Start by mapping the exchange, then define the events, fields, safeguards, responsibilities, and review process. The exact legal requirements depend on the countries, organizations, data, and documents involved.
What an audit trail must establish
An audit trail should let an investigator reconstruct a security-relevant exchange from initiation to outcome. The NIST CSRC Glossary defines an audit trail as “A chronological record that reconstructs and examines the sequence of activities surrounding or leading to a specific operation, procedure, or event in a security relevant transaction from inception to final result.” NIST CSRC Glossary: audit trail

For a cross-border transfer, that means being able to answer questions such as: who initiated the exchange, which document or transaction was involved, what happened at each relevant step, whether each step succeeded, and which organization or system recorded it. A record of a local upload alone may not establish that the partner received, accessed, or changed the document.
NIST SP 800-171 Rev. 3 provides security guidance for systems handling Controlled Unclassified Information in nonfederal organizations. It identifies baseline audit-record content, but it is not a universal law or a complete legal specification for every organization or exchange. Use it as a design reference where relevant, alongside the rules that actually govern the parties and information. NIST SP 800-171 Rev. 3

1. Map the exchange before choosing what to log
Document the route the information takes, including the organizations and systems involved, relevant people and service identities, document classes, transfer method, service providers or subprocessors, and points where custody or control changes. Include both your own systems and the partner-controlled steps that matter to the transaction.
NIST SP 800-47 Rev. 1 treats information exchange as a risk-managed activity and frames protections across the period before, during, and after an exchange. It recommends identifying exchanges, considering their security needs, and documenting necessary agreements; it does not require a particular transfer technology. NIST SP 800-47 Rev. 1
Use the map to identify where evidence originates and where it could be lost. For example, if a partner’s platform records access events but your organization cannot request or export them, the exchange has a visibility gap even if your own sending system is well logged.

2. Define the event scope and record fields
Choose events that reconstruct the workflow
Choose events according to the system’s security and audit needs, then revisit that selection as the workflow or risk changes. NIST SP 800-171 Rev. 3 discusses logging steps in distributed transactions and gives privileged functions and failed access as examples of events that may be relevant. The following is a practical event taxonomy to adapt to your process, not a verbatim list mandated by NIST:

- Exchange request, approval, or cancellation.
- Document send or upload, partner receipt, and acknowledgement.
- Access attempt, successful access, download, or denial.
- Version or relevant metadata change, revocation, or deletion.
- Administrative action affecting access, logging, or the exchange.
For each event, decide which system is authoritative for recording it and whether a corresponding event should be obtained from the partner. Logging an action on one side does not prove what happened on the other.
Specify a minimum useful record
NIST SP 800-171 Rev. 3 identifies event type, time, location, source, outcome, and the person, process, or entity associated with the event as audit-record content. It also discusses additional details such as addresses, identifiers, event descriptions, file names, and invoked access or flow-control rules. Select additional detail when it is needed to explain or investigate the event, rather than collecting it by default.
| Record element | What to define |
|---|---|
| Event type and transaction reference | Name the action and include a stable exchange or document reference that lets authorized reviewers correlate related events without relying only on a filename. |
| Time and system context | Record when the event occurred and the system or location context. As an implementation choice, coordinate time settings across participating systems and retain enough context to interpret timestamps from different parties. |
| Source and destination | Identify the relevant organization, system, account, or service identity for the event, as applicable. |
| Outcome | Record whether the action succeeded or failed and include a useful result or error code when available. |
| Associated identity | Record the person, process, or entity associated with the event, using an identity convention that can be mapped across the organizations. |
| Relevant rule or description | Where needed to explain why access was permitted or denied, record the relevant rule or a concise event description. |
Do not place document contents or unnecessary personal information in logs. NIST says additional audit-record content should be limited to information explicitly needed for audit requirements. NIST SP 800-171 Rev. 3
3. Preserve identity and connect records across organizations
Agree how an identity recorded in one organization’s systems maps to the identity visible to the other party. Define this for people as well as services or processes, and establish how the mapping is protected and retained. A local username or service account may not, by itself, identify the same actor in the partner’s records.

