How AI Is Used in Asylum Decisions—and Where Human Review Fits (2026 Guide)

AI can assist parts of asylum administration, but it is not the legal decision-maker in the United Kingdom’s published position as of 8 June 2026. Authorities may use software to search country information, organise case data, check identity documents, categorise files or produce summaries. A human official must still decide whether the evidence meets the refugee and human-rights tests, explain the reasons, complete required checks and provide appeal information.

That distinction matters because an AI-generated flag or summary can influence what an officer notices without having legal authority to determine protection. The safeguards that matter most are a named human decision-maker, review of the underlying record, documented reasoning, bias and accuracy testing, confidentiality and a real route to correct errors or appeal.

What AI means in an asylum case

“AI” is not one operation. In an asylum system it can refer to software that searches large collections of country-of-origin information, extracts fields from documents, groups cases, highlights possible identity or security issues, or summarises an interview file. These are forms of information handling and workflow support.

Adjudication is different. It is the legally accountable act of deciding whether a person has a well-founded fear of persecution or faces another form of protection risk, assessing the evidence and credibility, applying the Refugee Convention and human-rights law, and issuing a reasoned decision. A system that finds or arranges information is assisting that task; it is not necessarily performing it.

Assistance versus adjudication

Function What software may do What remains a human responsibility
Search and research Find passages in country-of-origin or policy material and surface potentially relevant documents. Choose authoritative material, check its date and context, and explain how it applies to the claimant.
Summarisation Condense interview notes, statements or a case file for easier navigation. Read the full record, detect omissions or mistranslations, and decide which evidence is material.
Categorisation and triage Group files or identify workflow characteristics that may need attention. Set lawful priorities and ensure that a category does not become an automatic outcome.
Identity and document checks Compare data or detect apparent inconsistencies in identity documents. Investigate explanations, consider document reliability and avoid treating a machine flag as proof of deception.
Risk support Highlight patterns for further human review. Carry out the legal and safeguarding assessment and make the final finding.

Why the distinction protects applicants

A summary can omit a detail, a search tool can return an outdated source, and a classifier can reproduce patterns in its training data. If the output is treated as an answer rather than a prompt for checking, a processing aid quietly becomes an unreviewed decision system. Keeping legal authority with an identifiable official makes it possible to ask who evaluated the evidence, what reasons were relied on and how an error can be corrected.

What the United Kingdom has said

In a parliamentary answer on 8 June 2026, Home Office minister Alex Norris stated: “AI technology does not make decisions on Asylum applications, instead, it helps analyse data and provides insightful information that can further inform choices.” The same answer says the tools operate under the “human in the loop” principle.

On that published account, an AI output may inform an official’s work, but it does not itself grant or refuse asylum. The statement is specific to the UK position reported on that date. It should not be read as proof that every country, agency or migration process uses technology in the same way.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What the UK statement says is not being done

The answer also said that, at that time, the Home Office was not using AI to transcribe asylum interviews or other components of asylum decision-making. This is a time-specific statement: systems and policies can change, so a later case should be assessed against the current published position and the records for that case.

What “human in the loop” should mean

The phrase has value only if the human review is substantive. An official should be able to inspect the source documents and interview record, question an output, correct it, and give independent reasons. Merely clicking approval on a machine-generated recommendation would leave the formal human role without meaningful judgment.

Where AI can enter the workflow

European Parliament Research Service reporting describes several possible uses in EU migration and asylum administration. The existence of a use case does not establish that every authority has deployed it, or that it is used to decide an individual claim.

Identity and document verification

Systems can compare biographical fields, inspect document characteristics or identify apparent duplicates. Such checks may help an officer locate a discrepancy quickly. A discrepancy is not the same as fraud: damaged documents, translation problems, different transliterations and the circumstances of flight can all require a human explanation.

Categorisation, triage and risk assessment

Automated categorisation can sort files for workflow purposes, while risk tools can highlight cases for additional scrutiny. These functions affect timing and attention even when they do not produce a formal refusal. Authorities therefore need to monitor whether particular nationalities, languages, genders, disabilities or other groups are disproportionately flagged, delayed or subjected to intrusive checks.

Country-of-origin information and policy search

A search assistant can retrieve relevant passages from a large policy library or country-information collection. The officer must still verify the source, publication date, geographic scope and subject matter. Country conditions can change rapidly, and a snippet without its surrounding qualifications can lead to a distorted assessment.

