscated strings, encoded commands, dynamic downloads, or network calls to unexplained domains.
  • Hard-coded credentials, private endpoints, signing material, or disabled verification checks.
  • File deletion, shell execution, reflection, or deserialization without a narrowly justified path.
  • A distinctive block of code whose license or origin cannot be documented.
  • A scanner finding that is marked “accepted” without a written reason and owner.

How to keep an auditable provenance packet

Use an immutable record or signed archive for each component. At minimum, include these fields:

asset_id, category, game_version, file_hash, original_output_hash, tool_name, model_version, generated_at, prompt, negative_prompt, input_references, seed_or_settings, human_edits, source_licenses, similarity_checks, security_scans, reviewer, approval_date, release_decision

Store the original output separately from edited derivatives. Link each hash to the exact file used in a release build and retain the build manifest. For code, add the commit identifier, dependency lockfile hash, static-analysis results, vulnerability findings, secret-scan result, malware-sandbox result, and any license notices. Restrict write access and keep an audit log so a later change cannot silently rewrite the history.

Checking tools and review services

If you compare generation tools or external review services, evaluate capabilities rather than marketing labels. Ask for evidence of the following:

Comparison axis Questions to ask
Provenance export Can you export prompts, settings, model versions, timestamps, hashes, and reviewer actions in a durable format?
Training and commercial disclosures Are training-data practices, output rights, attribution, retention, and commercial-use limits clearly stated for the exact version?
Model pinning Can a build be tied to a fixed model version instead of silently changing outputs?
Similarity controls Can the system flag close visual, audio, voice, character, or code matches and preserve evidence?
Code security Does it inspect dependencies, secrets, malware indicators, unsafe calls, and outbound network behavior?
License detection Can it identify licenses, copyleft obligations, unknown origin, and required notices?
Audit and access control Are actions logged, exports signed, and permissions limited by role?
Release coverage Does its analysis cover the jurisdictions, stores, editions, and platforms where your game will ship?

No tool substitutes for a documented human decision. Verify what the service actually scans, what it retains, and whether its report can be reproduced after a model or database update.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Store, platform, and jurisdiction checks

Store acceptance is a separate gate. A platform may request disclosure of AI-generated content, restrict certain likenesses or copyrighted material, require rights to every included file, or change its policy after your build is approved. Do not infer one store’s position from another’s. Before submission, read the current developer rules for each storefront, console, regional edition, and distribution channel; save the relevant policy version and date in the release packet.

Likewise, U.S. guidance does not settle copyright in every country. If your game will be sold internationally, identify where ownership, moral rights, personality rights, privacy, training-data rules, and software licensing differ. Obtain local advice for high-risk assets such as real-person likenesses, cloned voices, living artists’ distinctive styles, and community-contributed code.

What to do when a problem is found

Possible copyright or likeness match

  1. Quarantine the asset and remove it from release branches and marketing exports.
  2. Preserve the output, prompts, inputs, hashes, search evidence, and reviewer notes without editing the originals.
  3. Ask counsel to assess permission, transformation, nominative use, publicity, and territorial issues.
  4. Replace, rework, license, or delete the asset; update manifests, trailers, screenshots, and localization files.

Vulnerable or malicious code

  1. Stop distribution and isolate affected build systems, credentials, and network access.
  2. Revoke exposed keys, inspect logs, and determine whether a package or binary executed.
  3. Remove the dependency or rewrite the function, then rerun tests, scans, and reproducible builds.
  4. Record the incident, affected versions, user impact, fixes, and required notifications.

Unclear license or missing provenance

Do not fill gaps with assumptions. Mark the component as unapproved, contact the contributor or service for written terms, and replace it if the origin or obligations cannot be established. A clean-looking asset without a chain of custody is still a release risk.

Release checklist

  • Every generated component has an owner, category, file hash, tool/model version, date, prompt record, and input list.
  • Human selection, arrangement, editing, and code changes are documented in version history.
  • Similarity searches cover recognizable art, music, voices, dialogue, logos, and distinctive code.
  • All input and output licenses are confirmed for intended territories, stores, platforms, and commercial use.
  • Generated code passed peer review, tests, static analysis, dependency and vulnerability scans, secret scanning, and appropriate malware analysis.
  • Dependencies are pinned, transitive packages reviewed, and required notices prepared.
  • No unexplained secrets, privileged operations, dynamic downloads, or outbound connections remain.
  • Store policies and local legal requirements were checked for the actual release date and edition.
  • A signed approval links the final build to provenance, scan results, reviewers, and the release decision.

This process cannot guarantee that a court, platform, or attacker will agree with your assessment. It does give your studio a defensible, repeatable basis for deciding what ships and for responding quickly when new information appears.
