The European Commission’s Cloud Sovereignty Framework evaluates 48 criteria across those dimensions and assigns Sovereignty Effectiveness Assurance Levels (SEAL-0 through SEAL-4). Use that framework as your buying scorecard, then verify the exact service, regions, control plane, support model, certificates and switching contract.
An EU-hosted workload can still depend on a non-EU parent company, foreign-controlled support, overseas telemetry, proprietary recovery tooling or subprocessors. Conversely, a provider with strong sovereignty controls may operate several EU regions. Treat “sovereign” as a workload-specific, contract-and-evidence claim rather than a marketing label.

Start with a sovereignty scorecard
Before requesting prices, write down the protection your workload actually needs. Rank each axis as required, preferred or acceptable with a documented exception. A provider that passes one axis can still fail another.
| Axis | Questions to ask vendors | Evidence to request |
|---|---|---|
| Data and region sovereignty | Which physical regions process primary data, replicas, backups, logs and telemetry? Can support staff or subprocessors access them? | Service-and-region data-flow diagram, backup locations, subprocessors list and access logs |
| Legal and ownership control | Which entities own and operate the service? What foreign-parent, jurisdictional or compelled-disclosure exposure exists? | Corporate structure, governing law, disclosure process and customer-notification commitments |
| Technical autonomy | Are APIs, orchestration, identity, encryption keys and recovery procedures portable? | Open interfaces, export formats, key-management design and restore documentation |
| Certification evidence | Which exact service, region and operator are covered by each certification or attestation, and when does it expire? | Certificate or attestation, scope statement, version, validity dates and exclusions |
| Support and operations | Where are support personnel located? Who can access production? What are response, resolution and escalation targets? | Support-location policy, privileged-access procedure, audit rights, SLA and incident process |
| Exit and resilience | What are current egress and switching charges, export limits, transfer times, re-platforming effort and deletion evidence? | Tariff, export test, migration runbook, deletion certificate and multi-provider restore plan |
Score every answer with a confidence label: contractual (enforceable term), audited (independent evidence), documented (provider statement) or unverified. Do not award a full sovereignty score for an unverified assertion.

What “sovereign cloud” covers in Europe
Sovereignty has at least eight interacting dimensions: where data is located, who legally controls the service, who can administer it, how it is operated, which suppliers and hardware it depends on, how much of the technology you can control or replace, how security is assured, and how sustainably it is delivered. A postcode answers only part of the first question.
The Commission’s Cloud Sovereignty Framework, published 1 June 2026, groups 48 criteria into these categories and uses SEAL-0 through SEAL-4 to express increasing assurance. A low SEAL can still be suitable for public, low-risk workloads; a high SEAL is relevant when disclosure, operational dependence or strategic autonomy would create unacceptable harm. Ask the provider to map its service to the framework criteria instead of accepting an unexplained “sovereign” badge.
The Cloud and AI Development Act describes four cloud-and-AI sovereignty assurance levels. Its level 4 requires full transparency and control over the software supply chain and no third-country interference. That is a demanding target, not an automatic property of every EU region or certification.
Why an EU region is not automatically sovereign
EU rules generally allow storage and processing anywhere in the EU, subject to sector-specific rules and exceptions. That freedom helps with resilience and disaster recovery, but an EU location alone does not answer these questions:
- Control plane: Is account management, orchestration, identity or monitoring performed from outside the EU?
- Copies and metadata: Do backups, snapshots, logs, telemetry, support tickets or billing records leave the selected region?
- Human access: Can a foreign-based employee, parent company or subcontractor obtain a privileged session?
- Legal reach: Which company receives a compelled-disclosure request, under which law, and what notice or challenge process applies?
- Supply chain: Are the hypervisor, firmware, accelerators, security tools or managed databases dependent on a third-country supplier?
- Recovery: Could the provider restore your service only with a proprietary tool or a person located outside your approved jurisdiction?
Require a written boundary for each service SKU. “Data stays in Germany” is incomplete if the provider cannot state where the control plane, key service, support tooling and disaster-recovery copy run.

