In broad terms, GST registration is generally linked to the ₹20 lakh turnover threshold (₹10 lakh in specified northeastern and hill states), accommodation GST is 12% at or below ₹7,500 per unit per day and 18% above that tariff, and an online platform may withhold 0.1% under section 194-O. If you pay more than ₹50,000 a month in rent to a resident landlord, section 194-IB can require a separate 2% TDS deduction.
These are separate systems. GST charged to a guest, income-tax treatment of your profit or rent, platform withholding, and TDS on rent paid to your landlord must each be checked on their own facts.

When does a homestay need GST registration?
Airbnb’s India tax guide says a host generally is not liable to register until aggregate turnover exceeds ₹20 lakh, with a ₹10 lakh threshold in specified northeastern and hill states listed in that guide. Treat those figures as a starting point, not a universal exemption. The property’s state and the nature of your supplies must be confirmed, and all taxable supplies that count toward aggregate turnover have to be considered together.

Calculate aggregate turnover across the activity
Do not look only at the amount transferred to your bank account. A platform may deduct its fee, taxes or other charges before payout, while the booking record shows a larger guest charge. Keep the gross booking value, cancellations, refunds, cleaning or other separately charged services, platform deductions and the amount actually received in a reconciliation file. That record lets you test the threshold consistently and explain differences between booking statements and bank credits.
Check the state before relying on the threshold
The ₹10 lakh figure applies only to the specified northeastern and hill states identified in the host tax guide. A host in another state should not adopt that lower number merely because the property is small or called a homestay. If you operate in more than one state, obtain advice on registration and turnover treatment for each registration location rather than assuming that one listing determines the answer for all properties.
Registration is not the same as final tax liability
Crossing a threshold creates a registration question; it does not by itself determine your income-tax profit, the amount of GST embedded in a displayed price, or the amount a platform withholds. Once registered, issue the required tax invoices, charge the applicable GST, maintain prescribed records and complete the relevant returns. A host who is below the threshold still needs to examine local tourism, municipal and tax rules.
Which GST rate applies to the room?
CBIC’s published rate table places hotel accommodation, including the accommodation category used for hotels, inns, guest houses and homestays, into two tariff bands:
| Value of the unit per day | Total GST rate | How to use the band |
|---|---|---|
| ₹7,500 or less | 12% | Use this entry where the unit’s value is at or below ₹7,500 per day and the notification conditions are met |
| Above ₹7,500 | 18% | Use this entry where the unit’s value exceeds ₹7,500 per day and the notification conditions are met |
“Per unit per day” is important: assess the tariff for the accommodation unit, not simply the guest’s total bill for a multiday stay. The CBIC table also contains conditions concerning specified premises and input-tax-credit treatment, so the percentage should not be separated from the wording of the applicable notification.

