Neither Claude nor ChatGPT is universally more private or safer. The deciding factor is usually the product surface—consumer account, business or enterprise workspace, or API—rather than the assistant’s name. Consumer services expose chats to provider safety systems and may allow model-improvement use through configurable controls. Commercial and API offerings generally separate customer content from model improvement more strongly, but retention, logging, administrator access, geographic processing, subprocessors and legal-disclosure terms still depend on the exact product and contract.
For confidential work, choose the workspace or API whose written terms meet your organization’s requirements, then minimize sensitive data and verify retention and access controls. A privacy toggle alone is not a confidentiality guarantee.

The short answer: account type matters more than the logo
Comparing “Claude” with “ChatGPT” as if each were a single service produces the wrong answer. A consumer Claude account and an Anthropic commercial API account have different data practices. The same is true of a personal ChatGPT account versus ChatGPT Business, Enterprise, Edu, Healthcare or the API Platform.

- Consumer account: privacy settings can control whether conversations are eligible for model improvement, but safety, abuse-prevention and legal-compliance processing can still apply.
- Business or enterprise workspace: the organization’s contract, retention configuration, administrator permissions and audit controls become central.
- API: application-level logging, provider retention terms, zero-data-retention eligibility and your own security architecture determine much of the practical risk.
Do not infer enterprise privacy from a consumer subscription tier. “Pro,” “Max” or a similar paid personal plan is still a consumer surface unless the provider explicitly places it under commercial data-processing terms.
Consumer privacy controls compared
Claude’s model-improvement setting and Incognito chats
Anthropic’s consumer privacy guidance says chats and coding sessions may be used to improve models when the user permits model improvement. Anthropic also says that Incognito chats are not used to improve Claude, even when the main model-improvement setting is enabled.
That is a meaningful control for users who need a per-conversation boundary. It does not make an Incognito conversation invisible to every internal process: Anthropic says conversations flagged for safety review may be used or analyzed to improve detection and enforcement of its Usage Policy, including training models used by its Safeguards team.

ChatGPT consumer controls
OpenAI says users decide whether their data is used for training and model improvement through its privacy controls. The setting governs model-improvement eligibility; it should not be interpreted as a promise that content will never be processed for abuse prevention, security, support, legal compliance or other operational purposes.
OpenAI also says selected portions of content may be sent to trusted service providers for annotation and safety purposes under confidentiality and security obligations. Access to user content is monitored, and authorized personnel must complete security and privacy training.
What the consumer comparison does—and does not—show
| Question | Claude consumer service | ChatGPT consumer service |
|---|---|---|
| Can model-improvement use be controlled? | Yes. Anthropic says users can allow or disable model improvement; Incognito chats are excluded from improvement. | Yes. OpenAI says users control training and model-improvement use through privacy settings. |
| Can safety processing still occur? | Yes. Safety-flagged conversations may be analyzed for Usage Policy enforcement and safeguards training. | Yes. OpenAI describes safety and abuse-prevention processing, including selected-content annotation by trusted providers. |
| Does disabling improvement eliminate all retention or access? | No. Safety-classification and operational retention are separate questions. | No. The improvement choice does not eliminate safety, security, legal or operational processing. |
For either service, avoid entering passwords, private keys, unreleased credentials, full medical records or other secrets simply because a setting is disabled.

