Cloud GPU access does not put export controls out of reach. Under the U.S. Bureau of Industry and Security (BIS) rules in force on October 20, 2026, the controlled item can be the advanced GPU or server in a provider’s data center, while the decisive facts can include your company’s headquarters, ultimate parent, customer, intended use, model-weight location and the provider’s authorization. A server in Singapore is not automatically outside the rules if the customer or ultimate parent is headquartered in China, Macau or another Country Group D:5 destination.
Before you rent capacity, identify the hardware and its classification, map every relevant legal entity and location, describe whether you will train, fine-tune, evaluate, infer or store model weights, and confirm that a license, exception or Data Center Validated End User (VEU) authorization actually covers the transaction. Treat the provider’s marketing description as a starting point, not as a legal determination.

What export controls change for a cloud-GPU developer
Export controls are not limited to shipping a graphics card across a border. The Export Administration Regulations (EAR) can regulate an advanced-computing integrated circuit, a server containing one, a reexport or transfer, the end user and the end use. Renting compute as infrastructure-as-a-service (IaaS) may leave title to the hardware with the cloud provider, but the provider still has to manage export, reexport, transfer, end-user and end-use obligations. Your access method does not erase the controlled item.
The practical result is that GPU selection becomes a jurisdiction, identity, end-use and provider-compliance decision. A compliant deployment needs an auditable answer to five questions: what item is being supplied, where it is physically and legally supplied from, who ultimately receives the benefit, what the workload does, and which authorization permits it.

Why a remote GPU can still be a controlled export
The hardware remains the regulated object
BIS identifies advanced-computing items in classifications such as ECCN 3A090 and 4A090. Related servers and electronic assemblies can fall under entries including 5A992.z. A developer may see only a virtual machine, container or API endpoint, while the provider is operating the physical accelerator and server. The provider must therefore classify the equipment, control access and determine whether a release, reexport or transfer is allowed.
Cloud geography has more than one meaning
Record at least three locations: the data center holding the GPU, the legal entity supplying the service and the customer’s headquarters or ultimate parent. Data may also be copied to storage, backup or support systems in additional countries. A contract that names a facility in an approved country does not answer the headquarters or ultimate-parent question, and an IP address is not a substitute for customer due diligence.
Headquarters and ultimate parent can decide eligibility
BIS’s May 31, 2026 clarification says licensing requirements can follow an entity headquartered in Country Group D:5 or Macau even when that entity operates, owns servers or receives the service elsewhere. EAR provisions also address a foreign-located cloud or data-server provider whose headquarters or ultimate parent is in a restricted destination. Consequently, moving a workload from China to Singapore, Japan or another third country is not a dependable workaround.

A subsidiary’s local office may not change the analysis if the relevant parent remains headquartered in a restricted destination.
Training, fine-tuning, inference and model weights are not treated alike
Pretraining and prohibited training
The VEU acceptable-use text restricts training a specified advanced AI model outside approved destinations or providing that training as IaaS to an entity headquartered outside those destinations unless the required authorization exists. The May 13, 2025 BIS guidance also warns that advanced-computing ICs and servers in ECCNs such as 3A090.a, 4A090.a and 5A992.z can be subject to controls when the provider knows they will support a prohibited end use or user.

Fine-tuning and evaluation
Limited fine-tuning can be permitted under the stated threshold in the applicable VEU language, but the threshold and destination conditions must be checked against the current EAR text. Evaluation, benchmarking and safety testing should be described separately from training because the activity, model, data and location may produce a different result. Do not label a substantial additional training run as mere fine-tuning to fit a preferred exception.
Inference and API access
The cited VEU paragraph does not prohibit API access or IaaS inference, subject to its future-equivalence provisions and other controls. That is not a blanket inference safe harbor. The hardware, customer, destination, model, prohibited end use and any separate model-weight rule still matter. Providers should record what service is being delivered and preserve a way to suspend access if the legal analysis changes.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteModel-weight storage and transfer
Model weights are separately restricted in the relevant framework. Storing weights in one country, replicating them to a backup region or allowing a contractor to download them can be a controlled transfer even when the original training happened elsewhere. Map every persistent copy, export path, administrator role and support process, and apply access controls that match the authorization.
End use, end user and knowledge obligations
BIS catch-all controls can apply when an exporter or provider has knowledge that an AI model or commodity will support prohibited weapons-of-mass-destruction or military-intelligence end uses or users. Knowledge can come from a customer statement, technical documentation, transaction pattern, public information or an internal warning. An automated country check alone is therefore insufficient.
Use an intended-use statement that identifies the application, users, model purpose, training data, fine-tuning objective, deployment countries and any government, military or sensitive-industry customer. Establish an escalation route for contradictions, evasive answers, unusual payment or shipping instructions, requests for administrator access, or attempts to move weights to an unapproved region.

