AI trading systems make money only when their forecasts and execution produce a risk-adjusted edge that remains positive after spreads, commissions, market impact, financing, borrow costs, taxes and other frictions. The software may process prices, order-book data, news and other information, turn those inputs into signals and position sizes, then place orders automatically. A correct prediction can still lose money if the trade is too expensive, too large or too late.
There is no regulator-backed universal win rate or return for AI trading. Some services are legitimate tools; others are poorly tested, operationally unsafe or outright fraudulent. The difference is demonstrated, cost-adjusted performance, clear risk controls, accountable custody and a business that does not rely on guaranteed-return claims.

What an AI trading system actually does
“AI trading” is a broad label rather than one strategy. A system may use conventional statistics, machine learning, deep learning or language models. The CFTC identifies several legitimate uses: investment research, analysis of unstructured data, execution timing and venue selection, discovery of price correlations, and algorithmic or high-frequency trading.
Most systems perform four decisions:
- Prediction: estimate direction, return, volatility, liquidity or the likely cost of an order.
- Portfolio construction: translate those estimates into positions, position sizes, hedges and exit rules.
- Execution: choose order type, timing and venue while attempting to limit slippage and market impact.
- Monitoring: compare live results with assumptions and adjust or stop the strategy when conditions change.
The model does not “know” the future. It calculates probabilities from the data and rules it was given. Those probabilities can be wrong, stale or distorted, and a self-updating model can change behavior in ways its operator did not anticipate.

The money-making loop, step by step
1. Data and feature construction
The system ingests historical and live prices, volume, spreads, order-book information and, in some designs, news, filings, social-media text, satellite observations or other alternative data. It converts raw inputs into features such as momentum, volatility, correlation, estimated liquidity or sentiment.
Data quality is part of the strategy. Missing timestamps, delayed feeds, survivorship bias, corporate-action errors or a source that changes its format can create signals that exist only on paper. Text systems can also produce hallucinated or corrupted outputs, a risk specifically noted by the CFTC.
2. Signal generation
A statistical or machine-learning model estimates what may happen over a defined horizon. A short-term execution model might forecast the next few seconds of liquidity; a portfolio model might estimate relative returns over days or weeks. The forecast is useful only when its expected advantage is larger than uncertainty and trading costs.

What is the holding period? Was the model trained on information available at the time of each historical decision? What benchmark is the result measured against? Without those details, a percentage return says little.
3. Portfolio and risk decisions
Signals become orders through rules for position size, leverage, concentration, stop conditions, hedges and turnover. A high-confidence signal does not automatically justify a large trade. Sound systems cap exposure to one asset, sector, strategy and counterparty; restrict leverage; and define what happens when prices, volatility or liquidity move outside expected ranges.

4. Execution
An execution algorithm can split an order, wait for liquidity, select a venue or choose between market and limit orders. Realized performance depends on spread, slippage, latency, fees, market impact and available depth. The SEC noted in a 2014 speech that algorithmic execution was associated with more than 10% lower large-order price costs in 2013 than in 2006. That figure describes execution costs in general, not a forecast that AI trading strategies will be profitable.
5. Feedback and supervision
After trades settle, the operator compares fills, risk and returns with the model’s assumptions. Updating can help when market conditions evolve, but it can also create model drift, unstable feedback or unintended behavior. A system needs a human-approved change process, versioned code and data, alerts and a way to halt trading.

Trading costs and financing
Gross backtest returns are not investor returns. Spreads and commissions apply to every round trip. Market impact rises when an order is large relative to available liquidity. Short positions may incur borrow charges; leveraged positions incur financing; and taxes can reduce the amount retained. Latency can turn a favorable quote into an unfavorable fill. A strategy with a small statistical edge may therefore have a negative net result.
Overfitting and regime change
Overfitting occurs when a model learns noise or peculiarities of its training period rather than a durable relationship. The danger is greatest when developers test many variables, assets and parameter combinations but show only the best result. A strategy can also fail without any coding error when volatility, liquidity, regulation or participant behavior changes. A backtest that spans one market regime cannot establish how the system behaves in another.
Bad, delayed or manipulated data
Signals fail when feeds are missing, delayed, biased or corrupted. A language model may confidently summarize a false headline; a price feed may repeat an old quote; an alternative-data source may change its sampling method. Deliberate manipulation is another risk: an attacker can seed false information or distort an input that the model treats as reliable.

Operational and model risk
Bugs, incorrect deployment settings, expired credentials, exchange outages and network failures can send wrong orders or prevent exits. A change that appears harmless in testing can alter live position sizing. The SEC has emphasized pre-production testing, review after deployment or changes, supervision and effective controls. Those are operational necessities, not optional extras for an automated system.

