EU AI Act vs Ireland’s AI Governance Framework: Key Differences for Developers

The EU AI Act is the rulebook; Ireland’s AI governance framework is the national machinery that makes that rulebook work. Irish developers do not follow a second Irish risk classification instead of the Act. They must apply the EU’s risk-based duties and then identify the Irish authority, procedure and evidence requirements that apply to their sector and role. That means one compliance programme, with an Ireland-specific regulator map, reporting route and implementation calendar.

The difference in one view

Question EU AI Act Ireland’s AI governance framework
What is it? Regulation (EU) 2024/1689, a directly applicable EU regulation establishing harmonised, risk-based requirements for AI systems. Ireland’s national implementation and enforcement architecture for that regulation.
Who sets the risk categories? The EU regulation defines prohibited practices, high-risk systems, transparency duties, general-purpose AI (GPAI) obligations and lower-risk categories. Ireland cannot replace those categories with a separate national taxonomy.
Who supervises? EU institutions, including the European Commission and the AI Office, oversee EU-level duties and coordination. Existing Irish sector regulators are designated as competent authorities, coordinated by a planned AI Office of Ireland (Oifig Intleachta Shaorga na hÉireann).
What must a developer prove? Depending on role and risk: classification, prohibited-practice screening, documentation, data governance, testing, human oversight, logging, accuracy, robustness, cybersecurity and transparency. That the same controls are available to the relevant Irish authority, with national procedures, powers and reporting channels.
Does Ireland add a separate technical standard? The Act supplies the substantive obligations. Ireland adds institutional arrangements, enforcement powers, penalties and support mechanisms, rather than a new technical risk ladder.

The practical test is therefore not “EU compliance or Irish compliance.” It is “EU Act compliance, implemented through the Irish authority that covers this system.”

What the EU AI Act requires

Scope and purpose

Regulation (EU) 2024/1689 governs AI systems placed on the EU market or put into service in the EU. It creates a common framework for safety, fundamental rights and trustworthy deployment. The Act covers prohibited practices, transparency, high-risk systems, GPAI, governance, technical documentation, human oversight, accuracy, robustness and cybersecurity.

The Act entered into force on 2 August 2024. Its obligations do not all start on the same day. A developer should track the applicable date for each system, because a model may be affected by more than one provision as it moves from development to deployment or as a transition period expires.

Risk categories drive the work

  • Prohibited practices: certain AI uses are banned. Screening must happen before product launch, pilot use or internal deployment.
  • High-risk systems: systems in the Act’s high-risk categories face extensive requirements for risk management, data and data governance, technical documentation, records, transparency, human oversight, accuracy, robustness and cybersecurity. Some high-risk systems fall under Annex III use cases; others are linked to regulated products in Annex I.
  • GPAI: providers of general-purpose AI have obligations that apply on the GPAI timetable, with additional duties for models presenting systemic risk where applicable.
  • Transparency cases: certain systems must inform people that they are interacting with AI, label or disclose generated or manipulated content, or provide other user-facing information.
  • Minimal- or limited-risk uses: not every system has a large pre-market compliance file, but other duties can still apply, including AI literacy, transparency or general product and data-protection law.

Classification is not a one-time marketing decision. It should be recorded against the system’s intended purpose, users, sector, technical capability and deployment context, then revisited when those facts change.

Provider, deployer and other roles

The same company can have different roles for different products. A company building a model for other businesses may be a provider. A company configuring and using a third-party tool for its own work may be a deployer. A distributor, importer, product manufacturer or authorised representative can have separate responsibilities. Contracts and procurement records should identify who performs each role instead of assuming that the vendor carries every duty.

What Ireland adds

A distributed enforcement model

Ireland chose to use existing, well-established sectoral authorities rather than create one regulator for every AI system. The Department of Enterprise, Tourism and Employment reported an initial list of eight competent authorities in March 2025 and 15 designated authorities by September 2025. The relevant authority depends on the system’s sector and use case.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

This is the key operational difference for developers. A health, employment, financial-services, media or public-sector deployment may be examined through a different Irish authority even when the underlying EU obligations are the same. A developer should maintain a regulator map beside its system inventory, not wait until an investigation begins to decide who is responsible.

