GST ITC Denied Because a Supplier Failed to File Returns: What the Recipient Can Do

A supplier’s failure to report an invoice is different from reporting it but not filing GSTR-3B. Learn how to reconcile records, follow up and assess Rule 37A.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If your GST input tax credit (ITC) is missing or has been denied because a supplier did not file returns, first identify exactly what is missing: the supplier may not have reported your invoice, or may have reported it but failed to file the corresponding GSTR-3B. Those are different situations. Reconcile the invoice with your GST portal records, preserve evidence that the transaction took place, ask the supplier to correct the filing gap, and assess whether Rule 37A applies. A tax invoice by itself does not guarantee credit, and GSTR-2B is an information statement rather than a final legal decision on eligibility.

Why a supplier’s filing failure can affect your ITC

ITC is not determined only by whether you received a tax invoice or paid the supplier. Section 16 of the Central Goods and Services Tax (CGST) Act sets out conditions for claiming credit. Its current text includes the supplier’s furnishing of invoice or debit-note details in an outward-supplies statement and communication of those details to the recipient. The Act also addresses actual payment of the tax to the Government within its statutory framework, alongside other eligibility requirements. Read the version that applies to the tax period in question: Section 16 of the CGST Act.

That framework creates a practical problem when the supplier does not meet a filing obligation. The recipient’s purchase records may show a genuine transaction while the portal does not show the reported invoice, or while the supplier’s return status remains incomplete. The mismatch calls for investigation; it does not, by itself, establish either that the recipient is entitled to retain the credit or that the underlying purchase was fictitious.

Keep three questions separate:

  • Was the transaction eligible? Check the applicable Section 16 conditions and the documentary requirements under the version of the CGST Rules governing the transaction.
  • What did the supplier file? Establish whether the invoice details were furnished and whether the corresponding GSTR-3B was filed.
  • What is the procedural position? The steps available to you differ if you are reconciling a return, considering a Rule 37A reversal, answering a notice, or responding to an order.

The official CGST Rules are relevant to documentary requirements and to checking the rule version applicable to a transaction. For a live dispute, identify the actual tax period and the statutory text then in force rather than assuming that a current portal display resolves the legal question.

First identify which filing gap occurred

Start with the invoice in question and distinguish a missing outward-supply report from a missing supplier return. The portal status and the documents you hold can point to different next steps.

What you find What it means for your review What to check next
The invoice is absent from GSTR-2B and the supplier has not reported it The supplier’s invoice details may not have been furnished in the relevant outward-supplies statement, or a reporting or amendment issue may exist. Check the supplier’s invoice details, the relevant period and any later amendment; request that the supplier furnish or correct the details.
The supplier reported the invoice, but the corresponding GSTR-3B was not filed by the Rule 37A deadline This is the distinct supplier non-filing situation addressed by Rule 37A, subject to the rule’s operative text and conditions for the period. Confirm the supplier’s filing status and calculate the rule’s dates for the relevant financial year.
The invoice appears, but its details do not match your purchase records A value, identity, tax-period, amendment or other data mismatch may be involved. Compare the invoice and portal record field by field and seek correction where appropriate.

GSTR-2B is generated from supplier statements and specified other feeds. It is useful for reconciliation, but the GST portal says that the statement does not cover every legal scenario that can affect availability of credit. Recipients must self-assess eligibility; appearance in GSTR-2B is not an automatic guarantee, and absence should prompt a fact check rather than an unsupported conclusion. See the portal’s GSTR-2B FAQ.

Reconcile the invoice and keep the evidence together

Before claiming, reversing, or responding to a department communication, make a file for the disputed invoice. A useful reconciliation checks the underlying business record against the portal record and the supplier’s filing position. Do not rely only on a screenshot or an entry in your purchase ledger.

  • Match the supplier’s GSTIN and the invoice number and date against the original tax invoice or debit note.
  • Compare taxable value and tax amounts, the tax period, place-of-supply details, and any amendments or credit notes that could explain a difference.
  • Record whether the issue is that invoice details have not appeared, or that the corresponding supplier GSTR-3B has not been filed. These are not interchangeable facts.
  • Keep the purchase order or contract, proof of receipt of goods or services, ledger entries, and payment records, including the tax component.
  • Save relevant portal downloads and dated records of your reconciliation and follow-up. Retain correspondence in which you asked the supplier to report the invoice or file the return.

Section 16 and the CGST Rules set the legal conditions and documentary framework; the particular records that matter depend on the transaction and the version in force. Your file should show both what was bought and what you did to resolve the reporting gap. An invoice, payment record, or supplier email should not be treated as a substitute for checking the other applicable requirements.

Ask the supplier to fix the filing gap and track the result

Contact the supplier in writing with enough detail to identify the transaction: GSTIN, invoice number and date, relevant tax period, and the difference you found. Ask the supplier to furnish or correct the outward-supply details if the invoice was not reported, and to file the corresponding GSTR-3B if that return is outstanding. Keep the request and any response with your invoice file.

Then check whether the portal record changes. If the supplier reports or corrects invoice information, review the later GSTR-2B and your applicable portal records to see whether the invoice is reflected accurately. If the Rule 37A issue is that the supplier reported invoice details but did not file GSTR-3B, separately verify that the corresponding return has actually been filed. The portal’s GSTR-2B guidance explains how supplier-filed records feed into recipient statements, but portal visibility and statutory eligibility remain distinct questions.

