Short answer: In Canada, GST/HST treatment depends on the property’s actual use in taxable commercial activities—not simply on whether you call it a “business property” or a “personal property.” A GST/HST registrant can generally claim an input tax credit (ITC) for the commercial-use portion of capital real property, while personal use and exempt activities can restrict or eliminate the claim. Later changes in use can trigger deemed GST/HST, and housing built or substantially renovated by a “builder” can trigger self-supply rules even when nobody buys the building on the open market.
This article assumes Canadian GST/HST rules and uses Canada Revenue Agency (CRA) guidance available in 2026. Provincial application, ownership, registration status, property type, occupancy and the taxability of the activity can change the result. A specific construction project should be reviewed with a Canadian GST/HST adviser.

The rule that decides most projects
For GST/HST purposes, the key question is how much of the property is used in commercial activities. In this context, “commercial” generally means activities that make taxable or zero-rated supplies. It does not mean every activity carried on with a profit motive, and it does not include every use that people casually describe as business use.
Long-term residential rent is generally an exempt activity. A building leased to tenants for ordinary long-term housing therefore does not receive the same ITC treatment as a building leased for taxable commercial purposes. A professional practice can also be exempt depending on the service. A home office or a registered business name does not, by itself, make all construction costs creditable.

For a registrant, the practical starting point is:
- Identify the GST/HST paid or payable on the land, building, construction contracts, improvements and related costs.
- Determine the portion of the property used in taxable commercial activities.
- Claim an ITC only to the extent supported by that commercial use and the applicable capital-real-property rules.
- Track later changes, because a change in use can require GST/HST accounting even without a conventional sale.
Personal use, exempt use and taxable commercial use can coexist in one building. The allocation must be based on a reasonable, supportable measure of actual use, such as floor area where that fairly reflects use. Keep the method and evidence with the project records.
Business, personal and mixed-use builds compared
| Situation | Typical GST/HST direction | What can change the result |
|---|---|---|
| Building used entirely for taxable commercial activities | A registrant is generally entitled to ITCs for GST/HST on capital real property to the extent of that use. | Registration, taxable versus exempt supplies, timing of registration, documentation and property classification. |
| Individual’s home used primarily for personal enjoyment | The personal-use restriction generally prevents an ITC on acquisition and improvements to capital real property. | Actual commercial use, whether the individual or a related person uses the property, and later changes in use. |
| Property used for both taxable business activity and personal use | Only the supported taxable-commercial portion is normally creditable for an individual registrant, subject to the statute and evidence. | Allocation method, whether the property is primarily personal, and whether a later change reaches a significant threshold. |
| Property used for an exempt practice or exempt long-term residential rent | The exempt portion generally does not generate the same ITC as taxable commercial use. | The exact supply, any taxable ancillary activity and whether the use later changes. |
| New or substantially renovated housing built by a “builder” | Self-supply rules can deem a taxable supply based generally on fair market value, even without an ordinary sale. | Builder status, housing type, first possession or use, substantial completion, occupancy and statutory exceptions. |
When construction tax can be an ITC
Capital real property is treated by actual use
Land, a building and many substantial improvements are capital real property. CRA guidance states that a GST/HST registrant is generally entitled to an ITC for tax paid or payable to acquire capital real property to the extent the property is used in commercial activities. “To the extent” is important: a 40% taxable-commercial use does not automatically produce a 100% ITC.
For an individual registrant, the Excise Tax Act generally denies an ITC for capital real property acquired primarily for the personal use and enjoyment of the individual or a related individual. Calling a residence a business asset, registering for GST/HST or operating a business from one room does not override that restriction.
Taxable and exempt activities are different
A property used to make taxable commercial supplies is not treated the same as one used to make exempt supplies. For example, taxable commercial leasing and ordinary long-term residential leasing sit on different sides of the analysis. A medical or other professional practice may also involve exempt supplies, depending on the service. Confirm the tax status of the actual supplies rather than relying on the industry label.
How a mixed-use allocation works
CRA’s memorandum gives an illustration involving an individual’s property used 25% for an exempt medical practice, 30% leased to a dentist and 45% as a personal residence. The example describes a 30% ITC for the commercial-use portion—the space leased for taxable use—not a 55% claim for every non-residential area.
The percentages in that illustration are not a universal formula. A different building may require a floor-area, time-use, revenue or other reasonable method. The method should reflect the way the property actually supports taxable activities, and it should be applied consistently to construction, major improvements and later adjustments.

