There is no universal yes-or-no answer to whether you need consent to use an AI meeting note-taker. The answer depends on where participants are, the meeting and workplace context, and how the tool captures and processes information. A pop-up, bot announcement, or audio notice can help tell people what is happening, but it is not by itself proof that the recording is lawful or that the service’s data practices suit your needs.
What an AI meeting note-taker may capture
Some services join a meeting as a participant bot; others capture audio through a desktop application. Depending on the product, feature, permissions, platform, and operating system, the information handled may extend beyond audio and a transcript to video, chat, calendar or integration data, screen context, and account metadata. Do not assume that two features from the same vendor capture or handle information in the same way.

Otter meeting recording
Otter says recording begins when a user or meeting participant presses Record or invites Otter to a meeting, after which its AI records and transcribes automatically. Otter’s privacy and security page also says customer data is not used to train or improve AI service-provider models. These are Otter’s published statements, checked October 7, 2026; check the terms and settings for the account you use.

Fireflies desktop Take Notes and Talk
Fireflies documents Take Notes as desktop meeting capture, with notice options that can include an audio announcement, a meeting-chat message, and a visible camera watermark. Its guide says the available options differ between macOS and Windows and can be disabled. The guide describes an audio announcement playing about 10 seconds after Take Notes starts. Its example chat message is: “This meeting is being transcribed by Fireflies.ai.” Fireflies says users are responsible for notifying participants and following applicable laws. These are product-guide statements checked October 7, 2026.

Fireflies’ Talk feature has different terms: it is for live dictation of the user’s own words, not recording conversations involving other people. Its terms say Talk sends dictation audio, transcribed text, and screen context to Fireflies and listed providers for processing, and warn against using it while viewing information such as protected health information, credentials, or legally privileged material. They say dictation audio and screen context are not stored on Fireflies servers after processing. Those Talk terms should not be applied to Take Notes meeting capture.
Zoom diagnostic-data settings are not meeting-recording settings
Zoom’s Data & Privacy documentation addresses diagnostic data. Zoom distinguishes required diagnostic data from optional diagnostic data, which eligible users or administrators can disable. Zoom says those diagnostic-data settings do not cover customer content such as meeting audio, video, chats, agenda, or title, and do not authorize using customer content to train Zoom or third-party AI models. They are not controls for a particular meeting recording or AI Companion feature; check the documentation and configuration for the feature actually in use. Zoom’s statements were checked October 7, 2026.
Does using a meeting note-taker require consent?
There is no single rule that answers this for every meeting. Recording and interception laws can vary by jurisdiction, and other rules may also matter, including workplace policies, confidentiality obligations, professional duties, and the circumstances of the meeting. Participants may be in different locations, so a host should not assume that the rule where the host sits is the only relevant one.

United States: federal law is not the whole analysis
The federal Wiretap Act, 18 U.S.C. § 2511, prohibits specified intentional interception conduct and includes a one-party-consent exception for a person not acting under color of law when that person is a party to the communication or one party has given prior consent, subject to the statute’s text and exceptions. That federal provision does not settle state law, other legal regimes, employment rules, professional duties, or meeting-specific confidentiality requirements.
Otter’s current help guidance distinguishes single-party and all-party requirements and names California, Illinois, and Florida as examples of all-party states. This is vendor guidance, not a comprehensive or independent survey of state law. Otter recommends a consistent all-party practice for geographically distributed teams. For a particular meeting, check current local legal guidance rather than treating a vendor’s summary as legal advice.
UK data protection: recording consent and lawful basis are distinct
For UK data protection, do not assume consent is the only possible lawful basis for processing personal data, or that consent to a recording under recording law is automatically the same as consent under UK GDPR. If an organisation does rely on consent as its data-protection lawful basis, the UK Information Commissioner’s Office (ICO) says the controller must be able to demonstrate that consent. The ICO recommends recording who consented, when, what they were told, how they consented, and whether they later withdrew consent; the record should preserve the relevant version of the notice or script. This guidance was checked October 7, 2026.

The ICO’s surveillance guidance says audio recording is generally more privacy intrusive than visual recording. It advises identifying and evidencing a specific need, considering less intrusive alternatives, and making clear that audio capture is taking place. This is regulator guidance on surveillance, not a blanket ruling on every meeting transcription use. The ICO notes that portions of its guidance are under review following the Data (Use and Access) Act.