The AI Office of Ireland

Ireland’s planned AI Office of Ireland, or Oifig Intleachta Shaorga na hÉireann, is intended to provide the national coordination layer. Its stated functions include acting as Ireland’s Single Point of Contact, coordinating competent authorities, providing technical expertise, supporting innovation and operating a regulatory sandbox.

The office is not a replacement for every sector regulator. Its coordination role means that a developer may need to deal with the sector authority for a substantive question while using the AI Office for cross-sector guidance, coordination or sandbox engagement.

The proposed statutory framework

The General Scheme of the Regulation of Artificial Intelligence Bill 2026 would give this architecture statutory form. It would provide for national penalties, authority powers and the procedures needed to supervise and enforce the EU Act in Ireland. A General Scheme is a legislative proposal, not the same thing as an enacted statute. Developers should therefore monitor the final Irish legislation and any implementing guidance before relying on a draft power, deadline or procedure.

What Ireland does not do

Ireland does not create a parallel Irish definition of “high risk” that can be used to avoid the EU Act. Nor does an Irish registration or contact point remove the underlying EU duties. National arrangements determine who supervises, how information is supplied and which enforcement route is used; the substantive classification still comes from the regulation.

Deadlines that apply to developers in Ireland

The European Commission’s current AI Act timetable is phased. The dates below are the Commission’s published dates and may change if later amendments alter the transition rules.

Date What starts or changes Developer significance
2 August 2024 The EU AI Act enters into force. Use this date as the legal starting point for transition planning and version-controlled compliance records.
2 February 2025 Prohibitions and AI-literacy obligations begin. Screen every system for prohibited practices and train relevant staff. AI literacy is not postponed until a high-risk system is launched.
2 August 2025 GPAI obligations and governance rules apply. Providers and users in the GPAI supply chain should confirm whether their role triggers model, information-sharing or governance duties.
2 August 2026 Broad application and enforcement begin. Most remaining obligations become operational on the general timetable, subject to the Act’s specific transition provisions.
2 December 2027 Extended transition for Annex III high-risk use cases. Systems in these use cases must be ready for the end of the applicable transition by this date.
2 August 2028 Extended transition for Annex I high-risk systems. High-risk systems tied to regulated products under Annex I receive this later transition date.

The Department of Enterprise, Tourism and Employment describes the Act’s phased application period as 36 months. That description does not make every obligation optional during the period: the prohibitions, AI-literacy rules, GPAI duties and governance provisions have their own start dates.

How to identify the Irish regulator for an AI system

Start with the use case, not the model name

Regulators supervise applications and activities, not just model families. Record what the system does, who is affected, who controls the deployment, where it operates and whether it is part of a regulated product. A general-purpose model used for recruitment, credit, content moderation or a medical workflow can create different regulatory paths depending on the application.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Build a regulator map

  1. List the economic sector and public function. Record whether the deployment concerns media, employment, education, finance, health, transport, public administration, consumer services or another regulated activity.
  2. Identify the Irish entity and location. Note the provider, deployer, importer or product manufacturer established in Ireland, and where the system is placed on the market or put into service.
  3. Match the use case to the designated authority. Use the current Irish list of competent and designated authorities, then check the authority’s published remit and contact route.
  4. Record overlapping regulators. A system can involve more than one authority when it combines a regulated product, a sector-specific service and a transparency or consumer-facing function.
  5. Assign an owner and review date. Keep the map with the inventory, contracts and technical file. Recheck it when the system, sector, Irish designation or national legislation changes.

Example: media and transparency

Coimisiún na Meán identifies supervision of certain Article 5(1)(a) and (b) prohibited practices and Article 50 transparency duties. A developer supplying an AI feature to a media service should therefore examine both the system’s underlying risk classification and the media regulator’s specific remit. The example illustrates why “the AI Office handles everything” is an unsafe assumption.

