How Small Businesses Can Legally Reduce Exposure to U.S.–India Import Tariffs (2026 Guide)

Small businesses can reduce tariff exposure legally, but not by splitting orders, understating value or routing Indian goods through another country. The dependable approach is to lower the amount of duty legally due: classify each SKU correctly, document origin and valuation, use first-sale valuation only when its strict evidence requirements are met, defer duty with a foreign-trade zone (FTZ) or bonded warehouse when your inventory pattern fits, and claim drawback on qualifying exports or destruction.

Start with the entry date and the exact product facts. The White House said on February 9, 2026, that the reciprocal tariff on India would fall from 25% to 18% and that an additional 25% measure tied to Russian-oil purchasing commitments would be removed. Those changes do not eliminate ordinary HTSUS duty, Chapter 99 measures, Section 232 actions, antidumping or countervailing duties, merchandise-processing fees, or other charges. Rates and exemptions can change, so verify the HTSUS and CBP instructions immediately before each material shipment.

What the current tariff changes mean for an importer

The 18% figure is a reciprocal tariff rate announced for India, not a universal landed-cost rate for every Indian product. Your total can include the normal HTSUS duty, the reciprocal or other Chapter 99 duty in force on the entry date, merchandise-processing and broker fees, and any product-specific trade remedy. Antidumping and countervailing duties can be especially significant because they are separate from ordinary customs duty and may apply to only particular products and producers.

The White House described the 18% rate as part of a February 2026 framework while negotiations on a broader bilateral agreement continued. Treat that framework as a starting point, then check implementation notices and the current HTSUS Chapter 99 headings for the specific entry.

Cost or rule When it matters What to do
Normal HTSUS duty Determined by the product’s tariff classification and statistical suffix Build and maintain a SKU-level classification file; obtain a binding ruling when facts are uncertain
India-related reciprocal or additional duty Depends on the Chapter 99 heading and entry date Check the heading and effective date for every material shipment
Section 232, antidumping or countervailing duty Applies only to covered products, origins, producers or circumstances Have a broker or trade lawyer screen the SKU before purchase
Merchandise-processing, harbor and broker fees Can apply even when the customs duty rate is zero Include them in landed-cost calculations
De minimis treatment Generally unavailable for covered imports valued at or below $800 after August 29, 2025 Plan for an appropriate ACE entry and payment of applicable duties, taxes and fees

CBP guidance states that, beginning February 28, 2026, “all shipments must use the ad valorem method.” That means a business should not assume that a low-value shipment can avoid the ordinary percentage-based calculation.

Classify every SKU before negotiating a lower rate

Classification is the first lawful cost-control opportunity. The HTSUS duty follows the legal description of the merchandise, not the supplier’s marketing name or the tariff code printed on an old invoice. A mistaken code can produce overpayment, a demand for additional duty, penalties or a shipment hold.

Build a classification file

For each SKU, retain the commercial name and model number; detailed composition by weight or material; principal function; dimensions and technical specifications; photographs, drawings and manuals; manufacturing steps; country-of-origin facts; supplier invoices; and any prior ruling or broker advice. Record why the selected heading and subheading fit the General Rules of Interpretation and the relevant chapter and section notes.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Review the file when a supplier changes materials, firmware, packaging, processing or the product’s intended use. A classification that was correct for one version can become wrong after an engineering change.

Request a binding ruling when the answer is uncertain

Ask CBP for a prospective binding ruling rather than relying on an informal internet answer when a classification, valuation treatment or processing plan could materially affect cost. CBP’s rulings program accepts prospective FTZ and bonded-warehouse requests with a description of the transaction, the goods and the proposed processing. Keep the ruling with the SKU record and make sure the imported merchandise still matches the facts presented.

Prove origin and check additional measures

Country of origin is a legal determination based on the manufacturing facts, not simply the shipping point or the nationality of the seller. If Indian components are substantially transformed elsewhere, the result may differ; if no substantial transformation occurs, relabeling or repacking will not change the origin. Obtain a manufacturing narrative, bills of materials and supplier declarations that explain where each meaningful operation occurs.

The India-specific additional duty described by CBP was applied in addition to other duties, fees, taxes and charges. The same guidance stated that drawback is available for those additional duties under the cited measure. Before entry, check the current Chapter 99 headings and confirm whether the product has a specific exclusion, quota, date limitation or other condition.