Build a region-and-control-plane worksheet
Complete this worksheet for every production and recovery service, not just for the provider as a whole.
- Name the exact service and edition. Record the product, account type, region code, availability-zone design and any managed features you will enable. Sovereignty evidence is normally scoped to a service and operator.
- Draw every data flow. List primary storage, replicas, backups, snapshots, caches, logs, metrics, security events, support attachments and training or abuse-monitoring data. Mark the physical country and legal entity for each flow.
- Separate data plane from control plane. Ask where provisioning, identity, encryption-key management, firmware updates, orchestration and administrative consoles run. Capture any cross-border dependency needed to start or recover the workload.
- List people and subprocessors. Record support centres, incident responders, managed-service operators and subcontractors, together with their access method, approval requirement and session logging.
- Test a boundary condition. Create a non-production export, restore it in the declared recovery region and inspect logs and telemetry. Ask the provider to identify any unavoidable third-country call.
- Attach evidence and expiry dates. Store the region map, subprocessor register, contract clauses, audit reports and certificates with the worksheet. Set a review date whenever a certificate, contract or region changes.
| Worksheet field | Example entry to obtain from the vendor | Pass condition |
|---|---|---|
| Primary data | Country, facility or zone and legal operator | Matches your approved geography and contract |
| Replica and backup | Automatic and customer-selected locations, retention and deletion process | No undeclared copy outside the boundary |
| Control plane | Identity, orchestration, console and API endpoint locations | Administrative dependency is within the accepted jurisdiction or explicitly approved |
| Keys | Generation, storage, rotation and emergency-recovery location | You control keys or have a documented, auditable escrow arrangement |
| Support access | Countries, roles, approval workflow and session recording | Least-privilege, time-limited access with audit records |
| Subprocessors | Name, function, country and change-notification period | Contract gives notice and an objection or termination remedy |
Interpret certifications without overclaiming
Certifications are scoped evidence, not interchangeable guarantees. Gaia-X’s 2024 compliance document references SecNumCloud 3.2.a in France, BSI C5:2020 in Germany, ISO/IEC 27001:2022 and the EU Cloud Code of Conduct as evidence schemes. Each addresses a different set of controls and may cover only a named service, region, legal entity or operating process.
SecNumCloud 3.2.a
Ask for the current qualification or certificate, the qualified service name, operator, facilities, version and validity period. Confirm whether managed databases, backup services, support operations and the region you intend to use are inside the scope. A provider can hold a qualification for one platform while other products remain outside it.
BSI C5:2020
BSI C5 is a catalogue specifying minimum requirements for secure cloud computing for professional providers, auditors and customers. Request the complete attestation scope, the type of report, the reporting period, exceptions and complementary customer controls. A C5 report does not by itself prove EU ownership, absence of foreign legal exposure or portability.
ISO/IEC 27001:2022
Verify the certificate number, issuing body, validity dates, legal entity, locations, statement of applicability and included services. ISO 27001 demonstrates an information-security management system against its stated scope; it does not certify that all data, administrators or suppliers are European.

EU Cloud Code of Conduct
Check the provider’s current adherence statement, service scope and monitoring status. Treat the code as one privacy and compliance signal among several, not as proof of technical autonomy or immunity from third-country law.

Make support part of the sovereignty decision
Support is an operational control boundary. A technically EU-only data plane can still expose sensitive information through a ticket attachment or a remote troubleshooting session. Compare providers using a written support matrix.
| Support topic | Questions for procurement |
|---|---|
| Personnel location | In which countries are front-line, engineering and incident-response staff based? Can you require EU-only personnel for a workload? |
| Privileged access | Who may enter production, under what approval, for how long, and with what customer-visible logs? |
| Escalation ownership | Is there a named service owner, 24-hour escalation path and executive contact for a sovereignty incident? |
| Incident response | When will you be notified of unauthorised access, legal demands, subprocessor changes or a region outage? |
| Maintenance | Can maintenance be scheduled, rejected or performed without moving data outside the approved boundary? |
| Audit rights | May you review access logs, independent reports, facility controls and remediation evidence? |
| Language and time zone | Which languages and operating hours are contractual, and what happens outside them? |
| Service targets | What are response, workaround and resolution targets, service credits and termination rights? |
Put the answers in the order form or a security schedule. A web-page promise can change without giving you a remedy; a contract can define the people, locations, evidence and notice periods that make sovereignty testable.
Model the complete cost of leaving
Cloud exit is more than a data-egress invoice. Build a workload-level estimate before signing, using a conservative migration rehearsal where possible. A practical model is:
Exit total = export and transfer + format conversion + re-platforming + replacement licences + parallel operation + testing and validation + training + temporary destination capacity + specialist labour + contingency

Export and transfer
Measure the volume of databases, objects, snapshots, logs and machine images. Record the provider’s current egress and switching tariff, any minimum transfer size, throttling, daily limits and time to produce an export. Include transfer into the destination, not just out of the source.
Format conversion and re-platforming
Identify proprietary database engines, queues, identity integrations, serverless functions, observability agents and infrastructure-as-code modules. For each, choose a portable replacement or price the engineering needed to recreate behaviour. A nominally compatible API can still require application changes when consistency, networking or backup semantics differ.
Licences and people
Check whether software licences are portable, tied to the original provider, or priced differently on the destination. Budget architects, engineers, security reviewers, project management, retraining and the time business owners spend validating results.
Parallel operation and resilience
Plan a period in which both clouds run. Include duplicate compute, storage, monitoring, connectivity, backup and support. Decide how you will handle writes during cutover, roll back after a failed test and retain an independently verifiable copy.