A classification workflow developers can operate

  1. Inventory all systems. Include internally built models, fine-tuned models, APIs, embedded vendor tools, chatbots, ranking systems, computer-vision components and systems used only by employees. An internal pilot can still create compliance exposure.
  2. Describe the intended purpose in plain language. State the decision or task, affected people, operating environment, human decision-maker and any consequence of error. Avoid vague descriptions such as “automation” or “productivity.”
  3. Capture role and supply-chain facts. Record who developed the model, who places the system on the market, who configures it, who deploys it and who controls updates.
  4. Screen for prohibited practices first. If the intended function falls within a prohibited practice, do not continue as though documentation can cure the problem. Escalate the design for legal and product review.
  5. Check GPAI status. Determine whether the organisation provides a general-purpose model or integrates one supplied by another party. Preserve model documentation and supplier information needed for downstream duties.
  6. Test the high-risk routes. Compare the use case with Annex III categories and with AI functions embedded in products covered by Annex I. Record the reasoning and any applicable transition date.
  7. Check transparency duties. Decide whether users must be told they are interacting with AI, whether generated or manipulated content must be identified, and whether another Article 50 situation applies.
  8. Document the residual category. If the system is not prohibited, GPAI, high-risk or subject to a specific transparency duty, record why and which general obligations still apply.
  9. Approve and revisit. Obtain sign-off from product, legal, security and the relevant business owner. Reclassify after a material model update, new user group, new geography or changed intended purpose.

Controls to prepare by system type

For every system

  • Maintain a complete inventory with version, owner, provider or deployer role, intended purpose, sector and deployment geography.
  • Keep a written risk-classification decision and the evidence behind it.
  • Provide AI-literacy measures for staff whose work involves operating, procuring, monitoring or making decisions about AI. This obligation has applied since 2 February 2025.
  • Control changes through versioning, approval and rollback procedures.
  • Preserve user instructions, incident records, supplier notices and evidence of training.

For prohibited-practice screening

Make the screening a release gate. Product requirements, procurement forms and change-control templates should ask directly whether a proposed function could fall within an Article 5 prohibition. A later Irish regulator contact cannot legitimise a prohibited design.

For GPAI systems

Confirm whether your organisation is the GPAI provider, a downstream provider integrating the model, or a deployer. Collect the information needed to understand capabilities, limitations, intended uses and applicable instructions. The GPAI and governance timetable began on 2 August 2025, so supplier due diligence should not be left to a future high-risk assessment.

For high-risk systems

Plan a documented management system covering risk identification and mitigation, data governance, technical documentation, automatic logging, instructions for use, human oversight, accuracy, robustness and cybersecurity. The evidence should be usable by an authority, not merely written as an internal policy statement. Link each control to an owner, test method, acceptance threshold and retained record.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For transparency cases

Design the disclosure into the interface, output pipeline and user documentation. Check the wording, placement and timing of notices, and test whether a user can reasonably see and understand them. Article 50 duties can apply even when a system is not high-risk, so a “low-risk” label is not a reason to omit transparency review.

Evidence and records an Irish authority may need

A defensible compliance file should allow an authority to reconstruct what the system was intended to do, which version operated, who supervised it and what happened when it failed. Keep the following together or cross-referenced:

  • System inventory entry and classification rationale.
  • Provider, deployer, importer, distributor and supplier contracts.
  • Technical documentation, model or system specifications and instructions for use.
  • Training-data governance records, quality checks and data-provenance decisions where relevant.
  • Risk assessments, validation results, accuracy and robustness tests, security testing and remediation tickets.
  • Human-oversight design, escalation rules and evidence that staff can intervene.
  • Automatically generated logs and retention rules.
  • AI-literacy training content, attendance or completion records and role-based refresh dates.
  • User-facing transparency notices and tests showing where they appear.
  • Incidents, corrective actions, complaints, regulator communications and update history.

