New York Gov. Kathy Hochul said Jane Doe was “failed” by people and institutions responsible for protecting her, as she announced that state Attorney General Letitia James would take over the criminal investigation as special prosecutor. The statement was Hochul’s assessment of how the case was handled, not a judicial finding. No charges have been announced, and the underlying allegations remain unadjudicated.
What Hochul meant by “failed”
On Friday, Oct. 2, 2026, Hochul criticized the handling of Jane Doe’s case by Cornell University Police and Tompkins County prosecutors. She said the district attorney had closed the initial investigation without interviewing Doe or others involved, or requesting the full transcript of her campus-police interview. “And then at every turn, she was failed by people and institutions with an obligation to protect her,” Hochul said.

Hochul’s remarks accompanied her appointment of James as special prosecutor. They describe the governor’s view of institutional handling; they do not establish what happened during the alleged assault or determine whether any person committed a crime.
What the case involves
Jane Doe is the pseudonym used in court papers for a former Cornell student. In a civil lawsuit, she alleges that multiple men drugged and sexually assaulted her at a Chi Phi fraternity house in October 2024. Those allegations have not been adjudicated. Lawyers for some of the men named in the suit have denied sexual assault or said their clients did not touch her.

The criminal investigation was initially closed without charges in 2024. The Tompkins County district attorney reopened it in 2026 after the lawsuit and renewed public attention. The criminal inquiry and civil case are separate proceedings, and neither the allegations in the lawsuit nor the reopening of the investigation establishes criminal guilt.
Why the investigation has a new prosecutor
Hochul signed an executive order appointing James’s office to oversee the criminal investigation. The decision follows criticism of the original investigation and disagreement over what information prosecutors received from Cornell police.

James said her office would “review the facts, gather evidence, interview witnesses and, if warranted, pursue prosecutions.” Tompkins County District Attorney Matthew Van Houten said, “I trust that she will examine the facts and apply the law.” Those statements describe the officials’ positions and do not announce findings.

A central disagreement is what Doe told campus police and what the district attorney’s office received. The Associated Press described as “misleading” the claim that Doe never told police she was raped. AP reported that a transcript obtained by CBS records her saying, “Yes. It was coercion, yes,” that she was “completely and totally incapacitated,” and, “I can say with 100% confidence I was raped.”

Van Houten said his office had not received the latter information. He argued that the sworn statement he reviewed did not include allegations that Doe had been drugged against her will, incapacitated beyond the ability to consent, or forced to have sex. The parties’ accounts of what police conveyed—and what prosecutors had when they closed the case—remain disputed. The reporting does not establish that either side lied or resolve the disagreement.
What happens next
James’s office is conducting the active criminal investigation. She has said it will review facts, gather evidence and interview witnesses, with prosecution dependent on what the inquiry establishes. There is no announced outcome or timetable; AP reported that James suggested the inquiry could take months.

Hochul also supports a proposed change to New York law concerning sexual activity when a person voluntarily becomes intoxicated to the point that consent is compromised. The available reporting does not establish the proposal’s exact text, legislative status or eventual effect, so it should not be treated as enacted law.
How Cornell’s review differs from the criminal case
Cornell conducted a separate internal disciplinary investigation. AP reported that it included 50 interviews with 32 witnesses and 12 days of hearings; some students were expelled or suspended. Cornell has not publicly detailed individual sanctions, citing federal privacy laws. The university also agreed to bring in outside lawyers to independently review its handling of the allegations.

Those university processes are distinct from James’s criminal investigation. A campus disciplinary decision does not determine criminal guilt, and the publicly reported sanctions do not establish the outcome of the criminal case.
