Section 75(4) of the Central Goods and Services Tax (CGST) Act creates a clear duty to give a meaningful hearing when the taxpayer asks for one in writing or when an adverse decision is contemplated. Cross-examination has no equivalent, general grant in the CGST Act’s adjudication provisions. It is a fact-sensitive request, most persuasive when the proposed demand depends materially on a third party’s statement and credibility cannot fairly be tested from documents alone.
The short answer: two different procedural protections
A personal hearing lets the taxpayer (or an authorised representative) address the adjudicating officer before an order is made. It is the forum for explaining the written reply, answering questions, pointing out factual or legal errors, and making oral submissions. Section 75(4) contains two independent triggers: a written request from the person chargeable with tax or penalty, or the officer’s contemplation of an adverse decision.

Cross-examination is narrower. It is a method of testing whether a witness or statement-maker accurately perceived events, authored a statement, remained consistent, and is credible. The practical question is not simply whether a witness exists, but whether the witness’s evidence is material and whether testing that evidence could affect the result.

The distinction matters because denial of a statutory personal hearing can invalidate the process even though the taxpayer filed a detailed written reply. A cross-examination request, by contrast, generally requires a reasoned, case-specific assessment of necessity, materiality and possible prejudice.

What section 75(4) requires
“An opportunity of hearing shall be granted where a request is received in writing from the person chargeable with tax or penalty, or where any adverse decision is contemplated against such person.”
This wording does not make the hearing optional once either trigger is present. The Allahabad High Court held in Bharat Mint that a separate request is unnecessary when an adverse decision is contemplated: the officer must provide the opportunity before passing the adverse order. The Jharkhand High Court, in Godavari, likewise treated the hearing requirement as mandatory and quashed an order made without it.
Trigger one: a written request
Ask for the hearing in writing, preferably in the reply to the show-cause notice and again through the GST portal field or submission used for the proceeding. State that the request is made under section 75(4), identify the proceeding and notice number, and ask for the date, time and mode of hearing. Preserve the submitted copy and portal acknowledgment.
Trigger two: an adverse decision is contemplated
The second trigger protects a taxpayer even where the reply did not contain a separate hearing request. If the officer proposes tax, interest, penalty or another adverse determination, the hearing opportunity must precede the order. A taxpayer should not assume that silence in the original reply gives up this protection.
Adjournments under section 75(5)
Section 75(5) allows the proper officer to adjourn for sufficient cause, but reasons must be recorded in writing and the proviso limits adjournments to three during the proceedings. An adjournment request should therefore explain the concrete cause, identify the requested alternative date, and attach supporting material where appropriate. Keep the request, the officer’s response and any revised notice.

What a meaningful personal hearing includes
A hearing is more than an invitation to appear. It should give the taxpayer a real chance to influence the decision before it is finalized. The participant may:
- appear personally or through an authorised representative;
- explain and supplement the written reply;
- answer questions about invoices, returns, transactions, classification, payment or other disputed facts;
- identify errors in the notice, relied-on documents or proposed computation; and
- make oral submissions on the statute, rules and evidence.
The Delhi High Court in Jupiter Exports said that the statutory opportunity is “not an empty formality” and that personal hearing must be meaningful. A brief telephone conversation does not substitute for the hearing contemplated by section 75(4). The procedural record should show what hearing was offered and when, rather than merely noting that someone was contacted.

