An environmental protest does not automatically suspend an offshore gas project in Australia. It can create a lawful delay when campaigners challenge a specific approval or regulator decision through statutory submissions, a reconsideration request, Federal Court judicial review, or an urgent interlocutory injunction. The court tests whether the decision was made lawfully; it does not re-run the political or scientific merits simply because opponents object.
What a protest can—and cannot—do
Peaceful demonstrations, blockades and public campaigns have no automatic legal effect on an approval. Work continues unless the proponent, regulator or court takes a step that changes the project’s legal position. The practical objective is therefore to connect the protest to a decision, duty or condition that Australian law recognises.

- Regulatory route: file evidence and submissions with the decision-maker before a decision, or seek reconsideration where the relevant statute allows it.
- Judicial-review route: ask the Federal Court to examine whether a Commonwealth decision-maker acted within power, followed mandatory procedures and considered required matters.
- Injunction route: seek an urgent order restraining drilling, pipeline construction or other work while the court determines the underlying case.
- Merits limitation: a court will not substitute its preferred climate, economic or energy policy for the legally authorised decision-maker’s view.
The strongest cases identify an exact decision, a statutory duty and evidence showing why the alleged defect matters before irreversible work occurs.

The main legal options compared
| Option | Decision or work targeted | What must be shown | Potential result | Main exposure |
|---|---|---|---|---|
| Regulator submission or complaint | Pending environment-plan, referral, approval or condition | Evidence relevant to the statutory criteria and consultation record | Changed conditions, further information requests or a different decision | No guaranteed pause; depends on the regulator’s powers and timing |
| Judicial review | Completed federal approval or NOPSEMA decision | Jurisdictional error, failure to consider a mandatory matter, improper procedure, unlawful purpose or consultation defect | Quashing order, declaration or mandamus requiring lawful reconsideration | Usually no final refusal; costs and an adverse judgment are possible |
| Interlocutory injunction | Drilling, seabed work, pipeline construction or related activity pending trial | Arguable case, urgency and balance of convenience favouring restraint; evidence of harm and an undertaking as to damages | Temporary, partial or conditional halt | Damages exposure under the undertaking and possible security or costs orders |
| EPBC challenge or reconsideration | Referral decision, controlled-action approval, conditions or refusal to reconsider | Possible significant impact on a matter of national environmental significance, or an error in applying EPBC duties | Reconsideration, remittal or altered conditions | Outcome depends on the statutory pathway and available standing |
Challenging a NOPSEMA environment-plan decision
Why the environment plan matters
For offshore petroleum activities, the National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA) assesses an environment plan under the offshore petroleum environmental regulations. Acceptance permits the activity to proceed subject to the plan and its conditions. That acceptance is a distinct legal decision from a separate approval under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act).

A challenge can focus on whether the plan met the acceptance criteria, whether consultation was legally adequate, or whether NOPSEMA acted beyond the power given by the regulations. The Parliamentary Bills Digest (2024) records litigation about NOPSEMA decisions, including arguments concerning consultation and the authority to impose or rely on particular conditions.
Judicial review is about legality, not whether the project is desirable
In the Scarborough litigation, Justice Shaun McElwaine described the task as deciding whether it was legally open to NOPSEMA to accept the environment plan, rather than scrutinising the plan’s merits. ABC News reported his conclusion: “I have concluded it was open to NOPSEMA to accept the environment plan as meeting the environment plan acceptance criteria.” That illustrates why broad opposition to gas, without a statutory error, is unlikely to succeed.
A claimant would normally need to identify the decision, the legal source of power, the mandatory criterion allegedly missed, and the evidence showing the error. A court may remit the matter for a fresh decision, but it does not itself write a replacement environment plan.

What can be challenged
Judicial review can attack the process used to make a decision, including jurisdiction, mandatory considerations, legally unreasonable reasoning, improper purpose and required consultation. It is not a merits appeal and does not guarantee that a project will ultimately be refused.

The Federal Court filing in Friends of Australian Rock Art Inc v Minister for Environment and Water relies on section 5(1) of the Administrative Decisions (Judicial Review) Act 1977 and section 39B of the Judiciary Act 1903. It seeks “a quashing order, a declaration, and an order in the nature of mandamus requiring that the proposed action be re-considered and a decision made according to law.” The case concerns the North West Shelf extension approval made on 12 September 2025, subject to 48 conditions and effective until 31 December 2070.
EPBC duties that can matter
The filing describes the EPBC framework in which the Minister decides whether to approve a controlled action, may impose conditions needed to protect or mitigate matters of national environmental significance, and must consider environmental, economic and social matters. Where National Heritage values are engaged, the Minister must also avoid acting inconsistently with the applicable National Heritage management principles.
Possible grounds therefore include failure to consider a protected matter, reliance on an incorrect factual premise, inadequate emissions or mitigation conditions, failure to consider economic detriments, or inconsistency with heritage-management principles. Each ground must be tied to the statutory text and the decision record; a general assertion that climate change was not taken seriously is not enough on its own.
What happens if the challenge succeeds
The usual remedy is to set aside the decision and send it back for lawful reconsideration. The project may be delayed while that occurs, especially if related work cannot proceed without the impugned approval. Remittal is not a guaranteed refusal: the Minister or agency could make the same substantive decision again after correcting the legal error.

