FTX Bankruptcy Claims vs. Criminal Restitution: What Creditors Should Know

They are separate recovery tracks. An FTX bankruptcy claim is paid under the confirmed Chapter 11 plan from the FTX estates and related recovery structure. Criminal forfeiture in Sam Bankman-Fried’s case is a government-controlled process that may compensate victims through remission, while the Commodity Futures Trading Commission (CFTC) obtained a separate restitution and disgorgement order coordinated with the bankruptcy. None of those remedies creates an automatic second check, and the $11 billion forfeiture judgment is not a guaranteed amount for each creditor.

Bankruptcy claims and criminal compensation use different legal systems

The easiest way to avoid confusion is to treat your bankruptcy claim and any government compensation as different files with different administrators, eligibility rules and deadlines.

Question FTX bankruptcy claim Criminal forfeiture, remission or regulatory restitution
Legal source The confirmed Chapter 11 plan and the U.S. Bankruptcy Code A criminal judgment, a U.S. Department of Justice (DOJ) remission process or a CFTC order
Who administers it The FTX debtors, the post-confirmation recovery structure and appointed distribution providers The U.S. government or a regulator using forfeited or ordered funds
How loss is measured Your allowed claim and the plan’s court-approved valuation rules Victim-loss determinations and the funds ultimately recovered and available for distribution
What you must do Keep the claim in good standing, meet plan requirements and complete provider onboarding Follow verified DOJ or regulator notices if a separate process opens; do not assume eligibility
Risk of overlapping recovery The plan contains anti-double-dipping protections Coordination or crediting can reduce a duplicative recovery

Being recognized as an FTX creditor does not by itself enroll you in a criminal remission program. Conversely, a future remission payment would not replace the steps required to receive a bankruptcy distribution.

How the FTX bankruptcy distribution works

Your claim must be allowed

Distributions under the plan are made to holders of Allowed Claims who satisfy the plan’s pre-distribution conditions. A claim that is disputed, unresolved or subject to an objection may not be paid until its status is resolved under the plan and court process.

The confirmed plan binds creditors whether or not they voted for it. Confirmation and creditor voting operate under Chapter 11 provisions, including 11 U.S.C. §1126 and related provisions. The plan allocates value by the relative value of claims measured under its rules, rather than by whichever asset a creditor originally held.

What “allowed” does and does not establish

An allowed claim is an accepted claim for purposes of plan treatment. It is not a guarantee that the face amount will be paid in full, that payment will arrive on a particular date or that payment will be made in the cryptocurrency originally held. The eventual percentage and timing depend on the plan’s class treatment, recoveries available to the estate and satisfaction of all distribution conditions.

If your claim is marked disputed, watch for objection notices, settlement proposals and court orders. A creditor may need to respond by a stated deadline, provide supporting account records or accept a negotiated amount. Ignoring an objection can leave the claim unresolved when a distribution is calculated. Keep copies of every filing and confirmation rather than relying solely on the portal’s current status label.

Valuation is tied to the plan’s reference date

Many creditors ask why a bitcoin, ether or other token appears to be valued at a 2022 figure instead of at the price on the day a distribution is made. The answer is that the plan and court orders establish the valuation method. FTX’s official digital-asset guidance says the court-approved conversion table is used for estimation, solicitation, voting and distribution.

The disclosure statement describes petition-date valuation. In practical terms, the amount of cryptocurrency in your account is converted under the approved table and then treated as a dollar-denominated claim for plan purposes. A later market rally does not automatically rewrite that allowed amount, and a market decline does not automatically reduce it. This approach gives the plan a common reference point for thousands of creditors and prevents distributions from changing solely because token prices move after the reference date.

The conversion table is not a promise that you will receive the same tokens you deposited. It is a calculation rule for determining the claim and the distribution share. Check your claim record and the plan materials for the asset, quantity and conversion entry used in your case. If the quantity or account identity is wrong, use the formal claims or court process to challenge it; do not assume a provider can change the underlying allowed amount during onboarding.

Relative value and claim classes

The plan distributes value according to relative petition-date claim value and the treatment assigned to the applicable class. Two customers with different account types, priority status or legal claims may therefore receive different treatment even if their balances look similar. A customer claim, a general unsecured claim, an intercompany claim and a claim acquired by assignment are not interchangeable categories. Read the class designation and distribution language that apply to your claim before comparing another creditor’s percentage with your own.

