How Colleges Investigate Sexual Assault Reports: Process, Evidence and Timelines

A college report can prompt a response and supportive measures. A formal complaint may begin a structured Title IX process, with evidence review, a hearing and an appeal under the rules that apply to the case.

In the United States, a report can prompt a college to respond and offer supportive measures; a formal complaint can start a structured Title IX grievance process. That process may include an investigation, evidence review, a live hearing and an appeal, but which rules apply—and how long the process takes—depends on the case and the college’s current policy.

This guide describes the federal Title IX framework, not every college disciplinary process, state-law requirement, criminal investigation or individual case. The U.S. Department of Education said that a federal district court vacated the 2024 Title IX Final Rule on January 9, 2025, and identified the 2020 regulations as the basis for its Office for Civil Rights (OCR) enforcement. Because rules and campus policies can change, check the college’s current Title IX policy and the current OCR guidance for the matter at hand.

What happens after you report sexual assault to a college?

A report and a formal complaint are different steps. A report can give the college notice of an alleged incident. When a covered school has actual knowledge of sexual harassment within the applicable Title IX scope, it must respond promptly in a way that is not deliberately indifferent. The Title IX Coordinator should explain available supportive measures and the route for filing a formal complaint. Supportive measures can be available whether or not a formal complaint is filed.

A report does not, by itself, mean that a formal Title IX grievance procedure has begun, or that the school has found anyone responsible. A college may also have other conduct policies and reporting routes. Ask the Title IX Coordinator which process applies to the report and what options are available under the institution’s written policy.

What starts the formal Title IX investigation?

A formal complaint starts the federal grievance procedure described under the 2020 regulations. Once that procedure applies, the school follows required steps for notice, investigation, evidence review, decision-making and appeal. The precise policy and whether the federal procedure applies to a particular matter should be confirmed with the college.

The procedure is intended to gather and assess information impartially—not to presume that either party is responsible. OCR describes effective procedures as including an adequate, reliable and impartial investigation, with an opportunity for the parties to present witnesses and other evidence.

What are the stages of a college Title IX case?

  1. Written notice: The school gives written notice of the allegations under the applicable procedure.
  2. Investigation: The investigator gathers and assesses information relevant to the allegations. The parties may present witnesses and other evidence.
  3. Evidence review: Under the 2020 regulations, the parties have an equal opportunity to inspect and review evidence directly related to the allegations before the investigative report is completed, and to submit written responses.
  4. Investigative report: The school prepares a written report for the next stage of the procedure.
  5. Live hearing at a postsecondary institution: Under the 2020 federal procedure, each party’s advisor may ask the other party and witnesses relevant questions, including through cross-examination. If a party does not have an advisor, the school must provide one for that purpose. The decision-maker determines which questions are relevant.
  6. Written determination and appeal opportunity: The school issues a written responsibility determination and provides an opportunity to appeal under the applicable procedure.

The hearing rules above describe the 2020 federal procedure at postsecondary institutions; they should not be assumed to govern every college conduct process. Under that procedure, there are also limits on relying on statements from a person who does not submit to cross-examination at the hearing, subject to the regulation’s conditions. The school’s policy explains how the hearing and decision rules apply in a particular case.

What evidence can be used in a Title IX investigation?

Potential evidence includes the parties’ accounts, witness accounts, and relevant documentary or other material. What is relevant, how evidence is considered, and whether a particular item can be relied on depend on the allegations and the school’s procedure. No type of evidence should be assumed to be automatically admitted or decisive.

The federal framework provides for an impartial investigation and opportunities for both parties to present evidence and respond to relevant evidence. In a matter governed by the 2020 procedure, the parties’ equal opportunity to review evidence directly related to the allegations before the report is completed is distinct from the later hearing and decision stage.

How long does a Title IX investigation take?

There is no universal number of days that applies to every college investigation. OCR calls for reasonably prompt timeframes for major stages, but the time required can vary with the complexity, severity and extent of the allegations, as well as the school’s process. The specific steps can also vary with the nature and source of the complaint, the age of the students involved, and the school’s size and administrative structure.

For a useful estimate, read the college’s published Title IX policy for its target durations and rules for extensions. Those are policy timeframes, not a guarantee that an individual case will finish by a particular date.

Is OCR’s 180-day period the college’s investigation deadline?

No. The Department of Education’s general guidance says an OCR complaint usually must be filed within 180 days of the incident. That is a filing period for an external complaint to OCR, not the time allowed for a college to complete an investigation. A person does not have to first use the school’s grievance procedures before filing with OCR. Check OCR’s current instructions for the applicable requirements and any case-specific rules.

A campus Title IX grievance, an OCR complaint and a law-enforcement investigation are distinct routes. This federal campus process guide does not determine whether a criminal investigation or another school procedure is available in a particular situation.

What support and privacy should a reporting person expect?

The Title IX Coordinator can explain supportive measures and how to file a formal complaint. Contact the college’s Title IX office or consult its written policy for the actual options, contacts and procedures at that institution. Do not assume that a report will be kept absolutely confidential: what the school can keep private and what steps it can take depend on the circumstances and applicable policy.

If there is an immediate safety emergency, contact emergency services or campus safety; that is separate from the Title IX grievance procedure.