Case summarisation

The European Parliament Research Service has reported UK pilots involving an AI case-summarisation tool and an AI policy-search tool. A summary may make a long file easier to navigate, but it cannot replace reading the original evidence. The reviewer should check whether the summary preserved contradictions, dates, names, interpreters’ qualifications and details that support the claim.

Interview transcription and related experiments

The Council of Europe’s rights-focused report records that UNHCR does not use AI to determine or review refugee-status decisions. It says UNHCR has explored generative AI for transcribing protection interviews and researching country-of-origin information, subject to reliability, accuracy and transparency standards. Exploration of a transcription use is not an automated credibility finding and does not transfer legal responsibility to a model.

What human review must cover

Applying the legal test to the individual claim

UK credibility guidance says each claim must be considered on its own merits within the Refugee Convention framework. The decision-maker must connect the claimant’s account, documents, interview evidence, country information and applicable law. A score, label or generated paragraph cannot supply that legal reasoning.

Testing credibility fairly

Credibility assessment involves considering the whole account and plausible explanations for inconsistencies. Memory, trauma, interpretation, education, disability and the conditions of departure can affect how a person gives evidence. A machine-detected difference should prompt questions and an opportunity to explain, not an automatic conclusion that the account is false.

Recording reasons and preserving an audit trail

UK guidance requires decisions to be accurate, well reasoned and served without undue delay. Reasons must be recorded, relevant security checks completed and an auditable record maintained. Where software materially assisted a case, a defensible record should show the tool’s role, the information it used, the output supplied, corrections made by the official and the reasons for the final conclusion.

Separating decision and service stages

The guidance describes separate decision-making and service stages. A refusal notice must explain the reasons and provide appeal information. A process that uses an internal tool still has to produce a notice that a person can understand and challenge; “the computer said so” is not an adequate legal explanation.

Safeguarding children and people in danger

Human review includes welfare responsibilities. UK instructions require attention to children’s welfare and immediate referral when a person may be in danger. A workflow classifier cannot replace that judgment or delay an urgent safeguarding response while a file waits for automated processing.

Can AI tell whether an asylum seeker is telling the truth?

There is no sound basis in the cited material for treating emotion-recognition tools, automated credibility assessments or “lie detectors” as reliable adjudicators. The Council of Europe warns that these methods lack scientific validity. Facial movements, voice patterns and pauses are affected by culture, language, interpretation, trauma, disability and the interview setting; they are not a dependable measure of truthfulness.

AI can help organise evidence that a human then evaluates, but it cannot remove the need to ask fair questions, consider explanations and weigh evidence under the legal standard. Presenting an automated probability as a credibility finding would also make it difficult for a claimant to know what to challenge.

Risks that require active safeguards

Bias and unequal error rates

Training data may reflect historic reporting patterns rather than the true distribution of cases. Imbalanced data can cause a system to flag discrepancies inaccurately. Performance must therefore be checked across languages, nationalities, genders, disabilities and other relevant groups, not only by an average accuracy figure. The Council of Europe calls for continuous bias audits for AI used in asylum processing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Privacy and secondary use

Asylum files can contain biometric identifiers, medical information, political opinions, details of relatives and accounts of violence. Authorities should limit collection to a defined purpose, restrict access, protect data in transit and at rest, and prevent secondary use that was not explained or legally authorised. Sending a sensitive interview to an unapproved external service could create a new protection risk.

Opacity and explainability

If a claimant cannot discover that a tool materially influenced processing, what data it considered or how to correct a mistake, the appeal process is weakened. Transparency does not require publishing security-sensitive detection rules, but it does require enough information for a person and a reviewing body to understand the tool’s role and contest factual or procedural errors.

Language and accessibility

Speech recognition, translation and text-generation quality varies by language, dialect, accent and specialist vocabulary. Errors can be concentrated among people who already face barriers to communication. Human interpreters, accessible formats and a chance to correct the record remain essential where an automated system is used for administrative support.