A usable notice should communicate the date, time and venue or electronic mode. In Bharat Mint, the Allahabad High Court treated omissions that left the taxpayer without a workable hearing opportunity seriously. If a notice does not state when or how to attend, promptly ask for clarification in writing and retain the response.
What to preserve
- the hearing request in the reply or portal form;
- the GST portal acknowledgment and submission timestamp;
- the hearing notice, including date, time, venue or video/online instructions;
- any adjournment application and the reasons given;
- attendance, appearance or non-appearance records; and
- the final order and the documents it says were considered.
This file helps establish whether the statutory opportunity was offered, usable and actually available before the order.
What cross-examination is designed to test
Cross-examination is directed at a person’s evidence, not at the general presentation of the taxpayer’s case. Questions may test:

- what the person personally saw, received or did;
- how the person identified the taxpayer or transaction;
- who prepared, signed or supplied the statement;
- whether the account changes between statements or conflicts with records;
- whether the person had a reason to shift responsibility; and
- whether the disputed proposition is supported independently.
It is most consequential when the department’s demand depends substantially on a third-party statement and the dispute cannot be resolved fairly by invoices, ledgers, transport records, return data or other documents. A request should connect the witness to a specific proposition that the taxpayer disputes and explain why credibility testing could change the finding.

The cited 2025 Delhi High Court judgment records the adjudicating authority’s analysis that the CGST Act does not create a general right to cross-examine witnesses during GST adjudication. The judgment contrasts this position with section 138B of the Customs Act, which expressly addresses cross-examination in specified quasi-judicial proceedings. It also distinguishes section 136 of the CGST Act, whose context is court proceedings rather than a general adjudication right.
That is a limited, fact-sensitive position, not a rule that every cross-examination request may be rejected automatically. The same judgment discusses circumstances in which cross-examination may be unnecessary: the evidence may be documentary, independently corroborated, or sufficient without testing a witness personally. A request primarily intended to delay proceedings may also be refused.
How to make the request harder to dismiss
- Name the person. Identify the statement-maker or witness relied on in the notice or proposed order.
- Quote or pinpoint the evidence. Give the statement date, paragraph, page or transaction and the proposition you dispute.
- Explain materiality. Show that the proposition supports an essential element of the proposed tax, interest or penalty.
- Explain why documents are insufficient. Identify the inconsistency, lack of personal knowledge, authorship issue or credibility conflict that records alone cannot resolve.
- State the possible prejudice. Explain how accepting the statement without testing it would impair the defence.
- Ask for a reasoned decision. Request that the officer allow the examination or record reasons if it is refused.
A broad demand to “cross-examine everyone” is less persuasive than a focused request tied to a decisive factual issue. Do not treat the request as a substitute for answering the notice; file the documentary and legal defence separately and on time.
Personal hearing and cross-examination compared
| Issue | Personal hearing | Cross-examination |
|---|---|---|
| Legal source | Express duty in section 75(4) of the CGST Act | No general express CGST adjudication right identified in the cited 2025 Delhi High Court judgment |
| Trigger | Written request or contemplation of an adverse decision | Evidentiary necessity, usually involving a material witness or third-party statement |
| Purpose | Present oral submissions, answer questions and correct the proposed case | Test a person’s accuracy, authorship, consistency and credibility |
| Who participates | Taxpayer personally or an authorised representative, with the officer | The relevant witness or statement-maker, questioned on disputed evidence |
| Minimum protection | Meaningful notice and a genuine opportunity before the order | A reasoned decision on necessity, with the strongest case where the statement is central and uncorroborated |
| Effect of denial | Courts have quashed or remanded orders made without the required hearing | Remedy depends on materiality and prejudice; show how refusal impaired the defence |
Does filing a written reply waive the hearing?
No. A written reply and an oral hearing perform different functions. The reply creates the documentary and legal record; the hearing permits explanation, questioning and correction before the officer decides. Jupiter Exports makes clear that a meaningful statutory hearing is not replaced by a brief telephone exchange or by the fact that written submissions were filed.

