EU-Compliant File Transfer Services Compared for Businesses

EU compliance for file transfers depends on data flows, access, safeguards, and contract terms—not a provider badge. Compare three services and the questions to ask before signing.

No provider badge or EU headquarters alone proves that a file-transfer service is compliant for your business. The right choice depends on the personal data in your workflow, where files and metadata go, which organizations can access them, and what contractual safeguards apply. Tresorit, Proton Drive for Business, and WeTransfer offer different strengths; treat their claims as a shortlist, then verify the exact plan, data-processing agreement (DPA), locations, and subprocessors.

What “EU-compliant” means for a business file-transfer service

There is no single EU-compliant certification that settles whether a hosted service is suitable for every business. GDPR responsibilities depend on the processing and the roles of the organizations involved: your business may be a controller, while a service provider may process data on your behalf. The decision must account for the service’s actual data flows and your intended use.

The European Commission says EU data-protection rules apply across the European Economic Area (EEA), which includes EU countries plus Iceland, Liechtenstein, and Norway. GDPR Chapter V governs qualifying transfers of personal data outside the EEA. The EDPB’s small-business guidance identifies a transfer using three cumulative criteria:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. A controller or processor is subject to the GDPR for the processing.
  2. That organization discloses or otherwise makes personal data available to another organization.
  3. The recipient organization is in a country outside the EEA.

For procurement, this means checking more than the main file-storage region. Map who receives or can access files and related personal data, including subprocessors and support organizations, where those organizations are established, and which contract and transfer mechanism govern each relevant flow.

Transfer safeguards are not a location guarantee

The Commission lists several tools for international transfers: adequacy decisions, standard contractual clauses (SCCs), binding corporate rules, certification, codes of conduct, and derogations. Which mechanism is relevant depends on the transfer scenario. The EDPB describes SCCs as pre-approved model clauses for transfers outside the EU; they are one tool, not a general vendor-compliance certificate. Your organization should assess the applicable transfer and contractual module, including whether supplementary measures are needed for its circumstances.

EU or EEA storage, end-to-end encryption, and legal safeguards for transfers answer different questions. Storage location concerns where data is held; encryption concerns who can read it and under what conditions; transfer safeguards concern the legal basis and protections for data made available to an organization in a third country. One does not automatically establish the others.

Three services compared

The comparison below reflects the cited provider materials, not an independent audit of a particular account or configuration. Provider statements should be checked against the plan and contract you would actually buy.

Service What the cited material says What to verify for your workflow
Tresorit Business / Enterprise Tresorit’s data-storage documentation says customer data defaults to Microsoft Azure data centers in Ireland; Business and Enterprise customers can choose from available residency options. Its business material describes end-to-end encryption, file and folder activity logs, granular sharing controls, and administration. Tresorit says company personal data transferred to subprocessors outside the EEA is covered by SCCs. Confirm which residency choices are available to your account and contract, and whether the commitment covers content, metadata, backups, and logs. Ask about support access, retention, the current subprocessor list, and what data remains outside encrypted content. “Compliant by design” is the provider’s characterization, not a conclusion about your configuration.
Proton Drive for Business Proton’s business security material describes end-to-end encryption, password-protected sharing links, link expiration and revocation, and SOC 2 Type II and ISO 27001 certifications. The cited material does not establish EU-only locations for every file, metadata category, support function, or operational system. Obtain the applicable data-location terms and DPA before treating the service as a residency solution.
WeTransfer business WeTransfer’s security material, updated 2 October 2026, says files are stored in the EU when the sender uploads from an EU IP address and does not use an anonymous proxy; otherwise, files are stored in the US. It says transfers use TLS 1.2 or TLS 1.3 and files are encrypted at rest with AES-256. Its business material describes GDPR positioning and DPAs on business plans. Verify the location outcome for your actual upload workflow and the contractual commitment for files and other data. The conditional location rule may not suit a requirement for a fixed EU location. The company’s Netherlands base does not establish that every file or operational data flow stays in the EU.

How to interpret the differences

  • If residency choices and administration are priorities: Tresorit documents Ireland as its default and says Business and Enterprise customers can choose from available residency options. Confirm the eligible region and scope in the agreement for your plan.
  • If client-side confidentiality is the leading concern: Proton emphasizes end-to-end encryption and link controls in its business security material. That does not, by itself, answer where every data category is processed.
  • If you need convenient link-based sending: WeTransfer documents a location rule based on the sender’s IP and use of an anonymous proxy. Evaluate whether that conditional model satisfies your location requirement.

What to compare before choosing

Assess each service against the same workflow and data categories. A statement about stored files may not cover the metadata, logs, backups, support access, or identity systems associated with an account.

Rank #3
Integral 4GB Crypto-197 256-Bit 3.0 USB Flash Drive Encrypted - FIPS 197 Certified, Brute Force Password Attack Protection & Waterproof Double Layer Design
  • Certified to FIPS 197 - U.S. Government Approved High Level Information Security Standard.
  • Protection against brute force password attacks - Data is automatically erased after 6 unsuccessful access attempts. The data of the USB flash drive type c encryption with dual connectors is destroyed and the cryptographic drive is reset.
  • Durable dual-layer waterproof design* — Protects the crypto reader from bumps, drops, run-in and immersion in water. The electronics are protected by a hardened internal case. Rubberized silicone outer case provides a final layer of protection.
  • Auto-Lock —The cryptographic key automatically encrypts all data and locks when removed from a PC/Mac or when screen protection or "computer lock" is enabled.
  • Secure Entry —Data on these flash drives cannot be accessed without the correct alphanumeric password of 8 to 16 characters. A password indication option is available for this flash drive. The hint cannot match the password.
  • Data locations: Ask where files, metadata, backups, and logs are stored and processed, and whether the answer differs by plan or workflow.
  • Recipients and access: Identify subprocessor countries, support access, and other organizations that can receive or access personal data.
  • Transfer mechanism: For any relevant transfer outside the EEA, ask what mechanism applies and how it relates to your processing scenario. Have privacy or security counsel assess it.
  • Encryption and keys: Distinguish encryption in transit and at rest from end-to-end or client-side encryption. Ask who controls the keys and what access remains possible for the provider.
  • Sharing controls: Check password protection, expiration, revocation, permissions, recipient authentication, and download limits against your actual sending needs.
  • Governance and recovery: Review audit logs, retention, deletion, export, administrator controls, identity integration, and incident processes.
  • Contract scope: Confirm that the DPA and residency commitment apply to the selected plan and cover the relevant data categories and subprocessors.

Questions to put to vendors

Request current, plan-specific documents and answers rather than relying on a general compliance page. Useful procurement questions include:

  • Can you provide the current DPA, subprocessor list with locations, and a data-flow diagram for this plan?
  • What contractual residency commitment applies to content, metadata, backups, logs, and support data, and which locations can we select?
  • Which subprocessors or support organizations outside the EEA may receive or access personal data, and what transfer mechanism governs each flow?
  • How are encryption keys managed, and which provider staff or systems can access unencrypted content?
  • What are the retention and deletion schedules, including after a transfer link expires or an account is closed?
  • Can you demonstrate the audit, sharing, and administrator controls required by our workflow?

Have privacy and security counsel review any international-transfer scenario against your organization’s role, processing, and chosen legal mechanism. A vendor’s certifications, encryption claims, or European storage option can inform the assessment, but none replaces it.