How Data Center VEU authorization works operationally
BIS expanded the Validated End User framework to eligible data centers on September 30 and October 2, 2024. A Data Center VEU is a trusted-destination authorization, not a universal permission for every customer or workload. The data center must satisfy physical, cybersecurity, accounting and geographic conditions while the transaction must remain within the authorization’s scope.
Security and technical safeguards
- Maintain safeguards aligned with NIST Special Publication 800-53 and FedRAMP High expectations.
- Protect model weights, proprietary techniques and other sensitive information from unauthorized access.
- Use identity, privilege, logging and segmentation controls that let the operator identify who accessed which GPU, data set or weight.
- Detect tampering and preserve evidence for investigation.
Shipment and incident controls
- Maintain positive chain of custody for controlled hardware shipments and transfers.
- Secure packaging, receipt, inventory and installation records so equipment cannot be diverted unnoticed.
- Report theft, loss or tampering as required by the applicable VEU and EAR provisions.
- Keep accounting records that reconcile equipment, capacity allocation and transfers.
Geographic allocation limits
The EAR text cited for VEU structures imposes quantitative limits on where computing power can be installed or transferred. The percentages below are limits in that provision, not a general quota for every cloud customer.
| Provision | Limit | How to read it |
|---|---|---|
| Qualifying VEU outside specified approved countries | 25% of total AI computing power | Maximum share that may be transferred or installed outside the approved-country set described in the rule. |
| Any single country outside those approved countries | 7% of total AI computing power | Maximum share that may be transferred or installed in one such country under the cited provision. |
| U.S.-headquartered UVEU outside the United States | 50% of total AI computing power | Maximum share that may be transferred or installed outside the United States under the cited provision. |
Because these percentages are measured against the qualifying entity’s total AI computing power, ask the provider how it calculates the denominator, which facilities are included and how additions or relocations affect the calculation.
Key BIS milestones that shape current cloud decisions
| Date | Development | Developer significance |
|---|---|---|
| September 30 and October 2, 2024 | BIS expanded VEU authorization to eligible data centers. | Trusted facilities received a path to handle advanced compute, but only with security, accounting, chain-of-custody and geographic controls. |
| January 13, 2025 | BIS announced the AI Diffusion framework. | The framework revised EAR controls on advanced-computing chips, added a control on certain advanced closed-weight models and updated license exceptions and Data Center VEU rules. |
| May 13, 2025 | BIS issued AI-training guidance. | The guidance highlighted ECCNs 3A090.a, 4A090.a and 5A992.z and explained catch-all exposure when there is knowledge of prohibited WMD or military-intelligence end use. |
| January 13, 2026 | BIS changed the China licensing policy for specified high-end chips. | Nvidia H200, AMD MI325X and similar chips may receive case-by-case review when supply, customer-compliance and independent-testing conditions are met. |
| May 31, 2026 | BIS clarified headquarters treatment. | Licensing requirements can follow entities headquartered in Country Group D:5 or Macau even when their operations or servers are outside those locations. |
A practical pre-deployment workflow
Run the following sequence before committing to a long-term reservation, moving a production model or materially increasing capacity.
- Classify the capacity. Ask the provider for the GPU family, complete server configuration, relevant ECCN or classification, physical service location and the legal entity supplying the capacity. Request written confirmation of whether the classification has changed between regions or generations.
- Map the parties. Record your headquarters and ultimate parent. If you are serving another party, record that customer’s headquarters, ultimate parent, beneficial owners, contractors and anyone who can administer the environment or download weights.
- Describe the activity precisely. State whether the job is pretraining, fine-tuning, evaluation, inference, data preprocessing or model-weight storage. Identify the model, approximate scale, data sensitivity, expected users and all countries where data, weights and support access will reside.
- Screen counterparties. Check customers, beneficial owners, contractors and other counterparties against applicable restricted-party lists and Entity List controls. Retain the date, list version, search terms and disposition of possible matches.
- Test authorization. Determine whether a license exception, Data Center VEU authorization or case-by-case license covers this exact item, party, destination, activity and quantity. Do not infer eligibility from a provider’s marketing page or from the fact that another customer uses the same GPU.
- Contract for evidence and control. Require provider attestations, location notices, transfer records, access logs, incident reporting, audit rights and a process for suspending or relocating capacity if a rule changes. Align data-retention and deletion terms with model-weight restrictions.
- Recheck before scaling. Review BIS country groups, ECCN thresholds, provider terms and the customer’s ownership before adding regions, changing models, increasing capacity or enabling a new administrator. A previously acceptable pilot does not automatically authorize production expansion.

