The forum, deadline and remedy depend on that document. Obtain the signed order and proof of the date it was communicated, then use the designated statutory appeal or corporation review before considering a writ petition.
Do not assume that every industrial or commercial plot dispute belongs before RERA or the High Court. The allotment letter, lease or letter of intent, incorporated policy, payment history and the stated reason for cancellation determine the route.

1. Establish the jurisdiction before calculating time
“Punjab” may mean the Indian state of Punjab or Punjab province in Pakistan. Their development authorities, corporations and policies are different. Read the name and address on the allotment, cancellation or resumption letter rather than relying on the location of the plot alone.
- Indian Punjab: GMADA (Greater Mohali Area Development Authority), PUDA (Punjab Urban Planning and Development Authority), PSIEC (Punjab Small Industries and Export Corporation), Punjab RERA or another state body may be involved.
- Punjab, Pakistan: PSIC (Punjab Small Industries Corporation) and PIEDMC (Punjab Industrial Estates Development and Management Company) use their own policies and review arrangements.
The limitation clock normally turns on communication or service of the order, not merely the date printed on it. Preserve the envelope, email header, portal notification, acknowledgment, diary entry or other proof showing when you actually received it. If an authority says the order was served earlier, that evidence may decide whether an appeal is timely.

2. Match the cancellation to the correct first forum
| Allotting body or situation | Instrument or issue to check | Initial challenge route | Key timing or qualification |
|---|---|---|---|
| GMADA or PUDA Estate Officer | Resumption and forfeiture under the allotment terms and Section 45 of the Punjab Regional and Town Planning and Development Act, 1995 | Appeal to the concerned Additional Chief Administrator | Section 45(5) provides 30 days from communication; a delayed appeal may be admitted for sufficient cause |
| GMADA or PUDA after the appellate decision | Adverse decision of the Additional Chief Administrator or Chief Administrator | Written revision to the State Government, where the governing instrument permits it | GMADA’s published procedure describes 30 days from communication |
| PSIEC industrial estate | Allotment or transfer letter, estate terms and the applicable PSIEC policy | Use the policy’s prescribed representation, review or appeal channel; preserve the EMS record | The Estate Management System is a post-allotment service channel, but the cancellation order and current PSIEC policy control the forum and limitation period |
| PSIC industrial estate in Pakistan | PSIC SIE Policy 2023, development-charge schedule, bye-laws and allotment conditions | Follow the review or representation clause in the cancellation order and current policy | The published material does not establish one universal appeal deadline |
| PIEDMC SEZ plot in Pakistan | SEZ approval, possession and construction obligations | Challenge through the PIEDMC mechanism stated in the approval or cancellation documents | Collect proof of construction, production, cure requests and any approved extension |
| Dispute genuinely governed by the Real Estate (Regulation and Development) Act | RERA order or appealable determination | Form L to the Real Estate Appellate Tribunal | Punjab RERA identifies Form L under Section 44; RERA is not automatically the forum for a government industrial-estate cancellation |
A court petition is not a substitute for identifying the administrative route. The Punjab and Haryana High Court can exercise jurisdiction under Articles 226 and 227, but it commonly expects an effective statutory remedy to be used first unless the facts justify extraordinary intervention.
3. Indian Punjab: the GMADA and PUDA appeal
What the statutory scheme covers
Section 43 of the Punjab Regional and Town Planning and Development Act, 1995 authorizes the authority to dispose of its land on stated terms. The Estate Officer’s allotment letter normally sets the price, instalment schedule, construction or use conditions, transfer restrictions and consequences of default. Those incorporated terms matter as much as the statute when assessing a cancellation.
For an Estate Officer’s order resuming the plot and forfeiting money, Section 45(5) provides an appeal to the concerned Additional Chief Administrator. File it within 30 days from communication of the order. The appellate authority may confirm, vary or reverse the decision. If the deadline has passed, include a separate application asking for condonation and explain the specific cause of delay with supporting records; the statute allows a late appeal when sufficient cause prevented timely filing.

- Identify the challenged order: quote its date, number, issuing officer, plot number, scheme or estate, and the date and method of communication.
- State the legal route: describe the filing as an appeal under Section 45(5), name the concerned Additional Chief Administrator and attach the order.
- Set out the chronology: allotment or letter-of-intent date, each demand, payment, request for time, notice, reply and cancellation event in date order.
- Explain the error: connect each ground to a document—for example, a receipt disproving arrears, a clause allowing an extension, or proof that a reply was never considered.
- Ask for precise relief: seek setting aside of the resumption and forfeiture, restoration of the allotment, acceptance of outstanding dues on lawful terms, refund, or remand for a fresh decision after notice, as the facts support.
- Request interim protection: ask the appellate authority to suspend re-auction, repossession, forfeiture or creation of third-party rights while the appeal is pending.
Whether a stay is available, and on what conditions, depends on the governing statute and the authority’s practice. Make the request separately and explain the irreversible harm that would occur if the plot were re-allotted before the appeal is decided.
Revision after the appeal
GMADA’s published procedure describes a written revision to the State Government after an Additional Chief Administrator or Chief Administrator decision. It gives 30 days from communication of that decision. The same procedure describes a record-calling power exercisable within six months, with a reasonable opportunity of hearing before an adverse order. These are distinct powers: a revision is a party-initiated challenge, while record-calling is an authority’s supervisory examination. Confirm the current instrument and filing destination before relying on either.