Deletion and evidence
Require a deletion certificate covering primary data, replicas, backups, logs and encryption keys, with retention exceptions stated. Keep evidence of the final export, checksum, access revocation and account closure for auditors.

What the Data Act changes
The Data Act entered into force on 11 January 2024. During its first three years, providers may charge costs incurred for switching and data egress, but charges are limited to those costs. The European Commission states: “The Data Act will also entirely remove switching charges, including charges for data egress (i.e. charges for data transit), from 12 January 2027.”
Your Europe guidance says customers must be able to switch, receive their data in a common machine-readable format and obtain materially comparable outcomes for shared IaaS features. These rights do not make a complex migration free: conversion, engineering, testing, parallel capacity and training remain real costs. Ask the provider to identify which charges are pass-through cost, which are optional assistance and which disappear on 12 January 2027.
Exit questions to put in the contract
- Which machine-readable formats are available for each data type, and can you test them annually?
- What switching assistance, personnel and documentation must the provider supply?
- What are the current cost-based egress and switching charges, and how will they be removed or amended in 2027?
- What export rate, queue priority and transfer window will you receive during an emergency?
- How long will read-only access remain available after termination?
- What deletion evidence covers backups, replicas, logs and support systems?
- What remedy applies if an export is incomplete, corrupted or delivered late?
Use market signals without treating them as rankings
Cloud adoption makes these checks mainstream: Eurostat figures reported by the European Commission show that 45.2% of EU businesses used cloud services in 2023, including 77.6% of large enterprises, 59% of medium businesses and 41.7% of small businesses. A broad market does not mean every workload needs the same sovereignty level.
On 17 April 2026, the Commission announced a sovereign-cloud procurement that can reach EUR 180 million over six years and selected multiple providers to diversify supply and improve resilience. Named awards include a Luxembourgish-French partnership led by Post Telecom with OVHcloud and CleverCloud, and Germany’s STACKIT (Schwarz Group). These are dated procurement signals, not a universal ranking, endorsement for every service, or proof that a named provider meets your workload’s required scope. Verify current regions, pricing, certification status, partner programmes and contract terms directly.
Match assurance to the workload
Public or low-impact data
Prioritise availability, basic EU location controls, transparent subprocessors and a tested export. A lower SEAL may be proportionate if disclosure or provider failure would have limited consequences.
Personal, regulated or commercially sensitive data
Require explicit region and backup boundaries, EU-accessible support, strong key control, incident notification, audit rights and a current certification scope. Test restoration and export before production approval.
Critical public-sector or strategic workloads
Use the highest practical SEAL target, map every control-plane and supply-chain dependency, require strict privileged-access controls and maintain an independent recovery path. Consider two providers or a provider plus self-managed recovery when concentration risk outweighs operational complexity.

Procurement sequence that produces defensible evidence
- Classify the workload. Record data categories, impact of disclosure, outage tolerance, recovery point and recovery time objectives, and sector rules.
- Set non-negotiables. Define approved countries, legal entities, support locations, key ownership, certification scope, portability and maximum exit time.
- Issue the same questionnaire. Send the scorecard, worksheet and support matrix to every bidder so answers are comparable.
- Demand artefacts. Obtain certificates, scope statements, data-flow diagrams, subprocessor lists, sample access logs, export files, tariffs and draft contract language.
- Run a proof of exit. Export representative data, restore it elsewhere, measure elapsed time and validate application behaviour and audit evidence.
- Negotiate change controls. Add notice and termination rights for ownership changes, new subprocessors, region moves, certification loss or support relocation.
- Reassess continuously. Review the worksheet after major architecture, legal, certification or provider changes and at least annually for critical workloads.
Common buying mistakes and fixes
- Mistake: selecting by country name. Fix: map backups, telemetry, control plane and support personnel, not just primary storage.
- Mistake: treating one certificate as a sovereignty guarantee. Fix: read the scope, validity, exclusions and customer responsibilities for the exact SKU and region.
- Mistake: ignoring administrators. Fix: require EU-accessible support options, least privilege, approval, session recording and audit rights.
- Mistake: budgeting only egress. Fix: price conversion, licences, parallel running, testing, training, destination capacity and deletion evidence.
- Mistake: assuming the Data Act makes migration effortless. Fix: use the machine-readable export right, but rehearse a real workload and retain a rollback plan.
- Mistake: treating a procurement award as a live product guarantee. Fix: verify today’s service scope, region availability, pricing, certification and contractual remedies.
Decision rule
Select the provider whose documented service boundary, legal control, operational access, technical portability and exit plan meet your workload’s required assurance level with the fewest unverified assumptions. If a critical answer is only verbal, mark it as a gap, price the mitigation or reject the service. Re-score after every material change in ownership, region, certification, support location or contract.