Step-by-step method before claiming an ITC
- Identify the owner. Record whether the property is owned by an individual, corporation, partnership, trust or another entity. The individual personal-use restriction and builder exceptions do not apply identically to every owner.
- Confirm GST/HST registration. Establish the effective date of registration and whether the claimant is registered when the tax becomes claimable. Registration alone does not make personal or exempt use commercial.
- Classify the property. Decide whether the project is ordinary capital real property, new housing, a substantial renovation, a conversion to housing or a mixed-use building. Housing can bring self-supply provisions into play.
- List every intended use. Separate taxable commercial use, zero-rated use, exempt use and personal use. Include areas that will be vacant, used by related persons or occupied by tenants.
- Choose and document a reasonable allocation. Floor area may work where each area has comparable use; time, output or another measure may be more appropriate in other projects. Save plans, measurements, leases, schedules and explanations.
- Trace the tax. Match invoices and other tax records to the land, structure, improvements and operating components. Do not assume that one percentage applies to every cost if the costs serve different parts of the property.
- Check for self-supply or rebate rules. If the project creates or substantially renovates housing, determine whether the owner is a builder and whether a new housing or rental rebate is more relevant than an ordinary ITC.
- Set a change-in-use review date. Revisit the allocation when a tenant changes, a residence becomes a rental, a business moves out, a building is converted or a shareholder or owner begins occupying it.
What happens when use changes after construction?
The 10% significance rule
CRA describes an increase or decrease of 10% or more in the extent of commercial use of capital real property as generally significant for change-in-use treatment. A reduction of commercial use by at least that amount can require the registrant to account for GST/HST on the portion shifted out of commercial activities, unless the deemed sale is exempt. An increase can create a deemed acquisition of the added commercial portion and a related ITC opportunity where the conditions are met.

The 10% figure is a threshold for the change-in-use rules; it is not permission to ignore smaller changes forever. Small changes can accumulate, and the cessation of commercial use is significant even if the final percentage change is below 10%.
Stopping commercial use altogether
When commercial use stops, CRA says the whole property can be treated as sold and reacquired under the relevant deemed-supply rules. The tax calculation can depend on the type of change, whether personal use is involved, the property’s fair market value and its basic tax content. No money changing hands does not automatically eliminate the deemed GST/HST accounting.
Moving a property toward personal use
An individual who used capital real property in commercial activities and then begins using it primarily for personal enjoyment may be considered to have stopped commercial use, sold the property and collected GST/HST unless the deemed sale is exempt.
CRA describes a case in which personal use reaches at least 90% as engaging two provisions. The combined tax effect is described as the greater of the tax calculated on fair market value or the property’s basic tax content. The owner must calculate the actual deemed-tax result rather than assume that a private move is outside GST/HST.

Housing built by a builder: the self-supply rules
“Builder” has a technical meaning
A builder is not simply anyone who hires a contractor. CRA’s home-construction guide describes builders as including people who acquire an interest in housing while it is under construction and complete it, and people who convert certain properties into housing. An individual who builds a home as a personal residence is generally not a builder unless the person is acting in a business or in an adventure or concern in the nature of trade.

Ownership structure matters. A corporation or partnership does not receive the same individual exception merely because a shareholder or partner moves into the housing.
When self-supply can arise
When a builder constructs or substantially renovates housing and then occupies it, leases it or otherwise uses it in circumstances covered by the rules, the builder can be deemed to have made and received a supply. CRA says the value is generally based on the fair market value of the housing, including the building and land. The self-supply time is generally the later of substantial completion and first possession or use.
The purpose is to prevent a builder from obtaining a different GST/HST result merely by keeping the completed housing, leasing it or moving into it instead of selling it to another person. A conventional sale is therefore not required before the self-supply rules are considered.

