There is no single deadline for an NLRB union-recognition case. In a typical petition-and-election case, the Regional Office investigates the petition, resolves bargaining-unit issues, schedules a secret-ballot election, counts the ballots, handles any challenges or objections, and then certifies or dismisses the petition. Current procedures generally open a pre-election hearing about 8 calendar days after notice, require the employer to post the petition notice within 2 business days, and schedule the election at the earliest practicable date. The NLRB says an election normally occurs within 25–30 days after a regional decision following hearing issues.
A clean, agreed case can therefore move from petition to voting in weeks. Disputed units, challenged ballots, objections, post-election hearings, Board review or litigation can extend certification substantially. Voluntary recognition is a separate route that does not require an NLRB election.

Timeline at a glance
An NLRB recognition case is event-driven rather than governed by one guaranteed number of days. The sequence below describes an RC petition, the filing generally used by a union seeking initial certification.

| Stage | What happens | Timing anchor |
|---|---|---|
| Petition and showing of interest | The union files an RC petition supported by evidence that employees want representation. | No universal processing period; the Regional Office investigates. |
| Notice and pre-election procedure | The employer posts the Notice of Petition for Election. If the parties cannot agree on the unit or election details, the Regional Office holds a pre-election hearing. | Employer generally posts within 2 business days; a typical hearing opens about 8 calendar days after the Notice of Hearing is served. |
| Regional decision and election notice | The Regional Director decides whether a question of representation exists and sets the election type, date, time, place and eligibility period. | No mandatory 20-business-day waiting period; the election is set for the earliest practicable date. |
| Secret-ballot election | Eligible employees vote under Regional Office instructions. | The NLRB customer-service standard says an election normally occurs within 25–30 days after a regional decision following hearing issues. |
| Tally and disputes | Ballots are counted; parties may challenge voter eligibility or object to conduct affecting the election. | Routine, non-determinative issues may be resolved quickly; determinative challenges or objections can require investigation or a hearing. |
| Certification or dismissal | The Board certifies the union if it receives a majority of votes cast, or resolves the case under its procedures if it does not. | The NLRB customer-service standard describes a regional report or supplemental decision in about 35 days without a post-election hearing or 85 days with one. |
Those figures are service standards and event-specific anchors, not promises for every case. The actual duration depends on the procedural posture, the Regional Office, the issues raised and whether anyone seeks review.

Before an NLRB petition: authorization cards and the choice of route
Showing of interest
A union normally begins by collecting signed authorization cards or other evidence that a sufficient number of employees support representation. The cards support the showing-of-interest requirement for an RC petition; they are not themselves a certification. The Regional Office examines the petition and supporting showing to determine whether an election should be conducted.
RC, RD and RM petitions
An RC petition asks for initial certification of a union. An RD petition is generally used when employees or another eligible party seek to decertify an existing representative. An RM petition is filed by an employer that claims a question of representation exists. The stages and timing discussed here focus on the RC route, but the same kinds of unit, election and post-election disputes can affect the other petition types.
When voluntary recognition may avoid an election
An employer may voluntarily recognize a union after the union demonstrates majority support through authorization cards or another method. That agreement occurs outside the NLRB election process, so there is no Regional Office election to schedule or tally. The parties can move directly into bargaining, subject to the legal rules governing recognition and bargaining.
When voluntary recognition is reported to the Board, the NLRB explains that a 45-day notice period can apply during which a properly supported petition may be filed. The agency also describes a reasonable bargaining period of at least six months and no more than one year after recognition. Because those periods concern challenges to recognition and the protected bargaining relationship—not the time needed to conduct an election—they should not be added to an RC-election estimate.
Step-by-step NLRB election timeline
1. File the petition and establish the showing of interest
The union files the RC petition with the appropriate NLRB Regional Office. The filing identifies the employer, the proposed bargaining unit and the union seeking to represent it. The showing of interest is submitted in the manner required by the Board. The Regional Office then investigates whether the petition is properly supported and whether a genuine question of representation exists.
There is no fixed number of days from filing to the first response that applies nationwide. Missing information, jurisdictional questions, an unclear unit description or competing claims can lengthen the investigation. Early agreement on the employer identity, facility locations and proposed unit gives the Regional Office fewer threshold issues to resolve.

