There is no privacy advantage that comes simply from choosing a Chinese or Western AI model. The decisive variables are the product surface (consumer chat, API, enterprise workspace, or self-hosted deployment), the provider’s contract, where data is processed and backed up, whether prompts can improve models, and how deletion requests are handled.
DeepSeek’s published policy says it collects prompts, uploaded files, feedback and chat history; may monitor interactions and use information to improve and train its technology; and stores collected information on secure servers in the People’s Republic of China. OpenAI’s US policy describes a 30-day removal period for deleted consumer personal data, subject to legal, safety, security, fraud, financial and audit exceptions, while API data is governed by customer agreements. Anthropic publishes a 30-day default deletion window for API inputs and outputs, consumer model-improvement retention of de-identified data for up to five years when enabled, and organization-level controls that can include zero-data-retention arrangements.

What you are actually comparing
“Chinese AI” is not a single privacy category, just as “Western AI” is not one. A public chatbot, a business API, an enterprise workspace and a self-managed open-weight model have different data controllers, defaults, contracts, logs and deletion paths. The same model family can therefore present very different risk depending on how your organization accesses it.

The comparison below uses published policies and dated availability information. Policies can change, so procurement should obtain the current version and contract rather than rely on a model’s reputation.

What DeepSeek’s published policy says
Data categories
DeepSeek identifies Hangzhou DeepSeek Artificial Intelligence Co., Ltd. as the controller. Its policy lists account information; prompts and other inputs; uploaded files; feedback; chat history; device and network information; logs; approximate location; and payment information when applicable. That list matters because a prompt is rarely the only record created by an AI session. Authentication, telemetry, billing and abuse-prevention logs can all fall under different retention rules.
Use for monitoring, improvement and training
The policy says information may be used to operate, develop, improve and train DeepSeek technology. It also describes monitoring interactions and usage. Therefore, a user should not assume that a private-looking chat window is equivalent to a confidential enterprise channel. Check the actual account setting and business agreement before entering personal, confidential or regulated material.
Storage in China
DeepSeek’s policy makes an unusually direct geographic statement: We store the information we collect in secure servers located in the People’s Republic of China.
This answers the narrow question “Does DeepSeek store my prompts in China?” for information covered by that policy: the provider says collected information is stored there. It does not, by itself, answer where every backup, support record or separately contracted business workload is processed, so those details should be confirmed in the applicable terms.

DeepSeek does not promise one fixed deletion deadline for every record. It says retention depends on the amount, type, sensitivity and purpose of information, as well as legal requirements. Account, input and payment information may be kept for as long as an account exists. The policy describes account and chat-history controls plus access, correction, deletion, objection and complaint rights that can vary by location.
A deletion request should therefore be treated as a rights process, not an instant purge. Ask what happens to backups, security logs, legal holds, abuse investigations, payment records and de-identified information, and ask for the response time that applies to your jurisdiction.

What OpenAI’s current US policy says
Consumer ChatGPT services
OpenAI’s US privacy policy, updated September 10, 2026, covers consumer services and says prompts and uploaded content may be collected. It allows content to be used to improve services subject to available controls. The policy also describes sharing with vendors, service providers, affiliates and authorities in specified circumstances.
Deletion is a target with exceptions
OpenAI states: Once you choose to delete Personal Data, we will remove it from our systems within 30 days unless we need to retain it for longer as described below.
The same policy says temporary chats are automatically deleted within 30 days, subject to exceptions. The exceptions include legal obligations, safety, fraud, security, financial and audit needs. “Within 30 days” is therefore a stated removal period for eligible personal data, not a guarantee that every backup, safety record or de-identified derivative vanishes on day 30.
Consumer policy versus API data
The policy expressly does not apply to content processed on behalf of API customers; that content is governed by customer agreements. This is a critical boundary. A company cannot use the consumer policy’s 30-day language as a substitute for reviewing the API contract, configured retention, regional processing and incident terms.
Availability risk
A 2026 APAC industry report records a restriction on OpenAI API access affecting mainland China that took effect July 9, 2024. Treat that as a continuity and eligibility issue, not as a statement about the privacy of every OpenAI product. Confirm availability for the customer’s country, legal entity, ownership and intended use before building a dependency.
What Anthropic’s published guidance says
Consumer Claude and model improvement
Anthropic says personal data is retained as reasonably necessary. Its consumer guidance distinguishes a user’s choice to allow model improvement from ordinary service retention. When improvement is enabled, chats or coding sessions may be retained in de-identified form for up to five years in model-training pipelines. Anthropic also says deleting a chat prevents it from being used to train future models under the cited guidance.

That five-year figure is conditional: it applies to de-identified consumer chats or coding sessions when model improvement is allowed. It is not a universal retention period for every Claude account or every data category.

Anthropic’s organization guidance says API inputs and outputs are automatically deleted from its backend within 30 days by default. A different agreement, a zero-data-retention arrangement, a legal requirement or a policy-enforcement need can change that result. “Zero data retention” should be read as a contractual processing mode with defined scope, not as proof that no transient memory, security telemetry or customer-side copy exists anywhere.
Workspace, safety and feedback records
Organization products that save conversations retain them according to workspace or organization settings. Anthropic says flagged safety classifications can be retained for up to seven years, while feedback data can be retained for five years. Those periods illustrate why deleting a visible conversation is not identical to erasing every associated safety or quality record.
Availability and jurisdiction
The same 2026 APAC report describes Anthropic restrictions involving organizations linked to unsupported jurisdictions, including China, in September 2025. Check the current supported-country list and contract for the exact legal entity and ownership structure; an apparently available sign-up does not guarantee stable enterprise access.
Training use and retention are different questions
Users often ask, “If I turn off training, is my data no longer stored?” The answer is no. Training or model improvement concerns whether content can influence future model behavior. Retention concerns how long the original prompt, file, output, metadata, safety classification or backup remains accessible to the provider.