What changed for specified premises from 1 April 2025?
Notification 05/2025 changed the definition of “specified premises” with effect from 1 April 2025. It includes premises from which the supplier provided hotel accommodation above ₹7,500 per unit per day in the preceding financial year. It also covers premises for which a registered supplier files the required declaration in the prescribed window. Because the definition can affect the applicable GST treatment and credit conditions, preserve the prior-year tariff evidence and any declaration submitted under the notification.
Homestay, guest house and residential dwelling are not interchangeable labels
GST Council material places accommodation supplied by a hotel, inn, guest house, homestay, club or campsite under heading 9963. The same material distinguishes taxable accommodation from a residential dwelling rented for use as a residence. A short stay marketed with hospitality services should not automatically be treated as a long-term residential letting, and calling a property a “homestay” does not settle the classification. Examine the actual contract, duration, services and use of the premises.
Illustrative rate calculations
The following arithmetic illustrates the published percentages only. It assumes the quoted tariff is before GST; if your advertised price is GST-inclusive, the tax component must be backed out instead.
- A ₹7,000 daily tariff at 12% produces ₹840 GST and a ₹7,840 tax-inclusive amount.
- A ₹9,000 daily tariff at 18% produces ₹1,620 GST and a ₹10,620 tax-inclusive amount.
These examples do not decide whether you are registered, whether a platform is the supplier for a particular transaction, or whether another notification condition applies.
A practical GST workflow for a host
- Describe the supply. Record whether you provide a room, an entire dwelling, a guest house or another accommodation unit, the normal nightly tariff, the stay length and the services supplied.
- Establish the property’s state. Check the state threshold and any state-specific registration position before comparing your turnover with ₹20 lakh or ₹10 lakh.
- Aggregate the turnover. Combine the taxable supplies that count, using gross booking and adjustment records rather than only net platform payouts.
- Classify the tariff band. Test each unit against ₹7,500 per day and read the CBIC conditions on specified premises and input-tax credit.
- Register when required. After registration, configure your invoices and booking workflow to show the legally required particulars and GST separately where appropriate.
- Reconcile every month. Match invoices to booking statements, cancellations, refunds, platform fees, GST collected and bank receipts. Keep the evidence used for the threshold and tariff decisions.
Is the income house-property income or business income?
The Income Tax Department states that income is taxable under “Income from House Property” when it arises from a property consisting of a building or land appurtenant to it and the statutory ownership conditions are met. In practical terms, an owner who lets rooms with limited services may have a house-property position.

The same guidance says that where the person receiving the rent is not the owner, the receipts are chargeable as business income or residual income rather than house-property income. A lessee who takes a property and sublets it therefore cannot simply claim the owner’s house-property treatment because the receipts are described as rent.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsFacts that can move the classification
- Owner with relatively passive letting: House-property treatment may be relevant when the principal activity is letting the building or appurtenant land and services are limited.
- Owner running hospitality operations: Regular guest turnover, substantial services, staffing, meals, concierge functions or an organised accommodation business can support a business-income analysis.
- Lessee or operator: A person operating from leased premises or subletting generally needs a business-income or residual-income analysis because that person is not the property owner.
- Mixed activity: A host can have different facts for different properties or periods. Do not force every receipt into one head without reviewing ownership, contracts and services.
The head of income affects bookkeeping, deductions and the return schedules used. Keep the ownership or lease deed, service descriptions, invoices and operating records so the position can be explained. Where the activity is substantial or the lease permits subletting, obtain fact-specific professional advice rather than relying on the listing title.
Why did the booking platform deduct tax?
Section 194-O applies when an e-commerce operator facilitates a resident participant’s sale of goods or provision of services through its electronic platform. The current statutory text requires the operator to deduct income tax at 0.1% of the gross amount of those sales or services. A resident host whose accommodation bookings are facilitated online can therefore see a withholding line in the platform payout statement.
Withholding is a credit, not your final tax
Suppose the platform reports ₹1,00,000 of gross accommodation services for a period. At 0.1%, the section 194-O withholding is ₹100. That ₹100 is not a 0.1% limit on the income tax ultimately payable on your profit or rental income. It is tax withheld in advance and should be matched to the credit appearing in your tax statements and claimed according to the applicable return position.
Reconcile gross and net figures
Use a period-by-period schedule containing:
- guest booking value and the dates of service;
- cancellations, refunds and adjustments;
- GST charged or collected, where applicable;
- platform commissions and other deductions;
- gross amount used for section 194-O withholding;
- tax withheld at 0.1%; and
- the net payout deposited to your bank.
This prevents two common errors: treating the bank credit as turnover, and treating the 0.1% deduction as the complete tax on the activity. If a statement does not match the credit shown in your tax records, request a corrected statement from the operator and retain both versions.