What the January 2026 China policy does—and does not—allow
BIS’s January 13, 2026 announcement is a licensing-policy change, not blanket permission for China-linked workloads. Applications involving H200, MI325X and similar chips may receive case-by-case review only when the stated conditions are met.
- The export must not reduce semiconductor capacity available to U.S. customers.
- The Chinese purchaser must maintain export-compliance procedures, including customer screening.
- Independent testing in the United States must verify performance and security.
BIS Under Secretary Jeffrey Kessler said that export controls should evolve with technology while protecting national security. BIS also said that permitting controlled H200 sales could strengthen the American technology ecosystem. Those statements describe the policy rationale; they do not replace an application, a license or the conditions attached to one.
License Exception LPP and other numerical limits
The current EAR Part 740 text describes a limit of 26,900,000 cumulative TPP per calendar year for License Exception LPP to a single ultimate consignee. Treat this as the stated annual limit for that exception, not as a general amount of compute any developer may consume. Confirm what the relevant TPP measure means for the transaction, who the ultimate consignee is and whether other conditions of LPP are satisfied.
Likewise, the 25%, 7% and 50% VEU allocation figures are conditional limits in the cited EAR provisions. They do not prove that a particular region, instance type or customer is approved.
Common mistakes and how to correct them
Mistake: treating an overseas region as a workaround
Correction: analyze headquarters, ultimate parent, customer and provider ownership alongside the physical server location. Obtain a written determination before moving compute to a third country.

Correction: document the actual operation, including gradient updates, data volume, model changes and duration. Ask counsel or the provider’s export team to classify the activity rather than relying on a service label.
Mistake: checking only the account owner
Correction: screen beneficial owners, contractors, administrators and downstream customers. A reseller or local subsidiary can still connect the transaction to a restricted parent or end user.
Mistake: ignoring weights after the job finishes
Correction: inventory checkpoints, replicas, snapshots, backups and downloads. Set deletion, export and support-access rules before training begins.

Records to retain
A defensible file should connect the technical deployment to the legal conclusion. Keep the provider’s GPU and ECCN statement, data-center and legal-entity locations, ownership chart, customer and beneficial-owner screening, intended-use certification, workload description, authorization or license analysis, purchase orders, transfer and relocation records, access logs, incident reports and security evidence. Retention periods and required records depend on the applicable EAR provision and contract, so follow the longer applicable requirement.
What these rules do not establish
There is no aggregate public statistic in the cited primary sources showing how many developers have been blocked or the total price impact on cloud GPU users. The available official material establishes legal thresholds, allocation limits and compliance conditions instead. The framework described here is the U.S. BIS/EAR framework as of October 20, 2026; the European Union, United Kingdom, China and other jurisdictions may impose additional controls. A transaction-specific classification or legal opinion may be necessary before deployment.