Getting an urgent interlocutory injunction
The threshold
An injunction is the fastest potential way to pause work. The applicant asks the Federal Court to restrain specified activities until the final hearing or another court order. The court generally asks whether there is a serious question to be tried (or an arguable case), whether the balance of convenience favours restraint, and whether damages would be an adequate remedy.
Evidence should address the timing of mobilisation, the exact activity to be stopped, the environmental or cultural harm that may occur before trial, the prospects of restoring the site, and the financial and operational loss to the proponent. Applicants commonly must give an undertaking as to damages, promising to compensate loss if the injunction later proves unwarranted.
What the reported cases show
In Munkara v Santos NA Barossa Pty Ltd (No 2), the court was reported as finding a serious question concerning an environment-plan obligation and granting an injunction over part of the affected area. The order was not a blanket cancellation of the project; its scope followed the arguable legal issue and the area at risk.

The Tipakalippa litigation shows the discretionary nature of relief. Reported factors included the strength of the prima facie case, delay, possible cultural and marine harm, financial loss, urgency and the undertaking as to damages. Relief can be refused, narrowed, varied or later lifted. A protest group should therefore define a proportionate order rather than ask for an unlimited project-wide ban without evidence.

EPBC referral, approval and reconsideration
When the EPBC Act enters the picture
A proposed offshore action that may significantly affect a matter of national environmental significance can require referral under the EPBC Act. Depending on the referral decision, the project may become a controlled action requiring assessment and approval, potentially with enforceable conditions.
Environmental Justice Australia has described the North West Shelf challenges as raising arguments that the approval, and a refusal to reconsider climate impacts, did not comply with the EPBC Act. A campaign should distinguish among three different targets: the initial referral decision, the approval and conditions, and a later decision refusing reconsideration. Each has different statutory criteria and timing.
Heritage and cultural evidence
For projects affecting heritage places or cultural values, evidence should identify the value, the statutory protection engaged, the consultation undertaken and the specific condition or reasoning alleged to be inadequate. National Heritage principles may be relevant to the Minister’s decision, but heritage status does not automatically create a veto over every offshore activity.
Traditional Owner consultation and cultural rights
Traditional Owners do not receive an automatic power to veto an offshore gas project merely by objecting. Their legal influence depends on the statute, the affected area, recognised heritage or cultural interests, and the decision-maker’s consultation obligations.
Best Value
Consultation can become legally significant where an environment plan or approval requires the proponent to identify and engage relevant persons, assess cultural and marine risks, respond to information supplied, or implement agreed protection measures. A claimant should show what information was withheld or ignored, who should have been consulted, when consultation occurred, and how the defect could have changed the decision or conditions.
Cultural evidence can also affect the injunction balance. Courts may weigh disturbance to sacred places, sea Country, cultural practices and marine resources alongside the proponent’s mobilisation costs and contractual losses. The evidence should be specific, preferably supported by statements from knowledge holders and technical material explaining the timing and irreversibility of the harm.
Standing, timing and evidence
Who may bring a case
Standing depends on the statute and the applicant’s connection to the decision. Incorporated environmental organisations may be able to rely on section 487(3) of the EPBC Act, subject to that provision’s requirements. Traditional Owner organisations, affected individuals and other bodies may have different bases for standing. A court will not assume that every campaign participant can challenge every approval.

Act before drilling, seabed disturbance or pipeline work makes the alleged harm irreversible. Delay in seeking relief can weaken urgency and the balance of convenience, even where an arguable case exists. Applicants should obtain the decision and reasons promptly, check any statutory filing period, and seek interim directions if the complete record is not yet available.
Evidence checklist
- Identify the exact decision, decision-maker, statutory instrument and date.
- Obtain the accepted environment plan, approval, conditions, consultation records, reasons and relevant scientific or cultural material.
- Map each alleged defect to a mandatory statutory requirement or limit on power.
- Document the work schedule, vessel movements, drilling window and the point at which harm or expenditure becomes difficult to reverse.
- Prepare expert and Traditional Owner evidence on environmental, marine, heritage and cultural impacts.
- Quantify the proponent’s likely loss and propose a realistic undertaking as to damages.
- Frame the requested order narrowly enough for the court to supervise and enforce.
A practical campaign sequence
- Track the approvals: determine whether the immediate decision is a NOPSEMA environment-plan acceptance, an EPBC referral or approval, a heritage decision, or a state or territory permit connected to onshore infrastructure.
- Make the record: submit focused objections and supporting evidence while the decision-maker can still act on them. Ask for written reasons and identify unanswered consultation issues.
- Test reconsideration: where the EPBC Act or another instrument provides a reconsideration mechanism, file within its deadline and explain the new information or legal error.
- Obtain legal advice on review: select the correct Federal Court jurisdiction and pleading, such as an ADJR Act application or section 39B proceeding, rather than filing a general political objection.
- Seek interim restraint if necessary: file an injunction application before the critical work starts, with evidence addressing serious questions, irreparable harm, convenience and the damages undertaking.
- Continue lawful advocacy: use submissions, public meetings and peaceful protest without obstructing workers or breaching court orders. An unlawful blockade can create separate civil or criminal exposure and does not replace the legal case.
Likely outcomes and limits
- Temporary pause: the court may stop only the activity linked to the arguable defect or only for a defined period.
- Reconsideration: a successful judicial review usually returns the matter to the original decision-maker.
- Modified conditions: regulatory engagement may produce extra monitoring, consultation or mitigation requirements without stopping the project.
- Dismissal: if the decision was legally open to the regulator, the court will generally dismiss the challenge even when substantial opposition remains.
- Costs and damages: unsuccessful applicants can face adverse costs and liability under an undertaking given for an injunction.
The reported outcomes underline the uncertainty: Munkara produced limited interim restraint, relief in Tipakalippa was disputed or refused on the reported facts, and the Scarborough challenge was dismissed. No reliable general success rate or typical delay period has been established, so campaigners should not rely on an assumed probability or duration.
