But that does not mean every bank must accept e-signatures on every form. The document, applicable state law, bank process, and any notary, witness, or original-document requirement can change what you need to do. Before signing, ask the bank about the exact form and how to get a complete copy.
What U.S. law says about electronic signatures
The federal E-SIGN Act applies to transactions in or affecting interstate or foreign commerce. Its general rule is that a signature, contract, or record covered by the law may not be denied legal effect, validity, or enforceability solely because it is electronic. A contract also cannot be rejected solely because an electronic signature or record was used to form it. 15 U.S.C. § 7001

That is a legal baseline, not a requirement that banks and customers conduct every transaction electronically. E-SIGN generally does not require a person to agree to use or accept electronic records or signatures. A bank may have a process that requires ink, an original, or a particular signing method for a specific document.
Electronic and wet signatures compared

Why disclosure consent is a separate issue
Signing a document electronically and receiving a legally required disclosure electronically are related but distinct questions. If a law requires information to be provided to a consumer in writing, E-SIGN permits electronic delivery only when its conditions are met. These include affirmative consent that has not been withdrawn, clear information about paper access and withdrawal, the scope of consent and how to update contact details, notice of relevant hardware and software requirements, and an electronic consent or confirmation that reasonably demonstrates the consumer can access the format. 15 U.S.C. § 7001

For example, Regulation E allows covered disclosures to be provided electronically subject to E-SIGN and other applicable requirements. That rule does not mean every bank communication is subject to the same consent process; whether a particular disclosure is required to be in writing and which rules apply depend on the transaction. 12 C.F.R. § 205.4
Notaries, witnesses, and originals can change the answer
E-SIGN recognizes that an electronic notarization or acknowledgment can satisfy a legal requirement when the authorized person’s electronic signature and required information are attached to or logically associated with the electronic record. That provision does not settle every state-specific question about remote notarization, recording, witnesses, or the particular transaction. Check the state law and the bank’s instructions before relying on an electronic notary process. 15 U.S.C. § 7001

Similarly, do not assume that a bank will accept a scanned handwritten signature or that an electronically signed file meets an instruction to provide an original. Ask what the form requires and how the bank wants it delivered.

The Uniform Electronic Transactions Act (UETA) is a model law that establishes legal equivalence for electronic records and signatures and authorizes electronic execution of bilateral contracts when the parties agree. Its enacted version and amendments vary by state, so the model act alone does not determine how a particular bank form will be treated. A CFPB-hosted Uniform Residential Loan Application, marked effective July 2019, includes language stating that an application delivered as an electronic record with an electronic signature may be as effective and enforceable as a paper application signed in writing. - Identify the exact form. Use its full name and, if available, the account or application type when contacting the bank.
- Ask which signing methods it accepts. Confirm whether that form can be electronically signed, requires ink, or must be signed in person.
- Check formalities and delivery. Ask whether it needs a notary, witnesses, an original, or a specific delivery method, and whether electronic or remote notarization is accepted for your transaction and state.
- Clarify disclosure delivery. If required consumer disclosures will be delivered electronically, ask how consent is obtained and how to request paper access or withdraw consent.
- Save the executed record. Download or request the completed document, all attachments, and any signing record the bank provides. Keep them somewhere you can access later.
For real-estate-secured lending, estate-related documents, negotiable instruments, or a dispute over whether a particular signature is valid, do not rely on a general e-signature rule alone. Check the governing law and the transaction-specific instructions; those details can determine which formalities apply.