A participant might see a bot join the call, receive a chat message, see an on-screen indicator, or hear an audio announcement. In a desktop-capture workflow, there may be no meeting bot, and the notice may depend on settings in the app and operating system. Test the actual setup: a vendor’s description of a notice option does not establish what a particular attendee will see or hear.
Notice is a transparency measure, not a universal legal safe harbor. An announcement does not, on its own, establish that every participant agreed, that consent is the relevant legal basis, or that the organisation has addressed retention, access, or other data-protection duties. If a participant objects, have a workable way to pause capture, use a non-recorded route where feasible, or handle the conversation without the tool.

Are AI meeting notes private, and are they used to train models?
“Private” is not a single product setting. Consider what is captured, where it is sent, who can access the recording, transcript, or recap, how sharing works, how long each item remains, how deletion works, which subprocessors receive data, and whether any content is used for model training. A vendor’s published policy is a claim about its service and configuration—not independent verification of your account’s actual settings.
What the reviewed vendor statements say
| Service or feature | Published statement relevant to data handling | Scope to keep in mind |
|---|---|---|
| Otter | Otter says customer data is not used to train or improve AI service-provider models. | Otter privacy and security page, checked October 7, 2026; verify applicable account terms and settings. |
| Fireflies meeting content | Fireflies’ privacy policy says meeting content is not used to train internal or external AI models and describes a “Zero Data Retention” policy for meeting content at third-party vendors after processing. | This statement about third-party vendors after processing is distinct from Fireflies’ own storage and account retention. The policy also says account-related personal information is deleted within 30 days after account closure. Privacy policy checked October 7, 2026. |
| Fireflies Talk | Talk terms say dictation audio and screen context are not stored on Fireflies servers after processing. | This is feature-specific and does not describe Take Notes meeting capture. Terms checked October 7, 2026. |
| Zoom diagnostic data | Zoom says its diagnostic-data consent settings do not authorize using customer content to train Zoom’s or third-party AI models. | These settings concern diagnostic data, not controls for a specific recording or AI Companion feature. Documentation checked October 7, 2026. |
Fireflies’ privacy policy also says connected integrations may provide information such as calendar and meeting data, email, messages, chat, and profile information, depending on permissions. It describes controls for recap and meeting-content sharing. Review the permissions granted to integrations and the access settings for the actual account rather than inferring them from a general privacy statement.
A practical pre-meeting checklist for hosts
- Check the setting and the people involved. Identify participant locations, meeting purpose, workplace policy, confidentiality obligations, and any professional rules. Seek current local legal guidance when the situation is not clear.
- Decide whether capture is necessary. State the purpose before capture and consider whether handwritten notes, a non-recorded discussion, or another less intrusive option would work—especially for sensitive or privileged conversations.
- Describe the capture plainly. Tell participants that an AI tool will record or transcribe, what it is intended to do, and how they can raise an objection or use an alternative where feasible.
- Test the notification path. Determine whether the feature uses a meeting bot or desktop audio capture. Check what attendees actually see or hear on the platform and operating system in use, and whether the relevant notice options are enabled.
- Inspect the information flow. Check whether the tool captures audio, video, transcript, chat, screen context, calendar or integration data, and metadata; identify recipients, subprocessors, data location, and any model-training terms.
- Review access and lifecycle controls. Confirm who can view or share recordings, transcripts, and recaps, along with retention, deletion, and export behavior for the actual plan and settings.
- Keep evidence when needed. If consent is the basis relied on, or records are otherwise required, retain the notice or script version and a useful record of who was told what, when, and how they responded. Do not rely only on an unversioned policy link when exact wording and timing matter.
- Make a non-recorded route available where practicable. Participants should have a practical way to raise sensitive matters without sending them through the note-taker.
How to compare note-takers responsibly
Compare like with like: the same type of capture, platform, operating system, plan, and administrative configuration. A useful review covers:
- Whether capture is bot-based or local desktop capture.
- Which notice channels exist, whether they are enabled by default, and how participants can object or opt out.
- Platform and operating-system coverage, including differences between desktop and meeting-platform workflows.
- Access controls for recordings, transcripts, and recaps; sharing defaults; and admin controls or auditability.
- Retention and deletion for each type of content, including what happens after account closure.
- First-party processing, subprocessors, data location, and the exact language governing model training.
Without checking those details for the plans and settings being compared, a vendor ranking can imply equivalence where the workflows and privacy terms differ.