Different firms can train on similar data and react to the same news at the same time. The Federal Reserve has raised concerns about correlated trading, endogenous collusion, manipulation and concentration. When many systems sell together, liquidity can disappear and volatility can accelerate. A model that works in isolation may behave differently when many participants use comparable signals.
Self-learning and adversarial behavior
Adaptive systems can reinforce their own signals or conceal an emerging problem if monitoring is weak. The CFTC and Federal Reserve both identify risks from manipulated inputs and self-learning behavior. Controls should define which parameters may change automatically, which changes require approval and when the strategy must revert to a known-safe version.
How an AI trading provider can make money without your trading profits
A platform may charge a monthly or quarterly subscription, a management fee, or another service fee. That revenue is separate from whether customers earn returns. FINRA advises investors to understand the fee schedule and cancellation terms before signing up. Ask whether fees are charged on idle cash, assets under management, profits, data access, execution or withdrawals, and whether the fee continues after the system is paused.
Some providers connect to a customer’s brokerage account through an API. In that arrangement, clarify whether the provider can withdraw money or only submit orders, who holds the assets, and how credentials are stored and revoked. A service that cannot clearly explain its authority over the account should not receive access.

How to distinguish evidence from a sales pitch
FINRA says any auto-trading investment service should be able to explain specifically how its technology works. “Specifically” does not require disclosure of every line of proprietary code; it does require an understandable description of inputs, model objective, holding period, trading frequency, risk limits, execution method and fees.
Evaluate performance evidence in this order:
- Audited live history: Prefer a verifiable record from real accounts, with dates, assets, deposits and withdrawals, rather than screenshots.
- Net results: Confirm that commissions, spreads, slippage, financing, borrow costs and management fees are included.
- Drawdowns and losing periods: Request the maximum peak-to-trough loss, worst month, recovery time and frequency of losses, not just an annual return.
- Capacity and liquidity: Determine whether the stated result assumes a trade size the market can actually absorb.
- Benchmark and assumptions: Compare with an appropriate passive benchmark and ask whether the test used information that was unavailable at the decision time.
- Independent verification: Establish who audited the record, what was audited and whether the auditor had access to complete transaction data.
A hypothetical backtest can be useful for understanding a method, but it is not evidence of a typical investor outcome. No cited regulator or central bank publishes a representative average return, win rate or failure rate for AI trading systems.

The SEC, NASAA and FINRA warn that statements such as “Our proprietary AI trading system can’t lose!” or “Use AI to Pick Guaranteed Stock Winners!” are classic warning signs. High guaranteed returns with little or no risk are incompatible with how markets work.
The CFTC describes the Mirror Trading International case as a concrete warning. The scheme advertised at least 10% monthly returns, took more than 30,000 bitcoins worth about $1.7 billion at the time, and affected at least 23,000 people. Those figures come from a 2023 CFTC advisory; they describe alleged losses in that case, not normal trading performance.

Before depositing money:
- Verify the firm and named professionals with the relevant financial regulator.
- Use a registered exchange or brokerage where applicable, and confirm the legal entity that holds custody.
- Reject pressure to pay in cryptocurrency, recruit others, or keep depositing to unlock a withdrawal.
- Test a small withdrawal before committing additional funds, while recognizing that a successful first withdrawal does not prove legitimacy.
- Read dispute, cancellation, withdrawal and fee terms in full.
- Never share a password or API key that grants withdrawal permission when read-and-trade access is sufficient.
A practical comparison framework
Use the same questions for every system instead of comparing marketing claims:

Controls a responsible operator should have
A credible deployment treats the model as one component of a controlled trading process. Before production, developers should test historical data splits, out-of-sample periods, extreme volatility, missing feeds, rejected orders and exchange outages. They should document assumptions and preserve the exact code and data version used for each result.
In production, controls should include maximum order size, price collars, leverage and exposure limits, duplicate-order protection, rate limits, a kill switch and alerts for unusual turnover, losses, latency or data changes. Every order and model decision should be logged well enough to reconstruct what happened.
After deployment or any material change, staff should review activity and reconcile fills, positions, cash and fees. Compliance and development teams need a reliable communication path; a model change that bypasses review is an operational incident even if no loss occurs. A fallback procedure should specify who can disable trading, how open positions are hedged or closed, and how customers are notified.
Can an AI trading bot lose money?
Yes. Losses can result from an incorrect forecast, a regime change, trading costs, leverage, a data error, a software bug, an outage, a crowded trade or fraud by the provider. Automation removes hesitation, but it also removes a human pause before every order. Treat any bot as a high-risk tool whose downside must be bounded before it is connected to capital.
The sensible test is not whether the system ever loses. Every real strategy has losing trades and drawdowns. The test is whether the losses are measured, disclosed, survivable and consistent with the risk the user agreed to take—and whether the provider can show how those figures were produced.