Anti-double-dipping rules matter

The plan includes provisions intended to prevent a claimant from receiving more than similarly situated creditors by presenting the same loss in another forum or under another legal theory. If you receive money through a related settlement, regulatory order or government process, keep the payment record and follow any disclosure or crediting instructions that apply to your claim.

These provisions do not mean every outside payment will be deducted in the same way. The treatment depends on the plan language, the type of recovery and the applicable order. A creditor with a disputed claim, an assignment, a related-party issue or a potential duplicate recovery should obtain advice for the relevant jurisdiction before signing a release or submitting a new loss statement.

Why a bankruptcy claim is not the same as restitution

In a criminal case, restitution normally compensates identified victims under a sentencing order. In Bankman-Fried’s sentencing, the court did not impose individualized restitution because the number of victims and the complexity of calculating losses would have made that procedure impractical. A government sentencing filing explained that the court instead authorized compensation through a remission process using assets finally forfeited to the United States.

That decision changes the creditor’s role. A bankruptcy distribution follows the confirmed plan and its claims register. A remission process, if administered, follows government procedures for identifying eligible victims, calculating compensable loss and allocating the assets that have actually been recovered and forfeited. It may require a separate notice, form, certification or deadline.

Remission is not simply a relabeled bankruptcy distribution. The government may define eligible victims by reference to the offenses proved in the criminal case, request evidence of loss and exclude amounts already compensated. The process can also take place on a different schedule from Chapter 11 distributions. Until an official notice explains the procedure, no creditor can reliably calculate a remission percentage from the headline forfeiture figure.

What the $11 billion forfeiture judgment does—and does not—mean

On March 28, 2024, the DOJ announced that Bankman-Fried was sentenced to 25 years in prison and ordered to pay $11 billion in forfeiture. The announcement also said that Judge Lewis Kaplan authorized the government to use funds recovered through the forfeiture process to compensate victims of Bankman-Fried’s crimes.

The $11 billion figure is a criminal forfeiture judgment. It is not an account statement showing that $11 billion is already in a distribution fund, and it does not specify an equal payment for every FTX bankruptcy creditor. The amount ultimately available for a remission distribution can depend on what assets are located, restrained, liquidated and finally forfeited, as well as on the government’s victim-claims process.

A forfeiture judgment can cover property connected to criminal conduct, but the judgment amount and the cash available for victims are different concepts. Assets may require liquidation, third-party claims may have to be resolved and government procedures may determine which losses qualify. Do not treat the judgment as a reserve that can be withdrawn on demand or as evidence that a particular account will be made whole.

Do not pay a person who promises to “release” forfeiture money, asks for a processing fee or requests cryptocurrency to unlock a payment. Wait for a notice from a verifiable government channel and use only the contact details published in that notice.

The CFTC order is another coordinated remedy

On August 8, 2024, the CFTC announced a judgment requiring FTX to pay $8.7 billion in restitution and $4 billion in disgorgement, a stated total of $12.7 billion. The agency said the obligations were coordinated with the bankruptcy proceeding to further compensate victims.

Restitution is intended to address victim losses; disgorgement is designed to strip gains obtained through misconduct. Both are governmental remedies, not a replacement for filing and maintaining an FTX bankruptcy claim. Coordination with the bankruptcy is intended to reduce conflicting or duplicative recoveries. It does not establish that a creditor will receive the full amount of the CFTC judgment in addition to a plan distribution.

The CFTC order also does not turn every FTX customer into a direct judgment creditor of the agency. Administration, offsets and the relationship to the bankruptcy plan are controlled by the order and related procedures. If a CFTC, DOJ or other official notice asks you to identify amounts already recovered, answer accurately. Keep the notice, your submitted form and proof of any payment with your bankruptcy records.

How the two recovery tracks can interact

You may have to account for overlapping losses

The same trading loss, account balance or customer claim cannot ordinarily be counted twice merely because two authorities are involved. The bankruptcy plan’s anti-double-dipping language and the coordination provisions in regulatory remedies are designed to address that problem. The exact adjustment can depend on the type and timing of the payment, the class of claim and the terms of the relevant order.