2. Serve notices and address the bargaining unit
Once the petition is processed, the employer generally must post and distribute the Notice of Petition for Election within 2 business days under the 2023 representation-case rule. The notice informs employees that a petition has been filed and explains how to obtain information about the proceeding. The employer should follow the Regional Office’s instructions on locations, electronic distribution and the period the notice must remain available.
The parties also identify the employees who should be included in the bargaining unit. Typical questions include whether a classification shares a community of interest with the proposed unit, whether supervisors or confidential employees are excluded by law, which locations belong in the unit and what eligibility date should govern voting. Agreement on those points allows the case to proceed without a hearing.
3. Hold a pre-election hearing if issues remain
If the parties cannot agree on the unit, election details or another material issue, the Regional Office issues a Notice of Hearing. Under the 2023 rule, a typical pre-election hearing opens about 8 calendar days after the notice is served. The hearing is used to create a record on issues the Regional Director must decide before voting; it is not a full trial on every workplace dispute.
Preparation matters because the hearing can determine which employees vote and whether the election can be scheduled. Parties should identify witnesses, payroll or classification records and stipulations in advance. A hearing may be postponed when the parties need additional time, when a party raises a threshold jurisdictional issue or when the Regional Office grants an extension.
4. Receive the Regional Director’s decision and election notice
After an agreement or hearing, the Regional Director decides whether a question of representation exists. The decision ordinarily specifies the election type, date, time, location and eligibility period, along with the unit description and voting instructions.

The current process does not impose a 20-business-day waiting period before voting. Instead, the election is scheduled for the earliest practicable date consistent with notice, ballot preparation and the parties’ opportunity to communicate with employees. The practical interval can differ by region and by the amount of work required to resolve pre-election issues.

5. Campaign and prepare for secret-ballot voting
Before the election, the union and employer communicate with employees about representation. Campaign conduct must comply with the National Labor Relations Act and Board standards. The Regional Office provides the official voting instructions, including the polling method, locations, hours and eligibility list procedures.
Employees who meet the eligibility requirements cast secret ballots. The ballot normally asks whether employees wish to be represented by the petitioning union. The number of eligible employees is not the same as the number needed to win: certification generally turns on a majority of votes actually cast, not a majority of everyone on the eligibility list.
6. Count the ballots and prepare the tally
At the close of voting, the ballots are counted and a tally is prepared. The tally reports the votes for and against representation, challenged ballots and any other categories required by the Regional Office. A party may challenge a ballot when it has a good-faith question about the voter’s eligibility, such as employment status, classification or inclusion in the unit.

Most challenges do not require immediate litigation. If the challenged ballots cannot affect the result, the Regional Office may leave them unresolved without changing the outcome. If the number of potentially decisive challenges is large enough to alter who has a majority, the Regional Office investigates eligibility and may hold a post-election hearing.
7. File objections to conduct affecting the election
A party may file objections alleging conduct that affected the fairness or outcome of the election. Objections can concern statements, threats, promises, interference with access to voters or other conduct covered by Board standards. The objection must be filed within the deadline in the Regional Office’s instructions and should identify the conduct and its alleged effect.
The Regional Director determines whether an investigation is needed. If the allegations are unsupported or could not have affected the result, the objections may be overruled without a hearing. Substantial disputes can lead to an investigation, a post-election hearing, a rerun election or another remedy.

8. Issue certification, dismissal or a further decision
After resolving determinative challenges and objections, the Board certifies the union when it has received a majority of votes cast. If the union does not obtain that majority, the result is handled under Board procedures and the petition may be dismissed. A rerun election can be ordered when misconduct requires a new vote.
The NLRB’s current customer-service standards describe about 35 days for a regional report or supplemental decision after challenges or objections when no post-election hearing is held, and about 85 days when a post-election hearing is held. Those periods are measured from the post-election record to the regional report or decision; they are not a guaranteed total case length.
How long after filing is the election?
There is no universal filing-to-election average. In a case with an agreed unit and no significant dispute, the Regional Office can move from petition processing to an election without a pre-election hearing. In a contested case, the hearing schedule, briefing, decision and any review request come first.
The clearest current anchor is the NLRB customer-service standard that an election normally occurs within 25–30 days after a regional decision following hearing issues. That clock starts after the Regional Director has issued the relevant decision; it does not mean every petition reaches an election within 25–30 days of filing. The 8-calendar-day hearing-opening schedule and 2-business-day notice-posting requirement are earlier procedural events, not promises of a total duration.
Agreed election versus contested pre-election hearing
| Issue | Agreed election | Contested hearing |
|---|---|---|
| Bargaining unit | The parties stipulate to the unit or resolve the description with the Regional Office. | The parties present evidence and argument on classifications, locations or exclusions. |
| Scheduling | The Regional Office can set the election once administrative details are complete. | The hearing must open, the record must close and the Regional Director must issue a decision before voting is set. |
| Delay risk | Lower, assuming no later objections or eligibility disputes. | Higher because continuances, briefing, a decision or review can postpone the election. |
| What the parties should prepare | A signed agreement, eligibility list information and agreed voting logistics. | Witnesses, payroll and classification records, proposed unit language and legal arguments. |
An agreement reduces procedural work but does not eliminate post-election risks. Even an agreed election can produce challenged ballots or objections if voter eligibility or campaign conduct is disputed.

