FERPA and COPPA Rules for AI Grading and Student Data in U.S. Schools

Yes, a U.S. school can use ChatGPT or an AI grader, but only with a documented legal basis, tight vendor controls, and human oversight. FERPA governs personally identifiable information (PII) in education records, while COPPA governs commercial online services that collect personal information from children under 13. Sending an identifiable essay, grade, voice recording, image, account ID, or behavioral profile to an AI service can trigger both laws.

What FERPA and COPPA each regulate

FERPA and COPPA overlap in an AI-grading deployment, but they answer different questions. FERPA is a student-record privacy law. It generally applies to public schools, school districts, and postsecondary institutions that receive applicable U.S. Department of Education funds. Private and parochial K–12 schools are generally outside FERPA unless they receive those funds.

COPPA is a commercial online-privacy law. It applies to websites and online services directed to children under 13, and to services that have actual knowledge they are collecting personal information from a child under 13. A school can therefore face FERPA obligations when it sends education-record data to a vendor, while the vendor may face COPPA obligations because the users are young children.

Neither statute gives a blanket approval for “AI.” Compliance depends on the actual data flow, purpose, contract, age group, and commercial behavior of the service. Federal guidance also does not resolve every case—for example, whether a particular machine-generated score is an education record or whether a vendor’s model-improvement program fits the FERPA school-official exception.

When an AI grading deployment creates FERPA obligations

Identify the education records and PII

Treat the complete grading workflow as potentially sensitive, not just the final score. Inputs and outputs may include essays, handwriting images, audio or video, student names, IDs, accommodations, prompts, teacher rubrics, grades, feedback, audit logs, and inferred behavioral or performance profiles. If information is directly or indirectly linked to an identifiable student and maintained by a covered school or its agent, it may be PII from an education record.

Understand the parent and eligible-student rights

FERPA gives parents the right to inspect and review education records within 45 days, seek amendment of inaccurate records, and consent to disclosure of PII unless an exception applies. Those rights transfer to the student at age 18 or when the student attends a postsecondary institution. A district must be able to retrieve the original submission, the AI output, relevant prompts or rubric settings, and any human decision that became part of the record.

Using the FERPA school-official exception

The usual pathway for a district that hires an AI grading vendor is FERPA’s school-official exception to prior consent. The vendor must perform a service or function the school would otherwise use its own staff to perform; remain under the school’s direct control regarding use and maintenance of PII; use the data consistently with the school or district’s annual FERPA notice; and avoid unauthorized redisclosure or use.

“Direct control” is an operational requirement, not a label in a procurement file. The district should set the permitted fields, purposes, retention period, user roles, subprocessors, security requirements, and deletion process, then retain the ability to enforce those terms. A vendor’s standard consumer terms that allow broad reuse, advertising, profiling, or unrestricted model training are difficult to reconcile with this exception.

Why a routine grading service is not automatically a FERPA study

FERPA’s studies exception is narrower than ordinary vendor processing. A genuine study may develop, validate, or administer predictive tests; administer student aid; or improve instruction. It requires a written agreement specifying the purpose, permitted use, and destruction of information. Calling routine automated grading a “study” does not make it one. If the service is simply scoring class assignments, the district should analyze the school-official pathway or obtain consent rather than relabeling the activity.

What the AI-grading contract should require

A contract should translate the legal standards into enforceable technical and business rules. The following checklist covers the controls a district should negotiate before sending identifiable work.

Contract area Terms to require Why it matters
Purpose and fields List every input and output, the grading purpose, approved users, and prohibited uses. Shows that processing is limited to a school-authorized function.
Model training Prohibit training, fine-tuning, benchmarking, or human review for unrelated purposes unless the district expressly authorizes a defined use. Unrestricted improvement use may exceed direct control or the disclosed purpose.
Advertising and profiling Ban targeted advertising, sale, data brokerage, and behavioral or commercial profiling. School consent and the FERPA exception do not authorize unrelated commercial uses.
Access and security Require role-based access, least privilege, encryption, logging, secure development, incident response, and prompt breach notice. Limits exposure even though FERPA does not prescribe one technical control set.
Subprocessors and location Identify subprocessors and data locations, require written flow-down terms, and provide advance notice of changes. The district must retain control through the entire processing chain.
Retention and deletion Set a short, purpose-based retention schedule; require return or deletion at termination; define deletion from backups and derived stores where feasible. Supports FERPA purpose limits and COPPA’s necessity-based retention rule.
Parent access and correction Provide export, search, amendment, and correction support within the district’s FERPA response window. Parents and eligible students must be able to exercise record rights.
Audit and exit Give the district audit or assessment rights, records of processing, cooperation with investigations, and termination assistance. Paper promises are not direct control without verification and an exit path.

COPPA when children under 13 use an AI tool

When COPPA applies

COPPA covers a commercial service directed to children under 13 or one that has actual knowledge it is collecting personal information from a child under 13. Covered operators generally must give notice and obtain verifiable parental consent before collecting, using, or disclosing personal information, subject to narrow exceptions. Personal information can include persistent identifiers, images, voice, geolocation, and other data that identifies or can be linked to a child.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What school consent can and cannot do

A school may act as a parent’s agent only when the operator collects information for the use and benefit of the school and for no other commercial purpose. The operator must give the school direct notice of its practices and, on request, support review and deletion. The district should ensure that information is deleted when the educational purpose ends. School consent does not authorize advertising, sale, unrelated analytics, profiling, or model training for the operator’s independent business.