For example, a form may ask whether you have received a bankruptcy distribution, a settlement payment or another government recovery. Report the amount and date shown in your records, even if you believe the payment should not reduce your claim. The administrator, trustee or court can then apply the governing crediting rule. Omitting a payment can create a later dispute, repayment demand or loss of eligibility.

One process does not pause the other

Do not stop responding to the FTX claims administrator while waiting for a DOJ or CFTC notice. A government process may take a different timetable, and there is no authoritative universal date for a remission payment. Continue meeting every bankruptcy and distribution-provider requirement unless an official order says otherwise.

Eligibility may differ

An allowed bankruptcy claim is determined under the plan. A remission process may define “victim” by reference to the specific crimes proved in the criminal case and may use its own loss calculation. A regulator may apply yet another statutory definition. Consequently, a person who qualifies in one process should not assume qualification in all three.

Assignments and estates require extra care

If you bought or sold a claim, or if the original holder has died or entered an estate or trust, make sure the claims register and provider profile identify the legally entitled recipient. An assignment may transfer bankruptcy rights without automatically transferring eligibility in a criminal remission program. Executors, trustees and assignees should obtain advice before submitting conflicting forms or releasing information.

Distribution-provider onboarding and the six-month forfeiture rule

FTX’s official distribution guidance states that distributions are made only after an Allowed Claim holder completes the required onboarding with a designated distribution-service provider and satisfies identity, tax and other pre-distribution checks.

The dashboard FAQ gives a specific warning for the distribution dated July 31, 2026: a holder who does not successfully onboard within six months of that applicable distribution date may permanently forfeit that distribution. For that date, the six-month period runs to January 31, 2027, subject to the terms and time calculations stated in the official notice. Similar six-month rules apply to other distribution dates, so do not assume that one date applies to every creditor.

Onboarding is more than opening an account. A provider may require identity verification, tax information, a supported destination account and completion of all compliance questions. A failed verification, an incomplete tax form or a mismatch between the provider profile and the claims record can delay payment until corrected.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Start early enough to resolve name differences, expired identification, changed addresses or inaccessible two-factor authentication. Save the provider’s confirmation number and screenshots showing successful completion. If the portal displays a technical error, report it promptly through the provider’s verified support channel and retain the ticket number. A late claim that you tried to comply may be useful, but the published rule warns that the distribution can still be permanently forfeited.

Creditor checklist

  1. Check your claim status. Confirm in the official FTX claims portal that the claim is marked Allowed, or monitor objections, settlement notices and court orders if it remains disputed.
  2. Use official channels only. Access the claims portal and distribution-provider instructions from the official FTX communications you already trust. Treat unsolicited messages, social-media links and look-alike domains as potential fraud.
  3. Complete every pre-distribution requirement. Finish identity checks, tax forms, account setup and any other item listed for your distribution.
  4. Record the applicable dates. Save the distribution date, the onboarding deadline and confirmation that onboarding succeeded. Do not rely on a browser bookmark or an email reminder alone.
  5. Check the destination details. Verify the bank or digital-asset destination permitted by the provider before final submission. A payment sent to an incorrect destination can be difficult or impossible to recover.
  6. Preserve a complete file. Keep your claim number, allowed amount, valuation information, notices, forms, confirmation screens and payment records.
  7. Report outside recoveries accurately. If a DOJ remission process or regulatory distribution contacts you, disclose bankruptcy payments and other recoveries when the form requests them.
  8. Get targeted advice when necessary. Seek jurisdiction-specific legal or tax advice for an assigned claim, an estate or trust claim, a disputed amount, a tax filing or any possible duplicate-recovery issue.

Common situations and the safest response

“My claim is allowed. Does that guarantee a full payout?”

No. “Allowed” establishes the claim for plan treatment; it does not promise payment of the entire face amount. The amount and timing depend on the plan’s distribution provisions, the claim class, available estate recoveries and completion of required conditions.

“Will I get a second check from Bankman-Fried’s $11 billion?”

There is no automatic second check established by the forfeiture announcement. The DOJ authorized use of finally recovered forfeiture funds for victim compensation, but any remission program would have its own eligibility, loss-calculation and notice procedures.