- Improvement off, retention on: A provider may stop using chats to improve models while retaining them for account history, abuse prevention, security or legal compliance.
- Chat deleted, derivative retained: A deleted conversation may be removed from the user interface while a de-identified record, safety score, audit log or legal hold remains.
- Zero-data-retention contract: The arrangement may cover API inputs and outputs but exclude billing, account, security or abuse-prevention metadata. Read the scope and exceptions.
- Self-hosted model: Provider-side prompt retention can be minimized, but your own servers, application logs, observability tools, backups and administrators become the controllers of record.
Document these as separate controls in a data-flow diagram. A single “no training” checkbox is not a retention policy.

China’s Interim Measures for the Management of Generative Artificial Intelligence Services took effect August 15, 2023. The official government summary says providers must fulfill online-information-security duties, protect users’ personal information and operate under classified and graded supervision.
The translated CAC measures add obligations for services with public-opinion attributes or social-mobilization capacity, including security assessment and algorithm filing. Providers serving overseas parties must follow applicable cross-border data-transfer and security-assessment rules. Content governance and correction duties can also affect how prompts and outputs are reviewed.
These are provider and deployment obligations. A filing or security assessment does not prove that a particular model has passed your organization’s GDPR, HIPAA, PCI or sector-specific review. Conversely, a foreign provider’s privacy policy does not exempt a customer from Chinese transfer rules when Chinese personal information, infrastructure or operations are involved. Have counsel map the data subjects, processing locations, controller roles, transfer mechanism and regulated data classes.

Procurement questions to put in writing
Before a company sends confidential or regulated information to any hosted model, require written answers to the following:
- Controller and processors: Identify the legal controller, every sub-processor, support provider and affiliate that can access content.
- Data map: List prompts, files, outputs, account data, telemetry, payment records, safety scores, backups and human-review channels.
- Geography: Specify primary processing, disaster recovery, backups, support access and remote administration locations.
- Improvement choice: State whether customer content can train or improve models, how the setting is enforced and whether it applies to historical data.
- Retention schedule: Give a period for each data type, not one number for the whole service.
- Deletion service level: State the request path, completion target, verification method and all legal, safety, abuse, audit and backup exceptions.
- Contract controls: Obtain the DPA, security certifications, confidentiality terms, incident-notification deadline, audit rights and sub-processor change notice.
- Model changes: Require notice of material model, hosting, training-use or policy changes and define termination or migration rights.
- Availability: Confirm that the customer’s country, ownership structure and regulated sector are supported for the full contract term.
- Alternative deployment: Ask whether a private region, dedicated tenant, zero-data-retention API or self-managed route is available and what it excludes.
Choosing a deployment by risk
Personal experimentation
Use only information you would be comfortable disclosing to the provider. Remove names, account numbers, health details, source-code secrets and unique identifiers. Review chat-history and improvement settings before the first session, and do not treat temporary-chat labels as a legal deletion guarantee.
Internal business information
Prefer an organization workspace or API contract over an unmanaged consumer account. Limit access through identity controls, prohibit sensitive fields at the application layer, log who submitted each request, and test deletion with a non-production record before rollout.
Regulated or high-impact data
Do not rely on a model’s national origin as a compliance shortcut. Require a completed data-protection impact assessment, approved transfer mechanism, encryption and key-management design, retention schedule, incident process and written contractual allocation of controller and processor duties. If the provider cannot state where data and backups go, do not send the dataset.

Maximum isolation
A self-managed or private deployment can keep prompts inside infrastructure you control, but it shifts responsibility to your team. Secure model weights, inference servers, vector stores, application logs, monitoring, backups, administrator access and update procedures. Verify that telemetry is disabled or routed to an approved destination.
Practical safeguards that work across providers
- Minimize inputs: send only the fields needed for the task.
- Pseudonymize records and keep the re-identification key outside the AI system.
- Use allow-listed models and block consumer endpoints for corporate accounts.
- Disable prompt and output logging in your application unless it has a documented purpose.
- Encrypt data in transit and at rest, with separate keys for especially sensitive workloads.
- Set automated deletion for local chat exports, caches, vector indexes and backup snapshots.
- Red-team the integration for prompt injection, accidental file upload and cross-tenant leakage.
- Recheck provider policies, supported countries and sub-processors at every material model or contract change.
Bottom line for a buyer
DeepSeek’s public policy is clear that collected information is stored in China and may be used to improve and train its technology, with no universal fixed deletion deadline. OpenAI gives consumer users a stated 30-day removal period with significant exceptions, while API handling is contractual. Anthropic offers the clearest published menu of retention distinctions: up to five years for de-identified consumer improvement data when enabled, 30-day default API deletion, possible zero-data-retention arrangements, and longer periods for safety classifications or feedback.
Those facts do not make one group automatically safer. Select the product surface and contract that match your data, verify geography and availability, and treat training controls, retention, deletion, legal access and regulatory compliance as separate decisions.