Do not assume that a promise to file is the same as a filed return. Record the relevant filing status and date when you make your decision, and keep monitoring the supplier’s status if the matter remains unresolved. If a return or invoice detail appears later, preserve the updated portal record and reassess the treatment for the affected period under the rule then applicable.

When Rule 37A may require reversal and allow re-availment

Rule 37A addresses a specific case: a supplier furnished invoice details in GSTR-1 or the Invoice Furnishing Facility (IFF), but did not file the corresponding GSTR-3B by the specified deadline. It is not a general label for every invoice missing from GSTR-2B. The mechanism described in the GST Council’s published agenda note uses 30 September following the relevant financial year as the supplier-filing reference date and 30 November following that year as the recipient’s reversal date. It provides for re-availment after the supplier files the corresponding GSTR-3B. See the GST Council agenda note on Rule 37A.

Those dates are tied to the rule mechanism and financial year; they are not dates to apply blindly to every disputed credit. The agenda note is explanatory material, not a replacement for the notified rule. Verify the operative Rule 37A text, amendments, notifications and dates that apply to the relevant period before calculating a reversal or re-availment. The CGST Rules should be checked for the governing version.

  1. Confirm the trigger. Verify that the supplier furnished the relevant invoice details in GSTR-1 or IFF and that the issue is failure to file the corresponding GSTR-3B. If the supplier never reported the invoice, do not assume that this is the Rule 37A scenario.
  2. Identify the financial year and rule version. Map the invoice and corresponding supplier return to the relevant financial year, then confirm which operative text applies.
  3. Calculate the dates from the rule. The mechanism described in the agenda note refers to 30 September for supplier filing and 30 November for recipient reversal following the financial year. Confirm the precise legal application to your period before acting.
  4. Document the required treatment. If the conditions require reversal, keep the calculation and the basis for the treatment with the return and invoice records. Do not substitute a supplier’s assurance for evidence of filing.
  5. Check for re-availment eligibility. Once the supplier files the corresponding GSTR-3B, verify the filing and assess re-availment under the operative rule. Keep the evidence linking that return to the invoice and credit being reconsidered.

The dates and steps above explain the mechanism, not a case-specific conclusion. A tax period, amendment, or procedural history can affect the answer. Where the amount is material or a return is already under review, have an Indian GST practitioner verify the applicable text and calculation before filing.

Review IMS records without treating portal actions as legal approval

The Invoice Management System (IMS) allows recipients to take accept, reject, or pending actions on covered documents. For GSTR-2B generation, no action is treated as deemed acceptance. A record left pending does not flow to GSTR-2B or GSTR-3B while it remains pending, and it cannot be left pending beyond the relevant Section 16(4) timeline. These portal behaviours are set out in the GST portal’s IMS FAQ.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Review covered records and use the available action that reflects your actual position; do not let a pending item sit without considering the applicable time limit. At the same time, acceptance in IMS does not replace the Section 16 eligibility assessment. Reconcile the document, transaction evidence, supplier reporting and return status before deciding how to treat a credit in your records.

If you receive a notice or already have an order

A notice or order changes the task from routine reconciliation to a procedural response. First read the document itself and note the provision cited, the tax periods and amounts at issue, the date and manner of service, the response deadline, and whether any order has already been issued. Check the status of any appeal or other proceeding before deciding which step to take. A general article cannot establish the applicable response route or limitation period for an individual case.

Organize the response around the specific allegation. If the issue is a missing supplier report, assemble the invoice, transaction and receipt evidence, portal records, and supplier correspondence. If invoice details were reported but the corresponding GSTR-3B was not filed, include the verified supplier filing status and your Rule 37A analysis for the relevant period. If the department relies on a mismatch, identify the exact fields that differ and any amendment or correction that explains them.

Do not answer a notice only by asserting that you acted in good faith or paid the supplier. Those facts may be relevant to the evidence, but they do not eliminate the need to address the statutory conditions, the supplier’s filing status and the exact basis of the proposed action. Conversely, a portal mismatch alone does not explain every fact about the underlying transaction. A qualified Indian GST professional can assess the applicable law, evidence and procedural stage, particularly where a deadline is approaching or an appealable order has been made.

Why older mismatch relief is not a blanket defence

The 2025 Karnataka High Court material concerning Hindustan Construction Company discusses Circular 183/15/2022-GST in the context of bona fide reporting errors for financial years 2017-18 and 2018-19. That is a narrow historical setting. It should not be presented as a general current-period right to retain credit whenever a supplier fails to file, or as a substitute for applying Section 16 and Rule 37A to the period at issue. The decision can be read in its specific context in the Hindustan Construction Company judgment.

When relying on a circular or court decision, check its facts, tax years, statutory wording and procedural setting against your own case. A decision about bona fide reporting errors in those earlier years does not establish the outcome of a different supplier non-filing dispute.

A practical decision path

  1. Match the records. Compare the invoice and transaction evidence with GSTR-2B and relevant portal records.
  2. Classify the gap. Determine whether the supplier failed to report the invoice, reported it but did not file the corresponding GSTR-3B, or entered details that do not match.
  3. Request correction. Ask the supplier in writing to report or correct the details and, where applicable, file the corresponding return.
  4. Check the governing law and dates. Review the applicable Section 16 and CGST Rules versions. For the reported-invoice/non-filed-GSTR-3B situation, test Rule 37A and its deadlines separately.
  5. Keep the record current. Save portal downloads and correspondence, monitor the filing status, and reassess the treatment when new filing information appears.
  6. Escalate a formal dispute carefully. If a notice or order exists, identify its legal basis, periods, service date and deadline, then obtain case-specific professional advice.
