International recognition is a state’s acceptance of an entity as a state. Under the prevailing declaratory approach, recognition acknowledges a status; it does not, by itself, create statehood. In practice, however, recognition can shape whether an entity can establish diplomatic and legal relationships or participate in international organizations. A declaration of independence, a claim to statehood, recognition by other states and admission to the United Nations are separate steps, each answering a different question.
What has to happen before a breakaway region can be treated as a state?
A declaration of independence announces an intention to form a separate state. It is not proof that one exists. The Netherlands Advisory Committee on Issues of Public International Law explains in its 2018 report, The aspirations for independence by the Kurdish Autonomous Region of Iraq, that an aspiring state would generally need its own institutions and effective, stable control over the territory it claims. The existing state may retain or regain control, and the population’s support is relevant to assessing the situation.

International lawyers commonly use the four criteria in Article 1 of the 1933 Montevideo Convention to assess statehood. The Dutch advisory report says they are generally regarded as part of customary international law, but cautions that they are not a mechanical checklist: they were framed to identify an already independent state, and their application depends on intention and the facts.

Does declaring independence make the region a country?
No. A declaration is distinct from both statehood and the legality of secession. In its 22 July 2010 advisory opinion on Kosovo, the International Court of Justice considered whether the declaration of independence before it accorded with international law. The Court expressly said its question “does not ask whether or not Kosovo has achieved statehood.” It also did not decide the validity or legal effects of recognition by states that had recognized Kosovo. The opinion therefore is not a ruling that Kosovo—or any other breakaway region—is a state, nor that every unilateral secession is lawful.

Is there a general right to secede?
Self-determination does not generally amount to an unrestricted right to break away from an existing state. The Dutch advisory report describes internal self-determination within existing borders as the general rule. External self-determination is recognized in particular contexts, including decolonization and foreign subjugation. Whether a broader right of “remedial secession” exists when a population suffers severe denial of self-determination remains disputed.
Separately, a declaration may not be prohibited even where there is no established positive right to secede. The ICJ’s Kosovo opinion addressed the declaration’s accordance with international law, not a general entitlement to independence. The legality of any particular case depends on its facts and applicable rules. Unlawful force or another serious breach of a peremptory norm of international law can also affect whether a claim to statehood may lawfully be recognized.

What does recognition by another country mean?
Recognition is a decision by a state to accept an entity as a state. It may be explicit or inferred from conduct, according to the Dutch advisory report. Under the prevailing declaratory account, recognition does not create statehood and there is no general duty to recognize every entity that appears to meet the statehood criteria. But recognition is not merely symbolic: it can enable diplomatic relations and other legal dealings, while non-recognition can make it harder for an entity to act internationally.

Those examples illustrate how recognition can operate; they are not a current list or census of states’ positions. Recognition of a state should also be distinguished from dealings with a particular government that claims to represent it.

How many countries have to recognize a breakaway region?
There is no universal minimum number of recognizing states that settles statehood. A recognition count may describe diplomatic support at a particular date, but it is not a substitute for assessing the entity’s characteristics, the circumstances of its claimed independence and relevant international-law rules. Recognition positions can change, so any count needs to identify the entity, the date and what is being counted.
Can a breakaway region join the United Nations?
UN membership is separate from both a declaration of independence and bilateral recognition. Admission is governed by the UN Charter’s institutional process; it does not follow automatically from a declaration or recognition by some states. International organizations also have their own admission rules, so membership in one organization does not itself establish membership eligibility or admission to another. The World Bank Legal Review discusses this distinction and gives historical examples; those examples should not be treated as current membership information.

How should two breakaway-region claims be compared?
Apply the same questions to each case rather than treating a recognition count or any single criterion as a verdict:

- Population and territory: Is there a permanent population and defined territory, and what disputes affect the boundaries?
- Independence and external capacity: Does the entity intend to act independently, and can it conduct external relations?
- Legal circumstances: Is the claim connected to decolonization or foreign subjugation, or affected by unlawful force, a serious breach of a peremptory norm, or a relevant Security Council measure?
- Diplomatic and institutional position: Which states recognize the entity, what relationships follow, and has it separately been admitted to the organizations at issue?
These questions keep statehood, the right to secede, recognition and organizational membership distinct. The answer in a particular case turns on the facts and applicable rules, not a single diplomatic act.