Use first-sale valuation only with audit-level evidence

In a multi-tier transaction, customs value may sometimes be based on the price paid in an earlier sale rather than the final sale to the U.S. buyer. This is not an automatic discount. The first sale must be a bona fide, arm’s-length sale for export to the United States, and the importer bears the burden of proving that CBP should accept it.

Evidence CBP expects

  • Invoices for the factory-to-intermediary and intermediary-to-importer sales.
  • Purchase orders, contracts and proof that the prices were negotiated rather than created solely for customs purposes.
  • Payment records showing that the stated amounts were actually paid.
  • Documents showing when title and risk of loss transferred.
  • Evidence that the goods were destined for the United States at the time of the first sale, such as order instructions, shipping records or customer allocation.
  • Details of assists, tooling, design work, royalties, packing and other additions required in the customs-value calculation.

Coordinate the valuation method with your broker before the first entry. If the chain includes related parties, unexplained rebates, post-import adjustments or goods initially intended for another market, the evidentiary risk rises. Preserve the complete file for the period required by customs-record rules and be prepared to produce it during a CBP review.

When an FTZ can lower cash cost

An FTZ is useful for a business that regularly brings goods into the United States for storage, processing, assembly or re-export. CBP generally does not collect duty while merchandise remains in the zone. Duty becomes due when merchandise enters U.S. customs territory for domestic consumption, and qualifying users may be able to choose the duty rate on foreign materials or the finished product. Merchandise exported from the zone can leave without U.S. import duty.

Costs and limits

  • An FTZ defers or avoids duty in eligible situations; it does not erase duty on goods ultimately entered for U.S. consumption.
  • Admission, inventory-control, security, recordkeeping and operator charges can outweigh the cash-flow benefit at low volume.
  • Processing authority, zone procedures and the scope of approved operations must match what you actually do.
  • Inventory must be traceable from admission through domestic withdrawal or export.

Compare the present value of deferred duty with zone admission, storage, software, staffing, transportation and compliance costs. A company that exports a meaningful share of its Indian inventory or has a duty inversion between components and finished goods is a stronger FTZ candidate than a company making occasional domestic withdrawals.

When a bonded warehouse is better

A bonded warehouse allows imported merchandise to remain under customs control while you delay domestic entry, arrange a sale, or re-export it. Duty is generally paid when goods are withdrawn for U.S. consumption, not while they remain properly bonded. Re-exported goods can avoid U.S. import duty, subject to the applicable rules.

Bonded storage is often simpler than an FTZ when you need delayed release rather than manufacturing or complex manipulation. It still requires an approved facility, a customs bond, warehouse records, controlled withdrawals and payment of the correct duty and fees at entry. Storage rent, handling and the time limit for bonded warehousing must be included in the comparison. Do not move goods out of bond for domestic use before the entry and payment are complete.

Recover eligible duty with drawback

Drawback can refund eligible duties after imported merchandise is exported, re-exported or destroyed under a qualifying statutory program. It is a recovery mechanism, not a way to avoid duty at importation. Eligibility depends on the program, the relationship between the imported and exported or destroyed goods, filing deadlines and the quality of your records.

Prepare before importing

  1. Identify which imported SKUs will be exported, incorporated into exported products or destroyed.
  2. Ask a broker or drawback specialist to map the appropriate unused-merchandise, manufacturing or destruction program.
  3. Design inventory records that connect import entry numbers, lot or serial numbers, production usage and export documents.
  4. Retain commercial invoices, bills of lading, export declarations, carrier evidence, destruction certificates and payment records.
  5. File claims within the applicable deadline and reconcile the amount requested to the duty actually paid.

Do not assume that every export qualifies or that a simple spreadsheet is sufficient. Test the complete chain before changing sourcing, packaging or fulfillment practices.

The $800 de minimis rule is no longer a planning shortcut

CBP says that, effective August 29, 2025, covered imports valued at or below $800 generally no longer receive duty-free de minimis treatment. For non-postal shipments, an appropriate ACE entry by a qualified party is required, and duties, taxes and fees can apply. CBP also stated that all shipments must use the ad valorem method beginning February 28, 2026.

Repeatedly dividing one commercial order into many sub-$800 parcels can create compliance and logistics problems without reducing the legal duty. It can also look like an attempt to evade entry requirements. Consolidate shipments when that improves control, use the correct entry type and keep invoices that show the true transaction value.