Training use and safety review are separate decisions
Users often ask, “Does the provider train on my chats?” That question has at least two different meanings:
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errors- Model improvement: whether content may enter pipelines used to improve a general model or related systems.
- Safety and abuse operations: whether content can be scanned, classified, retained or reviewed to detect fraud, harmful activity, policy violations, security incidents or legal risks.
Turning off model improvement addresses the first question only. A provider may still need to process a conversation to prevent abuse or comply with law. Conversely, a safety review does not necessarily mean the entire conversation becomes training data for a general-purpose model; the provider’s policy determines the purpose and retention.
When a Claude conversation is flagged
Anthropic says conversations flagged for safety review may be used or analyzed to improve the ability to detect and enforce its Usage Policy. It specifically describes training models used by the Safeguards team. This is a narrower, safety-oriented use than assuming every consumer chat is automatically used to train the main assistant, but it remains a form of secondary processing that matters for sensitive material.
When ChatGPT content is selected for safety work
OpenAI says selected portions of content may be sent to trusted service providers for annotation and safety purposes. Those providers are subject to confidentiality and security obligations, and OpenAI says access is monitored. The statement means that disabling model improvement should not be read as “no human or contractor can ever encounter this content.”
Retention: what is known and what to verify
Claude’s stated model-improvement retention
Anthropic says that when a user permits model-improvement use, personal data may be retained in de-identified form for up to five years in model-training pipelines. This is a policy duration, not a measurement of safety or a guarantee that every item remains for five years. Anthropic separately describes retention for inputs and outputs, with longer or different treatment possible for safety-classification information when a conversation is flagged.
ChatGPT retention questions
The cited OpenAI guidance establishes the model-improvement controls and commercial defaults, but a single universal retention period should not be assumed for every ChatGPT surface. Retention can vary by product, workspace configuration, abuse-prevention needs, legal holds and account administration. Before using sensitive data, obtain the current terms for the exact service and region.

- Can a legal hold or abuse investigation extend retention?

- Can your organization set an automatic deletion period?
Business, enterprise and API use
ChatGPT Business, Enterprise, Edu, Healthcare and API Platform
OpenAI says content from ChatGPT Business, Enterprise, Edu, Healthcare workspaces and the API Platform is not used to improve models by default. That default is materially different from relying on a personal account, but it is not the end of the assessment.
Review the workspace’s administrator roles, audit and access logs, retention settings, regional processing, subprocessors, incident-notification commitments and legal-disclosure process. An administrator may be able to access or export workspace content even when OpenAI does not use it for model improvement.
Anthropic commercial services
Anthropic distinguishes consumer products from commercial services such as its API, Console, Claude for Work and Enterprise offerings. Commercial customers operate under commercial data-processing terms, while organization retention is affected by the product and workspace settings.

Zero-data-retention and limited-retention arrangements
Some API or enterprise customers may qualify for zero-data-retention or limited-retention arrangements, but eligibility and scope depend on the product and agreement. Ask whether the arrangement covers prompts, outputs, abuse-monitoring logs, support records, uploaded files and diagnostic metadata—not just the model-inference payload.
Safety and governance: different public frameworks
Anthropic’s Constitution and scaling policy
Anthropic’s Constitution is a natural-language document intended to shape Claude’s behavior and training. Its stated priority is broad safety first, followed by broad ethics, compliance with Anthropic’s guidelines and genuine helpfulness. When these goals conflict, the ordering matters: helpfulness is not treated as permission to ignore safety or policy constraints.

