Banks protect customer data in AI systems by applying the same privacy, information-security, cybersecurity, fair-lending and third-party-risk obligations that govern other banking activities—then adding controls for model behavior, generated outputs and automated actions. Those controls begin before deployment: the bank defines the use case, limits the data and permissions involved, tests the system, monitors results and holds vendors to written requirements. A vendor, cloud platform or fintech does not take the bank’s legal responsibility away.
The exact architecture differs by bank, jurisdiction, data sensitivity and the system’s capabilities. U.S. federal regulators describe a risk-based approach rather than one mandatory design. The available regulatory material also does not provide a statistic showing how much these safeguards reduce exposure, so claims about effectiveness should remain qualitative.

Why AI creates distinct customer-data risks
AI systems can process large volumes of account, transaction, identity and interaction data. That scale can improve fraud detection, service and internal analysis, but it also expands the number of places where information might be copied, retained, transformed or exposed.
Quick wins for a faster PC:
Repair Windows errors before they cause bigger problemsFix Now →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Generative systems add a specific risk: proprietary or customer information can appear unintentionally in a generated answer or other output. Federal Reserve Governor Michael Barr has also warned that AI agents able to access sensitive customer information or authorize transactions may attract malicious actors. These are risks to control, not evidence that every AI system exposes data.

Risk depends on the data flow. A model that analyzes de-identified historical records inside a bank is different from a third-party assistant that receives live customer messages, and both differ from an agent that can change an account or approve a payment. A sound program evaluates each use rather than treating “AI” as a single risk category.
Start with governance and use-case classification
Before an AI system is approved, the bank should document what it does, what information it can reach, who owns the decision and what could happen if it fails. The practical comparison axes below reflect regulator discussions of model risk, privacy, security and third-party oversight; they are not a universal regulator checklist.
| Question | Lower-risk characteristics | Higher-risk characteristics |
|---|---|---|
| Data sensitivity and volume | Limited, masked or aggregated records | Large volumes of identifiable customer, credential or transaction data |
| Deployment model | Controlled internal environment | External model, cloud service or fintech receiving bank data |
| Output behavior | Internal summaries reviewed by staff | Customer-facing responses that could reveal protected information |
| Ability to act | No connection to accounts or payment systems | Permission to retrieve records, alter accounts or authorize transactions |
| Business criticality | Experimental or advisory use with easy human review | Fraud, credit, compliance or operations decisions where an error can harm a customer |
| Jurisdiction | One clearly defined legal and supervisory regime | Cross-border processing or multiple privacy and banking regimes |
This classification determines the depth of review, testing, access restrictions, human involvement and vendor oversight. The OCC’s 2026 revised model-risk guidance describes a risk-based approach covering model development and use, validation and monitoring, governance and controls, and vendor products. It also says practices suitable for one institution or use may not suit another.
That bulletin is not a comprehensive generative-AI rule. It expressly excludes generative and agentic AI, does not establish prescriptive requirements and is not an enforceable standard. Banks therefore have to combine it, where applicable, with existing privacy, security, consumer-protection and operational controls.
Control the data throughout its lifecycle
Inventory and minimize what the system receives
Teams should identify every field sent to a model, every system that can retrieve information and every destination that stores prompts, responses, logs or training data. Data minimization means supplying only what the approved task requires. Masking, tokenization or aggregation can reduce exposure when a full identity or account number is unnecessary.
Separate environments and permissions
Production customer records should not flow into an unapproved development experiment. Banks can separate test and production environments, restrict which models can be called, and assign access according to job role and use case. Service accounts should have only the permissions needed for the documented task, especially when an AI component can query internal systems.

Protect data in transit, use and storage
OCC testimony emphasizes that banks must comply with applicable privacy and information-security requirements while using AI and maintain cybersecurity practices that safeguard sensitive data. In implementation, that means protecting connections and stored artifacts, controlling administrative access, monitoring unusual retrieval and preserving reliable logs. It also includes defenses against corrupted data compromising an AI application.
Set retention and deletion rules
A bank should know how long prompts, outputs, intermediate files and vendor copies remain available, who can retrieve them and how deletion is verified. Contracts and technical settings should align retention with the approved business purpose and applicable recordkeeping obligations. “The model is hosted elsewhere” does not answer where customer information is retained or who can use it.
Screen and review outputs
Generated text or classifications can contain confidential information, factual errors or unsupported inferences. Output controls can detect sensitive fields, route high-impact responses to trained staff and prevent an answer from being sent until required checks are complete. Customer-facing uses need clear ownership for correcting an erroneous response and handling a complaint or suspected disclosure.
Secure generative AI and AI agents
Generative AI can reproduce information from the context it receives in a response. Banks therefore need rules for which prompts may contain customer data, which models are approved and whether a provider may retain or reuse submissions. Staff should have an approved channel and a clear prohibition on pasting sensitive information into unapproved tools.
Agentic systems require an additional security boundary because they can retrieve information or take actions. A practical design separates reading from changing data, limits each tool call to a defined scope, records the identity and purpose behind an action, and requires human confirmation for transactions or other irreversible effects. Continuous monitoring should look for unusual access, repeated failed requests and actions outside the agent’s documented role.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsThese controls address the access and security risks highlighted by Barr without implying that all agents are unsafe. The level of restriction should reflect what the particular agent can reach and the harm a mistaken or malicious action could cause.