4. Procedural grounds that can undo a cancellation
Cancellation without notice or a meaningful hearing
A cancellation that removes an allottee’s accrued rights and money has adverse civil consequences. In a judgment dated 2 September 2026, the Punjab and Haryana High Court held that an Estate Officer could not cancel an allotment without prior notice and an adequate opportunity to be heard where earnest money had been paid. The court stated: It is well settled that an authority must adhere to the principles of natural justice, particularly the rule of audi alteram partem, even while exercising administrative powers.
The point is practical: distinguish between a demand notice that merely warns of a possible consequence and a final cancellation made before the allottee could answer. Attach the notice, your reply, proof of delivery and the order showing whether the reply was addressed. If no notice was served, explain how that prevented payment, clarification or a request for relief.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsA timely extension or condonation request ignored
The same case involved a letter-of-intent clause allowing a prior written request for payment-delay condonation. The stated options were up to 30, 60, 90 or 180 days, with surcharges of 1.5%, 2%, 2.5% and 3%, respectively, plus a stated penalty. The court held that the Estate Officer could not cancel before deciding an application submitted within the permitted period.
That ruling does not turn every late payment into an automatic right to restoration. It does mean the authority must examine a request that the allotment instrument actually allows before taking the irreversible step of cancellation. Show the clause, the date of your request, the surcharge or penalty offered, the payment tender and the authority’s failure to decide.
Payment and accounting errors
Reconcile the authority’s demand ledger with bank statements, receipts, challans and portal records. Identify the exact instalment allegedly unpaid, the due date, any grace period and how the authority calculated interest, surcharge or forfeiture. A general statement that “all dues were paid” is weaker than a table matching every demand to a dated transaction.

If the order relies on non-construction, misuse or an unauthorized transfer, request the inspection report, photographs, notices and measurement records on which it relies. Respond with dated photographs, building approvals, utility bills, possession evidence, invoices, production records or applications for extension. Do not submit undated images or documents that cannot be tied to the relevant period.

Authorities and courts assess the record placed before them. Assemble one indexed PDF or paper set with a page-numbered chronology and a short explanation of what each exhibit proves.
- Allotment letter, letter of intent, transfer letter, lease deed and every incorporated brochure, policy or scheme condition.
- Cancellation, resumption, forfeiture and demand orders, including annexures and inspection reports.
- Bank statements, receipts, challans, payment gateway confirmations and the authority’s account statement.
- Every request for extension, condonation, restoration or permission, with the email, portal receipt, diary number or registered-post proof.
- Notices, replies, hearing notices, attendance records and minutes or orders showing what the officer considered.
- Possession certificates, approved plans, building photographs with dates, utility connections, contracts, invoices, production records and other evidence addressing construction or operational conditions.
- Proof of service of the challenged order and proof of filing the appeal.
Keep the original files and metadata. A portal screenshot may show a submission but not its attachments; download the acknowledgment and the uploaded file list where available.
6. Filing sequence for a GMADA or PUDA matter
- Secure the complete file. Ask the Estate Officer for the signed order and relied-on documents if anything is missing. Record the communication date.
- Read the controlling terms. Mark payment dates, construction milestones, transfer restrictions, notice clauses, extension options and forfeiture language in the allotment and lease documents.
- Prepare the appeal and any condonation application. Use separate headings for jurisdiction, limitation, facts, grounds, interim relief and final relief. A late filing should explain each day or period of delay rather than offering a generic statement.
- File through the accepted channel. Obtain a diary number, portal acknowledgment or stamped copy. Send a duplicate by a traceable method if the rules permit.
- Serve the authority and preserve proof. Keep delivery reports, email headers and the complete filed set.
- Seek interim protection immediately. State the date of any proposed auction, repossession or third-party allotment and ask for a decision before that event.
- Attend every hearing and answer new material. Request a copy of any report or reply introduced by the department and seek reasonable time to respond.
- Evaluate revision or judicial review after the order. Check the next deadline from the date the appellate decision was communicated and obtain advice on whether a statutory revision or writ is appropriate.
7. PSIEC industrial estates in Indian Punjab
PSIEC’s official Estate Management System is the post-allotment channel for industrial focal points. An allottee can use it to apply for post-allotment services, view dues, make payments, receive communications and track service requests. Registration requires uploading the allotment or transfer letter.
Use EMS to create a dated documentary trail, but do not assume that an EMS service request is itself an appeal. The cancellation order and the current PSIEC policy determine the competent officer, review or appeal mechanism and limitation period. If the order is silent, request the rule or policy provision that identifies the remedy and file a protective representation without waiting for an informal answer.