“Why is my crypto converted at a 2022 value?”

The court-approved conversion table and petition-date valuation rules create a common dollar value for estimation, voting and distribution. The plan does not generally recalculate the claim at the market price on each distribution day.

“I missed the onboarding deadline. What should I do?”

Contact the designated provider through its verified official channel immediately and preserve evidence of any technical failure or attempted submission. The published rule warns that failing to onboard within six months of the applicable distribution date may permanently forfeit that distribution, so do not assume a late request will be accepted.

“A person says they can secure my remission payment for a fee. Is it legitimate?”

Stop communicating through that contact and verify any notice independently through a government website or publicly listed government telephone number. Genuine agencies do not require a private intermediary to unlock a forfeiture payment by sending cryptocurrency or paying an advance fee.

“Do I have to file a new claim with the DOJ?”

Do not submit an unsolicited form or rely on a bankruptcy filing as a substitute for a remission application. Wait for an official DOJ notice that states whether a separate claim, certification or proof of loss is required and provides the authorized submission method.

“Does the CFTC’s $12.7 billion judgment mean I receive $12.7 billion divided by the number of creditors?”

No. The $8.7 billion restitution and $4 billion disgorgement figures are obligations in a coordinated regulatory judgment, not a published per-creditor formula. Distribution and crediting depend on the order, the bankruptcy plan and the funds ultimately collected.

What to watch for next

For bankruptcy distributions, the decisive documents are the confirmed plan, claim-status notices and the instructions for the applicable distribution date. For criminal compensation, wait for a formal DOJ remission notice that explains who may apply, what evidence is needed and how losses will be calculated. For the CFTC remedy, follow agency or court notices rather than assuming that the judgment’s headline amount will be distributed directly to every creditor.

Keep your contact information current with the claims administrator and monitor court or agency notices for changes. A creditor who moves, changes legal representatives or loses access to an old email account can miss a time-sensitive notice even when the underlying claim remains valid.

The practical rule is simple: protect the bankruptcy claim you already have, meet every provider deadline, and treat any criminal or regulatory recovery as a separate process that must be verified and properly reported.

Frequently Asked Questions

Will an FTX bankruptcy claim be paid separately from criminal restitution?

Potentially, but the mechanisms are separate. The bankruptcy claim is paid under the confirmed Chapter 11 plan. Criminal compensation would come through a DOJ remission process using finally forfeited assets, subject to separate eligibility, loss calculations and available funds. No automatic second payment is established.

Do I automatically receive money from Sam Bankman-Fried’s $11 billion forfeiture?

No. The DOJ’s March 28, 2024 announcement authorized use of recovered forfeiture funds to compensate victims, but the $11 billion is a judgment amount, not a guaranteed fund or equal payment for each creditor.

Why does FTX value my cryptocurrency at a 2022 price?

The plan and court-approved conversion table use petition-date valuation for estimation, solicitation, voting and distribution. Later market prices generally do not recalculate the allowed claim.

What happens if I miss the FTX distribution deadline?

The official dashboard FAQ warns that an Allowed Claim holder who does not successfully onboard with the designated distribution provider within six months of the applicable distribution date may permanently forfeit that distribution. Contact the provider immediately through a verified channel.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Are the CFTC restitution and disgorgement amounts an extra payment on top of bankruptcy distributions?

Not automatically. The CFTC announced $8.7 billion in restitution and $4 billion in disgorgement, coordinated with the bankruptcy. Coordination and anti-double-dipping rules may require crediting or reduce duplicative recovery.

How can I tell whether a remission offer is real?

Use only contact details in a verifiable DOJ notice or official government website. Do not pay an advance fee, send cryptocurrency or give credentials to an intermediary promising to unlock forfeiture funds.

Does an allowed claim guarantee payment of the full amount?

No. Allowed status makes the claim eligible for plan treatment, but the amount and timing depend on the claim class, available recoveries and completion of all pre-distribution conditions.

The Bottom Line

Keep the FTX claim active and complete every distribution-provider requirement on time. Treat any DOJ remission or CFTC recovery as a separate, government-administered process; the $11 billion forfeiture judgment and $12.7 billion CFTC judgment are not automatic additional checks, and overlapping recoveries may be credited under the plan.