NIST SP 800-53 Rev. 5 includes controls addressing preservation of individual identity in cross-organizational audit trails and sharing audit information under defined agreements. It also recognizes that one organization’s audit records may not be sufficient to determine another organization’s use of a system. NIST SP 800-53 Rev. 5 derived OSCAL
Define a shared transaction-reference convention as well as the identity mapping. Specify which reference each party records, how it is carried through acknowledgements and later events, and how authorized personnel can resolve it to the relevant exchange. Avoid making a document name the only correlation key: names can change and may disclose information unnecessarily.
4. Protect audit records and their administration
Logs are evidence and can expose sensitive operational or personal information. Restrict access to the records and to the tools and settings that create, export, administer, or delete them. Separate audit administration from ordinary user activity where appropriate to the risk, and monitor for unexpected changes or gaps.
NIST SP 800-171 Rev. 3 calls for protecting audit information and audit tools against unauthorized access, modification, and deletion, and for limiting audit-management privileges. A separately managed copy or tamper monitoring can strengthen protection where the organization’s risk and systems support it; NIST does not prescribe one storage architecture for every case. 5. Put exchange responsibilities in a partner agreement
Translate the design into an agreement or operating procedure with each partner. The agreement should assign owners and resolve operational details before an incident or investigation requires evidence from both sides.
- Which events and fields each party records, and which records it can provide.
- Identity and transaction-reference conventions used to correlate events.
- How a document is handed off, receipt is acknowledged, and failed transfers are handled.
- Who may request or receive audit information, under what conditions, and how it must be protected.
- Responsibilities for retention, deletion, legal holds, and evidence export, subject to applicable law and contract.
- Operational and incident-escalation contacts, review cadence, and how material changes to systems or subprocessors are communicated.
These are practical agreement topics aligned with NIST’s exchange-management guidance. NIST SP 800-47 Rev. 1 includes agreement templates and addresses protection before, during, and after exchange; NIST SP 800-53 Rev. 5 addresses coordinated audit requirements and cross-organizational sharing agreements. Set retention according to your records policy, contract, risk, and the legal requirements that apply to the specific organizations and information. NIST SP 800-171 Rev. 3 calls for retaining audit records for a period consistent with the records-retention policy; it does not establish one universal duration. Define controlled disposal after the applicable period and procedures for preserving records subject to a legal hold. NIST SP 800-171 Rev. 3

7. Choose technology against the requirements
In-house logging, cloud document platforms, managed file transfer, and centralized SIEM or log-management services are implementation options, not substitutes for defining the exchange and its evidence requirements. NIST SP 800-47 is technology-neutral and does not rank or endorse vendors. Compare candidate approaches against the same questions:
| Evaluation area | Question to resolve |
|---|---|
| Workflow coverage | Can the approach capture the relevant events across the full workflow, including partner-side events that your investigation may need? |
| Identity and correlation | Can it preserve identity across organizational boundaries and correlate records using the agreed transaction reference? |
| Protection and administration | How are logs protected against alteration, deletion, unauthorized access, or overly broad administrative privileges? |
| Evidence sharing | Can each party obtain the needed records under the agreement, in a usable export format? |
| Retention and residency | Can the approach meet the actual retention, deletion, legal-hold, and data-residency requirements for the exchange? |
| Operations and failure handling | Can staff detect missing logs or service failures, review alerts, and sustain the operational workload? |
Assess data residency and access arrangements against the actual jurisdictions and information in scope. A product category alone does not establish that a particular configuration or provider meets a legal obligation.
Keep the legal scope specific to the exchange
The countries, sectors, data subjects, and document types determine which transfer rules, localization obligations, retention periods, and evidence requirements may apply. The general NIST guidance described here does not decide those questions for every organization, and the EU eIDAS provisions are not a global retention rule.

The consolidated text of Regulation (EU) No 910/2014 states: “An electronic document shall not be denied legal effect and admissibility as evidence in legal proceedings solely on the grounds that it is in electronic form.” The same text addresses preservation-service measures concerning durability, legibility, integrity, origin accuracy, and detection of subsequent changes in its specific regulatory context. This does not establish that every cross-border document exchange must use such a service or that every electronic record will be admissible.
