When a bank-related dispute makes your GST invoices, returns, input-tax credit (ITC) records or payment trail appear inconsistent, do four things immediately: identify the exact notice or transaction at issue, preserve the original records, reconcile every disputed payment to an invoice, and respond through the prescribed GST channel before the stated deadline. Do not edit or delete an issued invoice merely because a bank statement is different. The bank’s tax treatment, your GST liability and the evidentiary value of a bank entry are separate questions that must be documented separately.
This guide applies to businesses in India dealing with an invoice or ITC mismatch, a payment or settlement discrepancy, a GST notice, or provisional attachment of a business bank account. It is general information, not a determination of liability. Confirm the current form, portal workflow, jurisdiction and tax period, and obtain advice from a qualified GST professional or lawyer for contested tax, attachment or appeal matters.

First establish what actually triggered the dispute
Start by obtaining the complete communication rather than relying on a phone call, a bank employee’s summary or a portal alert. Save the notice, order, summons, email with its headers, portal reference and proof of service in their original formats. Record the following in a control sheet:
- Form number and issuing authority.
- Your GSTIN, the bank or counterparty identified, and the relevant tax period.
- Invoice numbers, dates, taxable values, tax components and the amount said to be wrong.
- The response deadline, hearing date and the channel specified for filing.
- Whether the communication concerns the bank’s own GST treatment, an attachment of your account, a payment-reference or settlement mismatch, or an invoice, return or ITC discrepancy.
These categories lead to different remedies. A bank statement can show that money moved, but it does not by itself prove that a particular taxable supply occurred, that the recipient accepted it, or that ITC conditions were met. Conversely, a valid invoice and delivery evidence may establish a supply even when a payment was netted, reversed or made by a third party. Keep those propositions distinct in your analysis.

Lock the evidence before anyone changes it
Export records from the GST portal and accounting system on the day you begin. Keep both machine-readable files and PDFs, and preserve the original notice and emails. CBIC rules require a registered person to maintain registers of tax invoices, credit notes, debit notes and delivery challans, with links between source documents and the accounting audit trail that can be produced on demand.
Build one transaction-level schedule
Create one row for every disputed invoice or payment. Include:
- Invoice number and date, supplier or recipient GSTIN, taxable value and each tax component.
- E-invoice or IRN details where applicable, plus the purchase order, contract and delivery or service proof.
- The relevant sales or purchase ledger account and the GST return row.
- Bank value date, amount, UTR or other payment reference, and the account from which or to which the payment moved.
- Tax payment details, including the applicable electronic ledger or challan reference.
- A separate exception field for timing differences, bank fees, reversals, refunds, chargebacks, net settlement, duplicate entries or third-party payments.
Never overwrite an exported file. Use versioned filenames, restrict editing rights and preserve a read-only copy. Keep a short evidence index that gives each document an ID, description, date and the schedule rows it supports. This allows an officer or appellate authority to follow the trail without guessing which bank entry belongs to which invoice.

Request missing records in writing
Ask the bank for a written transaction trace, settlement statement and explanation of any withheld, reversed, netted or charged amount. Request the original value date and the bank’s reference, not just a screenshot from an online portal. Ask the supplier or customer for the signed or issued invoice, GSTIN, return-reporting evidence and proof of delivery or service. Preserve both your request and the reply; an unanswered request can itself explain why a document is unavailable.
Reconcile each variance instead of treating the statement as the answer
Match the invoice, supply evidence, return entry and bank movement in that order. For every exception, select a clear classification and state what evidence resolves it:
| Variance type | What to test | Useful evidence |
|---|---|---|
| Timing | Whether invoice, return, settlement and bank value dates fall in different periods | Invoice date, GSTR filing, settlement report, bank value date and contract terms |
| Amount | Whether fees, withholding, discounts, interest or net settlement explain the difference | Bank fee advice, settlement statement, credit/debit note and ledger posting |
| Identity | Whether the payer, beneficiary, GSTIN or bank account differs from the invoice party | Contract, customer confirmation, mandate, UTR and written third-party payment authority |
| Tax rate or place of supply | Whether the tax charged and jurisdiction match the transaction facts | Tax determination, registration details, shipping or service location and invoice |
| Duplicate or cancellation | Whether the same invoice or payment was reported twice or later cancelled | System audit log, cancellation record, return data and approval trail |
| Credit or debit note | Whether a later adjustment legally changes value or tax | Note, original invoice link, reason and return-period reporting |
| Unsupported item | Whether no reliable supply, payment or accounting evidence exists | Document-gap memo and follow-up requests; do not create substitute records |
Reconcile gross invoice value to the tax components and then explain why the bank amount may be lower or later. A payment reference demonstrates a financial movement; it should be connected to the supply through the invoice, contract, delivery or acceptance evidence and ledger entry. Where the bank has combined multiple invoices into one settlement, attach a remittance advice or your allocation worksheet and have the counterparty confirm it.

Correct records without rewriting history
Do not delete, backdate or overwrite the original tax invoice. If the facts and statutory conditions justify a correction, retain the original and issue the legally permitted document with a clear link to it.

Revised tax invoice
Use a revised tax invoice only where the applicable GST provisions permit it. Include the required identifying particulars, reference the original invoice number and date, state the reason for revision and retain the approval trail. Ensure that the corrected document flows to the appropriate return period and that the recipient’s records and ITC treatment are aligned.
Credit or debit note
Use a credit note for an eligible reduction, return, cancellation or other permitted adjustment, and a debit note where an eligible increase or correction requires it. Link the note to the original invoice, record the reason, obtain internal approval and report it in the return in which the adjustment is legally required. A bank chargeback does not automatically authorize a GST credit note; establish what happened to the underlying supply first.