An October 19, 2026 roadmap update says Anthropic’s automated alignment assessment is a core metric, that interpretability evidence appears in recent system cards and that a prior routine oversight sample found no issues beyond existing review processes. Those are descriptions of Anthropic’s reported processes, not independent proof that Claude is safer in every task or environment.
OpenAI’s layered governance model
OpenAI’s Model Spec addresses how models should behave across many situations. Separate Preparedness and Frontier Governance materials address capability risks and mitigations, including cyber risk, chemical and biological risk, harmful manipulation, loss of control, security-risk management, incident response and external expert input.
This layered approach separates everyday behavioral rules from processes for evaluating frontier capabilities. It offers a public framework for governance, but framework transparency is not the same as a guarantee about a particular model response, account or deployment.
Why governance documents do not settle the privacy question
A constitution, model specification or frontier-risk policy primarily explains how a provider wants systems to behave and how it assesses dangerous capabilities. Privacy depends additionally on data flows, retention, human access, contracts, geography, logging and your own controls. A provider can publish strong safety principles while a poorly configured workspace still exposes sensitive material to too many administrators.
Can employees or contractors read your chats?
Neither service should be described as “never reviewed by humans.” Anthropic’s policy allows safety-flagged conversations to be used or analyzed for enforcement and safeguards improvement. OpenAI describes monitored access and selected-content annotation by trusted service providers for safety purposes.
Best Value
Human access is usually constrained by authorization, monitoring, confidentiality and security training, but those controls do not make exposure impossible. For business deployments, determine which provider personnel, subprocessors, workspace administrators, support agents and incident responders can access content, under what trigger and with what audit trail.
Geography, legal disclosures and regulated data
Privacy posture also depends on where data is processed and which legal regime applies. Before deployment, verify:
- Available data-residency or regional-processing options.
- Locations of subprocessors and support personnel.
- How the provider responds to government or court demands.
- Notification and objection procedures for legal disclosures.
- Contractual commitments for regulated or sector-specific data.
- Whether your organization can demonstrate access, deletion and incident-response controls to an auditor.
For regulated or high-impact work, provider documentation does not replace legal, compliance and security review. Keep a human decision-maker accountable for consequential decisions, even if an assistant is used for drafting or analysis.
Which service fits common use cases?
| Use case | Practical approach | Controls to confirm |
|---|---|---|
| Personal, low-sensitivity questions | Either consumer service can be used with available privacy controls. Do not submit secrets. | Model-improvement setting, safety-review expectations and account security. |
| Confidential business material | Use the relevant commercial or enterprise workspace or API, not a personal account. | Data-processing terms, retention, administrator access, region, subprocessors, logging and deletion. |
| Regulated or high-impact work | Require organizational approval and a documented human-governed workflow. | Contractual commitments, access governance, audit evidence, incident response and sector-specific compliance. |
| Highly sensitive secrets | Keep them out of general-purpose assistant prompts unless an approved architecture explicitly permits them. | Redaction, tokenization, private deployment controls and tested deletion procedures. |
A practical selection and configuration procedure
- Classify the data. Separate public information, internal business data, confidential material, regulated records and credentials.
- Choose the product surface. Match the classification to a consumer account, commercial workspace or API architecture. Do not use a personal account for an organization’s restricted data.
- Set model-improvement preferences. Disable improvement where policy requires it. For Claude consumer use, consider Incognito for conversations that should not be used to improve Claude.
- Read the exact retention terms. Check prompts, outputs, files, metadata, safety records, backups and legal holds.
- Map access. Identify provider staff, trusted annotators, subprocessors, workspace administrators and your own application operators who may access content.
- Confirm geography and legal terms. Record processing regions, disclosure procedures and any regulated-data commitments.
- Minimize the payload. Redact names, account numbers, secrets and unnecessary history. Send only the fields needed for the task.
- Log and review your own use. Apply least-privilege access, monitor API keys, set deletion schedules and periodically reassess provider terms.
Common mistakes and how to avoid them
- “I turned off training, so the chat is private.” Model improvement and safety or legal processing are separate. Treat the toggle as one control, not a confidentiality guarantee.
- “A paid personal plan is enterprise-grade.” Subscription price does not establish commercial data-processing terms.
- “The provider’s safety framework proves the model is safe for my industry.” Public governance documents do not perform your sector’s risk assessment.
- “Deleted means instantly erased everywhere.” Backups, safety records, legal holds and administrator exports can follow different schedules.
- “No humans can see API traffic.” Verify abuse-monitoring, support and incident-response access, including any limited-retention exceptions.
Bottom line
Claude has a clearly described Constitution-centered approach and an Incognito option that Anthropic says is excluded from model improvement. ChatGPT offers consumer privacy controls and states that Business, Enterprise, Edu, Healthcare and API content is not used for model improvement by default. Both providers describe safety-related processing that can continue outside the model-improvement choice, and neither should be treated as absolutely private or universally safer.
Choose based on the sensitivity of your data, the retention period you can accept, administrator and provider access, regional and legal requirements, auditability and the contract governing the exact product. For confidential or regulated work, the strongest answer is a controlled commercial or API deployment with redaction, logging, deletion and human oversight—not a brand-level assumption.