Do you have to deduct TDS from rent paid to your landlord?
This is a different obligation from GST charged to guests and section 194-O withholding by a platform. The TDS CPC FAQ states that section 194-IB applies when an individual or HUF tenant pays monthly rent above ₹50,000 to a resident landlord. It also states that the rate changed from 5% to 2% from 1 October 2024 and identifies Form 26QC as the challan-cum-statement.
Example
If an individual tenant pays ₹60,000 monthly rent to a resident landlord after 1 October 2024, the 2% rate produces ₹1,200 of TDS for that month. The example illustrates the threshold and rate; confirm the period, landlord’s residence status and the form procedure before deducting.
Keep the rent obligation separate
A host can simultaneously have all three flows:
- GST collected on taxable accommodation supplied to guests;
- 0.1% income-tax withholding by an e-commerce operator on gross facilitated services; and
- 2% TDS deducted from qualifying rent paid to the landlord under section 194-IB.
Record each against its own agreement, statement and reporting requirement. Do not net one deduction against another in the books merely because all appear around the same payout cycle.
Local permissions and taxes still matter
Central GST and income-tax rules do not replace local compliance. Tourism registration, municipal permissions, local taxes, guest-registration or police-reporting rules, fire precautions and other safety requirements vary by state and city. A property can be below the GST registration threshold and still require a tourism or municipal approval. Conversely, obtaining a local homestay registration does not decide the GST rate or income-tax head.
Recommended Free Tools
Before accepting guests, check the authority responsible for the property’s location and ask for the current requirements for short-term accommodation. Keep copies of registrations, renewals, inspection records and guest-reporting confirmations with the property file.

Records, mistakes and corrective steps
Mistake: using the listing name as the tax classification
Fix: Describe the actual premises, contract, duration and services. “Homestay,” “villa,” “serviced apartment” and “rent” are commercial descriptions, not conclusive tax categories.
Mistake: comparing only net payouts with the threshold
Fix: Reconcile gross booking statements, platform fees, refunds and GST before calculating aggregate turnover.
Mistake: applying 12% or 18% without checking the tariff basis
Fix: Document the per-unit, per-day tariff and review the CBIC conditions, including the specified-premises rules effective from 1 April 2025.
Mistake: treating platform TDS as the final income tax
Fix: Claim the 0.1% withholding as a tax credit and compute your actual liability under the correct income head.
Mistake: overlooking rent TDS because the platform handles guest payments
Fix: Review the separate landlord agreement. If you are an individual or HUF tenant paying a resident landlord more than ₹50,000 a month, check section 194-IB, the 2% rate applicable from 1 October 2024 and Form 26QC.
Core records to retain
- ownership documents or the lease and subletting permission;
- nightly tariff sheets and evidence supporting the ₹7,500 band;
- booking, cancellation and refund reports;
- platform fee and payout statements;
- GST registration, invoices and return workings, if registered;
- section 194-O withholding statements and tax-credit records;
- rent invoices, landlord details and Form 26QC evidence where applicable; and
- state or municipal licences and guest-reporting records.
A decision path for common host models
| Host model | Questions to resolve first | Likely tax focus |
|---|---|---|
| Owner occasionally lets a room | Is the activity a taxable accommodation supply, what is aggregate turnover, and what is the nightly tariff? | GST threshold and tariff band; possible house-property treatment if letting is relatively passive |
| Owner operates a regular hospitality business | What services, staffing and guest facilities are provided? | GST registration and rate; business-income analysis |
| Lessee sublets or operates the accommodation | Does the lease permit the activity, and what is the service model? | GST threshold and rate; business or residual income rather than owner’s house-property income |
| Platform-facilitated resident host | What gross amount does the platform report and withhold on? | Section 194-O reconciliation at 0.1% |
| Individual or HUF paying a landlord above ₹50,000 monthly | Is the landlord resident and does section 194-IB apply for the payment period? | 2% rent TDS from 1 October 2024 and Form 26QC |
The safest sequence is to classify the supply, test the state-specific turnover threshold, apply the tariff-based GST entry, identify the income-tax head from ownership and operations, reconcile any platform withholding, and separately test rent TDS and local permissions. Revisit the analysis when the tariff, ownership, lease, services or property location changes.