Parents retain the ability to review their child’s information, request deletion, and stop further use or collection. The operator must use reasonable security, retain information only as long as necessary for the specific purpose, and not make participation conditional on collecting information that is unnecessary for the activity.

What changed in 2025

The Federal Trade Commission announced amendments in January 2025; the final-rule notice is dated April 22, 2025. The amended rule requires separate verifiable parental opt-in for targeted advertising and certain disclosures to third parties, limits retention to what is reasonably necessary for a specific purpose, and expands the definition of personal information to include biometric and government-issued identifiers. A vendor handling student voice, face, handwriting, or official identifiers should therefore be reviewed against the amended requirements rather than an older COPPA checklist.

A practical approval workflow for a school or district

  1. Inventory the data. List essays, scans, voice, images, names, IDs, grades, accommodations, prompts, feedback, logs, and inferred profiles. Mark which fields are required and which can be removed or masked.
  2. Classify the legal facts. Decide whether each item is part of an education record and whether the service is directed to, or knowingly used by, children under 13. Record the school’s FERPA coverage and the vendor’s COPPA status.
  3. Choose the authorization path. Document the school-official exception, obtain individual consent where needed, or use a valid studies agreement for a genuine study. Record the COPPA school-consent basis or the vendor’s verifiable parental-consent process.
  4. Review the vendor before procurement. Examine privacy terms, model-training settings, advertising and profiling practices, subprocessors, data locations, security controls, retention, deletion, parent access, and incident procedures. Require written answers, not marketing assurances.
  5. Configure minimization. Use pseudonymous student IDs, suppress names and unnecessary metadata, limit uploads, set automatic deletion, restrict staff roles, and enable audit logs. Keep the source work and the AI output in systems the district controls when possible.
  6. Add human review. Require a qualified educator to review consequential scores, provide a correction route, and prevent an automated result from being the sole basis for discipline, placement, disability decisions, or denial of an opportunity.
  7. Notify families. Explain the service, data received, educational purpose, retention period, human-review process, and procedures for access, deletion, correction, and complaints. Update the FERPA annual notice when the use changes.
  8. Monitor continuously. Reassess when the vendor changes its model, terms, subprocessors, data location, retention, or commercial uses. Renewals should require confirmation that the original restrictions still apply.

Data minimization, security, and accuracy controls

FERPA does not prescribe a single encryption standard, certification, or architecture. The Department of Education nevertheless warns that breaches can cause serious harm and urges appropriate safeguards. For an AI grader, a sensible baseline is encryption in transit and at rest, least-privilege accounts, multifactor authentication for administrators, immutable access logs, tested incident response, vendor personnel screening, and documented deletion.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Minimization reduces both legal and practical risk. A rubric usually does not require a student’s full name, birth date, home address, or disability diagnosis. Replace direct identifiers with a district-controlled pseudonym, send only the text or image needed for scoring, and keep the re-identification key outside the vendor platform. Do not assume that removing a name makes a distinctive essay, voiceprint, or image anonymous.

Accuracy and fairness require their own controls. Preserve the original submission and the version of the rubric or model used. Log material prompts and configuration changes. Test for systematic errors across language varieties, disability-related writing differences, race, gender, and other relevant groups. Give teachers a way to override an erroneous score and give students a meaningful appeal path. Explain to families that an AI suggestion is not necessarily the final educational record until the school adopts it.

Vendor comparison questions that expose compliance gaps

Question Evidence to request
What educational function does the service perform? Workflow description showing what school staff would otherwise do and who makes the final decision.
Which data fields are collected? Field-level inventory, examples of metadata, biometric or voice handling, and minimization options.
Is data used to train or improve a model? Default settings, opt-out controls, retention of prompts and outputs, and a contractual prohibition on unrelated use.
Who receives the data? Current subprocessors, locations, transfer mechanisms, personnel access, and change-notice process.
How do families exercise rights? Search, export, correction, deletion, and stop-processing procedures with response times.
What happens after termination? Return and deletion certificates, backup treatment, derived-data handling, and transition assistance.
How is automated scoring challenged? Human-review policy, explainability materials, bias testing, appeal workflow, and audit records.

Questions federal law does not answer by itself

Federal compliance is not the end of the review. State student-privacy, biometric-privacy, breach-notification, records-retention, procurement, disability, and civil-rights laws may impose stricter or different duties. A state may restrict sale or profiling even when a federal exception appears available, and disability law may require accessible alternatives or individualized review.

There is also no universal federal rule deciding whether every AI-generated score is an education record. The answer can depend on whether the school maintains the score, relies on it for a decision, and incorporates it into the student’s record. District counsel should map the actual workflow, contract, age population, and retention practice rather than relying on the product’s label.

The safest design is therefore purpose-limited processing under district control: send the minimum data, prevent secondary commercial use, keep a human accountable for the grade, preserve a correction path, and make deletion and parent access work in practice. That approach addresses FERPA’s school-official conditions and COPPA’s limits on school consent without assuming that either law approves a vendor’s entire business model.