CRA describes an exception for an individual builder who did not claim ITCs and who, after completion, uses the housing primarily as the individual’s or a related person’s residence. The exception is fact-specific. It should not be extended to a corporation or partnership because an owner, shareholder or partner occupies the property.
Mixed-use housing and commercial space
For a building that combines long-term residential leasing with commercial leasing, CRA says a deemed self-supply may apply only to the residential part. A later sale may be treated as two supplies: GST/HST generally applies to the commercial part, while the residential part may be exempt. New, never-occupied mixed buildings can be treated differently, so the building’s history and first occupancy must be documented.
Rebates are not ordinary ITCs
Housing rebate programs can provide relief in circumstances where an ordinary commercial ITC is unavailable, but they have separate claimant, use, timing, price, construction and occupancy requirements. Do not describe a rebate as a percentage allocation of business use.

New housing rebate for a primary residence
CRA’s current guide describes a federal new housing rebate for an eligible individual who buys, builds or substantially renovates housing for use as a primary place of residence and is the first individual to live there. The guide states a federal rebate of 36% of the GST or federal part of HST, up to $6,300, with a price or fair-market-value threshold that generally excludes housing at $450,000 or more from that federal rebate.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsThe figures and conditions are date-sensitive. Provincial rebates can be separate, and the relevant valuation basis and eligibility tests must be checked for the project and publication date.
New residential rental property rebate
A landlord who buys or builds qualifying new housing for long-term residential use may instead qualify for a new residential rental property rebate if its conditions are met. CRA’s guide includes requirements such as expected primary-residence use by tenants for at least one year and the required tax accounting. This route is distinct from claiming ITCs for taxable commercial activities.
Enhanced purpose-built rental relief
CRA also describes an enhanced rebate of 100% of the federal component for certain purpose-built rental housing. Eligibility depends on construction commencement and completion windows, minimum-unit criteria and other conditions in the guide. Because those windows and amounts can change, verify the current CRA requirements before filing.

Common mistakes and how to correct them
“The owner is registered, so every invoice is creditable”
Registration is a prerequisite for many ITCs, not a blanket entitlement. Separate taxable commercial use from personal and exempt use before calculating the claim.
“Business use means taxable use”
Ordinary language is unreliable. Long-term residential rent and some professional services can be exempt. Confirm the supply being made.
“A home office makes the whole house commercial”
An office or practice area usually supports only the relevant commercial portion, and an individual’s primarily personal residence can face the personal-use restriction.

The threshold identifies generally significant changes; it does not erase cumulative changes or the consequences of ending commercial use.
“No sale means no GST/HST”
Deemed sales, deemed acquisitions and builder self-supplies can apply without an open-market transaction.
“A shareholder living in a company-owned house gets the individual exception”
CRA’s individual exception does not automatically extend to a corporation or partnership. Analyze the owner and the builder status separately.
“A housing rebate and an ITC are interchangeable”
They are different mechanisms with different eligibility rules. Select the route that matches the property, claimant, use and timing.
A practical decision framework
- Is the use taxable commercial, exempt or personal? If it is exempt or personal, do not treat it as ordinary taxable business use.
- Who owns and occupies the property? Individual, corporation and partnership rules differ, especially for personal-use restrictions and self-supply.
- Is the property housing? If yes, test builder self-supply and applicable housing rebates before applying a simple ITC percentage.
- What percentage is actually commercial? Measure and document the current use rather than relying on the project’s intention.
- Has use changed by 10% or more, or stopped entirely? Review deemed-supply rules and calculate any tax on the changed portion.
- Could a rebate apply? Check primary-residence, long-term-rental or purpose-built-rental conditions separately from ITC rules.
Bottom line for a Canadian build
A property built for business use can support GST/HST ITCs only to the extent it is used in taxable commercial activities and the claimant satisfies the registration, documentation and capital-real-property rules. Personal use and exempt use reduce or eliminate that entitlement. A mixed-use allocation must reflect actual use, and later changes can create deemed GST/HST. Housing introduces a second layer: a builder may face self-supply based generally on fair market value, while a qualifying personal residence or rental project may have a separate rebate path.
Before construction starts, record the owner, registration status, intended taxable and exempt uses, allocation method, builder status and occupancy plan. Recheck those facts when the building is substantially complete, first occupied, leased, converted or moved into personal use. Rates, thresholds, rebate windows and reporting details should be confirmed against current CRA guidance and the Excise Tax Act for the relevant province and date.