Test, validate and monitor models
For models within its scope, the 2026 revised model-risk guidance discusses development and use, validation, outcomes analysis, monitoring, governance and controls. Banks can use those practices to establish evidence that a system performs as intended and to detect deterioration after deployment.
Before deployment
- Define the intended purpose, acceptable inputs, expected outputs and failure conditions.
- Check data quality, representativeness and lineage, including whether sensitive fields are being used unnecessarily.
- Validate performance against the use case and examine errors that could create consumer, privacy or security harm.
- Confirm that access, logging, escalation and human-review procedures work in the actual operating environment.
After deployment
- Monitor performance and outcomes for drift, unexpected behavior and changes in the underlying data.
- Review access logs, incidents, complaints and overrides, not only accuracy scores.
- Reassess the system when its model, data source, vendor, permissions or business purpose changes.
- Keep governance records showing who approved the use, who can pause it and how remediation is tracked.
There is no single testing protocol mandated by the cited bulletin, and its scope does not extend to every generative or agentic system. Banks must set controls proportionate to the technology and risk, while still meeting other applicable legal requirements.
Manage vendors, cloud providers and fintechs
External providers may supply a foundation model, a hosted application, cloud infrastructure or specialized expertise. OCC testimony identifies robust due diligence, contract management and ongoing oversight scaled to the service’s criticality as key controls.

Plan and perform due diligence
Before sharing data, the bank should map the provider’s service, subcontractors, locations, access paths and incident processes. It should evaluate security, privacy, resilience, model documentation, testing evidence and the provider’s ability to support audits and investigations. The review should be deeper when the service affects payments, credit, fraud controls or a large population of customers.
Put data rights in the contract
Written terms should identify data ownership, permitted uses, confidentiality duties, security requirements, retention and deletion, breach notification, cooperation with regulators and conditions for subcontracting. They should state whether the provider can use prompts, outputs or derived data for training or other purposes, rather than leaving that question to a generic policy. Roles and responsibilities for model changes, incidents and customer complaints also need to be explicit.
Monitor throughout the relationship
Approval is not the end of oversight. Banks should review service reports, incidents, access records, material model changes and evidence that contractual controls remain effective. A provider’s compliance statement cannot replace the bank’s own risk assessment for the way it uses the service.

Prepare for exit
Termination planning should cover data return or deletion, revocation of credentials, migration to another process, continued access to logs and handling of a provider outage. The 2023 interagency guidance organizes third-party oversight across planning, due diligence, contracting, ongoing monitoring and termination.

The bank remains accountable
The 2023 interagency third-party risk guidance states that using a third party can increase a banking organization’s risk but “does not diminish or remove” its responsibility to perform activities safely and comply with applicable laws, including those protecting customer information. Outsourcing a model or cloud service therefore does not outsource accountability.
Federal Reserve Governor Michelle Bowman summarized the broader principle in a November 22, 2024 speech: “AI is not exempt from current legal and regulatory requirements, nor is its use exempt from scrutiny.” Read the Federal Reserve speech.
Those requirements can include privacy, information security, cybersecurity, fair lending, consumer protection and third-party risk management. Which rules apply depends on the bank, product, data, activity and jurisdiction. A bank’s AI program must fit that legal context rather than relying on a technology label.

Questions customers and oversight teams can ask
A bank will not disclose every defensive detail, but a useful inquiry focuses on accountability and data use:
The Tool Desk
Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →- What customer data does this AI feature receive, and is any of it retained or reused by a provider?
- Can the system access account records or initiate an action, and when is human approval required?
- How are outputs checked before they affect a customer?
- How are incidents, complaints, model changes and vendor failures handled?
- Which legal and supervisory requirements govern the particular product and location?
For institutional risk and compliance teams, the same questions become evidence requests: data-flow diagrams, permission inventories, validation results, monitoring reports, contract clauses and exit plans. The answers should correspond to the use case’s sensitivity and criticality, not to a generic claim that the system is “secure.”

Common control failures and fixes
Unapproved tools receive sensitive data
Failure: Employees paste customer information into a consumer or unapproved model. Fix: Provide an approved environment, block unsanctioned routes where feasible, minimize fields and train staff on permitted use.
Permissions are broader than the task
Failure: An AI service can search or change more records than its purpose requires. Fix: Narrow service-account permissions, separate read and write functions, require confirmation for high-impact actions and review access logs.
Contracts do not define data use
Failure: The bank cannot establish who owns prompts and outputs, whether data may be reused or how deletion works. Fix: Specify ownership, permitted uses, security, retention, incident response, audit support, subcontracting and termination duties before production access.
Validation happens only once
Failure: A model passes an initial review but changes in data, software or vendor behavior go unnoticed. Fix: Monitor outcomes and access continuously, set reassessment triggers and preserve authority to pause the system.
Guidance is treated as a GenAI certification
Failure: An institution presents the 2026 model-risk bulletin as a complete generative-AI rule or guarantee. Fix: State its scope and limitations accurately, then apply privacy, cybersecurity, consumer-protection and third-party controls relevant to the actual system.
What effective protection looks like in practice
A mature program connects governance to engineering and operations. It can show why a use case was approved, what data and permissions were necessary, how the system was tested, which vendor terms apply, who monitors it and what happens when results or circumstances change. It treats generated text and automated actions as controlled outputs rather than assuming that a model’s answer is harmless.
The central safeguard is accountability across the full data flow. Banks must protect information when AI is internal or outsourced, when a model only advises staff or when an agent can act, and when the relevant rule comes from privacy, cybersecurity, fair lending or third-party oversight. Technology can change the method of banking, but it does not remove the bank’s responsibility to keep customer information secure and use it lawfully.