| Comparison | Voluntary recognition | NLRB election and certification |
|---|---|---|
| Evidence of majority support | The employer recognizes the union based on authorization cards or another accepted showing. | The union proves support through a secret-ballot election conducted under NLRB supervision. |
| Procedural safeguards | No NLRB election process is required at the moment of recognition; the parties must comply with recognition and bargaining rules. | Regional Office procedures govern notice, eligibility, voting, counting and post-election disputes. |
| Timing control | The employer and union can agree on recognition without waiting for an election date. | The Regional Office controls the procedural schedule and sets voting at the earliest practicable date. |
| Review or challenge window | When recognition is reported to the Board, a 45-day notice period can apply for a properly supported petition. | Parties may request Board review within 14 days of certification, election results or petition dismissal. |
| Exposure to election objections | There is no campaign or ballot tally to challenge, although recognition can still be contested under applicable law. | Challenged ballots, objections, investigations, hearings, rerun elections and litigation can delay final certification. |
| Post-recognition bargaining period | NLRB guidance describes a reasonable period of at least six months and no more than one year. | Certification establishes the representative; bargaining then proceeds under the parties’ statutory obligations. |
What causes an NLRB case to take longer?
- Unit disagreement: Disputes over classifications, facilities, supervisors or exclusions require a pre-election record and decision.
- Incomplete or contested filings: Questions about the showing of interest, jurisdiction or the employer’s identity can delay initial processing.
- Board review: A party can seek review of certification, election results or petition dismissal within 14 days, adding another procedural layer.
- Challenged ballots: Determinative challenges require the Regional Office to investigate eligibility before the result can be finalized.
- Objections: Allegations of conduct affecting the election may require an investigation or post-election hearing.
- Post-election hearing: A hearing lengthens the time to a regional report or supplemental decision; the NLRB standard is about 85 days with a hearing versus about 35 days without one.
- Litigation or extraordinary events: Court proceedings, requests for injunctions, changes in the workplace or regional administrative constraints can move the case outside the ordinary schedule.
These are contingencies, not additions that can be stacked into a guaranteed forecast. A case may encounter several of them, or none.

Can challenged ballots delay union certification?
Yes, when the challenged ballots are potentially determinative. A challenge asks whether a particular voter was eligible; it does not automatically invalidate the election. If counting or excluding the challenged ballots cannot change which side has a majority, the Regional Office may resolve the case without a full eligibility hearing. If the challenges could change the outcome, the office investigates, may take evidence at a hearing and then issues a report or supplemental decision before certification.
Objections are different. They concern conduct that allegedly affected the integrity or fairness of the election, such as coercion or improper interference. A case can have both challenged ballots and objections, and either issue can delay certification when the result depends on it.
Do employees and employers have to hold an NLRB election?
No. An employer can voluntarily recognize a union after a valid majority showing, so long as the recognition complies with applicable labor law. That route avoids the NLRB election timetable. However, recognition can trigger the 45-day notice period described by the Board, and a properly supported petition filed during that period can place the representation question before the NLRB.
If the parties use the petition route, the election is conducted by secret ballot and the Regional Office controls the procedural schedule. The choice between voluntary recognition and an election affects evidence, timing, safeguards and exposure to later challenges; it should be evaluated with labor counsel familiar with the current Board rules.
A practical planning checklist
- Define the unit early. List every classification and location the union seeks to include, and flag likely supervisor, confidential-employee or community-of-interest disputes.
- Organize the showing of interest. Keep authorization-card records and petition information in the format the Regional Office requires; do not treat card totals as a guaranteed election result.
- Track the notice deadlines. After the Notice of Petition for Election, confirm that the employer posts and distributes it within the generally applicable 2-business-day period.
- Prepare for an 8-day hearing opening. If a Notice of Hearing is served, identify witnesses and documents promptly because the typical hearing opening is about 8 calendar days later.
- Confirm the eligibility period. Review the Regional Director’s unit description, voter eligibility date, polling place and voting hours as soon as the election notice arrives.
- Plan for post-election filings. Record the tally, calendar the deadlines for challenges and objections, and preserve evidence relating to any conduct that could affect the result.
- Separate the election estimate from certification. Use the 25–30-day standard only as an expectation from the regional decision to the election, then allow additional time for determinative disputes and any 35- or 85-day post-election report period.
- Calendar review rights. A party generally has 14 days to request Board review of certification, election results or petition dismissal.
Bottom line
Union recognition through the NLRB usually takes several distinct stages, not a fixed number of days. Current rules point to a pre-election hearing about 8 calendar days after notice, employer petition-notice posting within 2 business days and an election normally within 25–30 days after a regional decision following hearing issues. Certification can follow promptly when no dispute affects the result, but determinative challenges, objections, post-election hearings, review or litigation can add weeks or months. Voluntary recognition is faster in the sense that it bypasses the election, yet it has its own 45-day notice and six-month-to-one-year bargaining-period rules when reported to the Board.