Should you hire a customs broker?

A licensed customs broker is usually cost-effective when you have several SKUs, changing suppliers, Chapter 99 questions, first-sale transactions, FTZ or bonded inventory, or exports that may support drawback. The importer remains responsible for the accuracy of classification, value, origin and entry data even when a broker files the entry.

Give the broker a usable data package

  • SKU master data, technical literature, bills of materials and country-of-origin narrative.
  • Commercial invoices, purchase orders, packing lists, freight and insurance terms.
  • Any first-sale agreements, assists, royalties or related-party information.
  • Prior rulings, Chapter 99 determinations and product-safety or agency requirements.
  • Expected domestic withdrawals, re-exports, destruction and inventory movements.

Ask the broker to explain the proposed HTSUS and Chapter 99 codes, assumptions, record requirements and escalation triggers. Obtain written confirmation before relying on a novel valuation or duty-saving structure.

A practical implementation workflow

  1. List every imported SKU. Include supplier, factory, material, function, unit price, quantity, destination and expected entry date.
  2. Calculate a baseline landed cost. Add factory price, assists, freight, insurance, normal HTSUS duty, current Chapter 99 or reciprocal duty, merchandise-processing and broker fees.
  3. Resolve classification and origin. Complete the technical file, obtain supplier manufacturing evidence and request a binding ruling where uncertainty is material.
  4. Screen special duties. Check Section 232, antidumping and countervailing measures, exclusions, quotas and implementation notices.
  5. Test first sale. Confirm a bona fide arm’s-length export sale and assemble invoices, payment, title, risk and U.S.-destination evidence before entry.
  6. Model inventory alternatives. Compare ordinary entry, FTZ and bonded-warehouse costs, including storage, systems, staffing, bonds and transportation.
  7. Map drawback. If goods will be exported or destroyed, establish traceability and program eligibility before importation.
  8. Control each entry. Have the broker verify the current HTSUS and Chapter 99 instructions on the actual filing date, then archive the entry and supporting records.

Which option fits which business?

Option Best fit Main benefit Main burden or risk
Classification review or binding ruling New or ambiguous SKUs Prevents overpayment and reduces classification uncertainty Technical file, lead time and continued factual accuracy
First-sale valuation Multi-tier sales with a documented arm’s-length factory sale May reduce dutiable transaction value High evidentiary burden; CBP can reject unsupported transactions
FTZ U.S. stocking, processing or regular re-export Duty deferral, possible rate choice and duty-free export from the zone Admission, inventory controls, fees and operating complexity
Bonded warehouse Delayed domestic release or re-export Defers duty while goods remain bonded Storage, bond and withdrawal controls
Drawback Goods later exported or destroyed Potential refund of eligible duties Detailed traceability, deadlines and program rules

Practices that can turn savings into penalties

  • Misclassification: choosing a lower rate without facts that support the heading.
  • Undervaluation: omitting assists, royalties, packing, commissions or other required additions.
  • False origin: using paperwork, labels or transshipment to conceal Indian manufacture.
  • Uncontrolled bonded or FTZ withdrawals: moving goods into domestic commerce before the proper entry and payment.
  • Unsupported drawback claims: requesting refunds without records linking import, inventory and export or destruction.
  • Ignoring other regimes: assuming the reciprocal rate replaces Section 232, antidumping, countervailing or agency requirements.

Consequences can include additional duty, civil penalties, seizure, loss of import privileges and delayed deliveries. If an error is discovered, stop repeating it, preserve the transaction file and ask your broker or customs counsel about correction, prior disclosure or other available remedies.

How to keep the program current

Assign one person to review CBP and U.S. Trade Representative notices before each material shipment and whenever a supplier, product, route or customer changes. Keep the entry date, tariff headings, ruling numbers and assumptions in the landed-cost spreadsheet. Recalculate the model when rates, exemptions, carrier charges or warehouse arrangements change. This disciplined process usually saves more than chasing an unverified “loophole,” because it prevents the overpayments and enforcement events that can erase a small importer’s margin.

This article provides general information, not a legal opinion. Product-specific classification, valuation, origin, sanctions, forced-labor, antidumping and countervailing-duty questions should be reviewed by a qualified customs professional.

Product prices and availability are accurate as of the date/time indicated and are subject to change. Any price and availability information displayed on Amazon at the time of purchase will apply.