Safeguards for an accountable system

  1. Name the accountable official. A specific decision-maker must remain responsible for the legal outcome; responsibility cannot be assigned to a vendor or model.
  2. Review primary evidence. Require the official to check source documents, the complete interview record and relevant country information rather than relying on a summary alone.
  3. Keep an auditable case file. Preserve the tool version, relevant inputs, prompts, outputs, corrections, overrides and the reasons for the final decision, subject to lawful retention limits.
  4. Measure errors and disparate impacts. Test false flags, missed risks and processing delays across relevant demographic, language and disability groups, and repeat the testing as data or models change.
  5. Protect confidential information. Apply strict access controls, encryption and purpose limitation, especially for biometric and interview data.
  6. Disclose material assistance where required or permitted. Tell claimants and representatives when an AI tool materially assisted processing if applicable law or policy calls for that information.
  7. Provide correction and review routes. Make it possible to challenge a factual error, obtain a human reconsideration and use the available appeal or judicial-review process.
  8. Exclude scientifically unsupported functions. Do not use emotion recognition, automated lie detection or an unvalidated credibility score as a substitute for evidence assessment.

What to do if an AI-assisted decision appears wrong

The exact procedure and deadlines depend on the country and the decision notice. A claimant or representative can still use a practical sequence to identify and challenge an error.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Read the reasons carefully. Mark statements that are factually wrong, omit important evidence or rely on an unexplained classification.
  2. Ask what role technology played. Where law or policy provides for disclosure, request information about any material AI assistance, the record considered and the human official responsible.
  3. Correct the underlying record. Supply clearer documents, explain translation or date discrepancies and identify missing interview answers. Ask that corrections be placed on the case file.
  4. Use the stated appeal route. A refusal notice should explain appeal rights. Follow its deadline and required form; do not assume that an informal complaint pauses the deadline.
  5. Raise procedural unfairness. If an undisclosed or uncorrectable machine output drove the result, explain why that prevented a meaningful opportunity to respond.
  6. Seek qualified assistance. Immigration and asylum procedures are jurisdiction-specific. A regulated adviser, solicitor or recognised legal-aid organisation can match the evidence to the available appeal or judicial-review route.
  7. Report urgent safeguarding concerns immediately. A child at risk or a person in immediate danger should be referred through the relevant emergency or safeguarding channel rather than waiting for an automated case workflow.

How to compare AI systems used by different authorities

Speed is an incomplete comparison. A system that processes files quickly but produces opaque, unequal errors can reduce rather than improve decision quality. Use the following axes when information is available.

Axis Questions to ask
Task Is the tool searching, summarising, transcribing, checking identity, triaging, assessing risk or making a legal determination?
Human authority Can a named official reject the output and is that official legally accountable for the result?
Transparency Are claimants told when the tool materially assisted processing, and can they understand its practical effect?
Data protection What information is collected, who can access it, how long is it kept and can it be reused?
Bias and accuracy testing Are error rates and disparate impacts tested by language, nationality, gender, disability and other relevant characteristics?
Auditability Are inputs, outputs, model versions, corrections and reasons preserved for later review?
Accessibility Does performance hold across interpreters, dialects, scripts, accents and accessible formats?
Correction and appeal Can a person correct the record, obtain human reconsideration and use an appeal or judicial-review route?

What the available quality figures do—and do not—show

UNHCR UK reported a 330% increase in First-tier Tribunal asylum appeals in the first quarter of 2024. It also reported that around half of asylum decisions considered by the Tribunal were overturned. UNHCR used these figures to argue that first-instance quality matters.

Those numbers are not measurements of AI accuracy, AI adoption or the share of decisions influenced by software. They describe appeals and outcomes in the specified period and jurisdiction. An overturned decision can result from many causes, including evidence or legal arguments considered later. The figures support investment in careful first-instance reasoning, not a claim that AI caused or solved the problem.

What is known globally—and what is not

There is no reliable, current global percentage showing how many asylum decisions are made with AI. Adoption is jurisdiction-specific and task-specific. Public evidence is strongest for pilots and assistive functions such as search, summarisation, identity checks and workflow support, while legal authority is generally described as remaining with human officials in the UK material cited here.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That uncertainty is itself important. A claim that “AI decides asylum everywhere” overstates the evidence, while a claim that technology has no effect because it does not sign the refusal ignores the influence of triage, search results and summaries on human attention. The useful question is not simply whether a country uses AI, but what task it performs, what safeguards surround it and how a claimant can challenge an error.

The practical standard for human review

A defensible AI-assisted process has a clear chain: the tool performs a limited administrative task; the official verifies the underlying material; the official applies refugee and human-rights law to the individual facts; reasons are recorded in an auditable file; the claimant receives an intelligible decision and appeal information; and an independent reviewer can examine both the evidence and the technology’s role.

When any link is missing, “human in the loop” can become a label rather than a protection. When all links are present, AI may reduce routine searching or organising without replacing the judgment that asylum law requires.