When the correction period or facts are uncertain
Pause filing and obtain professional advice if the statutory time limit, place of supply, tax rate, recipient’s ITC or effect on an already-furnished return is unclear. A document that makes the ledger look tidy but conflicts with the supply facts can create a larger liability than the original mismatch.
Answering a notice, audit query or discrepancy
Prepare a cover letter that lets the reviewing officer test each allegation quickly. Number the allegations, then map each one to a schedule row and an evidence-index ID.
Recommended Free Tools
- State your position for every item. Mark it accepted, partly accepted or contested; do not use one blanket response for unrelated invoices.
- Explain the variance. Identify the timing, net settlement, reversal, fee, identity or tax-treatment issue and cite the attached record.
- Calculate separately. Show principal tax, interest and any potential penalty as separate amounts. Explain assumptions and identify amounts that are not admitted.
- Correct where appropriate. If a lawful revised invoice, credit note, debit note or return amendment has been made, give its reference and reporting period.
- Request a hearing when facts are disputed. State the issues that require oral clarification and ask that the hearing date and mode be confirmed.
- File through the specified route. Upload the response and attachments in the prescribed portal form or submit by the channel stated in the notice. Save the acknowledgement, ARN or receipt and a complete copy of what was filed.
For an assessment discrepancy, the CGST rules allow a registered person to accept the discrepancy and pay, or to furnish an explanation in FORM ASMT-11. Follow the form and deadline in the actual communication; a generic email or an attachment sent to the wrong office may not preserve your response rights.

If GST provisionally attaches the business bank account
Treat an attachment as an urgent legal event, not as an ordinary reconciliation query. Section 83 of the CGST Act permits provisional attachment of property, including a bank account, during specified proceedings when the Commissioner considers it necessary to protect revenue. The attachment should identify its written legal basis, the proceeding, the amount and the affected account.
- Obtain the signed provisional-attachment order and the proceeding or case reference on which it relies.
- Confirm the exact account number, date, amount and whether the bank has blocked all debits or only a stated sum.
- Ask the jurisdictional officer in writing for release, modification or clarification, attaching evidence that customer receipts, payroll funds, statutory remittances or trust money are unrelated to the disputed tax.
- Ask the bank for a written statement of the operational restriction and preserve evidence of failed payments or returned instruments.
- Seek urgent tax-law advice if payroll, statutory payments, essential suppliers or basic operations are blocked, or if the order appears to exceed the proceeding or amount stated.
Do not move funds to conceal them or open substitute accounts to defeat the order. Instead, document the operational harm and propose a narrowly tailored release or alternative security through the proper channel.
Retention, appeal and other deadlines
Records: the 72-month baseline
Section 36 of the CGST Act sets a baseline of 72 months from the due date of the relevant annual return for retaining books and records. The period can be longer where the records relate to an appeal, revision, proceeding or investigation. Keep the invoices, notes, bank statements, workings, correspondence, submissions, acknowledgements and hearing notes together for the longer applicable period, not merely until the account is reconciled.
Appeal: three months plus possible condonation
Under section 107, an aggrieved person generally has three months from communication of an appealable order to file the first appeal. The appellate authority may allow a further one month where sufficient cause is shown. Calculate the period from the actual communication date, not the date printed on the order, and confirm the required form, pre-deposit and any stay or recovery risk. Calendar an internal review date well before expiry so a missing document does not consume the condonation margin.
Bank details after registration
CGST Rule 10A generally requires bank-account details to be furnished within 30 days of registration, unless the rule’s earlier outward-supply filing trigger applies. Check the current rule and portal instruction for your registration status; this deadline is separate from responding to a dispute or attachment.
Choose the response route that matches the problem
| Situation | Primary decision | Questions to answer | Immediate record |
|---|---|---|---|
| Document mismatch | Correct lawfully or defend the existing record | Is a revised invoice, credit note or debit note permitted? Which return period and ITC are affected? | Original document, corrected document if permitted, approval and reconciliation |
| Notice or audit | Accept and pay, or submit a reasoned explanation | Which allegations are admitted? What are the separate tax, interest and penalty exposures? | Numbered response, evidence index, calculation and acknowledgement |
| Account attachment | Seek release, modification or clarification urgently | What proceeding, amount and account are stated? What operations and unrelated funds are blocked? | Order, bank restriction, operational-impact evidence and written request |
| Adverse order | Assess appeal and recovery strategy | When was it communicated? What pre-deposit, stay and documentary strengths apply? | Order, service proof, appeal computation and filing plan |
Common mistakes that weaken a defensible file
- Relying on a bank statement without connecting the entry to the supply, invoice and ledger.
- Editing an invoice PDF or deleting an accounting entry instead of preserving the original and using a permitted document.
- Submitting screenshots without native statements, UTRs, settlement reports or audit-trail exports.
- Combining timing, identity and tax-rate variances in one unexplained net figure.
- Ignoring a portal acknowledgement or assuming that a request for more time pauses the statutory deadline.
- Sending records that include unrelated customer money without explaining the segregation.
- Waiting for the bank and counterparty to agree before filing a timely, qualified response.
A strong file is chronological, indexed and honest about what remains unproved. It shows the original record, the transaction linkage, the reason for each variance, the lawful correction if any, and the action taken before the deadline.