8. Punjab, Pakistan: PSIC cancellations
PSIC’s published material states that failure to pay two consecutive development-charge instalments can lead to cancellation and refund after a stated deduction. It also states that breach of preconditions, bye-laws or the PSIC SIE Policy 2023 may result in cancellation and repossession.
Those consequences are not a single province-wide appeal rule. Obtain the signed cancellation order, the relevant allotment and development-charge schedule, the current SIE policy and any clause describing review, representation or appeal. The searched PSIC material does not state one universal deadline, so do not import the 30-day Indian GMADA period into a PSIC case.
Respond to the precise default alleged. For instalments, attach the ledger and proof of payment or tender. For a bye-law or precondition breach, identify the clause, explain compliance or cure, and include any permission or extension. Ask for suspension of repossession or re-allotment while the representation is pending if the policy permits it.
9. Punjab, Pakistan: PIEDMC and SEZ plots
PIEDMC’s FAQ states that an SEZ enterprise must take possession and start construction within six months of SEZ approval. It must complete the project and commence commercial production within 24 months. Non-compliance may lead to penalties or cancellation and repossession. SEZ plots are non-transferable and may only be surrendered to PIEDMC.
A challenge should therefore focus on the SEZ approval notification, possession date, approved project schedule, construction and production evidence, inspection reports, penalties, cure notices and any extension or force-majeure correspondence. If you transferred or attempted to transfer the plot, address the non-transferability condition directly rather than treating the transaction as an ordinary sale. Follow the review or representation mechanism in the approval and cancellation documents.

10. When Punjab RERA is—and is not—the forum
The Punjab RERA website identifies Form L as the appeal to the Real Estate Appellate Tribunal under Section 44, and the tribunal’s orders index includes appeals involving PUDA and other Punjab parties. That does not make every government industrial-estate cancellation a RERA dispute.
Before using Form L, identify the registered project, the statutory decision being challenged and the provision that gives RERA or the tribunal jurisdiction. A direct allotment by a development authority, a resumption under its land-disposal statute or an industrial-estate policy dispute may remain outside RERA. Filing in the wrong forum can consume the limitation period, so obtain a jurisdictional view from the allotment documents and the challenged order.
11. Interim relief, money and realistic remedies
Protecting the plot
Ask for an order preventing re-auction, repossession, forfeiture or creation of third-party rights. Explain why later compensation would not repair the loss—for example, a site-specific approval, installed plant, access arrangement or irreversible third-party allotment. Offer to pay undisputed dues or comply with reasonable conditions where the instrument allows it.
What may happen to earnest money and other payments
The outcome depends on the allotment terms, the cancellation ground and the decision-maker’s power. Possible relief includes restoration on payment of dues, acceptance of a permitted surcharge or penalty, refund after contractual deductions, reversal or reduction of forfeiture, or a remand for a fresh decision. Do not promise a full refund merely because notice was defective; ask for the exact forfeiture clause and the accounting supporting the deduction.
Interest, surcharge and restoration charges
Separate the principal paid from interest, delay surcharge, penalty, forfeiture and any restoration or extension charge. The 1.5%, 2%, 2.5% and 3% figures described above belonged to the payment-delay options in the 2026 High Court case; they are not a universal rate for every Punjab allotment. Use the rate in your own allotment or policy and show the calculation.
12. Common mistakes that weaken an appeal
- Calculating time from the order date while ignoring the date and proof of communication.
- Sending a general complaint to the minister or estate office instead of filing in the forum named by the statute or policy.
- Waiting for an informal promise of restoration until the appeal period expires.
- Filing without the cancellation order, allotment terms, payment ledger or proof of an extension request.
- Arguing only hardship while failing to answer the specific default—arrears, construction, misuse, transfer or an SEZ milestone.
- Assuming that an online service request, RERA form or writ petition automatically stops re-auction.
- Using the Indian GMADA/PUDA procedure for a PSIC or PIEDMC plot in Pakistan, or treating PSIEC’s EMS as the appeal forum.
- Submitting undated photographs or unsigned statements that cannot establish compliance at the relevant time.
13. A practical decision checklist
Before filing, answer these questions in writing:
- Which Punjab, authority and scheme issued the allotment?
- What document actually cancels, resumes or forfeits the plot?
- When and how was that document communicated?
- Which clause or statutory section is said to have been breached?
- Was prior notice given, and did the authority consider the reply and any timely extension request?
- What amount is undisputed, and can it be tendered with the lawful surcharge or penalty?
- Which forum has power to grant restoration or interim protection?
- What event—auction, repossession, forfeiture or third-party transfer—requires urgent protection?
For GMADA or PUDA resumption and forfeiture, the statutory appeal to the concerned Additional Chief Administrator is the central first step. For PSIEC, PSIC, PIEDMC and RERA matters, read the specific policy and order rather than borrowing that route. A lawyer familiar with the relevant authority can check limitation, jurisdiction and interim relief, but the allottee should preserve the evidence and lodge the correct protective filing immediately.