The purpose is auditability. A spreadsheet that says “compliant” without linking to tests, decisions and owners will not explain how the conclusion was reached.

Do Irish developers have extra requirements?

They have extra national interfaces, not a second substantive AI Act. An Irish developer must follow the same EU classification and technical duties as an equivalent developer elsewhere in the EU, while also identifying the Irish competent authority, national contact route, enforcement procedure and any Irish legislative requirements once enacted.

Ireland’s distributed model can create more coordination work where a system crosses sectors. That is an operational burden rather than a separate risk category. The planned AI Office, with its Single Point of Contact and technical-coordination role, is intended to reduce that fragmentation and support an Irish regulatory sandbox.

National implementation can also change the consequences of non-compliance. The General Scheme of the Regulation of Artificial Intelligence Bill 2026 would provide for Irish authority powers and penalties, but the final scope and wording depend on the enacted legislation. Do not quote an unconfirmed penalty amount or assume that a draft provision is already in force.

Common mistakes and how to correct them

“The vendor is responsible for everything”

Why it fails: responsibilities follow the role performed in the supply chain, and a deployer can have duties even when it did not train the model.

Correction: assign provider, deployer and other roles contractually and in the inventory. List which party supplies documentation, monitors performance, handles incidents and controls changes.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“An Irish authority will classify the system for us”

Why it fails: the organisation placing or using the system needs its own documented analysis and cannot outsource accountability by waiting for a regulator.

Correction: classify before procurement or release, record the reasoning and seek authority or legal clarification where the facts are genuinely uncertain.

“Only high-risk systems need attention before 2026”

Why it fails: prohibitions and AI-literacy obligations began on 2 February 2025, and GPAI and governance obligations began on 2 August 2025.

Correction: use a date-based obligations register and assign owners for each start date.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“A general-purpose model is automatically high risk”

Why it fails: GPAI and high-risk are different regulatory routes. A GPAI provider can have duties without the downstream application being an Annex III high-risk system, and a high-risk application can use a model that is not itself a GPAI provider.

Correction: assess the model role and the application use case separately, then document how the two assessments interact.

“One Irish regulator covers the whole project”

Why it fails: Ireland’s model is sectoral and distributed, with the AI Office coordinating rather than replacing all competent authorities.

Correction: maintain a regulator map and record overlapping authorities when the product crosses sectors.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“Transparency is just a privacy notice”

Why it fails: Article 50 transparency duties concern how people are informed about AI interaction or generated content and can require product-level disclosures.

Correction: design notices into the interface and output process, test them with representative users and retain the evidence.

A practical Ireland-ready implementation plan

  1. Week one: inventory and ownership. Gather every AI system, supplier and internal project. Give each an accountable business owner and technical owner.
  2. Week two: classification sprint. Record intended purpose, role, geography, sector, prohibited-practice result, GPAI result, high-risk route and transparency result.
  3. Week three: evidence gap analysis. Compare each system’s file with the documentation, logging, testing, oversight, cybersecurity and literacy controls required for its category.
  4. Week four: Irish authority mapping. Identify the competent or designated authority, the AI Office coordination route and any overlapping sector regulator. Record the source and review date for every designation.
  5. Before release or material change: approval gate. Require sign-off on classification, user disclosures, human oversight, incident handling and retained evidence.
  6. After deployment: monitoring. Review incidents, performance, user complaints, model updates, supplier changes and regulatory developments. Reopen classification when the system’s purpose or context changes.

What developers should monitor next

Three moving parts deserve particular attention. First, the European Commission’s AI Act timetable and any amendments can change transition dates or implementation detail. Second, Ireland’s General Scheme must progress through the legislative process before its final powers, penalties and procedures can be treated as settled law. Third, Ireland’s list of designated authorities and the practical remit of the AI Office may evolve as the national architecture becomes operational.

Keep a dated register of these changes, assign someone to review Commission and Irish government publications, and connect each change to affected systems. A notice that changes a deadline is useful only when it reaches the owner of the system that must meet it.
