ASML can sell some chipmaking systems to Chinese customers only after the relevant authorities approve an export licence. The controls are not one blanket prohibition: Dutch, United States and European Union rules can require a licence, impose conditions, delay shipment or result in a denial, depending on the machine, its software and services, the destination and the specific customer or fab.
What an export control changes in an ASML sale
An export control inserts a government review between ASML and shipment. A customer may have a purchase agreement, but ASML cannot legally dispatch the equipment until the required authorisation is in place. Officials examine the technology, where it will go and who will operate it. The result can be approval, approval with conditions, a request for more information, a delay or a refusal.

The Dutch government describes its system as case-by-case licensing and explicitly says the requirement is “not an export ban.” That distinction matters. A licence requirement can still prevent a particular transaction, but it does not automatically prohibit every sale of every ASML tool to a country.
Controls can also apply after the scanner leaves the factory. Software updates, metrology functions, installation assistance and other services may be restricted, so a customer’s ability to install, upgrade or maintain a machine can depend on the same licensing regime.

Which ASML equipment is covered?
The scope has expanded beyond the most advanced lithography systems. The exact obligation depends on the product classification, the exporting jurisdiction and the destination.

“DUV” and “EUV” describe different lithography technology groups, but neither label alone determines the legal outcome. A particular DUV model, software package or metrology module may be controlled in one transaction and require a different analysis in another because the destination or end user changes.
Who decides whether an ASML shipment can go ahead?
Dutch government: the central authority for exports from the Netherlands
For equipment exported from the Netherlands to destinations outside the European Union, Dutch national rules are decisive. On 7 September 2024, the Netherlands expanded its authorisation requirement to additional advanced semiconductor-manufacturing equipment, specifically DUV lithography exported on that route. The Dutch government says it assesses applications individually.
ASML said the change means it applies to the Dutch government for export licences for the TWINSCAN NXT:1970i and NXT:1980i systems, rather than applying to the US government for those exports. NXT:2000i and later DUV systems were already subject to Dutch controls. EUV sales are also subject to licence requirements.

Dutch Foreign Trade and Development Minister Reinette Klever explained the policy on 6 September 2024: “I’ve made this decision for reasons of security. We see that technological advances have given rise to increased security risks associated with the export of this specific manufacturing equipment, especially in the current geopolitical context.”
United States: jurisdiction that can follow technology and destination
US export-control rules can apply through US-origin technology and other jurisdictional links, not only to a machine physically shipped from the United States. ASML’s 2 December 2024 statement said the US update added metrology and software to restricted technologies and added mainly Chinese fab locations.
That destination detail is important. Two customers seeking comparable equipment can face different outcomes if one intends to install it at a location identified by the US rules. ASML also noted that comparable Dutch security assessments could affect DUV exports to those locations. The applicable US authorisation is handled under the relevant US export-control process; the available statements do not identify a single approval office for every possible transaction.

European Union: a common control list, implemented through national licensing
In November 2025, certain Dutch national controls were incorporated into the EU Control List, according to ASML’s 2025 annual-report materials. The change means those items are no longer only a Dutch national concern in the way they were previously described; they are part of a wider EU control framework. Exporters still need to follow the licensing procedure applicable in the member state from which the goods leave the EU.

How a controlled sale is evaluated
The public statements do not provide a universal processing time or a guaranteed approval standard. They do show the decision points that determine whether an order can ship.
- Classify the item. ASML and the authorities identify the exact scanner model, components, metrology or inspection equipment, software and services involved. A model number matters: NXT:1970i and NXT:1980i entered the Dutch application process in September 2024, while NXT:2000i and later systems were already covered.
- Identify the exporting jurisdiction. An export from the Netherlands to a destination outside the EU is assessed under Dutch national requirements. US-origin technology or another US jurisdictional connection can trigger US rules as well.
- Check the destination and facility. Authorities examine the country, named customer and intended fab. The US update specifically added mainly Chinese fab locations, so the same class of tool may receive different treatment at different sites.
- Review the end use and services. The assessment can extend to how the equipment will be used and whether software, installation, maintenance, upgrades, metrology or other support will be supplied.
- Submit the licence application. ASML applies to the authority required for the transaction. For the newly covered DUV models exported from the Netherlands, that authority is the Dutch government.
- Receive a decision or conditions. A government may approve, condition, delay or deny the transaction. A licence requirement by itself does not predict which of those outcomes will occur.
- Control later activity. Shipment, re-export, software delivery and service work must remain within the licence and any subsequent rule changes. A previously approved sale does not create a permanent exemption from new controls.

The table should not be read as an EUV-versus-DUV ban chart. Both categories can require a licence, and either can be affected by software, service, destination or end-user restrictions.
How the rules changed from 2024 through 2025
September 2024: Dutch expansion to additional DUV equipment
The expanded Dutch authorisation requirement took effect on 7 September 2024. It covered additional advanced semiconductor-manufacturing equipment, including DUV lithography exported from the Netherlands to destinations outside the EU. ASML identified NXT:1970i and NXT:1980i as the newly covered systems for which it would apply to the Dutch government.
December 2024: wider US technology and location controls
On 2 December 2024, ASML said the updated US regulations added metrology and software to restricted technologies and added mainly Chinese fab locations. This broadened the compliance question from “Can the scanner ship?” to “Can the associated measurement tools, software and services be supplied to this particular facility?”

January 2025: additional Dutch controls
ASML’s 2025 annual-report materials describe another Dutch expansion effective 15 January 2025. The materials do not provide a single short list in the available statement for every affected product, so the applicable classification must be checked for each transaction.
November 2025: incorporation into the EU Control List
In November 2025, certain Dutch national controls were incorporated into the EU Control List. Exporters therefore need to account for both the EU framework and the national licensing process that applies at the point of export.

That was forward-looking guidance made before the 2025 results were reported, so it should not be substituted for the later 29.1% historical figure. The difference illustrates why readers must distinguish a forecast from a completed-year result.
These percentages cover ASML’s total net sales, not a separately published EUV or DUV split. They therefore show the scale of China exposure but cannot establish how much revenue came from any particular machine family, software product or service contract.
What a licence requirement means for customers and suppliers
- Purchase orders are not shipment permissions. A commercial agreement does not override the government authorisation needed before export.
- Delivery schedules can move. A review adds an administrative step, and requests for information or conditions can postpone shipment.
- A machine is not the whole transaction. Metrology, inspection, software, installation and support may be independently relevant to the control analysis.
- Site selection matters. A customer’s fab address can change the outcome, particularly where US rules identify specific Chinese locations.
- Rules can change after planning begins. The September 2024, January 2025 and November 2025 changes show that a compliance assessment must be refreshed when regulations are amended.
- Approval is not guaranteed by precedent. A licence issued for one model, customer or destination does not establish that another transaction will be approved.
How to read headlines about an “ASML ban”
Headlines often compress several legal questions into the word “ban.” Ask five narrower questions instead: Which exact system or software is involved? From which country is it exported? Which authority’s rules apply? Which customer and fab will receive it? Does the licence cover later service and software activity?
If the answer is that a licence is required, the legally accurate description is “restricted pending authorisation,” not an unconditional worldwide ban. If an authority denies a specific application or prohibits exports to a named location, that narrower decision can effectively block that transaction while leaving other licensed sales possible.
What is not publicly established by the available statements
The cited government and company materials do not publish a universal approval rate, standard processing time or a complete list of individual licence decisions for 2026. They also do not provide a product-by-product breakdown of China revenue. Any claim that every Chinese customer is barred, that every DUV system is treated identically, or that a licence will be granted within a fixed period goes beyond the documented facts.