- Please Note: To reach 10Gbps speed, keep the cable under 3.3 ft. For USB A Male to USB C adapters, try flipping the USB C connector. USB C Male to USB A adapters support bidirectional 10Gbps transfer within 3.3 ft
For that reason, include an explicit hearing request even when the notice does not appear adverse. If the officer later proposes an adverse outcome, the independent section 75(4) trigger still applies.
What to do when a GST order is passed without a hearing
- Check the record immediately. Collect the notice, reply, hearing request, portal acknowledgments, hearing notices, adjournment correspondence and order.
- Identify the defect precisely. Was no hearing offered, was the notice missing a usable date or mode, was a requested adjournment ignored, or was the “hearing” only a short call?
- Show prejudice. List the submissions, documents or explanations that could have addressed the proposed demand and explain why they were not considered orally.
- Preserve the cross-examination issue separately. Identify each relied-on statement, the disputed proposition and why credibility testing is necessary. Do not assume that a successful personal-hearing challenge automatically decides the cross-examination question.
- Use the available challenge procedure promptly. The authorities summarized here show that courts may quash or remand an order for breach of the statutory hearing duty. The appropriate forum, limitation period and filing requirements depend on the order and the applicable procedural route, so obtain advice on the specific case.
A challenge is stronger when the record proves both the statutory trigger and the failure: for example, a written hearing request with a portal acknowledgment followed by an order that records no hearing or gives no workable opportunity.

The following structure keeps the request clear without turning it into a generic demand:
Subject: Request for personal hearing under section 75(4), CGST Act
I request a personal hearing in proceedings arising from [notice number and date].
This request is made under section 75(4) of the CGST Act. Please provide the date,
time and mode of hearing and place this request on the record before any adverse order
is passed. I reserve the right to make oral submissions and answer questions on the
issues identified in the notice.
If the department relies on [identified statement-maker’s] statement dated [date], I
also request permission to cross-examine that person on [specific disputed proposition],
because [brief materiality and credibility reason]. If that request is not allowed,
please record the reasons.
Replace the bracketed text with the actual proceeding details. The wording does not create an automatic cross-examination entitlement; it makes the materiality and prejudice argument visible to the officer reviewing the request.
Common mistakes and better alternatives
“I filed the reply, so no hearing is needed”
A reply does not eliminate the section 75(4) duty when an adverse decision is contemplated. Ask expressly and keep proof of submission.

“The officer called me, so the hearing happened”
A short call is not necessarily a meaningful personal hearing. Ask for a formal notice stating the date, time and mode, and submit any explanation in writing as well.
“The department used a statement, so cross-examination is automatic”
The CGST Act has no general express adjudication provision identified in the cited Delhi judgment. Tie the request to a decisive statement, a concrete credibility dispute and the insufficiency of documentary corroboration.
“I will request cross-examination later”
Waiting can make it harder to show timely objection and prejudice. Raise the issue when the statement is disclosed or relied on, identify the witness and proposition, and ask for a reasoned ruling before the order.
“Any adjournment request must be granted”
Section 75(5) permits an adjournment for sufficient cause, requires recorded reasons and caps adjournments at three. Give a specific reason and proposed date rather than assuming an open-ended postponement.
Decision checklist
- Need to explain your case orally? Invoke section 75(4) and request a personal hearing in writing.
- Is an adverse order being considered? The officer must provide the opportunity even without a separate request.
- Is a third-party statement central? Identify the statement-maker, disputed proposition and why credibility testing could alter the result.
- Can documents fairly resolve the issue? If yes, the officer may regard cross-examination as unnecessary; address that possibility directly.
- Was the hearing unusable or omitted? Preserve the record and consider a prompt challenge showing the statutory trigger and resulting prejudice.
Key takeaways
Section 75(4) gives personal hearing a defined statutory footing: a written request or a contemplated adverse decision is enough to activate the duty. The opportunity must be meaningful, with usable notice and a chance to make oral submissions before the order. Section 75(5) governs adjournments, including the sufficient-cause and three-adjournment limits.
Cross-examination answers a different question—whether a person’s evidence can be trusted on a material disputed fact. Under the position discussed in the 2025 Delhi High Court judgment, there is no general CGST adjudication right comparable to the express Customs provision. A focused request is strongest where a third-party statement is central, documentary evidence cannot fairly resolve credibility, and refusal would cause identifiable prejudice.
