Fierce Lobbying Over the EU’s Proposed ‘Forever Chemicals’ Restriction

A 2025 investigation documented extensive lobbying around the EU’s proposed PFAS restriction. The broad measure is still pending, and the available evidence does not prove lobbying caused the timeline or will determine the outcome.

Lobbying around the EU’s proposed restriction on PFAS has been substantial, according to a 2025 investigation by Le Monde and its media partners. But the broad restriction is not yet law, and the available reporting does not establish that lobbying caused a delay or determined the final outcome. The European Chemicals Agency (ECHA) was expected to complete its scientific assessment by the end of 2026; the European Commission said it would then present a restriction proposal.

What is at stake in the EU PFAS debate?

PFAS are a large family of man-made chemicals used in a wide range of industrial and consumer applications. The European Commission identifies their persistence and potential to accumulate as reasons for concern. The policy debate centres on a proposed broad, sometimes called “universal,” restriction under the EU’s REACH chemicals law.

The word “universal” describes the breadth of the proposed approach, not a final legal outcome. The Commission’s June 2026 account said the proposal would take shape after ECHA’s scientific assessment. The Commission’s July 2026 REACH Restrictions Roadmap still listed PFAS work as ongoing. The Commission’s stated direction is to consider restrictions on PFAS in consumer goods, while allowing some critical industrial uses to continue under strict conditions when adequate alternatives are not available, until substitutes can be developed.

That approach matters to technology and manufacturing because reported lobbying positions included sectors such as batteries, medical devices and semiconductors, as well as textiles. Those groups argued for continued uses or exemptions, according to Le Monde’s reporting. Their positions are part of the policy debate; they are not ECHA’s scientific conclusions or the Commission’s final decision.

What the investigation found about lobbying

The Forever Lobbying Project was a collaborative investigation coordinated by Le Monde with Corporate Europe Observatory and media partners. Le Monde described a year-long investigation into PFAS pollution and industry efforts to influence the proposed restriction, drawing on public-record requests and collected documents. The project said it involved 46 journalists and 29 media partners in 16 countries.

Consultation participation and company spending

In a story published on 15 January 2025, Le Monde reported that ECHA received 5,642 contributions to the consultation on the proposed restriction, with two-thirds attributed to economic actors. The reporting described coordinated participation, including a password-protected Chemours advocacy portal that provided materials to customers.

Le Monde also reported, citing declarations in the EU transparency register, that Chemours’ declared EU lobbying expenditure rose from €550,000 in 2017 to more than €2.25 million in 2023. These are dated figures reported by the investigation, not current spending estimates or findings that ECHA made about the company.

Access to policymakers and record-keeping

The investigation also described a January 2024 email from Cefic director Marco Mensink to the Belgian prime minister’s office concerning an industry summit, alongside gaps in records of some discussions. These examples raise questions about access and transparency. On their own, they do not show that access was improper or that lobbying produced a particular policy result.

What the lobbying evidence does—and does not—show

The reporting documents organised advocacy, substantial consultation participation and declared lobbying expenditure. It does not, by itself, demonstrate that lobbying caused the timetable for the restriction, changed ECHA’s scientific assessment or will determine the Commission’s eventual proposal. The Commission’s stated policy also recognises that alternatives may not yet be available for some critical industrial applications. That distinction is important: a company’s or trade group’s request for an exemption is evidence of its position, not proof that an exemption is scientifically necessary or that regulators will grant it.

The separate dispute over ECHA’s consultant rules

A separate governance issue concerns contracts with consultancy Ramboll. Transparency International EU said it and Corporate Europe Observatory, LobbyControl and the Good Lobby complained about ECHA contracts after reporting alleged that Ramboll advised ECHA on PFAS while also advising companies lobbying on PFAS rules.

Transparency International EU reported that ECHA maintained it had assessed possible conflicts of interest. The watchdog also said ECHA subsequently expanded rules requiring service providers to assess conflicts and requiring tenderers or contractors to declare and avoid them. The complaint and the reported rule changes are relevant to scrutiny of the process, but the complaint itself does not establish misconduct.

Other PFAS measures are already in effect or advancing

The pending broad REACH restriction is not the only EU PFAS measure. From 12 January 2026, harmonised PFAS drinking-water monitoring requirements applied: Member States must monitor and report, and must act if limits are exceeded. This is a distinct adopted regime, not the proposed universal restriction.

The Commission also lists other measures, including restrictions concerning PFHxA and firefighting foams, and says a restriction on PFAS in food-contact packaging applies from August 2026 above specified concentration limits. Technical limits and compliance duties depend on the relevant legal text, so these broad summaries should not be used as compliance advice.

The proposed restriction is part of a wider REACH programme. In its July 2026 roadmap, the Commission said 11 restrictions covering hundreds of hazardous substances had been adopted since 2022, while six others were at final evaluation stages. PFAS remained one of the major ongoing initiatives.

Quick Recap

What happens next?

  1. ECHA completes its assessment. The Commission’s 15 June 2026 update said ECHA was expected to deliver its final scientific assessment by the end of 2026. That was an expected timetable, not confirmation that the assessment had already been delivered.
  2. The Commission presents a proposal. The Commission said it would present a restriction proposal after receiving ECHA’s assessment. Its stated direction points to considering a ban in consumer goods and conditional continuation of some critical industrial uses where adequate alternatives are lacking.
  3. The proposed rules and their conditions become clearer. The proposal will determine the restriction’s actual scope and how it treats alternatives, critical uses and any transition arrangements. Until then, the Commission’s stated direction should not be mistaken for adopted universal rules.
